CIRCULAR

Supplementing and amending some points of Circular No. 07/2006/TT-BLDTBXH dated July 26, 2006 of the Ministry of Labor, Invalids and Social Affairs guiding on files and procedures for implementing preferential policies for persons who have rendered meritorious service to the revolution.

Pursuant to Decree No. 54/2006/NĐ-CP dated May 26, 2006 of the Government guiding the implementation of certain Articles of the Ordinance on Preferential Treatment for Persons Who Have Rendered Meritorious Service to the Revolution.

The Ministry of Labor, Invalids and Social Affairs supplements and amends some points of Circular No. 07/2006/TT-BLDTBXH dated July 26, 2006 of the Ministry of Labor, Invalids and Social Affairs guiding on files and procedures for implementing preferential policies for persons who have rendered meritorious service to the revolution as follows:

MINISTRY OF LABOR, INVALIDS AND SOCIAL AFFAIRS

1. Amending and supplementing Clause 2 Section I Part I as follows:

The Organizational Department of the Provincial Party Committee, Municipal Party Committee, the Cadre Organization Department of Ministries, Agencies, and Sectors (collectively referred to as organizational agencies) shall prepare files for cases meeting the conditions and submit them to the Standing Committee of the Provincial Party Committee, Municipal Party Committee, or the Party Committee, Party Group, or the Council of Party Members of Ministries, Sectors, and Central Mass Organizations for examination and issuance of decisions recognizing and transferring to the Department of Labor, Invalids and Social Affairs at the place where the person who has rendered meritorious service resides for registration and management and issuance of allowances and subsidies; prepare allowance and subsidy certificates and implement preferential policies.

The specific bases for examination and recognition are as follows::

- Original personal history records of cadres and party members declared from 1960 or earlier, if these records are lost with justifiable reasons and subsequent records (1961, 1962) are also lost, then the basis for declaration shall be according to Directive No. 90-CT/TW dated March 1, 1965 and Notice No. 297-TT/TW dated April 20, 1974 of the Central Committee of the Communist Party of Vietnam (written from 1975, 1976).

- In cases where individuals continuously engaged in revolutionary activities in battlefields B, C, and K from 1954 to April 30, 1975, the basis for examination shall be the cadre and party member records written in 1975 or 1976.

2. Supplementing sub-item c into Point 1.1 Clause 1 Section II Part I as follows:

c. In cases of sacrifice or injury occurring after September 30, 2006, within ninety days, the competent authority as prescribed by law must issue a death certificate or injury certification as the basis for preparing files to confirm persons who have rendered meritorious service to the revolution.

3. Supplementing sub-item d into Point 2.2 Clause 2 Section II Part I as follows:

d. The reissuance of the "National Commendation Certificate" in cases of damage or loss shall be carried out as follows:

- The Department of Labor, Invalids and Social Affairs shall be responsible for:

+ Preparing the "National Commendation Certificate" based on the original file of the烈士的原始档案。

+ Preparing a report along with a list and issuing the "National Commendation Certificate" to the Chairman of the People's Committee of the province.

- The Chairman of the People's Committee of the province shall submit the reissue of the "National Commendation Certificate" to the Prime Minister for the family of the martyr.

The reissue of the "National Commendation Certificate" shall be transferred to the Office of the Government.

4. Amending Point 1.1 Clause 1 Section III Part II as follows:

1.1 Place of Departure:

- A letter (or application) requesting the transfer of the file of a person who has rendered meritorious service to the revolution.

- A copy of the household registration at the new place of residence or a copy of the long-term temporary residence certificate at the new place of residence.

- An introduction letter for the transfer of the file and preferential treatment of a person who has rendered meritorious service issued by the Department of Labor, Invalids and Social Affairs, accompanied by the entire file (original) of the person who has rendered meritorious service. The file shall be sealed and handed over to the person who has rendered meritorious service (with signature for receipt of the file). Any issues regarding benefits and files must be resolved before the transfer. Within thirty days from the date of issuance of the introduction letter for the transfer, the person who has rendered meritorious service must submit the file to the Department of Labor, Invalids and Social Affairs at the destination.

5. Amending Point 1.2 Clause 1 Section III Part II as follows:

1.2 Place of Arrival:

The Department of Labor, Invalids and Social Affairs shall be responsible for receiving, inspecting the file, registering the management of the subject, and continuing to implement preferential policies for persons who have rendered meritorious service to the revolution as prescribed.:

6. Supplementing Clause 5 into Part III as follows:

5. From October 1, 2006, the file confirming persons who have rendered meritorious service to the revolution shall be implemented according to the guidance of Circular No. 07/2006/TT-BLDTBXH dated July 26, 2006.

Cases that have prepared files but have not been completed and have not received a decision on allowances and preferences before October 1, 2006, must reprepare the files according to Circular No. 07/2006/TT-BLDTBXH dated July 26, 2006.

7. Implementation organization:

This Circular takes effect fifteen days from the date of publication in the Official Gazette.

During the implementation process, if there are any difficulties, localities should reflect them to the Ministry of Labor, Invalids and Social Affairs for guidance on resolution.
