JOINT CIRCULAR

Guidelines for Implementing Decree No. 131/2007/NĐ-CP dated August 6, 2007 of the Government on Amending and Supplementing Decree No. 157/2005/NĐ-CP dated December 23, 2005 of the Government on Certain Regulations for Cadres and Civil Servants Serving Fixed Terms at Vietnamese Agencies Abroad

Pursuant to Decree No. 157/2005/NĐ-CP dated December 23, 2005 of the Government on Certain Regulations for Cadres and Civil Servants Serving Fixed Terms at Vietnamese Agencies Abroad (hereinafter referred to as Decree No. 157/2005/NĐ-CP) and Decree No. 131/2007/NĐ-CP dated August 6, 2007 of the Government amending and supplementing Clause 1 and Clause 2 of Article 9 of Decree No. 157/2005/NĐ-CP (hereinafter referred to as Decree No. 131/2007/NĐ-CP), the Ministry of Foreign Affairs, the Ministry of Home Affairs, the Ministry of Finance, and the Ministry of Labour, Invalids and Social Affairs hereby provide guidelines for implementing the contents of Article 1 of Decree No. 131/2007/NĐ-CP as follows:

I. SCOPE AND APPLICABLE OBJECTS

The diplomatic spouse allowance shall be applied to the following objects:

1. Cadres and civil servants serving fixed terms at Vietnamese agencies abroad with positions from Third Secretary and above.

2. Heads of Vietnamese agencies abroad who do not hold diplomatic positions.

3. Cadres and civil servants enjoying living allowances outside the country equivalent to the living allowance of First Secretaries.

4. Diplomatic cadres and civil servants enjoying living allowances outside the country equivalent to the living allowance of Third Secretaries and above.

II. LEVELS OF LIVING ALLOWANCES TO BE ENJOYED

1. Spouses of Ambassadors shall enjoy 125% of the minimum living allowance level.

2. Spouses of Chargés d'Affaires, Deputy Chiefs of Mission, Chiefs of Mission, and Heads of Vietnamese agencies abroad who do not hold diplomatic positions shall enjoy 110% of the minimum living allowance level.

3. Spouses of Third Secretaries and above shall enjoy 80% of the minimum living allowance level.

4. Spouses of cadres and civil servants enjoying living allowances outside the country equivalent to the living allowance of First Secretaries shall enjoy 80% of the minimum living allowance level.

5. Spouses of diplomatic cadres and civil servants enjoying living allowances outside the country equivalent to Third Secretaries and above shall enjoy 80% of the minimum living allowance level.

The minimum living allowance level shall be implemented according to the provisions set out in Appendix I (Table of Minimum Living Allowances at Vietnamese Agencies Abroad) issued together with Joint Circular No. 29/2006/TTLT-BNG-BNV-BTC-BLDTBXH dated November 8, 2006 of the Ministry of Foreign Affairs, the Ministry of Home Affairs, the Ministry of Finance, and the Ministry of Labour, Invalids and Social Affairs guiding the implementation of Decree No. 157/2005/NĐ-CP dated December 23, 2005 of the Government.

III. IMPLEMENTATION

1. This Circular shall take effect 15 days after its publication in the Official Gazette. For other contents not specified in this Joint Circular, they shall be implemented according to Joint Circular No. 29/2006/TTLT-BNG-BNV-BTC-BLDTBXH dated November 8, 2006 of the Ministry of Foreign Affairs, the Ministry of Home Affairs, the Ministry of Finance, and the Ministry of Labour, Invalids and Social Affairs guiding the implementation of Decree No. 157/2005/NĐ-CP dated December 23, 2005 of the Government.

2. The regulations stipulated in this Circular shall be applied from the date Decree No. 131/2007/NĐ-CP takes effect.

3. Ministries and sectors with Vietnamese agencies abroad shall be responsible for directing units under their management to implement this Circular.

4. In the course of implementation, if there are any difficulties, ministries, sectors, and Vietnamese agencies abroad shall submit written requests to the Ministry of Foreign Affairs for discussion and agreement with the Ministry of Home Affairs, the Ministry of Finance, and the Ministry of Labour, Invalids and Social Affairs to consider and decide.
