CIRCULAR

Regulations on the allowance for responsibility in forensic appraisal work

Pursuant to Decree No. 67/2005/NĐ-CP dated May 19, 2005 of the Government detailing the implementation of certain provisions of the Ordinance on Forensic Appraisal;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the Salary System for Civil Servants, Public Officials, and Military Personnel;

Pursuant to Circular No. 05/2005/TT-BNV dated January 5, 2005 of the Ministry of Home Affairs guiding the implementation of the allowance for responsibility in work for officials, civil servants, and employees;

With the agreement and consensus of the Ministry of Home Affairs and the Ministry of Finance as stated in Official Letter No. 1034/BNV-TL dated April 15, 2009 and Official Letter No. 5012/BTC-PC dated April 7, 2009;

The Ministry of Justice hereby stipulates the allowance for responsibility in forensic appraisal work as follows:

Article 1. Scope of application

The allowance for responsibility in forensic appraisal work prescribed in this Circular shall apply to forensic medical examiners, forensic psychiatric examiners, and forensic technical examiners who are currently receiving salaries from the state budget.

1. A 25% allowance rate shall be applied to:

The amount of the allowance for responsibility in forensic appraisal work for the subjects specified in Article 1 of this Circular is 0.3 times the minimum wage.

Article 3. Time of Enjoyment

1. The time of enjoying the allowance for responsibility in forensic appraisal work shall be calculated from January 1, 2009.

2. In cases where forensic examiners are appointed after January 1, 2009, they shall enjoy the allowance for responsibility in forensic appraisal work from the date of appointment.

Article 4. Source of funding

1. For forensic medical examiners, forensic psychiatric examiners, and forensic technical examiners belonging to agencies and units fully funded by the state budget, the allowance for responsibility in forensic appraisal work shall be paid by the state budget according to the current budget classification within the annual budget allocation for the agency or unit.

2. For forensic medical examiners, forensic psychiatric examiners, and forensic technical examiners belonging to agencies implementing personnel quotas and administrative management expenses, and public institutions operating with financial autonomy, the allowance for responsibility in forensic appraisal work shall be paid by the agency or unit from the allocated funds and the autonomous financial resources assigned.

Article 5. Method of Payment

The method of paying the allowance for responsibility in forensic appraisal work shall be implemented in accordance with the provisions of Circular No. 05/2005/TT-BNV dated January 5, 2005 of the Ministry of Home Affairs guiding the implementation of the allowance for responsibility in work for officials, civil servants, and employees.

Article 6. Effectiveness

This Circular takes effect 45 days from the date of issuance. Any issues arising during implementation should be reported to the Ministry of Justice for study and resolution./.
