CIRCULAR

Guidelines for State Management of Livestock Raising

Pursuant to the Livestock Breed Law dated March 24, 2004;

Pursuant to Decree No. 08/2010/NĐ-CP dated February 5, 2010 of the Government on the management of livestock feed;

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; and Decree No. 75/2009/NĐ-CP dated September 10, 2009 of the Government amending Article 3 of Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Circular Joint No. 61/2008/TTLT-BNN-BNV dated May 15, 2008 of the Minister of Agriculture and Rural Development and the Minister of Home Affairs guiding the functions, tasks, powers, and organizational structure of specialized agencies under provincial and district People's Committees and the state management tasks of commune-level People's Committees regarding agriculture and rural development;

The Ministry of Agriculture and Rural Development guides the state management tasks of livestock raising from central to commune level as follows:

Article 1. Tasks of the Livestock Production Department

The Livestock Production Department is a specialized agency under the Ministry of Agriculture and Rural Development, performing state management functions over livestock raising nationwide pursuant to Decision No. 18/2008/QĐ-BNN dated January 28, 2008 of the Minister of Agriculture and Rural Development stipulating the functions, tasks, powers, and organizational structure of the Livestock Production Department and other relevant laws.

Article 2. Tasks of the Department of Agriculture and Rural Development concerning livestock raising

Based on the assigned functions, tasks, and powers, the Departments of Agriculture and Rural Development of provinces and centrally-administered cities (hereinafter referred to collectively as provincial level) perform state management functions over livestock raising as follows:

1. Drafting and submitting to the Provincial People's Committee

a) Draft decisions, directives; long-term, five-year, and annual plans for livestock raising, livestock feed, and livestock farming environment;

b) Draft regulations stipulating the functions, tasks, and powers of subordinate organizations responsible for state management of livestock raising.

2. Directing livestock raising

a) Advising and being responsible before the Provincial People's Committee for directing livestock production, disease prevention, and disaster recovery for livestock raising; organizing the application of scientific and technological progress in livestock production;

b) Developing livestock raising plans linked with slaughterhouses, processing facilities, and product storage systems at the local level;

c) Implementing basic investigation projects on livestock raising;

d) Providing professional guidance related to livestock raising; inspecting the implementation of management regulations, coordination work, and reporting systems of agricultural departments at districts or economic departments at urban districts;

đ) Developing, directing the implementation, and evaluating annual livestock production plans.

3. Regarding livestock breeds

a) Implementing and executing planning and programs for developing livestock breeds consistent with the overall socio-economic development plan within the locality;

b) Managing, exchanging, and effectively utilizing livestock genetic resources locally;

c) Implementing breed management within the locality as prescribed in the List of Permitted Livestock Breeds for Production and Trade; the List of Rare Livestock Genetic Resources for Conservation; and the List of Prohibited Exported Rare Livestock Breeds;

d) Organizing and being responsible for certifying conformity declarations about livestock breeds within the scope managed by the Department or delegated by the Provincial People's Committee and guided by the Ministry of Agriculture and Rural Development.

4. Regarding livestock feed

a) Providing professional guidance related to livestock feed;

b) Organizing and being responsible for certifying conformity declarations about livestock feed within the scope managed by the Department;

c) Participating in managing livestock feed items listed in the Catalogue of Permitted Livestock Feed Circulation in Vietnam;

d) Organizing and being responsible for managing prohibited substances in the production, import, circulation, and use of livestock feed locally.

5. Regarding the livestock farming environment

a) Developing and directing the implementation of measures to handle waste and protect the environment in livestock raising;

b) Guiding, supervising, and inspecting the implementation of environmental control activities in livestock raising;

c) Supervising and inspecting the implementation of national standards and technical regulations on the environment in livestock production locally.

6. Quality management of products and food safety in livestock raising

a) Organizing the implementation of programs and plans for ensuring quality and food safety in livestock raising;

b) Developing and submitting to the Provincial People's Committee legal normative documents and policies to ensure quality and food safety in livestock raising;

c) Proposing plans for building and developing safe livestock-raising zones;

d) Supervising, inspecting, and guiding the implementation of management regulations for safe livestock-raising facilities; technical standards and regulations for safe livestock-raising production.

7. Science and Technology

a) Participating in managing livestock genetic resources and microorganisms used in livestock raising;

b) Proposing research topics and applications of technological advancements and specialized techniques;

c) Participating in drafting national technical standards for livestock housing and specialized livestock materials;

d) Participating in testing livestock breeds and livestock feed;

đ) Organizing the application of scientific and technological advancements in livestock raising, livestock feed, and improving the livestock farming environment.

8. Programs, Projects, and Agricultural Extension in Livestock Raising

a) Reviewing and implementing investment programs and projects in livestock raising;

b) Directing, supervising, and implementing agricultural extension activities in livestock raising.

9. Trade Promotion and International Cooperation in Livestock Raising

a) Participating in trade promotion activities in livestock raising;

b) Implement international cooperation in livestock management within the scope of the Department's jurisdiction according to the分级授权的省级人民政府和法律规定。

10. Regarding inspection and supervision

a) Popularize and inspect the implementation of state management regulations concerning animal breeding stock, livestock feed, and livestock farming environment as stipulated by law; inspect the organization of slaughtering and processing of livestock products to ensure food safety;

b) Inspect the quality of animal breeding stock and livestock feed produced and circulated in the locality;

c) Resolve or participate in resolving complaints, accusations, anti-corruption efforts; recommendations from organizations and citizens related to the industry and sector managed by the Department; organize citizen reception in accordance with the provisions of the law.

11. Information and reporting

Carry out information and regular or ad hoc reporting on the situation of implementing state management tasks in the field of livestock farming according to the regulations of the provincial People's Committee and the Ministry of Agriculture and Rural Development.

Article 3. Tasks of the Agricultural and Rural Development Office at the District level or the Economic Office at the Urban District, City, and County level regarding livestock farming

Based on the functions, tasks, and authorities assigned, the Agricultural and Rural Development Office at the district level or the Economic Office at the urban district, city, and county level shall perform state management functions in livestock farming as follows:

1. Draft and submit to the People's Committee at the district level

a) Decisions, Directives; long-term, five-year, and annual development plans; Programs encouraging the development of livestock farming for the district People's Committee to submit to the same-level People's Council for approval;

b) Relevant documents related to the livestock farming sector within the authority of the district People's Committee.

2. Directing livestock raising

a) Implement plans and zoning for livestock farming linked to the slaughter and processing system for livestock and poultry;

b) Advise the district People's Committee to direct production, disease prevention, and disaster recovery in livestock farming; organize the application of scientific and technological progress in livestock production;

c) Implement basic investigation projects on livestock farming in the locality;

d) Develop, direct implementation, and evaluate the annual livestock production plan.

3. Regarding livestock breeds

a) Implement plans and programs for developing animal breeding stock consistent with the overall socio-economic development plan within the district;

b) Popularize and organize the implementation of regulatory legal documents, programs, projects, national standards, technical regulations, and economic and technical norms related to animal breeding stock;

c) Popularize, guide, and inspect the implementation of projects and the establishment of models for developing livestock farming within the scope of management;

d) Manage rare animal genetic resources that need conservation in the locality.

4. Regarding livestock feed

a) Popularize, guide, and organize the implementation of regulatory legal documents and specialized professional documents related to livestock feed;

b) Participate in managing the quality of livestock feed produced and circulated in the locality;

c) Inspect business conditions for livestock feed sales; price labeling for livestock feed sales organizations and individuals in the locality;

d) Participate in managing prohibited substances used in livestock feed at feed production facilities; feed sales agents, veterinary drug sellers; livestock and poultry farms, and slaughterhouses.

5. Regarding the livestock farming environment

a) Organize propaganda and popularization of laws and policies on livestock farming environments;

b) Popularize, guide, and organize the implementation of regulatory legal documents and implement measures to handle waste to protect the environment in livestock farming.

6. Management of product quality and food safety in livestock farming

a) Promote and organize the implementation of programs and plans for livestock farming production ensuring quality and food safety;

b) Propose plans to build safe livestock farming zones; establish livestock farming models according to safe livestock farming procedures;

c) Participate in managing the quality of livestock products, animal breeding stock, livestock feed, and food safety;

d) Supervise organizations and individuals producing and trading in relation to food preservatives, growth promoters, weight gainers, and other harmful substances related to food safety as prescribed by law;

đ) Guide, inspect, and supervise the organization of slaughtering and processing of livestock products to ensure food safety.

7. Science and technology

a) Participate in scientific research activities, applying technological advancements and specialized techniques in livestock production;

b) Participate in guiding livestock farmers to implement state regulations on specialized livestock production materials;

c) Participate in and organize the implementation of scientific and technological projects on livestock farming in the district.

8. Implementation of programs, projects, and agricultural extension in livestock farming

a) Participate in and implement investment programs and projects in livestock farming;

b) Participate in and implement agricultural extension activities in the livestock farming sector.

9. Trade Promotion and International Cooperation in Livestock Raising

a) Implement trade promotion and international cooperation in livestock farming within the scope of the district's management;

b) Participate in inspecting the activities of associations and non-governmental organizations in the livestock farming sector according to the law.

10. Inspection and supervision

a) Cooperate in inspecting the quality of animal breeding stock and livestock feed produced and circulated in the locality;

b) Resolve complaints, accusations, anti-corruption efforts, and handle violations of the law in livestock farming;

c) Prevent illegal acts violating the law on animal breeding stock, livestock feed, and livestock farming environment in the district.

11. Information and reporting

Carry out information and regular reporting according to regulations or ad hoc reporting when required by higher-level management agencies on the situation of implementing state management tasks in the livestock farming sector.

Article 4. Tasks of the People's Committee of Communes, Towns, and Urban Districts regarding livestock farming

1. Direct livestock farming production

a) Direct plans for livestock farming production and the livestock farming environment; organize guidance for farmers to implement technical measures to adjust the economic structure and livestock according to approved plans and programs;

b) Propose measures to address natural disasters and diseases in livestock farming production.

2. Regarding livestock breeds

a) Organize and guide the implementation of planning, programs, plans, and projects to encourage the development of animal husbandry within the jurisdictional area;

b) Organize propaganda and dissemination of laws and policies on animal husbandry;

c) Manage the business activities of boar breeding in the locality in accordance with the Livestock Breeds Ordinance.

3. Regarding animal feed

a) Participate in managing the quality of animal feed production and circulation in the locality;

b) Participate in managing prohibited substances used in animal feed at feed production facilities, animal husbandry establishments, and livestock slaughterhouses;

c) Organize the exploitation and development of raw materials for animal feed in the locality;

d) Coordinate inspections, supervision, and administrative penalty handling within the authority regarding the quality of animal feed produced and circulated in the locality.

4. Environmental protection in animal husbandry

a) Propagate and disseminate laws and policies on animal husbandry environmental protection;

b) Guide the implementation of regulatory documents and measures to handle waste to protect the environment in animal husbandry.

5. Management of product quality and food safety in animal husbandry

a) Propagate and disseminate the Food Safety Law to the public;

b) Organize the implementation of programs and plans for animal husbandry production ensuring quality and food safety and building safe animal husbandry models;

c) Coordinate the supervision of organizations and individuals producing and trading in food preservatives, growth stimulants, and other substances affecting food safety as prescribed by law;

d) Coordinate inspections and monitoring of the organization of slaughtering, processing, and sales points for livestock and poultry and animal husbandry products in the locality.

6. Implementation of programs and projects

a) Participate in implementing investment programs and projects in animal husbandry;

b) Participate in agricultural extension activities in the field of animal husbandry;

c) Participate in promoting trade and international cooperation in animal husbandry;

d) Organize the implementation of administrative reform and public service delivery in the field of animal husbandry according to regulations.

7. Science and technology

a) Participate in scientific research activities, application of technological advancements and specialized techniques in production in animal husbandry; management of specialized animal husbandry supplies at commune, ward, and town levels;

b) Organize the implementation of scientific and technological projects on animal husbandry in communes, wards, and towns.

8. Handling complaints and disputes

Handle complaints and disputes related to livestock breeds, animal feed, and animal husbandry environmental protection in the locality.

9. Information and reporting

Provide regular or ad hoc information and reports on the situation of state management tasks in the field of animal husbandry as prescribed.

Article 5. Effectiveness

This Circular takes effect 45 days from the date of issuance.

Article 6. Responsibility for Implementation

1. The Director of the Ministry's Office, the Director of the Animal Husbandry Department, the Director of the Veterinary Department, the heads of relevant units under the Ministry, the Directors of Provincial Departments of Agriculture and Rural Development, and local animal husbandry management agencies at the district and commune levels are responsible for implementing this Circular.

2. During the implementation process, if there are difficulties or need for supplementation or amendment, agencies and units shall report to the Ministry of Agriculture and Rural Development for study and resolution./.
