DECREE

Regulations on Family Affairs

 ______________

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Marriage and Family Law dated June 9, 2000;

Pursuant to the Gender Equality Law dated November 29, 2006;

Pursuant to the Domestic Violence Prevention and Control Law enacted on November 21, 2007;

At the proposal of the Minister of Culture, Sports and Tourism;

The Government promulgates the Decree on regulations concerning family affairs,

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree stipulates on family affairs; responsibilities of agencies and organizations in implementing family affairs.

Family affairs work is the activity of agencies and organizations aimed at building warm, equal, progressive, happy, and sustainable families.

Article 2. Applicability

This Decree applies to agencies and organizations in implementing family affairs.

Article 3. State Management Agencies for Family Affairs

1. The Ministry of Culture, Sports and Tourism shall be responsible before the Government for state management of family affairs nationwide.

2. Ministries and ministerial-level agencies, within their respective tasks and authorities, shall have the responsibility to coordinate with the Ministry of Culture, Sports and Tourism in state management of family affairs.

3. People's Committees at all levels shall implement state management of family affairs locally.

Chapter II

CONTENT OF FAMILY AFFAIRS WORK

Article 4. Building and Implementing Policies and Laws on Family Affairs

Building and implementing policies and laws on family affairs; equality within the family; preventing and combating domestic violence and social evils infiltrating the family.

Article 5. Planning, Training, and Capacity Building for Staff Engaged in Family Affairs

1. Building and implementing plans for staff engaged in family affairs at various levels.

2. Training and enhancing the capacity of staff engaged in family affairs; compiling materials on family affairs.

3. The Ministry of Culture, Sports and Tourism and the Ministry of Home Affairs shall provide detailed regulations for Clause 1 of this Article.

Article 6. Propaganda, Mobilization, and Dissemination of Knowledge on Family Affairs

1. Propaganda and dissemination of the Party's guidelines, state policies and laws on family affairs, implementation of equality within the family, prevention and combat of domestic violence, and prevention and control of social evils infiltrating the family, implementation of family planning.

2. Compiling and disseminating knowledge on family affairs, mobilizing the people to eliminate outdated customs and practices regarding marriage and family; inheriting, preserving, and promoting the fine traditional cultural values of the family and clan while fostering advanced family values in a developing society.

Article 7. Organizations and Entities Providing Public Services in the Field of Family Affairs

1. Provision of public services in the field of family affairs shall be carried out by public service units and enterprises.

2. Conditions, procedures, formalities, authority for establishment, restructuring, dissolution of public service units and enterprises providing public services in the field of family affairs shall be implemented in accordance with the provisions of Government Decree No. 55/2012/NĐ-CP dated June 28, 2012 on the establishment, restructuring, and dissolution of public service units, the Enterprise Law, and other relevant laws.

Article 8. Support Activities for Building Families

1. Pre-marriage counseling and education; provision of knowledge and skills for building and organizing family life; integration of appropriate content on family life education into curricula at all educational levels; support for maintaining and preserving fine traditional values of the family.

2. Mediation of conflicts and disputes within the family and protection of the legitimate rights and interests of family members.

3. Building and guiding the replication of models of happy and sustainably developing families.

4. The Ministry of Culture, Sports and Tourism, the Ministry of Education and Training, the Ministry of Justice, and related ministries and ministerial-level agencies shall provide detailed regulations for Clauses 1, 2, and 3 of this Article.

Article 9. Organizing the Commemoration of Vietnam Family Day

Annually, organize the commemoration of Vietnam Family Day (June 28) to highlight the responsibility of leaders at all levels, sectors, organizations, and families in building warm, equal, progressive, happy, and sustainable families; encourage and promptly reward organizations, individuals, and families with outstanding achievements in family work.

Article 10. Inspection, Supervision, and Handling of Violations of Laws on Family Work

Organize activities for inspection, supervision, and handling of violations of laws on family work according to the provisions of the law.

Article 11. Scientific Research and Construction of Family Data Bases

1. Organize activities for surveys, investigations, and scientific research to serve the development of policies and laws on family work.

2. Construct databases on families and family work.

3. The Ministry of Culture, Sports and Tourism shall provide detailed regulations for Clause 2 of this Article.

Article 12. International Cooperation

Cooperate with countries, international organizations, and non-governmental organizations in developing policies, management experiences, scientific research, exchanging experts, providing technical and financial support in the field of family work according to the provisions of the law.

Article 13. Mid-term Review, Final Evaluation, Information System, and Reporting

1. People's Committees at all levels shall organize mid-term reviews, final evaluations, and assessments of the implementation of family work activities in their localities, and report to higher-level authorities.

2. By December 15 each year, relevant Ministries, Departments, Provincial People's Committees, and Municipal People's Committees directly under the Central Government shall be responsible for submitting reports on the results of family work to the Ministry of Culture, Sports and Tourism for consolidation and reporting to the Prime Minister.

Chapter III

IMPLEMENTATION

Article 14. Responsibilities of the Ministry of Culture, Sports and Tourism

1. Develop and implement policies and laws on family.

2. Guide and organize training and capacity enhancement for staff working in family work.

3. Guide and promote the dissemination of policies, laws, and knowledge on family work.

4. Build and guide the replication of family models.

5. Manage state-owned public service units in the field of family.

6. Organize the commemoration of Vietnam Family Day.

7. Conduct international cooperation and scientific research on family and family work according to the provisions of the law.

8. Construct databases on family and family work.

9. Inspect, supervise, and handle violations of family work according to the provisions of the law.

10. Mid-term review, final evaluation, and regular reporting.

Article 15. Responsibilities of the Ministry of Planning and Investment

Take the lead and coordinate with the Ministry of Culture, Sports and Tourism to guide and integrate policies on family work into strategies, planning, and plans for socio-economic development.

Article 16. Responsibilities of the Ministry of Finance

Take the lead and coordinate with the Ministry of Culture, Sports and Tourism and related Ministries and Departments to allocate funds for family work according to the current state budget classification; guide and inspect related Ministries, Departments, and localities in allocating and using funds for family work.

Article 17. Responsibilities of the Ministry of Justice

1. Take the lead and coordinate with the Ministry of Culture, Sports and Tourism and related agencies in developing policies and laws on family work within their assigned functions and tasks.

2. Guide the resolution of conflicts and disputes within families according to the provisions of the law.

Article 18. Responsibilities of the Ministry of Education and Training

Take the lead and coordinate with the Ministry of Culture, Sports and Tourism and the Vietnam Women's Union to appropriately integrate family education content into educational programs at all levels.

Article 19. Responsibilities of the Ministry of Interior

Coordinate with the Ministry of Culture, Sports and Tourism to guide the implementation of planning and improve the cadre team working on family affairs at all levels.

Article 20. Responsibilities of the Ministry of Labor, Invalids and Social Affairs

Take the lead and coordinate with the Ministry of Culture, Sports and Tourism, relevant ministries and agencies to develop policies and laws regarding the protection, care, and education of children within families, care for elderly people within families, and prevention and control of social evils infiltrating families according to their assigned functions and tasks.

Article 21. Responsibilities of Ministries and Agencies Equivalent to Ministries

1. Take the lead and coordinate with the Ministry of Culture, Sports and Tourism to implement contents related to family affairs within their scope, functions, duties, and authorities.

2. Issue and submit to competent authorities for promulgation policies, laws, programs, and projects related to family affairs; guide, inspect, audit, review, and summarize the implementation of policies, laws, programs, and projects under their management responsibilities related to family affairs.

3. Annually, summarize the implementation of tasks related to family affairs within their areas of state management, and send them to the Ministry of Culture, Sports and Tourism for consolidation and reporting to the Prime Minister.

Article 22. Responsibilities of People's Committees at all levels

1. Organize and inspect the implementation of policies and laws on family affairs at local levels.

2. Develop and implement family work programs and plans in conjunction with local socio-economic development programs.

3. Allocate budget for family work in accordance with the provisions of the State Budget Law.

Article 23. Participation in State Management of Family Affairs by Women's Union at All Levels

The Ministry of Culture, Sports and Tourism, ministries and agencies equivalent to ministries, government agencies, and People's Committees at all levels shall ensure that the Women's Union at the same level participates in state management of family affairs in accordance with the provisions of the law and Articles 4, 6, Clauses 1, 2, and 3 of Article 8, and Article 9 of this Decree.

Article 24. Participation in Implementing Family Work

Request the Vietnam Fatherland Front Central Committee and its member organizations to participate in propaganda, dissemination, and education on policies and laws related to family affairs, and inspect and supervise the implementation of such policies and laws according to the provisions of the law.

Article 25. Funding for Implementing Family Work

1. Funding allocated for activities related to family work by ministries, sectors, and People's Committees at all levels shall be sourced from the state budget in accordance with the provisions of the law. The preparation of budgets and allocation of funding for family work shall be carried out in accordance with the State Budget Law and related documents.

2. Funding raised from domestic and foreign organizations and individuals for family work shall be managed and utilized in accordance with the provisions of the law.

Chapter IV

IMPLEMENTING PROVISIONS

Article 26. Effective date

This Decree takes effect from February 18, 2013.

Article 27. Responsibility for Implementation

Ministers, Heads of agencies equivalent to ministries, Heads of government agencies, Chairmen of provincial and centrally-run city People's Committees, and related agencies and organizations are responsible for implementing this Decree./.
