PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
refers to the systematic process of imparting and acquiring knowledge of laws, skills, and expertise related to counter-terrorism.
Capacity Building
Article 2. Interpretation of Terms
In this Circular, the following terms shall be understood as follows:
1. refers to activities aimed at equipping, updating, and enhancing knowledge of laws, skills, and expertise related to counter-terrorism. Article 3. Objectives and requirements for training and capacity building
2. 1. To equip and provide knowledge of laws related to counter-terrorism; necessary skills and expertise for students, trainees, and officials engaged in counter-terrorism work. 2. Students, trainees, and officials participating in training and capacity building must master the following knowledge, skills, and expertise:
a) Knowledge of Vietnamese law, international law, and the laws of other countries on counter-terrorism; international cooperation in counter-terrorism;
b) Knowledge of the system of agencies implementing and participating in counter-terrorism in Vietnam and around the world;
c) Skills, expertise in implementing counter-terrorism;
d) Measures and methods for organizing and implementing counter-terrorism;
đ) Rights and obligations of individuals, agencies, and organizations implementing and participating in counter-terrorism.
Article 4. Recipients of training and capacity building
1. Recipients of training are students of public security and military schools.
2. Recipients of capacity building are officials engaged in advisory and direct implementation of counter-terrorism tasks within the Ministry of Public Security, the Ministry of National Defense, and the Ministry of Transportation.
Chapter II
SPECIFIC PROVISIONS
Article 5. Content, curriculum, and duration of training and capacity building
1. The Ministry of Public Security shall take the lead and coordinate with the Ministry of National Defense and the Ministry of Transportation to compile the content and curriculum for training and capacity building of students, trainees, and officials engaged in counter-terrorism work. The content of training and capacity building includes:
a) Provisions of Vietnamese law, international law, and the laws of other countries on counter-terrorism;
b) Measures and methods for organizing and implementing counter-terrorism;
c) Knowledge, skills, and expertise in counter-terrorism;
d) Knowledge of the system of agencies implementing and participating in counter-terrorism in Vietnam and around the world;
đ) Provisions of law regarding the rights and obligations of individuals, agencies, and organizations implementing and participating in counter-terrorism.
2. Capacity building for officials engaged in counter-terrorism work shall be conducted annually.
3. Counter-terrorism is a core component of the formal curriculum of schools and centers providing vocational training for students, trainees, and officials engaged in counter-terrorism work within the public security and military sectors.
4. Depending on the recipients of training and capacity building, the training institutions shall develop the content, curriculum, and duration of training and capacity building and submit them for approval by the competent authority.
2. The training of officials for anti-terrorism work shall be conducted annually.
3. Anti-terrorism is a component and course of formal training at schools and vocational training centers for students, trainees, and officials engaged in anti-terrorism work within the People's Public Security and the People's Armed Forces.
4. Depending on the trainee category, the training institutions shall develop the content, curriculum, and duration of training and submit them for approval by the competent authority.
Article 6. Requirements for Compiling Content, Programs, and Materials
1. The content, programs, and materials must be suitable for each training and development target; they must be regularly updated and improved to meet research and implementation requirements for anti-terrorism work.
2. The content and materials must ensure a combination of theory, practice, and practical skills.
Article 7. Issuance of Training Certificates and Development Certificates
1. The issuance of training certificates shall be carried out in accordance with the regulations of the Ministry of Education and Training.
2. After completing the development program on anti-terrorism work, officials will be issued a certificate for development in anti-terrorism work; the head of the development center signs and issues the completion certificate for the anti-terrorism work development program.
Article 8. Training and Development Funding
1. Training and development funding is allocated from the annual budget of the Ministry of Public Security, the Ministry of National Defense, and the Ministry of Transport.
2. In cases where ministries or sectors send their trainees, students, or officials to other ministries' or sectors' training and development centers to participate in anti-terrorism training and development programs, the sending ministry or sector must cover the training and development costs.
Article 9. Training and Development Centers
1. Training centers are the People's Police Academy and the People's Armed Forces Academy.
2. Development centers are the anti-terrorism professional development centers under the Ministry of Public Security and the Ministry of National Defense.
Article 10. Responsibilities of Ministries
1. Ministry of Public Security
a) Implement anti-terrorism training in the People's Police Academy;
b) Annually organize courses to enhance knowledge of laws, expertise, and skills related to anti-terrorism for participants involved in anti-terrorism work;
c) Annually, the Ministry of Public Security shall take the lead and coordinate with the Ministry of National Defense and the Ministry of Transport to conduct mid-term and final evaluations of the training and development of personnel engaged in anti-terrorism work.
Directing and guiding functional agencies to coordinate with the Environmental Crime Prevention Police Force
a) Coordinate with the Ministry of Public Security to develop training and development content and programs for students, trainees, and officials involved in anti-terrorism work under the Ministry of National Defense;
b) Conduct anti-terrorism training in the People's Armed Forces Academy;
c) Annually organize courses to enhance knowledge of laws, expertise, and skills related to anti-terrorism for students, trainees, and officials involved in anti-terrorism work.
3. The Ministry of Transport
a) Coordinate with the Ministry of Public Security to develop development content and programs for officials involved in anti-terrorism work under the Ministry of Transport;
b) Annually, based on the development requirements for anti-terrorism work of the Ministry of Transport, assign officials to attend development courses organized by the Ministry of Public Security or jointly organize such courses with the Ministry of Public Security.
Chapter III
IMPLEMENTING PROVISIONS
Article 11. Effective Date
This Circular takes effect from August 3, 2016.
Article 12. Implementation Organization
1. The Ministry of Public Security, the Ministry of National Defense, and the Ministry of Transport shall, based on their functions and responsibilities, be responsible for implementing this Circular.
2. During the implementation process, if any difficulties arise or guidance is needed, please promptly report to the Ministry of Public Security, the Ministry of National Defense, and the Ministry of Transport for timely study, guidance, amendment, and supplementation.
