Guidelines for organizing the Month of Action on Occupational Safety and Health

On the basis of Law on Occupational Safety and Health No. 84/2015/QH13 dated June 25, 2015;

Decree No. Article 14/2017/ND-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - Invalids and Social Affairs;

Pursuant to Decision No. Decision No. 87/QĐ-TTg dated January 12, 2016 on organizing the Month of Action on Occupational Safety and Health;

At the proposal of the Director of the Occupational Safety and Health Inspectorate;

The Minister of Labor, Invalids and Social Affairs issues this Circular guiding the organization of the Month of Action on Occupational Safety and Health.

Article 1. Scope of Regulation

This Circular guides the organization of the annual Month of Action on Occupational Safety and Health.

Article 2. Applicability

This Circular applies to state management agencies at all levels concerning occupational safety and health; production and business establishments; and other organizations and individuals related to occupational safety and health work.

Article 3. Theme of the Month of Action on Occupational Safety and Health

Annually, the Ministry of Labor, Invalids and Social Affairs bases on the current situation and the status of labor accidents and occupational diseases to build the general theme of the Month of Action on Occupational Safety and Health. Ministries, sectors, localities, and production and business establishments may choose specific themes suitable to their economic and social conditions and the actual situation of occupational safety and health work.

The theme must be concise, easy to understand, linked to specific goals and contain messages that promote action, raise awareness, and enhance compliance with laws on occupational safety and health, focusing on key and prominent issues in occupational safety and health work that businesses, society, and public opinion are concerned about.

Article 4. Contents of Activities during the Month of Action on Occupational Safety and Health

Focus on organizing and implementing specific activities to implement the theme of the Month of Action on Occupational Safety and Health; provisions of the Law on Occupational Safety and Health; requirements, directives, and orientations in occupational safety and health work; objectives to improve working conditions, reduce labor accidents and occupational diseases, and build civilized and safe working culture.

Encourage the organization of activities during the Month of Action on Occupational Safety and Health to be integrated and connected with environmental protection activities, prevention of climate change, fire prevention, and activities of the Month of Workers.

Main activities include:

1. At the Ministry, Sector, and Local Level

a) Communication activities on occupational safety and health

Develop and send out messages and slogans to implement the theme and contents of the Month of Action on Occupational Safety and Health; provide relevant materials and information on the theme and contents of the Month of Action to mass media agencies; organize information and propaganda activities on newspapers, radio, internet, mobile phones; develop guidelines, communication materials, and sample products; print and distribute posters, banners, slogans; organize film screenings and training sessions on safe working skills and procedures for workers; organize mobile propaganda vehicles on occupational safety and health.

b) Launching Ceremony of the Month of Action on Occupational Safety and Health

At the Central level: The Ministry of Labor, Invalids and Social Affairs will coordinate with key ministries, sectors, and localities to organize a national launching ceremony of the Month of Action on Occupational Safety and Health.

At ministries, sectors, and localities: organize launching ceremonies or specific activities to respond to the Month of Action on Occupational Safety and Health according to local conditions, ensuring practical and effective outcomes for enterprises and workers.

The launching ceremony will involve representatives from party committees, authorities, relevant agencies, organizations, associations, enterprises, workers, students, and pupils in the locality. The program of the launching ceremony includes the following main contents: overview of the current status of occupational safety and health work, labor accident and occupational disease situations; launch and convey the message of the Month of Action on Occupational Safety and Health; award for occupational safety and health.

c) Inspection and Supervision on Occupational Safety and Health

Organize specialized or inter-sector inspection teams on occupational safety and health. The focus of inspections and supervision is on requirements and directives according to the theme launched in that year; laws on occupational safety and health; industries, occupations, and fields with high risks of labor accidents and occupational diseases.

d) Launching Campaigns and Competitions on Occupational Safety and Health

Annually or during specific periods, ministries, sectors, and localities organize campaigns and competitions on occupational safety and health during the Month of Action to promote the implementation of the Law on Occupational Safety and Health in agencies, units, production and business establishments, and the community. The contents of these campaigns and competitions should aim at improving working conditions, reducing labor accidents and occupational diseases; promoting the construction of preventive culture, industrial manners, labor discipline, and civilized and safe working culture.

đ) Awarding for Occupational Safety and Health

Ministries, sectors, and localities base on the Law on Awards and Commendations and the actual situation of their agencies and units to organize awards for outstanding collectives and individuals in occupational safety and health during the Month of Action on Occupational Safety and Health.

For forms of awards for occupational safety and health within the authority of the Ministry of Labor, Invalids and Social Affairs or proposed for commendation by the Government: ministries, sectors, localities, and production and business establishments proactively prepare award application files according to procedures and submit them to the Ministry of Labor, Invalids and Social Affairs (through the Department of Labor Safety) before January 30 of the following year.

e) Organizing Special Activities on Occupational Safety and Health

Organize some specialized activities on occupational safety and health suitable for specific conditions each year such as: organizing roundtable discussions, policy dialogues, conferences, and specialized seminars on occupational safety and health; organizing advisory, training, and instruction activities on business skills and safe working techniques; organizing health check-ups and occupational disease examinations for workers.

g) Organize other activities such as: visiting and encouraging victims and their families affected by workplace accidents and occupational diseases; organizing cultural and artistic exchanges incorporating contents on occupational safety and health; organizing visits to exemplary models and production and business establishments in occupational safety and health work.

2. For production and business establishments

Maintain regular activities on occupational safety and health in accordance with the provisions of the law and focus on the following basic contents:

a) Develop and implement specific action programs on occupational safety and health within production and business establishments;

b) Develop, review, and supplement internal regulations and safe working procedures; organize inspections, self-inspections, reviews, and assessments of risks related to occupational safety and health for each machine, equipment, workshop, team to promptly address incidents and risks of workplace accidents and occupational diseases.

c) Review and organize training activities on occupational safety and health suitable for different groups according to the provisions of the law; provide information and advice to workers on how to assess risks related to occupational safety and health; review and conduct certification for machines, equipment, and materials with strict requirements for occupational safety and health.

d) Organize health check-ups and occupational disease examinations for workers; monitor the labor environment.

đ) Organize practical exercises and demonstrations on handling technical incidents related to occupational safety and health, first aid practices; organize competitions and initiatives to improve working conditions, reduce workplace accidents and occupational diseases; sign competition agreements to ensure occupational safety and health in workshops, teams in accordance with the specific conditions of the unit and establishment.

e) Encourage corporations, state-owned enterprises, and production and business establishments to organize Launching Ceremonies to respond to Occupational Safety and Health Action Month within their units and establishments; organize awards for collectives and individuals who perform well in occupational safety and health work; organize visits and encouragement for victims and their families affected by workplace accidents and occupational diseases; organize cultural and artistic activities with contents promoting occupational safety and health suitable for the establishment's conditions.

Article 5. Time of Organization

a) The Occupational Safety and Health Action Month is organized from May 1st to May 31st every year.

b) The Launching Ceremony of the Occupational Safety and Health Action Month is held on one day between May 1st and May 10th every year.

Article 6. Implementation Organization

1. Ministry of Labor, Invalids and Social Affairs

a) Guide the implementation of the Occupational Safety and Health Action Month nationwide.

b) Take the lead and coordinate with the Ministry of Health, the Vietnam General Confederation of Labor, and relevant ministries and sectors to select themes and key localities to organize the National Occupational Safety and Health Action Month annually.

c) Take the lead and coordinate with key localities and relevant ministries, sectors, and agencies to develop comprehensive programs and plans, convene meetings to unify plans, press conferences to launch the Occupational Safety and Health Action Month, organize the National Occupational Safety and Health Action Month Launching Ceremony and other key activities according to the guidance at Clause 1 of Article 4 of this Circular.

d) Develop messages, slogans, and model communication materials during the Occupational Safety and Health Action Month, distribute them to localities, production and business establishments, and post models on the website of the Occupational Safety and Health Administration at the address: http://www.antoanlaodong.gov.vn; the electronic portal of the Ministry of Labor, Invalids and Social Affairs at the address: http://www.molisa.gov.vn.

đ) Summarize experiences, draw lessons learned, and compile results of organizing the Occupational Safety and Health Action Month by ministries, sectors, and localities, report to the Prime Minister.

2. Relevant Ministries, Sectors, and Agencies

a) Relevant ministries, sectors, and agencies develop and issue plans and organize appropriate and practical activities to respond to the Occupational Safety and Health Action Month; coordinate with the Ministry of Labor, Invalids and Social Affairs to organize the National Occupational Safety and Health Action Month Launching Ceremony; guide units and establishments under their management to implement response activities; summarize and evaluate the results of organizing the Occupational Safety and Health Action Month.

b) Propose the Vietnam General Confederation of Labor, the Vietnam Chamber of Commerce and Industry, the Vietnam Federation of Trade Unions, and the Vietnam Farmers' Union to cooperate in organizing the National Occupational Safety and Health Action Month Launching Ceremony; develop programs and plans, organize and guide units and establishments under their management to implement response activities; summarize and evaluate the results of organizing the Occupational Safety and Health Action Month.

3. People's Committees at all levels

a) Develop and issue plans and guide the implementation of the Occupational Safety and Health Action Month annually in the locality.

b) Direct and assign specific responsibilities to relevant departments and sectors at the locality level to implement response activities to the Occupational Safety and Health Action Month throughout the district, county, commune levels; regularly inspect, urge, and evaluate the organization and implementation in units and establishments under their management.

c) Allocate funds to organize practical and appropriate activities to respond to the Occupational Safety and Health Action Month according to the guidance at Clause 1 of Article 4 of this Circular, focusing on prioritizing solutions to address key issues and existing problems in occupational safety and health work in the locality.

d) Organize activities to provide information, propaganda, legal education, display posters, distribute leaflets, banners, materials, and specific guidelines on safe working procedures for workers both within and outside the labor relationship area.

4. Departments of Labor, Invalids, and Social Affairs of provinces and centrally governed cities and Labor, Invalids, and Social Affairs Offices at district level

a) Take the lead and coordinate with provincial Safety and Health Councils and relevant agencies and organizations to advise People's Committees on directing and issuing plans to implement the Month of Action for Occupational Safety and Health in their localities.

b) Develop programs, plans, and organize appropriate and practical activities to respond to the Month of Action for Occupational Safety and Health in their localities.

c) Develop publications and guidance materials for communication during the Month of Action, distributing them to production and business establishments, workers, and areas without labor relationships.

d) Summarize and report the results of implementing the Month of Action for Occupational Safety and Health in their localities.

5. Groups, Corporations, Production and Business Establishments

a) Based on the contents of activities stipulated in Clause 2 of Article 4 of this Circular, develop detailed plans, contents of activities, and budgets for implementing the Month of Action for Occupational Safety and Health in accordance with the actual production and business conditions of the unit.

b) Direct and guide affiliated units to organize practical activities to respond to the Month of Action for Occupational Safety and Health.

c) Summarize, evaluate, draw lessons learned, and report the results of implementing the Month of Action for Occupational Safety and Health to competent management authorities.

Article 7. Reporting System

1. Production and business establishments, Labor, Invalids, and Social Affairs Offices shall report the results of implementing the Month of Action for Occupational Safety and Health to the Department of Labor, Invalids, and Social Affairs before July 15 each year according to the form specified in the Appendix of this Circular.

2. Ministries, sectors, groups, corporations, Departments of Labor, Invalids, and Social Affairs of localities shall compile reports on the implementation of the Month of Action for Occupational Safety and Health to the Ministry of Labor, Invalids, and Social Affairs before July 30 each year according to the form specified in the Appendix of this Circular.

Article 8. Implementation clause

This Circular takes effect from April 6, 2017, and replaces the organization of National Week on Occupational Safety and Health - Fire Prevention annually as guided by Directive No. 4280/BCĐTLQG-ATLĐ dated November 30, 2006, of the Central Steering Committee for the National Week on Occupational Safety and Health - Fire Prevention.

During the implementation process, if there are difficulties or obstacles, they should be promptly reflected to the Ministry of Labor, Invalids, and Social Affairs for timely guidance and supplementation.
