Detailed regulations on the List of goods for purchase and exchange

of border residents

Pursuant to Decree No. 98/2017/NĐ-CP dated August 18, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

On the basis of Government Decree No. 14/2018/NĐ-CP dated 23 the 01 Article 2. 4. Supplement Clause 7 following Clause 6 Article 2 as follows: detailed regulations on the List of goods for purchase and exchange of border residents.

Article 1. Scope of Regulation

This Circular details the List of goods for purchase and exchange across the border of border residents as prescribed in Clause 2, Article 12 of Decree No. 14/2018/NĐ-CP dated January 23, 2018 of the Government detailing the provisions on cross-border trade activities.

Article 2. Applicability

2. Agencies and organizations managing and overseeing cross-border trade activities.

3. Other agencies, organizations, and individuals related to cross-border trade activities.

1. Issuing the List of goods eligible for import under the form of purchase and exchange of border residents as prescribed in Appendix I attached hereto.

2. Goods not included in the list prescribed in Clause 1 of this Article shall not be imported under the form of purchase and exchange of goods of border residents.

3. In cases where food safety and disease prevention at the border need to be ensured, the Ministry of Industry and Trade, after consultation with relevant ministries and sectors, may decide to temporarily suspend the importation of certain goods from the List of goods for purchase and exchange of border residents issued pursuant to Clause 1 of this Article in specific areas for a specified period of time.

Article 4. Organization of Implementation

1. The Ministry of Industry and Trade shall be responsible for:

Directing and inspecting agencies, organizations, and individuals related to the implementation of this Circular.

2. Provincial People's Committees along the border shall be responsible for:

a. Directing the Department of Industry and Trade to take the lead and coordinate with relevant agencies to implement this Circular with related provincial agencies, and develop a coordination mechanism to manage the purchase and exchange of goods by border residents within their jurisdiction.

Article 5. Effective Date

1. This Circular takes effect from the date of signature.

2. Repealing Circular No. 54/2015/TT-BCT dated December 30, 2015 of the Ministry of Industry and Trade detailing the List of goods for purchase and exchange of border residents as prescribed in Decision No. 52/2015/QĐ-TTg dated October 20, 2015 of the Prime Minister on the management of cross-border trade activities with neighboring countries sharing borders. 3. During the implementation process, if there are difficulties, obstacles, or new issues arising, agencies, organizations, and individuals related to the matter shall report in writing to the Ministry of Industry and Trade (Directorate of Foreign Trade) for resolution./.

3. During the implementation process, if there are difficulties, obstacles, or any emerging issues, relevant agencies, organizations, and individuals shall reflect them in writing to the Ministry of Industry and Trade (Department of Import-Export) for resolution./.
