Regulations on reporting the implementation of technology transfer contracts included in the List of restricted technology transfers; sample documents for issuing Technology Transfer Licenses, registering extensions, amendments, and supplements to the content of technology transfers

Pursuant to the Law on Technology Transfer dated June 19, 2017;

Pursuant to Decree No. 95/2017/NĐ-CP dated August 16, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

At the proposal of the Director of the Department of Evaluation, Appraisal, and Technology Inspection and the Director of the Legal Department;

The Minister of Science and Technology issues this Circular stipulating the reporting system for implementing technology transfer contracts included in the List of restricted technology transfers; sample documents for issuing Technology Transfer Licenses, registering extensions, amendments, and supplements to the content of technology transfers.

Article 1. Scope of Regulation and Applicability

2. Applicability:

This Circular guides Clause 3 Article 28, Clause 5 Article 29, Clause 7 Article 30, and Clause 4 Article 33 of the Law on Technology Transfer regarding the reporting system for implementing technology transfer contracts included in the List of restricted technology transfers and some sample documents for issuing Technology Transfer Licenses, registering extensions, amendments, and supplements to the content of technology transfers.

The application form for technology transfer registration and the Certificate of Registration for technology transfer shall be implemented according to the regulations of the Government.

a) Authority issuing Technology Transfer Licenses, issuing Certificates of Registration for extending, amending, and supplementing the content of technology transfers;

b) Organizations and individuals requesting issuance of Technology Transfer Licenses, reporting on the implementation of technology transfer contracts included in the List of restricted technology transfers, requesting registration for extensions, amendments, and supplements to the content of technology transfers;

c) Other relevant organizations and individuals.

Article 2. Reporting System for Implementing Technology Transfer Contracts Included in the List of Restricted Technology Transfers

1. Annually, organizations and individuals specified in Clause 3 Article 28 of the Law on Technology Transfer shall submit reports on the implementation of technology transfer contracts included in the List of restricted technology transfers (in Form No. 05 attached hereto) to the Ministry of Science and Technology before December 31 of the reporting year.

2. Data for the report shall be taken from December 15 of the preceding year to December 14 of the reporting year.

In the case of the first report on the implementation of technology transfer contracts included in the List of restricted technology transfers where the contract implementation period has not yet reached one year, the party responsible for reporting under this Article shall submit the report in the following year, with the data including the entire period of the technology transfer contract implementation prior to that.

3. The report format shall be in writing, including both paper and electronic versions:

a) The paper version must have the signature of the head of the unit and the stamp as prescribed (for organizations); signed and clearly stated name (for individuals);

b) The electronic version must use the Portable Document Format (.pdf), Vietnamese font of the Unicode character set according to Vietnam Standard TCVN 6909:2001, and the content must match the paper version.

4. Method of submitting reports

Organizations and individuals may submit the paper report directly or through postal service to the Ministry of Science and Technology, and simultaneously send the electronic report to the email address: [email protected].

Article 3. Sample Documents Issued Along with This Circular

1. For activities related to issuing Technology Transfer Licenses:

b) Sample document explaining the technology (Form No. 02);

d) Sample Technology Transfer License (Form No. 04).

2. Sample report on the implementation of technology transfer contracts included in the List of restricted technology transfers (Form No. 05).

3. For activities related to registering extensions, amendments, and supplements to the content of technology transfers:

a) Sample document requesting registration for extensions, amendments, and supplements to the content of technology transfers (Form No. 06);

b) Sample Certificate of Registration for extensions, amendments, and supplements to the content of technology transfers (Form No. 07).

Article 4. Effectiveness and Implementation

1. This Circular takes effect from July 1, 2018.

2. The Ministry of Science and Technology assigns the Department of Evaluation, Appraisal, and Inspection of Technology to take the lead in implementing this Circular.

3. Ministries, ministerial-level agencies, government agencies, provincial People's Committees, and relevant organizations and individuals are responsible for enforcing this Circular.

4. During the implementation of this Circular, if there are any difficulties, please promptly reflect them to the Ministry of Science and Technology for appropriate revision and supplementation./.
