CIRCULAR

Regulations on criteria for farm economy

Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 55/2015/NĐ-CP dated June 9, 2015 of the Government on credit policies serving agricultural and rural development, and Decree No. 116/2018/NĐ-CP dated September 7, 2018 of the Government amending and supplementing certain articles of Decree No. 55/2015/NĐ-CP dated June 9, 2015 of the Government on credit policies serving agricultural and rural development;

At the request of the Director of the Department of Cooperative Economy and Rural Development,

The Minister of Agriculture and Rural Development issues this Circular on criteria for farm economy.

Article 1. Scope of Regulation and Applicability

1. Scope of regulation: This Circular stipulates criteria and reporting procedures for farm economy.

a) Individuals and household heads engaged in production and business activities in agriculture (crops, livestock, forestry, aquaculture, salt production) meeting the farm economy criteria as prescribed in this Circular;

b) State management agencies, organizations, and other relevant individuals.

Article 2. Classification of farms

1. Specialized farms are determined based on the field of production such as crops, livestock, forestry, aquaculture, salt production, and the proportion of production value of the field accounting for more than 50% of the farm's production value structure in the year. Specialized farms are classified as follows:

a) Crop farms;

b) Livestock farms;

c) Forestry farms;

d) Aquaculture farms;

e) Salt production farms.

2. Integrated farms are those in which no production sector accounts for more than 50% of the farm's production value structure in the year.

Article 3. Criteria for farm economy

1. For specialized farms:

a) Crop farming: Average production value must reach VND 1 billion/year or more and total production land area must be 1 hectare or more;

b) Aquaculture: Average production value must reach VND 2 billion/year or more and total production land area must be 1 hectare or more;

c) Livestock farming: Average production value must reach VND 2 billion/year or more and must meet the scale of livestock farming as stipulated in Article 52 of the Livestock Law and guiding documents;

d) Forestry: Average production value must reach VND 1 billion/year or more and total production land area must be 10 hectares or more;

e) Salt production: Average production value must reach VND 0.35 billion/year or more and total production land area must be 1 hectare or more.

2. For integrated farms: Average production value must reach VND 2 billion/year or more and total production land area must be 1 hectare or more.

Article 4. Calculation of total production land area and production value of farms

1. The total production land area as stipulated in Article 3 of this Circular is the total production and business land area of the farm, legally used according to the laws on land, including land for crop farming, livestock farming, forestry, aquaculture, salt production, and land for infrastructure construction serving production at the time of declaration.

2. The production value of the farm/year is the production value achieved in at least one year out of the three most recent years prior to the declaration year; calculated as the total production value of harvests or exploitation periods in the year. For newly established farms without harvested products, the production value is estimated based on the production plan and actual implementation situation of the farm.

Article 5. Monitoring, statistics, and reporting system on farm economy

1. The Commune People's Committee has the responsibility:

a) Guide and disseminate criteria for farm economy to individuals and household heads engaged in agricultural production and business activities within the commune's jurisdiction;

b) Implement monitoring, statistics, and updates on changes regarding farm owners, cultivated land area, and types of farms;

c) Establish a record book for tracking the development of farm economy within the commune according to the model set forth in Appendix I attached hereto.

2. Reporting system on farm economy according to the model set forth in Appendix II attached hereto:

b) Before December 19 each year, the Department of Agriculture and Rural Development shall aggregate and report on the farm economy within the province for the year to the People's Committee at the provincial level and the Ministry of Agriculture and Rural Development;

c) The method of sending and receiving reports, and the time for finalizing report data shall be implemented in accordance with Clause 4, Article 8 and Clause 4, Article 12 of Decree No. 09/2019/NĐ-CP dated January 24, 2019 of the Government on the reporting system of administrative agencies;

Article 6. Responsibility for Implementation

1. The Cooperative Economy and Rural Development Department shall organize the implementation of this Circular; aggregate and periodically and ad hoc report to the Ministry;

2. The People's Committee at the provincial level shall implement this Circular within the provincial jurisdiction;

Responsibilities of farm owners:

a) Declare information about the farm according to the model set forth in Appendix III attached hereto, submit to the People's Committee at the commune level before November 15 each year; bear responsibility under the law for the truthfulness and accuracy of the declared information;

b) Organize production and business in compliance with land use planning and plans within the jurisdiction; comply with legal regulations on product quality, food safety, disease safety, and environmental protection;

Article 7. Implementation Provisions

1. This Circular takes effect from April 14, 2020 and replaces Circular No. 27/2011/TT-BNNPTNT dated April 13, 2011 of the Ministry of Agriculture and Rural Development on criteria and procedures for issuing certificates for farm economies;

2. Certificates for farm economies issued according to Circular No. 27/2011/TT-BNNPTNT dated April 13, 2011 of the Ministry of Agriculture and Rural Development on criteria and procedures for issuing certificates for farm economies shall cease to be valid from the date this Circular takes effect;

3. Criteria for farm economies stipulated in this Circular serve as the basis for determining beneficiaries of state policies applicable to farm economies;

4. During implementation, if there are difficulties, agencies, organizations, individuals, and household heads engaged in agricultural production and business activities shall promptly reflect them to the Ministry of Agriculture and Rural Development for research and resolution in accordance with regulations./.
