Providing measures to implement Decree No. 28/2024/NĐ-CP dated March 6, 2024 of the Government detailing the procedures and formalities for awarding and posthumously awarding the "Venerable Youth Volunteer Medal" and the commendation of achievements in the resistance war.

Pursuant to the Law on Competition and Reward dated June 15, 2022;

Pursuant to Decree No. 28/2024/NĐ-CP dated March 6, 2024 of the Government detailing the procedures and formalities for awarding and posthumously awarding the "Venerable Youth Volunteer Medal" and the commendation of achievements in the resistance war;

Pursuant to Resolution No. 6-NQ/TVQH dated August 29, 1960 of the Standing Committee of the National Assembly, promulgating the Regulations on rewarding achievements in the resistance war against France;

Pursuant to Resolution No. 47-NQ/HĐNN7 dated September 29, 1981 of the State Council, promulgating the Regulations on rewarding achievements in the resistance war against America;

Pursuant to Decree No. 63/2022/NĐ-CP dated September 12, 2022 of the Government on the Functions, Tasks, Authorities, and Organizational Structure of the Ministry of Home Affairs;

At the proposal of the Head of the Central Steering Committee for Encouragement and Reward;

The Minister of Home Affairs issues this Circular providing measures to implement the Decree detailing the procedures and formalities for awarding and posthumously awarding the "Venerable Youth Volunteer Medal" and the commendation of achievements in the resistance war.

Article 1. Scope of Regulation and Applicability

Article 1. This Circular provides measures to implement the Decree detailing the procedures and formalities for awarding and posthumously awarding the "Venerable Youth Volunteer Medal" and the commendation of achievements in the resistance war.

Article 2. This Circular applies to youth volunteers who have achieved merits in the resistance wars and national defense, completed their tasks, and served for at least 24 months; youth volunteers who died while performing tasks in the resistance wars and national defense and were recognized as martyrs; organizations and individuals related to the activities of awarding and posthumously awarding the "Venerable Youth Volunteer Medal" and the commendation of achievements in the resistance war.

Article 2. Matters concerning the awarding and posthumous awarding of the "Venerable Youth Volunteer Medal"

Clause 1. For youth volunteers who have been recognized as martyrs, the application for posthumously awarding the "Venerable Youth Volunteer Medal" shall be submitted at the place of residence of the relatives of the youth volunteer.

Clause 2. In cases where the application for awarding or posthumously awarding the "Venerable Youth Volunteer Medal" is not valid or requires additional information according to regulations, the agency receiving the application shall guide the youth volunteer or the relatives of the youth volunteer to complete the application in accordance with the regulations and resubmit it.

Clause 3. At locations in remote areas, border regions, islands, and particularly difficult regions, the list of individuals proposed for awarding or posthumously awarding the "Venerable Youth Volunteer Medal" shall be publicly displayed at the People's Committee offices of the communes in addition to being publicly displayed according to the provisions of Decree No. 28/2024/NĐ-CP dated March 6, 2024 of the Government.

Clause 4. The Department of Home Affairs of provinces and centrally governed cities must provide opinions on the forms of rewards for youth volunteers who have received awards as declared in the application for awarding or posthumously awarding the "Venerable Youth Volunteer Medal" and report cases meeting the conditions and criteria to the Provincial Competition and Reward Council before the meeting to award or posthumously award the "Venerable Youth Volunteer Medal".

Clause 5. For youth volunteers who have died or passed away, after the President decides to posthumously award them the "Venerable Youth Volunteer Medal", the presentation ceremony will be held at the place of residence of the relatives of the youth volunteer.

Article 3. Examination and awarding of achievements in the resistance war

1. The examination and proposal for rewarding achievements in the resistance war must ensure accuracy, objectivity, have sufficient legal grounds, reward the right person and the right achievement. When appraising the dossier for proposing rewards for achievements in the resistance war, attention should be paid to the level of achievement; individuals proposed for rewarding achievements in the resistance war must actively and continuously participate in the resistance war, meeting the standards and conditions stipulated in the Regulations on Rewarding Achievements in the Resistance War and guiding documents.

2. The appraisal of dossiers and submission to competent authorities for examination and proposal for rewarding achievements in the resistance war against France and America must be carried out according to the provisions of the Regulations on Rewarding Achievements in the Resistance War against France issued together with Resolution No. 6-NQ/TVQH dated August 29, 1960 of the Standing Committee of the National Assembly; the Regulations on Summarizing Achievements in the Resistance War against America issued together with Resolution No. 47-NQ/HĐNN7 dated September 29, 1981 of the State Council and guiding documents that have been issued.

Article 4. Awarding achievements in the resistance war against America

1. For proposals for rewarding cadres and staff at commune-level agencies in the northern region, the basis shall be the list of cadres and staff of Party organizations, administrative bodies, mass organizations, and cooperatives from July 20, 1954 to April 30, 1975 established as the basis for rewarding (the local personnel lists have been compiled according to regulations). Personal confirmation shall not be used as a basis for rewarding, but only as reference material.

2. For proposals for rewarding demobilized military personnel, there must be a decision on demobilization, discharge, or transfer to another profession; in cases where documents are lost, a certificate from the Military Command of the district (or the former managing unit) regarding their service period, specifying the source of information, the volume number, the serial number in the list; date of enlistment, date of discharge, time spent in battlefields B, C, K (if applicable), and the date, month, year they were assigned to a unit or registered in the reserve force with the Military Command of the district, accompanied by a copy of the list bearing the name of the person being certified (a photocopied copy stamped by the Military Command of the district or the former managing unit).

3. For proposals for rewarding party members, there must be a copy of the Party member's biography and a confirmation of the party member's participation in party activities by the grassroots Party Committee responsible for managing the party member. A copy of the Party member's biography confirmed by the People's Committee of the commune or ward shall not be used.

4. For proposals for rewarding civil servants and employees, there must be a civil servant and employee biography, retirement decision, resignation decision, incapacity decision, or Labor Book. Civil servants and employees, military personnel...must have a certificate from the agencies where they worked from 1983 to the present regarding their work history, rewards, disciplinary actions, and reasons for not receiving resistance war rewards. If there is only a retirement decision, resignation decision, incapacity decision, or Labor Book, it is insufficient evidence. If the person has only worked at one agency since the implementation of the rewarding program, the grassroots Competition and Reward Council must state the reason for not being considered for rewarding.

5. Individuals under 18 years old can only be recognized and considered for rewarding achievements in participating in the resistance war against America to save the country when they join an organization and are officially recognized in its roster while participating in activities. Individuals under 18 years old who are not active members of resistance organizations are not eligible for consideration and rewarding of achievements in the resistance war.

6. For those who assisted the resistance war, the individual achievement report and confirmations must specifically describe the assistance provided in accordance with the regulations.

7. Certifications from collectives and individuals who are responsible cadres, task assigners, co-participants, or those who are certainly aware of the assistance provided to the resistance war must align with the materials in "Local Resistance War History" or "Local Party Organization History."

8. The proposal dossier for rewarding must include a certificate from the place of residence regarding compliance with the Party's policies and state laws and the minutes of the grassroots Resistance War Reward Council's review at the commune or ward level.

Article 5. Responsibilities of the People's Committee of the province

1. The People's Committees of the provinces and centrally governed cities shall be responsible for directing specialized agencies to carry out the examination and proposal for awarding and posthumously awarding War Merit Medals to cases that meet the conditions and criteria.

2. Clearly explain the situations where declarations have been made but lack sufficient grounds, conditions, and criteria for commendation, thereby resolving pending commendations for war achievements conclusively.

Article 6. Effectiveness

This Circular takes effect from August 1, 2024.

Article 7. Implementation Provisions

1. Heads of central ministries, sectors; Chairpersons of provincial People's Committees of centrally governed cities are responsible for implementing this Circular.

2. In case of difficulties during implementation, agencies, organizations, units, and individuals are requested to report to the Ministry of Home Affairs for study and guidance.
