Pursuant to Decree No. 52/2022/NĐ-CP dated August 8, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

Pursuant to Decree No. 37/2010/NĐ-CP dated April 7, 2010 of the Government on the preparation, examination, approval, and management of urban planning;

Pursuant to Decree No. 44/2015/NĐ-CP dated May 6, 2015 of the Government detailing certain contents regarding construction planning;

Pursuant to Decree No. 72/2019/NĐ-CP dated August 30, 2019 of the Government amending and supplementing certain articles of Decree No. 37/2010/NĐ-CP dated April 7, 2010 on the preparation, examination, approval, and management of urban planning and Decree No. 44/2015/NĐ-CP dated May 6, 2015 detailing certain contents regarding construction planning;

Pursuant to the Government Decree No. 35/2023/NĐ-CP dated June 20, 2023 amending and supplementing certain articles of decrees under the Ministry of Construction's jurisdiction;

In accordance with the proposal of the Director of the Institute of Construction Economics and the Director of the Department of Construction Economics;

The Minister of Construction issues this Circular guiding the determination and management of detailed planning costs according to simplified procedures.

Article 1. Scope of Regulation

Article 1. This Circular guides the determination and management of detailed planning costs according to simplified procedures (hereinafter referred to as overall site planning costs) as prescribed in Articles 1 and 2 of Decree No. 35/2023/NĐ-CP dated June 20, 2023 of the Government amending and supplementing certain articles of Decrees under the jurisdiction of the Ministry of Construction.

Article 2. This Circular applies to organizations and individuals using public investment funds, state funds outside public investment for determining and managing overall site planning costs.

Article 2. Determination of Costs for Preparing and Examining Overall Site Planning

Clause 1. Costs for preparing overall site planning (for areas within urban development zones): determined at 65% of the cost of preparing detailed urban planning. The cost of preparing detailed urban planning is determined according to the current guidance on determining the cost of preparing detailed urban planning projects.

Clause 2. Costs for preparing overall site planning (for areas within functional zones): determined at 65% of the cost of preparing detailed construction planning for functional zones. The cost of preparing detailed construction planning for functional zones is determined according to the current guidance on determining the cost of preparing detailed construction planning projects for functional zones.

Clause 3. In cases where it is necessary to adjust overall site planning, the cost of adjusting overall site planning is determined according to the current guidance on determining the cost of partial adjustments to urban planning and construction planning projects.

Clause 4. Fees for examining overall site planning projects are determined according to the current regulations on fees for examining planning projects.

Clause 5. Costs for managing business operations in preparing overall site planning and other related costs are determined according to the current guidance on managing business operation costs for preparing detailed urban planning and construction planning projects.

Article 3. Management of Costs for Preparing and Examining Overall Site Planning

The management of costs for preparing overall site planning, examination fees for overall site planning projects, and costs for managing business operations in preparing overall site planning shall be carried out according to the current regulations on managing costs for preparing detailed urban planning and construction planning or according to the current regulations on managing investment construction costs when the Project Owner organizes the preparation of overall site planning.

Article 4. Competent authority for reviewing and approving the budget for planning costs

The competent authority for approving the overall land use plan shall organize the review and approval of the budget for planning costs, including the preparation and review of the plan, and the management of planning business operations. In cases where the Project Investor organizes the preparation of the overall land use plan, the authority to approve the planning preparation costs and the management of planning business operations shall be implemented in accordance with the current regulations on construction investment cost management.

Article 5. Effective Date

This Circular takes effect from July 15, 2024.
