 DECISION

On the price range for the average retail electricity price level

Pursuant to the Law on Organization of the State Administration dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the State Administration and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Electricity Law dated December 3, 2004; and the Law Amending and Supplementing Certain Provisions of the Electricity Law dated November 20, 2012;

At the proposal of the Minister of Industry and Trade;

The Prime Minister issues this Decision on the price range for the average retail electricity price level.

 Article 1. Scope of Regulation and Applicability

1. This Decision stipulates the maximum and minimum levels of the average retail electricity price.

2. This Decision applies to organizations and individuals participating in the electricity sector and using electricity.

Article 2. Price Range for the Average Retail Electricity Price

The price range for the average retail electricity price (excluding value-added tax) is as follows:

1. The minimum average retail electricity price is 1,826.22 VND/kWh;

2. The maximum average retail electricity price is 2,444.09 VND/kWh.

Article 3. Implementation Organization

1. When there are significant fluctuations in the parameters for calculating the price range, production and business costs of electricity, and requirements for allocating expenses not included in the average retail electricity price, the Ministry of Industry and Trade shall be responsible for leading and coordinating with the Ministry of Finance to calculate and adjust the price range for the average retail electricity price level, and submit it for approval.

2. The Vietnam Electricity Corporation shall be responsible for monitoring and reporting to the Ministry of Industry and Trade and the Ministry of Finance when there are significant fluctuations in the parameters for calculating the price range for the average retail electricity price level, production and business costs of electricity, and the need to allocate expenses not included in the average retail electricity price.

Article 4. Effective date

1. This Decision takes effect from February 3, 2023. The Decision No. 34/2017/QD-TTg dated July 25, 2017 of the Prime Minister on the price range for the average retail electricity price level for the period 2016-2020 ceases to be effective from the date this Decision takes effect.

2. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally governed cities, Heads of power units, and related organizations are responsible for implementing this Decision./.
