CIRCULAR
Guidelines for implementing Decision No. 28/TTg dated January 13, 1997 of the Government
Following Circular 01TM/XNK dated January 24, 1997 of the Ministry of Trade;
Pursuant to Circular No. 674/BKH-TMDV dated January 31, 1997 of the Ministry of Planning and Investment on import quotas for 1997 after consultation with relevant ministries and agencies (as stipulated in Article 4 and Article 6 of Decision No. 28/TTg); the Ministry of Trade issues guidelines for implementing Decision No. 28/TTg dated January 13, 1997 of the Prime Minister regarding specific imported goods as follows:
I. LIST OF GOODS AND IMPORT QUOTAS FOR 1997
Steel: 500,000 tons
Billets: approximately 900,000 tons
Cement: 500,000 tons - 700,000 tons
Clinker: 1,100,000 tons
Construction glass: approximately 2 million square meters
Trucks and passenger vehicles: approximately 30,000 units
Paper: approximately 20,000 tons
Sugar:
II. MANAGEMENT MECHANISM FOR IMPORTS
1. Steel:
a. Types of steel that domestic production can meet will not be imported (listed in Appendix 1 attached).
b. Import quota for types of steel that domestic production cannot meet or does not fully meet: 500,000 tons.
Where:
Various types of steel (listed in Appendix 2 attached) 400,000 tons
Steel sheets for billet making, pipe rolling, and galvanizing 100,000 tons
40% of the above quota will be assigned by the Ministry of Trade to the Steel Corporation to implement. The remainder will be assigned to enterprises with export-import licenses for the relevant commodity group to import.
c. Billets for 1997 imports approximately 900,000 tons (including imports by foreign-invested enterprises): The Ministry of Trade will allocate to steel smelting and rolling enterprises or export-import enterprises with supply contracts for steel smelting and rolling enterprises to implement.
d. Special types of steel (listed in Appendix 3 attached) enterprises with export-import licenses for the relevant commodity group may import according to production and business needs and complete import procedures at customs without going through the Ministry of Trade.
2. Cement:
The Ministry of Trade will manage supplementary imports of approximately 500,000 tons to 700,000 tons, directing the Cement Corporation to import approximately 40% of the demand and allocating the remainder to enterprises with sufficient capital, market supply conditions, and import experience to implement.
Clinker: 1,100,000 tons
Based on cement production plans, the Ministry of Construction will directly allocate the above quota to cement production facilities without going through the Ministry of Trade. Production facilities allocated import plans may directly or entrust others to import according to current regulations.
3. Construction Glass:
The Ministry of Trade will allocate to enterprises with export-import licenses for the relevant commodity group to import approximately 2 million square meters of construction glass types over 3mm to under 12mm that domestic production cannot meet or does not fully meet demand. Mainly serving construction in southern provinces.
Colored glass and other types of glass (including white glass with thickness from 3mm to 12mm) enterprises with export-import licenses for the relevant commodity group may import according to production needs and complete import procedures at customs without going through the Ministry of Trade.
4. Vehicles:
The import quota for trucks and passenger vehicles with 12 seats or more for 1997 is approximately 30,000 units. Enterprises with export-import licenses for the relevant commodity group, if needed, will be allocated import plans within this quota by the Ministry of Trade.
Other types of vehicles enterprises with export-import licenses for the relevant commodity group may import according to needs and comply with current regulations.
5. Paper:
a. The following types of paper that domestic production can meet will not be imported temporarily:
Newspaper printing paper, writing paper, general printing paper, toilet paper.
All types of cardboard and flat cartons.
b. The Ministry of Trade will allocate to enterprises with export-import licenses for the relevant commodity group to import approximately 20,000 tons of paper types that domestic production cannot meet or does not fully meet demand including:
High-quality printing paper.
Duplex cardboard.
In case of necessity, the Ministries and sectors will consider supplementing quotas to balance supply and demand.
c. Other types of paper enterprises with export-import licenses for the relevant commodity group may import according to production and business needs and complete import procedures at customs without going through the Ministry of Trade.
6. Sugar:
Domestic sugar production in 1997 is expected to meet demand, therefore, except for 10,000 tons of refined sugar (RE) imported for Tet and reserve circulation in the northern region, imports will not be made temporarily.
III. IMPLEMENTATION PROVISIONS
In case of necessity, relevant ministries and sectors will consider additional imports to balance demand and stabilize prices.
The Ministry of Trade requests all ministries, agencies equivalent to ministries, central agencies of mass organizations, provincial people's committees under direct central jurisdiction, and central agencies of social organizations to notify the contents of this circular to the enterprises under their management and implement it, while reflecting any issues arising during implementation to the Ministry of Trade for timely adjustment. This circular takes effect from the date of issuance until March 31, 1998/.
