Joint Circular No. 02-TT-LB guiding the implementation of Decision No. 62-CP dated May 8, 1963 of the Council of Ministers on the allowance and travel expenses for People's Council delegates when attending meetings and during the period of the People's Council meeting.

Guidelines for implementing Decision No. 62-CP dated May 8, 1963 of the Council of Ministers on the allowance and travel expenses for People's Council representatives when attending meetings and during the meeting period

Pursuant to Article 39 of the Law on the Organization of People's Councils and Administrative Committees at all levels dated October 27, 1962, the Council of Ministers issued Decision No. 62-CP dated May 8, 1963 on the allowance and travel expenses for People's Council representatives when attending meetings and during the meeting period.
The Joint Ministries provide detailed guidelines for implementing the above decision as follows:

A. REGARDING THE ALLOWANCE FOR PEOPLE'S COUNCIL REPRESENTATIVES

1. Recipients of the allowance and the allowance amount:

Clause 1 of Decision No. 62-CP of the Council of Ministers stipulates: "People's Council representatives who are not state-salaried personnel, during their attendance at their own level's People's Council meeting or at lower-level People's Council meetings within the unit that elected them, shall be entitled to the following allowance:

- People's Council representatives of communes and towns: VND 0.80 per day;

- People's Council representatives of districts, zones, streets, towns, and cities under provinces: VND 1.00 per day;

- People's Council representatives of provinces and centrally-administered cities: VND 1.50 per day;

- People's Council representatives of autonomous regions: VND 1.80 per day."

Currently, People's Council representatives who are not state-salaried personnel include those from the following categories:

+ Members of agricultural and handicraft cooperatives;

+ Members of small trade cooperative groups;

+ Grassroots cadres of towns, towns, zones, and cities;

+ Cadres and staff of privately-established educational and health organizations and other privately-established organizations;

+ Village cadres, including full-time and part-time Party, mass organizations, and administrative cadres at the village level, whether they receive subsidies or not;

+ State employees who have retired or left work due to health reasons and are currently receiving pension benefits or labor disability benefits from the social insurance fund;

+ Intellectuals not receiving salaries from the state or mass organizations;

+ And other ordinary citizens not belonging to the aforementioned categories.

People's Council representatives from the above categories are not supported by the salary fund, so they are all eligible for the allowance stipulated in Decision No. 62-CP of the Council of Ministers.

People's Council representatives from the following categories are not eligible for this allowance:

- Cadres, workers, and staff in state agencies and enterprises (industrial, agricultural, commercial, forestry enterprises, etc.);

- State cadres, workers, and staff dispatched to communes and towns, agricultural cooperatives, and handicraft cooperatives but still receiving their original salary from the state salary fund;

- Cadres and staff working in Party and mass organizations at the district level and above, who are paid by these organizations.

2. Method of paying allowances to non-state-salaried People's Council representatives:

a) Commune and town People's Council representatives are entitled to allowances for the days they attend their own level's People's Council meetings.

b) People's Council representatives at the district level and above are entitled to allowances for:

- The days they attend their own level's People's Council meetings;

- The days they attend lower-level People's Council meetings within the unit that elected them;

- The days they report to voters.

If for any reason a People's Council meeting at the district level and above does not open on the scheduled date and is postponed for one or two days, and representatives from distant places who are eligible for the allowance are required to stay and wait for the meeting, then these representatives will also be entitled to the allowance for the waiting days.

A meeting day or voter reporting day that does not last the entire day will still be counted as one day for the purpose of paying the allowance to the representative.

The allowance will be paid directly to representatives eligible for the allowance each time they attend a People's Council meeting or report to voters.

Those who are not People's Council representatives but are invited to attend People's Council meetings at various levels are not entitled to this allowance.

B. TRAVEL EXPENSES REGIME - METHOD OF PAYMENT

According to Clauses 2 and 3 of Decision No. 62-CP, People's Council representatives (whether salaried or not) at the district level and above, when attending their own level's People's Council meetings or lower-level meetings within the unit that elected them, or when reporting to voters, are entitled to travel expenses according to the current general regime applicable to state cadres, workers, and staff on official business trips.

Train and bus fares, and food allowances for People's Council representatives at the district level and above, will be covered by the same-level administrative committee. In necessary cases, the administrative committee may advance funds to the representatives and settle the accounts later.

Allowances and travel expenses for People's Council representatives at any level are budgeted and settled by the same-level administrative committee from the local budget.

This Circular takes effect from the date of issuance. Previous regulations contrary to this Circular are abolished.
