Guidelines for Implementing Uniforms for Economic Arbitrators

 Pursuant to Article 10 of the Economic Arbitration Ordinance adopted by the State Council on January 10, 1990;

Pursuant to Decree No. 436/HĐBT dated December 22, 1990 of the Council of Ministers regarding the organization and staffing of economic arbitration at various levels and the treatment of arbitrators;

The Joint Ministry of National Economic Arbitration and Finance hereby issues guidelines for implementing uniforms for economic arbitrators at all levels as follows:

I. OBJECTS, STANDARDS AND PERIOD OF USE FOR ARBITRATOR UNIFORMS.

1. Economic arbitrators at all levels shall be provided with uniforms for use when performing their duties.

2. Economic arbitrators at all levels shall be provided with uniforms according to the following standards and periods:

3. Specifications and colors of the uniforms shall be prescribed by the National Economic Arbitration.

4. Arbitrator uniforms shall not be lent to others, shall not be given as gifts, shall not be bought or exchanged, and must be used during duty performance if lost or damaged within the usage period without valid reasons, in which case compensation shall be required.

When an arbitrator is dismissed or transferred to another position, the managing authority shall be responsible for recovering the issued uniforms if they are still within the usage period.

5. The National Economic Arbitration, provincial and centrally-administered city economic arbitrations, district, county, city, and town economic arbitrations under provinces and centrally-administered cities shall tailor and purchase a certain number of uniforms including the five items mentioned above for secretaries to borrow when working alongside arbitrators during hearings, as follows:

a/ The National Economic Arbitration and provincial economic arbitrations each unit shall tailor and purchase three sets of uniforms for secretaries to borrow during hearings.

b/ District and county economic arbitrations and equivalent units shall tailor and purchase one set of uniforms for secretaries to borrow during hearings.

6. Economic arbitrations at all levels must maintain detailed records to strictly manage the borrowing of uniforms and the issuance of uniforms to arbitrators from the purchasing stage to the distribution stage, ensuring compliance with the prescribed standards and periods.

II. MANAGEMENT OF EXPENSES FOR PURCHASING UNIFORMS

1/ Expenses for purchasing uniforms for economic arbitrators at any level shall be covered by the budget of that level.

2/ Annually, economic arbitrations at all levels shall base the quantity and types of uniforms due for issuance on the number of arbitrators, prepare a budget estimate, and submit it to the financial authorities at the same level. Financial authorities at all levels shall be responsible for reviewing and approving the budget to ensure timely and adequate procurement and issuance of uniforms in accordance with the prescribed periods.

3. Economic arbitrations at all levels shall settle accounts for uniform procurement expenses quarterly and annually according to current financial management regulations. Expenses for purchasing uniforms for arbitrators shall be recorded separately (arbitrator uniforms) in item 75 of the state budget classification corresponding to chapters, types, sections, and categories.

III. IMPLEMENTATION PROVISIONS:

This Circular takes effect from the date of signature. Any difficulties encountered during implementation should be reported to the National Economic Arbitration and the Ministry of Finance for appropriate resolution./.
