DECREE OF THE GOVERNMENT

Von functions, tasks, authorities, and organizational structure of the Sports Committee

THE GOVERNMENT

Pursuant to the Government Organization Law dated September 30, 1992;

BASED ON THE GOVERNMENT DECREE NO. 15/CP DATED MARCH 2, 1993 ON THE TASKS, POWERS, AND RESPONSIBILITIES FOR STATE MANAGEMENT OF MINISTRIES AND GOVERNMENT AGENCIES EQUIVALENT TO MINISTRIES;

At the proposal of the Minister and Chairman of the Sports Committee and the Minister and Head of the Government Organizational Structure - Civil Service Department, 

DECREE:

Article 1. The Sports Committee is an agency at the level of a ministry responsible for state management of sports throughout the country and coordinates with relevant ministries, sectors, and organizations to fulfill tasks related to the development of sports.

Article 2. The Sports Committee performs the tasks, authorities, and responsibilities of a ministry or an agency at the level of a ministry as stipulated in Decree No. 15/CP dated March 2, 1993 of the Government, including the following specific tasks and authorities:

1. Drafting or participating in drafting legal normative documents on sports to submit to competent authorities for consideration and decision-making, and organizing the implementation of such documents;

2. Submitting to the Government strategies, plans, programs, and key projects for the development of the sports sector and organizing their implementation after approval by the Government. Directly organizing and directing national and international sports activities;

3. Cooperating with state agencies, mass organizations, and social organizations in developing mass sports movements, particularly among young people, improving sports achievements, training young sporting talents, high-performance teams, and national teams;

4. Issuing standards and deciding on the recognition of sports ranks for coaches, referees, and athletes;

5. Submitting to the Prime Minister for decision-making on the organization of the sports sector, conferring honors and awards on coaches, referees, and athletes with outstanding achievements;

6. Organizing the training and development of coaches, referees, and sports managers; directing the compilation of programs and plans and uniformly managing the content and programs of training and teaching in sports according to the regulations of the Ministry of Education and Training. Directly managing universities, colleges, and national sports training centers in accordance with government regulations;

7. Organizing and directing scientific research and the application of advanced science and technology to develop the sports sector; exploiting and developing traditional ethnic sports;

8. Submitting to the Government for signing, joining, and approving international agreements on sports; organizing and directing the implementation of international cooperation plans and international agreements on sports according to government regulations;

9. Inspecting and auditing ministries, sectors, local people's committees, organizations, and citizens, both domestic and foreign, operating within Vietnam regarding compliance with laws in the field of sports;

State management over certain social organizations in the field of sports that have national significance and operate nationwide, especially in the establishment, operation, and correct development of these organizations such as the Vietnam Olympic Committee, sports federations and associations, and sports associations by industry;

10. Managing the organization, staffing, assets, and budget of the Sports Committee according to current state regulations;

Article 3. The leadership of the Sports Committee consists of the Minister and Chairman, Deputy Chairmen, and part-time members;

The Minister and Chairman of the Sports Committee is responsible before the Government and the Prime Minister for all activities of the Sports Committee;

Deputy Chairmen are appointed by the Prime Minister and are responsible to the Minister and Chairman of the Sports Committee for the areas of work assigned by the Minister and Chairman;

Part-time members include a Deputy Minister of Education and Training, a Deputy Minister of National Defense, a Deputy Minister of Interior, and a Deputy Minister of Health, proposed by their respective ministries and appointed by the Prime Minister. These part-time members are tasked with attending important meetings of the Sports Committee, discussing and contributing opinions on major policies and work initiatives of the committee, and being responsible for directing their respective sectors to implement tasks in the field of sports as assigned;

The Minister and Chairman of the Sports Committee shall specify the division of tasks and working regulations for the leadership of the Sports Committee;

Article 4. Tasks of some ministries in relation to coordination with the Sports Committee:

1. The Ministry of Education and Training is responsible for directing and implementing physical education and development, enhancing sports achievements for students and college students, contributing to discovering and nurturing young sporting talents; jointly with the Sports Committee, directing the development of programs, contents, and plans for teaching at sports universities and colleges;

2. The Ministries of National Defense and Public Security:

Strengthening and promoting sports activities in training and physical fitness exercises in military and police forces to enhance effectiveness in work and contribute to fulfilling assigned tasks;

Building a team of athletes and enhancing sports achievements, gradually establishing high-performance sports teams in the military and public security forces;

3. The Ministry of Health:

Cooperating with the Sports Committee to organize medical-sports research, comprehensively and effectively combining medicine and sports, training medical-sports personnel, and organizing appropriate physical exercise forms suitable for health conditions at healthcare facilities and communities;

Article 5. The organizational structure of the Sports Committee includes:

A. OFFICES ASSISTING THE MINISTER AND CHAIRMAN OF THE SPORTS COMMITTEE IN PERFORMING STATE MANAGEMENT FUNCTIONS:

1. Mass Sports Department;

2. High-Performance Sports Department I;

3. High-Performance Sports Department II;

4. Planning and Finance Department;

5. Organization and Training Department;

6. International Relations Department;

7. Department of Legal Affairs;

9. Product Quality Management Bureau (with two subordinate branches: the Product Quality Management Branch located in Da Nang City, the Product Quality Management Branch located in Ho Chi Minh City; quality inspection units at international border gates as decided by the Minister of Science and Technology after obtaining permission from the Prime Minister).

9. Inspectorate;

B. SUBORDINATE ORGANIZATIONS UNDER THE SPORTS COMMITTEE INCLUDE:

1. University of Physical Education and Sports I;

2. University of Physical Education and Sports II;

3. College of Physical Education and Sports Da Nang;

4. National Sports Training Center I;

5. National Sports Training Center II;

6. National Sports Training Center III;

7. Institute of Physical Culture and Sports;

8. Ba Đình Sports Center;

9. Vietnam Sports Newspaper.

The Minister and Chairman of the Physical Culture and Sports Committee shall specify the functions, tasks, powers, and organizational structure of the aforementioned organizations.

C. STATE ENTERPRISES FOR PHYSICAL CULTURE AND SPORTS SHALL BE ORGANIZED AND OPERATED IN ACCORDANCE WITH THE GOVERNMENT'S REGULATIONS.

Article 6.Physical culture and sports organizational structure at the local level:

1. In provinces and centrally-administered cities meeting the conditions for establishing a Department of Physical Culture and Sports in accordance with the regulations of the inter-ministerial Physical Culture and Sports Committee and the Government's Organizational and Cadre Affairs Board, shall propose to the Prime Minister for consideration and decision on the establishment of a Department of Physical Culture and Sports.

2. Physical culture and sports organizations at the district, county, town, and provincial city levels shall be organized in accordance with the guidelines of the Government's Organizational and Cadre Affairs Board and the Physical Culture and Sports Committee.

Article 7. This Decree takes effect fifteen days from the date of signing the document. The Government Decree No. 11/CP dated November 28, 1992 regarding the functions, tasks, powers, and organizational structure of the General Department of Physical Culture and Sports is hereby repealed.

Article 8. The Minister and Chairman of the Physical Culture and Sports Committee, Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, and Chairmen of provincial and centrally-administered city People's Committees are responsible for implementing this Decree./.
