MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT - ORGANIZATION AND STAFF OF THE GOVERNMENT
GUIDELINES TO COMPLEMENT JOINT CIRCULAR NO. 07/LB-TT DATED APRIL 24, 1996 ON FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF PROVINCE DEPARTMENTS OF AGRICULTURE AND RURAL DEVELOPMENT AND DISTRICT AGRICULTURE AND RURAL DEVELOPMENT BOARDS

The Prime Minister issued Decision No. 1128/1997/QĐ-TTg dated December 25, 1997 to transfer the state management functions over salt production and business from the Ministry of Trade to the Ministry of Agriculture and Rural Development.
To implement the assigned tasks, the Ministry of Agriculture and Rural Development and the Government's Organization and Staff Department provide guidelines to complement the functions, tasks, powers, and organizational structure of Province Departments of Agriculture and Rural Development and District Agriculture and Rural Development Boards as follows:
I. FOR PROVINCE DEPARTMENTS OF AGRICULTURE AND RURAL DEVELOPMENT (FOR PROVINCES WITH SALT PRODUCTION AND BUSINESS):
1. Functions: In addition to the functions prescribed in Circular No. 07/LB-TT, the Department also assists the Provincial People's Committee in performing state management functions over salt production and business within the province; at the same time, it is subject to the direction and management of the Minister of Agriculture and Rural Development regarding professional matters related to salt production and business.
2. Regarding Tasks: In addition to the tasks prescribed in Joint Circular No. 07/LB-TT, the following additional tasks are now added:
2.1. Submit to the Provincial People's Committee for issuance within its authority legal normative documents to implement laws, ordinances, and other legal normative documents on salt production and business.
2.2. Submit to the Provincial People's Committee strategies, overall plans, long-term, medium-term, and annual plans on salt production and business within the province and organize guidance and direction for their implementation after approval.
2.3. Organize supervision and inspection of the implementation of policies on salt production and business.
2.4. (Task 2.6 in Joint Circular No. 07/LB-TT) Add: Organize guidance for salt promotion work.
2.5. (Task 2.9 in Joint Circular No. 07/LB-TT) Add: Perform state management functions over salt-producing and trading enterprises according to the Law on State-Owned Enterprises and the provincial people's committee’s regulations on delegation or authorization to the Department of Agriculture and Rural Development for management.
3. Regarding the organization of salt industry state management at the Department:
Depending on local circumstances, the Director of the Department of Agriculture and Rural Development may assign additional salt production and business management tasks to one of the Departments' offices.
II. DISTRICT AGRICULTURE AND RURAL DEVELOPMENT BOARDS (FOR LOCALITIES WITH SALT PRODUCTION AND BUSINESS):
1. Functions: In addition to the functions prescribed in Joint Circular No. 07/LB-TT, the District Agriculture and Rural Development Board assists the District People's Committee in performing state management functions over salt production and business within the district.
2. Tasks: In addition to the tasks prescribed in Joint Circular No. 07/LB-TT, the following additional tasks are now added:
2.1. Implement legal normative documents on state management by the State, province, and district people's committees regarding salt production and business within the district.
2.2. Develop plans and organize guidance and direction for their implementation regarding salt production and business after approval by the competent authority.
2.3. (Task 2.4 in Joint Circular No. 07/LB-TT): Coordinate with agricultural and forestry extension stations to organize guidance for salt promotion work.
III. COMMUNE LEVEL (FOR COMMUNES WITH SALT PRODUCTION AND BUSINESS):
AT One member of the Commune People's Committee shall perform the tasks prescribed in Joint Circular No. 07/LB-TT, and the following additional tasks are added:
- Monitor salt production and business plans;
- Coordinate with the Agricultural Extension Station to implement salt promotion;
- Compile and report on the situation of salt production and business.
For localities where state management functions over salt production and business have been assigned to other Departments or Boards, the Head of the Provincial Organization and Administration Department shall coordinate with the Director of the Department of Agriculture and Rural Development to submit to the Chairman of the Provincial People's Committee for transfer to the Department of Agriculture and Rural Development and the District Agriculture and Rural Development Board to assume.
During the implementation of this supplementary circular, if there are any issues encountered, localities shall promptly report to the Ministry of Agriculture and Rural Development and the Government's Organization and Staff Department for resolution.
This circular takes effect fifteen days from the date of signature. Any previous regulations and guidelines that conflict with this circular are hereby abolished.
