CIRCULAR
Guidelines for Implementing the Prime Minister's Decision
No. 254/1998/QĐ-TTg dated December 30, 1998 on the management of import and export of goods in 1999.
Based on the provisions of the Prime Minister's Decision No. 254/1998/QĐ-TTg dated December 30, 1998 on the management of import and export of goods in 1999;
After reaching consensus with the Ministry of Planning and Investment and relevant ministries;
The Ministry of Commerce hereby provides guidelines for implementing Decision No. 254/1998/QĐ-TTg of the Prime Minister as follows:
I. LIST OF GOODS FOR EXPORT AND IMPORT
List of goods prohibited from export and import (Annex 1)
List of goods for export and import under permits issued by the Ministry of Commerce (Annex 2).
II. MANAGEMENT OF EXPORT AND IMPORT OF GOODS
The management of export and import of goods in 1999 shall be carried out in accordance with Decision No. 254/1998/QĐ-TTg dated December 30, 1998 of the Prime Minister, and the Ministry of Commerce provides additional specific guidance as follows:
1. Export of rice:
The export of rice shall be implemented in accordance with Decision No. 250/1998/QĐ-TTg dated December 24, 1998 of the Prime Minister and Circular No. 22/1998/TT-BTM dated December 30, 1998 of the Ministry of Commerce on the management of rice exports and fertilizer imports in 1999.
2. Textile and garment products exported to markets with quota regulations in 1999 shall be implemented in accordance with Document No. 1126/CP-KTTH dated September 21, 1998 of the Government and Joint Circular No. 20/1998/TTLT/BTM-BKHĐT-BCN dated October 12, 1998 of the Ministry of Commerce, the Ministry of Planning and Investment, and the Ministry of Industry.
3. Export of rubber:
After reaching consensus with the Ministry of Agriculture and Rural Development and Vietnam Rubber Corporation, the Ministry of Commerce will issue guidelines for implementation. In the meantime, current regulations shall apply.
4. Import of fertilizers: shall be implemented in accordance with Decision No. 250/1998/QĐ-TTg of the Prime Minister dated December 24, 1998 and Circular No. 22/1998/TT-BTM dated December 30, 1998 of the Ministry of Commerce.
5. Import of parts for production and assembly of two-wheeled motorized vehicles (IKD):
Domestic enterprises investing in the production and assembly of two-wheeled motorized vehicles (IKD) are allowed to import parts (IKD) according to their production capacity as stipulated in Circular No. 04/1998/TT-BTM dated March 12, 1998 of the Ministry of Commerce.
6. Goods imported under specialized management:
Pending approval by the Government of the list of goods for export and import under specialized management in 1999, the export and import of such goods shall temporarily continue as in 1998.
7. Import of steel billets:: Enterprises with steel rolling facilities confirmed by the Ministry of Industry to meet production conditions and ensure product quality are permitted to import steel billets or entrust the importation of steel billets according to production needs.
8. Import of alcohol:
The import of alcohol shall be conducted through several key enterprises approved by the Ministry of Commerce in 1998 as stipulated in Circular No. 06/1998/TT-BTM dated March 26, 1998.
9. Export and import of barter goods:
The Ministry of Commerce, after reaching consensus with the Ministry of Planning and Investment, the State Bank, and the General Customs Department, will promulgate a regulation encouraging enterprises to export domestically produced goods mainly from domestic raw materials through barter contracts, including certain conditional imported goods.
10. For goods for which the State guarantees foreign currency balance for import demand such as: fuel oil, fertilizers, iron and steel can only be re-exported when foreign countries guarantee payment in freely convertible foreign currency and obtain approval from the Ministry of Commerce. Domestic-produced fertilizers and iron and steel can be exported based on demand.
11. For goods imported under the list of goods specified in Annex 2 If these goods were not subject to temporary suspension of import or required import licenses from the Ministry of Commerce in 1998, enterprises that signed import contracts before January 15, 1999 may complete import procedures at customs according to current regulations but must arrive at Vietnamese ports no later than March 31, 1999.
12In addition to the provisions of the Prime Minister's Decision No. 254/1998/QĐ-TTg dated December 30, 1998 and the specific guidelines provided in this Circular, the export and import of goods shall be carried out based on demand and the regulations of 1998.
III. IMPLEMENTATION PROVISIONS.
The export and import of goods by enterprises with foreign investment capital shall be implemented according to separate guidelines.
The Ministry of Commerce requests all ministries, agencies equivalent to ministries, government agencies, People's Committees of provinces and centrally-administered cities, and central bodies of social organizations to inform enterprises under their jurisdiction about the contents of this Circular and implement it, while reporting any issues arising during implementation to the Ministry of Commerce for timely adjustment.
This Circular takes effect 15 days after its date of issuance until March 31, 2000./.

PROHIBITED EXPORT AND IMPORT GOODS

I. PROHIBITED EXPORT GOODS:
1. Weapons, ammunition, explosives, military technical equipment;
2. Antiques;
3. Various types of narcotics;
4. Toxic chemicals;
5.Roundwood, sawn timber, peeled wood from natural forests in Vietnam; firewood, charcoal from wood or firewood; semi-finished products made from natural forest wood in Vietnam as specified in Decision No. 65/1998/QĐ-TTg dated March 24, 1998 of the Prime Minister.
6.Wild animals and rare natural flora and fauna.
II. PROHIBITED IMPORT GOODS:
1.Armaments, ammunition, explosives (except industrial explosives regulated separately by the Prime Minister), technical equipment for military purposes.
2.Drugs;
3.Poisonous chemicals;
4.Obscene and subversive cultural products;
5.All types of artillery (except signal artillery for maritime safety and other needs regulated separately by the Prime Minister). Children's toys that have a negative impact on moral education, public order, and social security.
6.Cigarettes (except personal luggage within specified quantities).
7.Used consumer goods (except movable property including goods serving the needs of individuals belonging to diplomatic missions of foreign countries, international organizations, and personal luggage within the prescribed quantity).
8.Cars with left-hand drive (including dismantled form and those converted to left-hand drive before importation into Vietnam).
Special self-propelled equipment with left-hand drive operating in narrow areas such as cranes, trench diggers, garbage trucks, street sweepers, road surface construction vehicles, airport passenger buses, warehouse and port cargo lifters... are permitted to import and shall be handled by the Minister of Commerce upon request.
9. Used spare parts for automobiles, two-wheeled and three-wheeled motorcycles with engines, including used chassis with automobile engines attached.
10.Amphibole asbestos-containing materials.
11.Used internal combustion engines with power less than 30 horsepower.
