JOINT CIRCULAR

 

 Guidelines for implementing adjustments to the levels of

monthly allowances and subsidies for revolutionary activists,

families of martyrs, war invalids, disease invalids, and those who have contributedto the revolution,

having contributed to the revolutionary cause.

Pursuant to Point 4, Article 1 and Clause b, Point 2, Article 2 of Decree No.175/1999/NĐ-CP dated December 15, 1999 of the Government;

After obtaining approval from the Prime Minister and reaching consensus with theCentral Organization Committee, the Civil Service Bureau of the Government; theMinistry of Labor, War Invalids and Social Affairs, and the Ministry of Finance shallcoordinate to guide the adjustment of monthly allowances and subsidies forrevolutionary activists, families of martyrs, war invalids, disease invalids, andthose who have contributed to the revolution as follows:

I/ AMOUNT OF MONTHLY ALLOWANCES AND SUBSIDIES TO BE IMPLEMENTED FROMJANUARY 1, 2000:

1/. Revolutionary activists before 1945:

a/Allowance amount: 135,000 VND/month

b/Main dependents of revolutionary activists before 1945 who have passed away:

Basic pension allowance amount: 90,000 VND/person/month

Caretaking pension allowance amount: 290,000 VND/person/month

2/. Revolutionary activists before the August Revolution in 1945: "Basic pension allowance level: 90,000 VND/person/month":

Monthly subsidy amount: 60,000 VND/month

3/. Dependents of martyrs:

Basic pension allowance amount: 90,000 VND/person/month

Caretaking pension allowance amount: 290,000 VND/person/month

4/. Mothers of Vietnam Heroic Martyrs, Heroes of the Armed Forces, and LaborHeroes:

a/Mothers of Vietnam Heroic Martyrs:

Allowance amount: 350,000 VND/month.

Caretaking allowance amount for single mothers without support: 400,000 VND/month.

b/Heroes of the Armed Forces and Labor Heroes:

Allowance amount: 80,000 VND/month.

5/. War invalids:

a/War invalids and those receiving policies equivalent to war invalids:

The monthly allowance amount is calculated as: 3,588 VND x % Disability Rate (annexedappendix).

b/War invalids category B (confirmed before December 31, 1993, now referred to as militarypersonnel injured in work-related accidents):

Disability rate from 21% to 30%: Allowance amount = 62,000 VND/month.

Disability rate from 31% to 40%: Allowance amount = 77,000 VND/month.

Disability rate from 41% to 50%: Allowance amount = 108,000 VND/month.

Disability rate from 51% to 60%: Allowance amount = 123,000 VND/month.

Disability rate from 61% to 70%: Allowance amount = 169,000 VND/month.

Disability rate from 71% to 80%: Allowance amount = 200,000 VND/month.

Disability rate from 81% to 90%: Allowance amount = 246,000 VND/month.

Disability rate from 91% to 100%: Allowance amount = 277,000 VND/month.

c/Caretakers of war invalids category A, category B, and those receiving policiesequivalent to war invalids with disability rates of 81% or higher currently beingtreated at home:

Allowance amount for caretakers of war invalids with disability rates of 81% orhigher: 132,000 VND/month.

Allowance amount for caretakers of war invalids with disability rates of 81% orhigher with particularly severe injuries: 165,000 VND/month.

d/Main dependents of war invalids and those receiving policies equivalent to warinvalids with disability rates of 61% or higher who have passed away:

Basic pension allowance amount: 72,000 VND/person/month.

Caretaking pension allowance amount: 126,000 VND/person/month.

6/. Disease invalids:

a/Monthly allowance amount for disease invalids:

Disability rate from 61% to 70%: Allowance amount = 180,000 VND/month.

Disability rate from 71% to 80%: Allowance amount = 207,000 VND/month.

Disability rate from 81% to 90%: Allowance amount = 249,000 VND/month.

Disability rate from 91% to 100%: Allowance amount = 277,000 VND/month.

b/Disease invalids category 3 (confirmed before December 31, 1994, now referred tomilitary personnel suffering from occupational diseases):

Disability rate from 41% to 50%: Allowance amount = 97,000 VND/month.

Disability rate from 51% to 60%: Allowance amount = 110,000 VND/month.

c/Caretakers of disease invalids with disability rates of 81% or higher currentlybeing treated at home:

Allowance amount for caretakers of disease invalids with disability rates of 81%or higher: 132,000 VND/month.

Allowance amount for caretakers of disease invalids with disability rates of 81%or higher with particularly severe illnesses: 165,000 VND/month.

d/Main dependents of disease invalids with disability rates of 61% or higher whopassed away:

Basic pension allowance amount: 72,000 VND/person/month.

Caretaking pension allowance amount: 126,000 VND/person/month.

7/. Those who have contributed to the revolution:

a/Those who have contributed to the revolution before the August Revolution in1945:

Basic allowance amount: 90,000 VND/month.

Caretaking allowance amount: 290,000 VND/month.

b/Those who have contributed to the revolution during the resistance war:

Basic allowance amount: 65,000 VND/month.

Caretaking allowance amount: 200,000 VND/month.

All allowances and subsidies not specified in this Circular remain unchanged atthe levels of December 1999.

II/. FUNERAL ALLOWANCE:

For those confirmed as martyrs; war invalids and disease invalids with disabilityrates of 61% or higher; Mothers of Vietnam Heroic Martyrs; main dependents ofmartyrs and those who have contributed to the revolution who receive takingcare allowances and pass away, the person responsible for burial will be providedwith funeral expenses (funeral fees) at the same level as civil servants and stateemployees who pass away (amount from January 1, 2000 is 1,440,000 VND).

III/. REGIONAL SUBSIDY (IF APPLICABLE):

Calculated according to the general regulations of the State on the current minimumwage (minimum wage implemented from January 1, 2000 is 180,000 VND/month).

IV/. PROCEDURE FOR DOCUMENTATION AND ADJUSTMENT:

1/.The Department of Labor, War Invalids and Social Affairs (Department ofOrganizational Labor and Social Affairs) at the district level shall prepare twocopies of the list according to Model No. 01, send one copy to the ProvincialDepartment of Labor, War Invalids and Social Affairs, and retain one copy.

2/.The Provincial Department of Labor, War Invalids and Social Affairs shall compilea summary of eligible recipients for adjustment of allowances and subsidiesaccording to Model No. 02 (three copies), submit it to the Provincial People'sCommittee for decision, then send two copies to the Ministry of Labor, WarInvalids and Social Affairs (Veterans and Martyrs and Those Who Have Contributedto the Revolution Bureau), and retain one copy at the provincial department.

3/.The Ministry of Labor, War Invalids and Social Affairs shall compile a summary ofeligible recipients for adjustment of allowances and subsidies, prepare a budgetfor additional allowances and subsidies, and send it to the Ministry of Finance.

4/.The Ministry of Finance shall allocate funds based on the budget prepared by theMinistry of Labor, War Invalids and Social Affairs for additional allowances andsubsidies for eligible recipients according to the regulations.

5/.After receiving the notification of funds, the Director of the ProvincialDepartment of Labor, War Invalids and Social Affairs shall report to theProvincial People's Committee to adjust allowances and subsidies according to theapproved list.

V/. ORGANIZATION AND IMPLEMENTATION:

1/.The Provincial Department of Labor, War Invalids and Social Affairs shall be responsible for reviewing and approving recipients of allowances and subsidiesaccording to this Circular.

2/.In the short term, to ensure that eligible recipients can receive adjustedallowances and subsidies as soon as possible starting from January 2000, theMinistry of Finance will temporarily allocate additional allowances and subsidiesfor January 2000 and the first quarter of 2000 for localities to implement. From thesecond quarter of 2000 onwards, the Ministry of Finance will allocate additionalallowances and subsidies for localities after receiving the approved lists from theprovinces.

3/. The Department of Labor, Invalids and Social Affairs; the Department of Finance and Prices; the Provincial Treasury have the responsibility to coordinate, guide, and organize the implementation of the contents prescribed in this Circular.

4/. The Ministry of National Defense and the Ministry of Public Security, after reaching an agreement with the Ministry of Labor, Invalids and Social Affairs and the Ministry of Finance, shall provide guidance for implementation concerning armed forces under their management.

5/. This Circular takes effect from January 1, 2000.

In the course of implementation, if there are any difficulties, they shall be reported to the Joint Ministries for resolution./.
