THE MINISTER OF CULTURE AND INFORMATION
Pursuant to Article 34 of the Constitution of the Socialist Republic of Vietnam.
Pursuant to Article 69 of the Land Law adopted by the National Assembly of the Socialist Republic of Vietnam, Session IX on July 14, 1993, and promulgated by the State Council on July 24, 1993, concerning the regime for managing and using land for relics.
Pursuant to Ordinance No. 14/LCT-HĐNN on the Protection and Utilization of Historical and Cultural Relics and Scenic Beauty Spots promulgated by the State Council of the Socialist Republic of Vietnam on April 4, 1984.
Pursuant to Decree No. 81/CP dated November 8, 1993 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture and Information.
Upon examination of the relic dossier and the proposal submitted by the Chairman of the People's Committees of the provinces of Nghe An, Ha Tinh, Quang Binh, Quang Tri, Thua Thien Hue, Binh Phuoc, Quang Nam, Gia Lai, Dak Lak, and Kon Tum.
Considering the proposal of Mr. Director of the Relic Preservation Museum Department.
DECISION:
Article 1. Now recognizes: The historical Ho Chi Minh Trail relic sites in the provinces of Nghe An, Ha Tinh, Quang Binh, Quang Tri, Thua Thien Hue, Binh Phuoc, Quang Nam, Gia Lai, Kon Tum, and Dak Lak (including the listed locations).
Article 2. Strictly prohibit all construction and exploitation activities within the delineated areas of the relic. In exceptional cases where land use is required at historical and cultural relics and scenic beauty spots, permission from the Minister of Culture and Information must be obtained.
Article 3. People's Committees at all levels shall implement state management over historical and cultural relics and scenic beauty spots in accordance with the law.
Article 4. This Decision replaces Decisions No. 236/QĐ dated December 12, 1986; No. 451/VH-QĐ dated April 21, 1989; No. 1568/VH-QĐ dated April 21, 1989; and No. 886/QĐ dated May 20, 1991 of the Ministry of Culture and Information recognizing the locations of historical Trail Mountain relic sites.
Article 5. The Heads of the Ministry’s Office, the Director of the Heritage Museum Management Department, the Chairmen of the People's Committees, and the Directors of the Departments of Culture and Information of the provinces of Nghe An, Ha Tinh, Quang Binh, Quang Tri, Thua Thien Hue, Binh Phuoc, Quang Nam, Gia Lai, Dak Lak, and Kon Tum are responsible for implementing this Decision.
