JOINT CIRCULAR

GUIDELINES FOR THE USE OF FUEL GAUGES IN HANDLING AND SALES OF FUELS FOR WATERBORNE VEHICLES
purchase and sale of fuel supplied to watercraft

Pursuant to the Law on Measurement No. 16/1999/PL-UBTVQH10 dated October 6, 1999;

Pursuant to Decision No. 2537/1998/QĐ-BKHCNMT dated December 31, 1998 of the Minister of Science, Technology and Environment on the issuance of the List of Measuring Instruments Subject to State Inspection;

Considering the current status of fuel gauges equipped by enterprises engaged in fuel trade;

The Ministry of Trade and the Ministry of Science, Technology and Environment hereby issue guidelines for the uniform use of fuel gauges in handling and sales of fuels for waterborne vehicles as follows:

1. General Provisions

1.1. Handling and sales of fuels for waterborne vehicles shall uniformly use fuel gauges (hereinafter referred to as measuring instruments).

Fuels referred to in this Circular include: automotive gasoline of all types, domestic kerosene (KO), diesel fuel (DO), jet fuel (JET A1, TC1), and bunker fuel (FO).

1.2. In handling and sales of fuels for waterborne vehicles, measuring instruments shall be uniformly used as measuring devices when selling. The measurement values obtained from the measuring instruments shall be used for settlement upon handling and sales.

1.3. Buyers and owners of transport vessels have the right to use the vessel's capacity table for verification. If there is a significant discrepancy between the measuring instrument reading and the capacity table that cannot be resolved by the parties involved, disputes shall be resolved according to the provisions of the law.

1.4. The technology system using measuring instruments (hereinafter referred to as the technology system) for handling and sales of fuels must meet the technical and measurement requirements set forth in Section 2 of this Circular.

1.5. The General Department of Standardization, Metrology and Quality Control shall be responsible for organizing the inspection of measuring instruments and confirming the technology system compatible with inspected measuring instruments to ensure the accuracy of measurements at fuel handling and sales points for waterborne vehicles.

2. Technical and Measurement Requirements for the Technology System

The technology system using measuring instruments for handling and sales of fuels includes main components such as measuring instruments and display mechanisms, pumps, storage tanks, and technological pipelines. These devices must meet the following requirements:

a) Measuring instruments must have an accuracy of ± 0.5% and be suitable for each type of fuel, ensuring fire prevention and explosion protection.

b) Display mechanisms must operate reliably and be positioned conveniently for monitoring and checking measurement results.

c) Pumps must have appropriate power and flow rate matching the measuring instrument's flow range.

d) One or more air separators must be installed on the technological pipeline system. These air separators must effectively separate air and have a structure compatible with the technology system.

3. Requirements for Operation and Inspection of the Technology System

3.1. Enterprises handling and selling fuels using measuring instruments must have operational procedures and inspection processes for the technology system. These procedures must be publicly displayed for easy monitoring and inspection.

3.2. The operational procedures and inspection processes of enterprises must cover the following contents:

a) Clearly stipulate the sequence, content of steps, operations, and establishment of technological parameters consistent with the technology system's technical requirements;

b) Specify the minimum fuel level in the source tank to prevent air entry during fuel pumping;

c) Provide regulations for regular inspections of the entire system and the accuracy of measuring instrument displays;

d) Provide regulations for continuous inspections during fuel handling and sales;

3.3. Operators and technicians handling and operating the technology system must be trained thoroughly in the procedures and fully understand their functions and responsibilities.

3.4. Maintain the continuous operation of the technology system, promptly identify and repair malfunctions and discrepancies. In necessary cases, re-inspection of measuring instruments before the prescribed time may be conducted.

4. Implementation Clause

4.1. This Circular takes effect from July 1, 2001. Enterprises already meeting the requirements of this Circular are encouraged to implement it immediately after its issuance.

4.2. During implementation, if difficulties or issues arise, they should be reported to the Ministry of Trade and the Ministry of Science, Technology and Environment for guidance and resolution.
