Guidelines for marking the number of traffic law violations on driver's licenseson driver's licenses

Implementing Resolution No. 13/2002/NQ-CP dated November 19, 2002 of the Government on measures to curb the increase and gradually reduce traffic accidents and traffic congestion, the Ministry of Public Security and the Ministry of Transport provide guidelines for marking the number of traffic law violations on driver's licenses, as follows:

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

1. Scope and subjects of application:

A person operating a motor vehicle on the territory of Vietnam who commits a violation of road traffic laws that, according to the law, has the highest fine amount from 200,000 VND (two hundred thousand dong) or more shall, in addition to administrative penalties, be marked with a violation on their driver's license.

In cases where international treaties to which the Socialist Republic of Vietnam is a party have different provisions, such provisions shall be implemented.

2. Marking violations on driver's licenses:

Marking violations on driver's licenses is carried out by punching holes (circular, diameter 4.5 mm) at the designated location on the driver's license.

3. Principles for marking violations on driver's licenses:

a) Each violation of road traffic laws as specified in point 1 above will result in one hole being punched on the driver's license; if multiple violations occur simultaneously and according to the law, all such violations require a hole to be punched, only one hole will be punched on the driver's license;

b) When a driver's license reaches its third hole, it loses its validity and will be revoked;

c) For violations of road traffic laws subject to the supplementary penalty of revoking the driver's license indefinitely, there is no need to punch a hole.

II. SPECIFIC PROVISIONS

1. Position for punching holes on driver's licenses:

a) The position for punching holes on the driver's license is located on the outer edge line on the back side, to the right, and punched in sequence from top to bottom as follows:

The first hole at the intersection of the outer edge line and the line dividing category A₂ and A₃;

The second hole at the intersection of the outer edge line and the line dividing category B₁ b) The Law Amending and Supplementing Certain Provisions of Laws on Taxation to be examined and adopted at the 10th Session according to the procedure at one session;₂;

The third hole at the intersection of the outer edge line and the line dividing categories D and E;

b) If the driver's license specifies the marking position, the hole should be punched at that exact position.

2. Authority to mark violations on driver's licenses:

The authority to impose penalties for violations of road traffic laws as specified in point 1 of Part I of this Circular belongs to traffic police forces, which decide on marking violations on driver's licenses.

3. Handling driver's licenses marked with violations:

a) After the violator has fully executed the penalty decision, the hole is punched and the date of punching is clearly recorded on the penalty decision. If the driver's license is punched for the third time, the traffic police agency (where the third hole was punched) temporarily retains the driver's license and notifies in writing the Vietnam Highway Administration or the Department of Transportation (transportation public works) responsible for management to coordinate and report to the Traffic Police Corps of Vietnam.

b) After twelve months from the date of the third punch, the violator may take an examination to obtain a new driver's license according to regulations.

III. IMPLEMENTATION

1. The Traffic Police Corps of Vietnam, under the Ministry of Public Security, guides and directs traffic police forces to implement the marking of violations of road traffic laws as stipulated in this Joint Circular; monthly reporting cases of the third punch to the competent agencies of the transportation sector for coordination.

2. The Vietnam Highway Administration, under the Ministry of Transport, guides and directs relevant units to strictly follow the provisions of this Joint Circular; receives and monitors cases of the third punch reported by traffic police for management. At the same time, monthly reports are made to the Traffic Police Corps of Vietnam about cases of the third punch that have been resolved through re-examination and issuance of a new driver's license.

3. The Traffic Police Corps of Vietnam, in collaboration with the Vietnam Highway Administration, leads the development of a uniform notification form for application in the cases specified in points 2 and 3 above.
