DIRECTIVE OF THE MINISTER OF FINANCE
On strengthening the work of
disseminating and educating financial laws
----------------
The work of disseminating and educating laws in general and financial laws in particular holds a very important position and role in enhancing the effectiveness of state management activities, especially in the current renewal process of the country. In recent years, the work of disseminating and educating financial laws within the Finance sector has been recognized, cared for, directed, and timely and regularly implemented by units. The information needs about financial laws of financial managers, organizations, individuals operating in the financial field, and the people have gradually been adequately met.
However, given the situation where new and numerous mechanisms, policies, and financial laws are issued, the dissemination and education of financial laws throughout the Finance sector need to be carried out more frequently, continuously, comprehensively, widely, with focus and priority; there must be mechanisms and plans for close coordination among units under the Ministry; between the Ministry and provincial Departments of Finance, Tax Revenue Bureaus, State Treasury Provincial Departments, National Reserves Regional Departments, and Local Customs Departments and mass media agencies to leverage the combined strength of the entire sector and society towards the goal of enhancing the dissemination and education of financial laws.
To promote the work of disseminating and educating financial laws, thereby increasing understanding and respect for financial laws, ensuring the effectiveness of financial law enforcement; implementing Directive No. 32 CT/TW dated December 9, 2003 of the Politburo on strengthening Party leadership in the work of disseminating and educating laws, raising awareness of law compliance among cadres and the people; concretizing the program of disseminating and educating laws from 2003 to 2007 approved by the Prime Minister at Decision No. 13/2003/QD-TTg dated January 17, 2003, the Minister of Finance issues the following directive:
1- Each cadre and civil servant belonging to the central and local finance sectors as well as organizations and individuals operating in the financial field must clearly recognize that studying and researching to understand financial laws and strictly enforcing financial laws is their responsibility; they must set an example in implementing and complying with laws and have the responsibility to disseminate and educate financial laws to the people.
2- Heads of units under the Ministry, Directors of provincial Departments of Finance have the responsibility to direct and regularly inspect the implementation of the work of disseminating and educating financial laws within the scope of their unit's operations:
a- Appointing a unit leader to oversee and organize the implementation of the work of disseminating and educating financial laws.
b- Bringing the work of disseminating and educating financial laws to each type of target group; the dissemination and implementation of newly issued legal documents is considered part of the annual work program and plan of the unit.
c- Based on the action program to promote the dissemination and education of laws by the Prime Minister from 2003 to 2007 and the Ministry of Finance to develop an annual plan for disseminating and educating laws, clearly defining appropriate and proactive content, forms, and methods to enhance the dissemination and education of financial laws for cadres and civil servants within the unit's management scope and other related targets.
For units organized vertically (Tax General Department, State Treasury, Customs General Department, National Reserve General Department), unit heads have the responsibility to direct and regularly inspect the implementation of the work of disseminating and educating laws for cadres and civil servants throughout the system.
d- Allocating reasonable budget funds in the annual state budget approved by the competent authority to implement activities of promoting, disseminating, and educating financial laws.
e- Regularly reporting the results of the work of disseminating and educating laws annually and the plan for the next year to the Ministry of Finance (Legal Affairs Department) before November 30 each year for consolidation into a unified plan for the entire sector.
3- Financial press agencies, including online newspapers, allocate appropriate time for information dissemination and education through dedicated pages and columns on laws with suitable forms. Strengthening the team of reporters, editors, and contributors writing about laws to provide for central and local newspapers and radio stations to meet the timely and comprehensive needs of the people to understand financial laws.
4- The Ministry Office takes the lead in coordinating with the Legal Affairs Department to build plans and measures to promote the dissemination of financial laws annually through mass media outside the Ministry with suitable forms.
5- The Cadre and Civil Servant Organization Department coordinates with training institutions under the finance sector and related units to build and submit to the Ministry Leadership for approval a plan for training and developing cadres and civil servants managing state affairs on financial laws; take the lead in exchanging with relevant ministries and sectors to include financial law content in recruitment exams and grade transfer exams for finance cadres and civil servants suitable for different types of targets.
6- Directors of enterprises under the Ministry base this Directive's content to build a plan for disseminating and educating laws in their units suitable for production and business requirements.
7- The Legal Affairs Department is responsible for:
a- Serving as the focal point to coordinate with units under the Ministry to guide provincial Departments of Finance, Tax Revenue Bureaus, State Treasury Provincial Departments, Local Customs Departments, National Reserves Regional Departments, and other organizations at all levels in the finance sector to build annual plans for the work of disseminating and educating financial laws for each target group and incorporate this work into routine practices.
b- Building the annual and long-term activity programs for disseminating and educating financial laws of the Ministry and submitting them to the Minister of Finance for approval.
c- Guiding, monitoring, and inspecting the implementation of this Directive and regularly reporting results to the Minister.
8. The awarding of commendations to collectives and individuals with outstanding achievements in the work of disseminating, popularizing, and educating about financial laws shall be carried out annually in accordance with the current regulations of the State.
Heads of units under the Ministry, heads of local financial agencies have the responsibility to organize and implement the tasks mentioned above and coordinate with relevant agencies to strictly implement this Directive.
