Regarding the issuance of the Working Regulations of the Ministry of Fisheries

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 43/2003/ND-CP dated May 2, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Fisheries;

Pursuant to Decree No. 23/2003/NĐ-CP dated March 12, 2003 of the Government on the Working Regulations of the Government;

At the proposal of the Director of the Ministry of Fisheries Office,

 

DECISION:

Article 1. The Working Regulations of the Ministry of Fisheries are hereby promulgated along with this Decision.

Article 2. Heads of Departments, Bureaus, Inspectors General of the Ministry, and the Ministry Office shall issue specific working regulations for their units in accordance with these regulations.

Article 3. This Decision takes effect fifteen days from the date of publication in the Official Gazette and replaces Decision No. 839/2001/QĐ-BTS dated October 10, 2001 of the Minister of Fisheries on the issuance of the Working Regulations of the Ministry of Fisheries. Leaders of the Ministry, the Director of the Ministry Office, and Heads of Departments, Bureaus, and Inspectors General of the Ministry are responsible for implementing this Decision.

WORKING REGULATIONS OF THE MINISTRY OF FISHERIES

(Issued together with Decision No. 03/2005/QĐ-BTS dated January 31, 2005

of the Minister of Fisheries on the issuance of the Working Regulations of the Ministry of Fisheries)

PART I

GENERAL PROVISIONS

Article 1. Scope of application

These regulations stipulate the scope of responsibility and work procedures of the Ministry of Fisheries (hereinafter referred to as the Ministry); the working relationship between the Minister and Deputy Ministers (hereinafter referred to as the Ministry Leaders), between the Ministry Leaders and Heads of units assisting the Minister in performing state management functions (hereinafter referred to as units under the Ministry), between Heads of units under the Ministry, between the Minister and the Party Cadre Committee, Party Committee of the Ministry, and between the Ministry and political-social organizations, social-professional organizations; the system for developing programs, plans, information, reports, meetings, travel regulations, and reception procedures of the Ministry of Fisheries.

Article 2. Principles of operation

The Ministry of Fisheries operates according to the following principles:

1. Ensuring the leadership of the Party, complying with laws, and implementing the head system.

2. Resolving matters within the assigned authority and scope of responsibility; superiors do not perform tasks that should be handled by subordinates, and subordinates must obey superiors.

3. In the Ministry Leadership, each matter is assigned to one person who is responsible or primarily responsible when multiple people are involved. Deputy Ministers assigned tasks are responsible for those tasks. Heads of units are accountable to the Minister for their work in accordance with their assigned functions and responsibilities.

4. Adhering to procedures, formalities, and deadlines for resolving matters as set forth in the government's and the Ministry's work programs; implementing administrative reform to ensure transparency, timeliness, effectiveness, and compliance with legal provisions.

5. Ensuring cooperation and information exchange in the resolution of matters.

Chapter II

SCOPE AND AUTHORITY TO RESOLVE MATTERS

Article 3. Scope of Matters Resolved by Ministry Leaders

1. The Minister and Deputy Ministers resolve regular matters based on advice, reports, and information provided by Heads of units.

The Minister and Deputy Ministers directly direct and manage matters within their assigned areas of responsibility.

Deputy Ministers report weekly to the Minister and provide information to other Deputy Ministers regarding the resolution of assigned matters.

2. The Ministry Leadership discusses collectively the following matters:

a) Strategies, planning, and development plans for the industry: annual, five-year, and long-term; allocation and adjustment of annual state budget funds; industry development programs, projects, and key construction works;

b) Annual work program of the Ministry;

c) Annual and six-month reports on the summary and review of the implementation of national plans and the assessment of the leadership and management of the Ministry Leadership;

d) Plans and action programs of the industry to implement important policies of the Party and State; economic development related to national defense and foreign affairs;

đ) Legislation plan for the entire term and annually;

e) Cadre and civil servant planning within the Ministry and industry according to authority; issues related to organizational structure and personnel management of the Ministry as prescribed by law;

g) Proposals submitted to the Government regarding the organizational structure of the Ministry; establishment, merger, division, dissolution of units under the Ministry; reform and restructuring of state-owned enterprises under the Ministry;

h) Other matters deemed necessary by the Minister to be discussed collectively by the Ministry Leadership.

3. For matters specified in Clause 2 of this Article, in urgent cases where there is insufficient time or conditions for collective discussion, upon the Minister's directive, the Ministry Office will coordinate with the assigned unit to seek opinions from Deputy Ministers in writing, compile them, and submit to the Minister for decision.

Article 4. Scope of Matters Resolved by the Minister

1. The Minister fulfills the duties of a member of the Government as prescribed in the Working Regulations of the Government. The Minister leads and directs the overall work of the Ministry, directly oversees certain matters and fields, and assigns various matters and fields to each Deputy Minister. The Minister will adjust assignments as necessary to suit the situation.

2. In addition to general oversight, the Minister directly directs and resolves the following matters:

a) Matters within the Minister's authority as stipulated in the Constitution, Law on the Organization of the Government, Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government, and other relevant legal documents.

b) Determining policies and strategies for industry development;

c) Determining measures and organizing the implementation and management of key tasks of the Ministry and industry during each period;

d) Matters arising beyond the authority of Deputy Ministers responsible for them;

e) Matters involving multiple units that have been directed by responsible Deputy Ministers but still have differing opinions;

g) Organizational and cadre work of the industry;

h) Other matters that the Minister deems necessary to resolve personally.

3. Signing legal documents and administrative management documents of the Ministry. For organizational and personnel documents, the Minister signs cases involving personnel from the rank of Senior Specialist upwards. (There are separate regulations for sending cadres abroad for work and study).

4. For important issues related to multiple fields, the Minister shall establish advisory organizations to advise the Minister in resolving such matters. The tasks, methods of operation, composition, relationships with relevant Departments and Bureaus, and duration of activities of these organizations shall be specified in the establishment documents.

5. The Minister is responsible for decisions made by Vice Ministers in handling assigned tasks within the scope of work delegated by the Minister.

6. In cases where the Minister is absent from the Ministry for one working day or more, the Minister shall delegate authority to a Vice Minister to handle daily operations of the Ministry. The delegated Vice Minister shall report in writing to the Minister on all matters resolved during the Minister's absence.

Article 5. Scope of work resolution for Vice Ministers

1. A Vice Minister assists the Minister in leading and directing the general work of the Ministry; directly oversees certain areas of work and units as assigned by the Minister.

2. When handling assigned tasks, a Vice Minister may exercise the powers of the Minister and is accountable to the Minister for the resolution of those tasks. The Vice Minister is responsible for:

a) Organizing, directing, and guiding units to implement tasks within their assigned areas.

b) Proactively addressing emerging issues within their assigned areas. Reporting and seeking guidance from the Minister before resolving complex issues related to major policies, national security, defense, foreign affairs; involving multiple ministries, sectors, and localities; concerning mechanisms and policies not clearly defined by law.

c) Reporting to the Minister and informing other Vice Ministers about the situation regarding the resolution of assigned tasks. Cooperating proactively when tasks involve other Vice Ministers' responsibilities; reporting to the Minister for decision-making if there are differing opinions among Vice Ministers.

3. Signing on behalf of the Minister for documents within their assigned areas and handling tasks on behalf of the Minister when the Minister is absent.

4. In case a Vice Minister is unexpectedly absent and has tasks to resolve during the absence, that Vice Minister must report to the Minister to hand over the tasks for the Minister to resolve or the Minister may assign another Vice Minister to handle them.

The Office of the Ministry is responsible for reporting back to the absent Vice Minister on the content of resolved tasks.

5. The Minister may designate a Vice Minister to serve as the permanent Deputy, in addition to the duties and authorities stipulated in Clause 2 of this Article, the permanent Deputy is entrusted by the Minister to handle some daily tasks managed by the Minister, and is responsible for leading the Ministry's work when the Minister is absent.

Article 6. Scope of work resolution for Heads of Units under the Ministry

1. Heads of Units under the Ministry are responsible to the Minister for all work within the unit's functions and tasks; progress, quality, and effectiveness of assigned tasks; activities and work of deputy-level officials and staff under their command. Proposing solutions to the Minister or the Vice Minister in charge of the unit for issues exceeding their authority or due to objective reasons cannot be implemented.

2. Regularly and urgently reporting to the Minister or the Vice Minister in charge about the work area of their unit (as stipulated in Article 13 of this Regulation).

3. Heads of Units who are absent from the office for one working day or more must report in writing to the Minister and delegate authority to a deputy-level manager to manage and operate the unit; specifically, organizational personnel matters and tasks entrusted by the Minister to the head level cannot be further delegated. The person delegated is responsible for reporting on the resolution of tasks and the situation of the unit to the Head of the Unit during the delegation period.

4. Heads of Units are responsible for preparing reports as required by the Minister, the Vice Minister in charge, or as assigned at meetings chaired by the Minister or the Vice Minister. The Head of the Unit has the right to propose to the Minister (or the Vice Minister) for guidance within the scope of the unit's functions and tasks, and to propose opinions on the overall work of the Ministry.

5. The Director of the Office, in addition to the duties and authorities stipulated in Clauses 1 to 4 of this Article, also has the following duties and authorities:

a) Leading and coordinating with units to develop the Ministry's work program and plan, and monitoring and urging the implementation of these programs and plans after approval by the Minister; proposing solutions to the Minister to ensure the implementation of the Ministry's programs and plans.

b) Assisting the Minister in guiding, urging, and inspecting the implementation of the Ministry's Work Regulations.

c) Assisting the Minister and Vice Ministers in coordinating the activities of the Ministry's leadership. Serving as the liaison between the Ministry's leadership and external agencies.

d) Compiling, processing, and proposing to the Minister policies and mechanisms needed to be assigned to relevant units for research and development before the annual work program of the Ministry is established.

e) Organizing the issuance of the Minister's decisions and directives, and assisting the Ministry's leadership in monitoring and urging their implementation. Being authorized by the Minister to make official statements to the press on information, data, and situations of the Ministry. Promptly announcing conclusions and guidance from the Minister and Vice Ministers at meetings chaired by the Minister or Vice Minister.

g) When the Ministry's leadership is not present or due to special conditions unable to attend weekly briefings, the Director of the Office is authorized by the Minister to chair the weekly briefing meeting with unit leaders to evaluate the week's work.

h) Managing the Ministry's account.

i) Resolving specific tasks according to the Minister's authorization.

Article 7. Coordination and cooperation in resolving work between units and organizations

1. The heads of units when handling issues related to the functions and tasks of other units must exchange opinions with the heads of relevant units. In cases where opinions are exchanged in writing, the heads of relevant units who are asked for opinions have the responsibility to reply in writing within the earliest possible time, not exceeding three working days from the date of receipt of the document (unless the document requesting opinions specifies a different timeframe). Beyond this deadline, if there is no reply, it will be considered as agreement with the handling unit's solution.

2. The head of the main unit and the units cooperating in resolving work matters must bear joint responsibility for the results of the work before the Minister according to their respective functions and tasks.

3. The person in charge of Steering Committees of Programs and Projects and those assigned to coordinate other common activities of the Ministry shall be responsible to the Minister for organizing the completion of Program and Project tasks, coordinating activities, and complying with regulations on functions, tasks, and authorities granted to management units under the Ministry's agency.

4. Units according to their functions and tasks are responsible for coordinating the implementation of Programs, Projects, and other common activities of the Ministry.

Article 8. Responsibilities of civil servants

1. Civil servants must comply with job assignments and directives from the unit head, based on which they themselves build annual, six-monthly, and monthly work plans for individual approval by the unit head; they are responsible for fully implementing laws and regulations of the agency concerning civil servants; and they must follow the provisions of the Ministry's democratic regulation.

2. Civil servants are responsible for processing work in accordance with procedures, formalities, deadlines, ensuring quality, and bearing responsibility before the unit head for the results of assigned work; they must exercise their rights as prescribed by law.

3. During the process of performing work, civil servants must establish files on assigned tasks; they are responsible for preserving, using, and submitting files to the agency archive upon completion of tasks in accordance with state regulations on documentation and archiving, and following the guidance of the Ministry's Office.

4. Civil servants are responsible for preparing work performance reports and evaluations of civil servants at year-end, to be submitted to the unit head for review and comments, and to be filed according to the Civil Servant Ordinance.

Article 9. Authority to sign documents by heads of units under the Ministry

1. Heads of units under the Ministry, according to their functions, tasks, and specialized fields, may sign documents on behalf of the Minister as follows:

a) Based on legal provisions, Decisions, Directives, Circulars, and standards issued by the Ministry, sign guiding documents on specialized professional matters to be sent to Fisheries Departments and state management agencies regarding fisheries in localities, State-owned Enterprises, units under the Ministry, affiliated organizations, political-social organizations, and occupational associations. Documents urging Departments, Enterprises, and units to implement government policies, plans, and the Ministry's sectoral work programs;

b) Documents informing about the implementation of the Minister's decisions and directives; invitations to meetings within the unit's specialized field organized by the unit; letters of introduction for work-related contacts and travel permits for unit staff; documents related to management work within the unit's functions and tasks; copies of guiding documents within the unit's scope of responsibility;

c) Documents sent to units under the Ministry, State-owned Enterprises, affiliated organizations, Fisheries Departments, state management agencies regarding fisheries in localities, Associations, and related agencies to solicit opinions on draft documents prepared by the unit;

d) Reports on specialized fields.

Documents signed by heads of units under the Ministry on behalf of the Minister must be reported to the Minister and Deputy Minister in charge. These documents can only be sent to units under the Ministry, affiliated organizations; agencies or units at the same level as other Ministries or equivalent agencies of the Government in localities, and organizations and individuals related to fisheries activities.

2. The Director of the Ministry's Office, in addition to signing documents as mentioned in Clause 1 of this Article on behalf of the Minister, also signs on behalf of the Minister weekly, monthly, and quarterly work reports sent to the Government Office; documents informing the results of Ministry meetings (including meetings approved by the Minister or Deputy Minister for content and delegated to the main unit head); documents informing leadership directives; invitations to meetings from leaders; announcements of the Ministry's program and work plan to units, localities, and bases; copies of issued documents and other memoranda and papers within authority; approving the sending of faxes and telegrams (if faxes and telegrams are translated into foreign languages, the original Vietnamese version must be attached).

In urgent situations, due to the absence of specialized unit leaders or other reasons during the period of lacking specialized unit leadership, the Director of the Office may sign documents within the authority of the unit head on behalf of the Minister.

3. The Director of the Personnel Organization Department, in addition to signing documents as mentioned in Clause 1 of this Article on behalf of the Minister, also signs on behalf of the Minister decisions on personnel from specialist level and below, dispatching staff for training, participating in domestic organizations and activities, confirming personal history files for Ministry staff or staff working in management organizations of Programs and Projects established by the Ministry, and letters of introduction related to personnel work.

The Director of the Personnel Organization Department signs labor contracts for work in Departments, Inspectors, and the Ministry's Office based on the proposal of the unit head using labor, in accordance with the unit's work requirements and the agency's salary fund.

4. The Director of the Planning and Finance Department, in addition to signing on behalf of the Minister for the types of documents mentioned in Clause 1 of this Article, also signs on behalf of the Minister for budget allocation notifications, approval of budget expenditure estimates, and final accounts for units under the Ministry's management; investment capital notifications for construction projects, and related guiding documents concerning construction project management procedures as prescribed.

5. The Inspector General of the Ministry, in addition to signing on behalf of the Minister for the types of documents mentioned in Clause 1 of this Article, also signs and affixes the Inspectorate seal for operational inspection activity documents such as procedural guidance, forwarding complaints and petitions, responding to appeals and denunciations, reporting inspection conclusions, and other documents related to the activities of the Inspection Team.

6. Heads of units under the Ministry may sign on behalf of the Minister certain documents within the Minister’s authority when authorized in writing by the Minister according to the State regulations on archival work.

7. The Bureau Chief does not sign on behalf of the Minister for any documents of the Ministry. Documents drafted by Bureaus for issuance in the name of the Ministry must be submitted to the Ministry Leadership for signature.

Article 11. Procedures for submitting documents and handling matters

1. Documents submitted to the Ministry Leadership for signature by the unit head must include a Memorandum clearly explaining the content of the matter to be resolved, differing opinions on issues, recommendations for resolution, relevant files and documents attached, and a summary of the opinions of related units.

The procedures for submitting documents for signature and the procedures for submission for signature shall be carried out in accordance with the Regulation on Receipt, Processing, Issuance, and Archiving of Documents of the Ministry.

2. The drafting and submission for signature of normative legal documents shall be conducted in accordance with the Law on Enacting Normative Legal Documents and the Regulation on Construction and Issuance of Normative Legal Documents of the Ministry.

3. The unit head who submits a draft document for signature is responsible for its content and form. The Office shall check the file, procedures, content, format of the document, and the legality of non-normative legal documents to ensure they are properly submitted and issued.

4. Urgent, very urgent, and immediate incoming and outgoing documents must be processed immediately in accordance with the Regulation on Receipt, Processing, Issuance, and Archiving of Documents. Documents containing confidential information must be handled in accordance with the Regulation on Protecting State Secrets of the Fisheries Management Agency.

5. Incoming documents marked with specific deadlines must be processed in accordance with the deadline indicated on the document. In cases where it is objectively impossible to process within the specified time due to reasons beyond control, the main unit must report the reasons to the Minister or Deputy Minister responsible for the field.

6. For matters that fall within the scope of regular processing, the Ministry Leadership must provide formal comments on the submitted documents within two working days from the date the Ministry Office forwards them.

7. For important matters requiring extensive processing time, if the Ministry Leadership needs to consult experts or request the main drafting unit and related units to clarify further before making a decision, the Ministry Office will notify the main unit to prepare the content and organize meetings for the Ministry Leadership to deliberate. The Ministry Leadership must make a final decision within ten working days from the date the Ministry Office forwards the documents.

8. For matters requiring collective discussion among the Ministry Leadership, the Ministry Leadership must make a final decision within fifteen working days from the date the Ministry Office forwards the documents.

9. If there is no decision from the Ministry Leadership within fifteen working days from the date the Ministry Office forwards the documents, the Ministry Office must issue a written notification to the submitting unit explaining the reasons.

Chapter III

PROGRAM AND WORK PLAN

Article 12. Chapter Program of Work of the Ministry

1. The program of work includes: Annual, quarterly, monthly, and weekly programs of work prepared by the Ministry's Office based on the government's program of work and the consolidation of the anticipated programs of work of units approved by the Ministry's leadership.

2. The Ministry's leadership has a weekly program of work, including tasks of the Minister and Deputy Ministers that need to be resolved each day of the week, sent to units for preparation of meeting content.

Every week, the Minister meets with Deputy Ministers in the afternoon on Friday, before the departmental meeting of the Ministry to exchange information and unify measures for directing and managing the Ministry's work.

Article 13. Procedure for building programs and plans of work

1. Annual program of work

By the latest on November 1st each year, units under the Ministry and affiliated organizations must submit reports on the implementation of tasks and the annual program of work, along with the anticipated next year’s program of work. Reports are submitted to the Minister and the Ministry's Office for consolidation.

The annual program of work must cover all tasks, solutions for implementation, and identify the list of projects, proposals, and documents that the unit plans to implement in the coming year. The list of projects, proposals, and documents must clearly state the name of the project, proposal, document to be submitted, level of submission, reviewing agency, completion deadline, coordinating agencies, resources for implementation, ensuring feasibility.

The Ministry's Office consolidates and builds the Ministry's annual program of work to be submitted to the Minister for approval by the latest on November 10th, and sends it to the Government's Office by the latest on November 15th each year.

After the annual program of work of the Ministry is approved by the Minister, the Ministry's Office is responsible for sending it to units for implementation. Based on the approved program, units concretize it into their own program of work.

2. Quarterly program of work

At the end of each quarter, units under the Ministry and affiliated organizations must evaluate the implementation of the quarterly work, review the implementation of projects, proposals, documents, assigned tasks, and new emerging tasks to build the next quarter's program of work.

The anticipated next quarter's program of work of the unit must be submitted to the Minister and the Ministry's Office by the latest on the 10th of the last month of the quarter for consolidation by the Ministry's Office. The Ministry's Office is responsible for consolidating and submitting the quarterly program of work to the Ministry's leadership for approval and sending it to the Government's Office by the latest on the 15th of the last month of the quarter.

The Ministry's Office is responsible for sending related units the Government's quarterly program of work and the Ministry's quarterly program of work. Based on the Ministry's quarterly program of work, units concretize it into their official quarterly program of work.

3. Monthly program of work

Each month, units must submit a report evaluating the implementation of tasks and the monthly program of work of their unit.

Based on the quarterly program of work, the implementation of the monthly work, and newly arising issues, build the next month's program of work appropriately. The evaluation report of the monthly work and the next month's program of work of the unit must be submitted to the Minister and the Ministry's Office by the latest on the 17th of each month.

The Ministry's Office consolidates and builds the monthly work report and the next month's program of work of the Ministry to be submitted to the Minister for approval and sending to the Government's Office by the latest on the 20th of each month.

The Ministry's Office is responsible for sending the Ministry's monthly program of work to related units by the latest on the 28th of each month for implementation. Based on the Ministry's monthly program of work, units adjust their anticipated program and concretize it into their official program.

4. Weekly program of work

Heads of units register the weekly schedule by the latest on Thursday of the previous week. The Ministry's Office prepares and submits the weekly schedule of the Ministry's leadership for decision by the Ministry's leadership, and sends it to heads of units at the weekly briefing meeting on Friday.

5. For financial planning

Units must prepare the annual financial plan simultaneously with the development of programs and projects to be submitted for approval by the Ministry's leadership. It must then be sent to the Ministry's Office and the Department of Planning and Finance for consolidation by the latest on August 15th of the previous year.

In monthly planning, units must prepare a budget estimate for activities to be sent to the Ministry's Office for implementation.

Article 14. Management and Implementation of Programs and Plans of Work

1. The Ministry's leadership uniformly manages the plan of work according to the division of labor by the Ministry's leadership, directs the implementation of the program and plan of work according to the field of work and the unit responsible.

2. The Ministry's Office is the central unit managing the program and plan of work of the Ministry, responsible for advising the Ministry's leadership on the consolidation, construction, adjustment, and organization of the implementation of the program of work to ensure compliance with the requirements of direction and management by the Ministry's leadership; monitoring and urging the implementation of tasks and the implementation of projects by units; consolidating and building reports to be submitted to the Ministry's leadership and the Government's Office; coordinating with the Government's Office and relevant agencies in the construction of the Ministry's program of work and the Ministry's leadership. The time of implementation is as stipulated in Article 13 of this Regulation.

3. Heads of units manage the program of work of civil servants in their units; actively organize the implementation of tasks and coordinate and exchange with related units to ensure progress, quality, and effectiveness of work.

Chapter IV

MEETINGS, CONFERENCES, BUSINESS TRIPS, AND GUESTS

Article 15. Meetings of the Ministry

1. The Minister or Deputy Minister chairs meetings according to their specialized fields and areas of responsibility. Meetings chaired by the Minister, if the Minister is absent, the Minister delegates a Deputy Minister to chair in his place; in cases where there is a permanent Deputy Minister, when the Minister is absent, the permanent Deputy Minister chairs the meeting on behalf of the Minister.

2. The Ministry's leadership, the Chairperson of the meeting will decide the content, time, participants, and agenda of the Ministry's meetings;

3. The Office of the Ministry has the duty to urge units assigned to prepare projects, programs and must be responsible for ensuring materials for meetings according to the prescribed time. According to the assignment of the Minister, the Office of the Ministry shall inspect, compile files, projects presented at meetings under items a, b, c, d, e, g, h of Clause 2, Article 3 of this Regulation, record minutes, issue notifications on the conclusions of the Minister or Deputy Minister in charge of the meeting for relevant units to implement.

4. In accordance with the Ministry's general work program, the Minister and each Deputy Minister decides on the content, time, measures, and chairing of meetings to implement tasks according to their assigned functions and responsibilities.

Article 16. Meetings of the Ministry

1. The Ministry holds Mid-Year Review Meetings and Annual Summary Meetings to implement development plans.

a) Annual Summary and Mid-Year Review Meetings of the entire Sector

Held once a year; the Annual Work Summary Meeting and Discussion on Measures to Implement the Next Year's Plan takes place from December 15 of the previous year to January 15 of the following year; the Mid-Year Review Meeting is held around the end of June and beginning of July each year.

b) Composition, time, location, and method of conducting the meeting are decided by the Minister after consulting opinions of Deputy Ministers.

c) The Office of the Ministry is responsible for notifying related units of the assignments to prepare meeting contents as directed by the Minister, such as issuing meeting invitations, preparing mid-year review reports, annual summary reports, and organizing conditions for the meeting; recording minutes, issuing conclusions, and other documents related to the meeting content.

2. International conferences and seminars are conducted in accordance with Decision No. 122/2001/QĐ-TTg dated August 21, 2001, of the Prime Minister on organizing and managing international conferences and seminars in Vietnam. The main unit organizing the conference or seminar must report to the Minister and notify the Office of the Ministry in advance about the content, composition, time, and location of the event.

Article 17. Working sessions and meetings of units under the Ministry

1. At least twice a year, the Minister or Deputy Minister will work with the leadership and staff of each unit to direct and supervise the implementation of tasks, plans, and policies of the Party, State, and Ministry.

2. Annual summary meetings and mid-year reviews of units under the Ministry must be carefully prepared in terms of content and reported to the responsible Ministry leadership for guidance.

Article 18. Official travel

1. The Minister travels to localities and bases to inspect and urge the implementation of plans and policies for sector development or according to the assignment of the Prime Minister for government members to perform government tasks.

Deputy Ministers travel to localities and bases to understand the situation, inspect, and resolve sector-related matters according to their assigned tasks. Deputy Ministers travel according to the assignment of the Minister or the request of the Prime Minister, Party and State agencies, National Assembly through the Minister.

According to the assignment of Ministry leadership, heads of related units under the Ministry direct and inspect the preparation of materials and service for work content.

The Director of the Office is responsible for:

a) Drafting the work program and plan of the Minister and Deputy Ministers;

b) Coordinating with heads of related units to prepare the content for the Minister and Deputy Ministers' local travel;

c) Notifying localities in advance about the schedule of the Minister and Deputy Ministers' visits.

After completing the official trip, the Office of the Ministry is responsible for reporting the results of the Minister and Deputy Ministers' work to related units.

2. Heads of units under the Ministry traveling on official business must develop a work program and plan clearly stating the content, departure date, destination; delegate management of daily operations of the unit to be reported to the Minister and responsible Deputy Minister in writing, and notify the Office of the Ministry and units within the Ministry for contact purposes.

3. Civil servants of units under the Ministry traveling on official business are appointed by the head of the unit, and urgent cases are decided by Ministry leadership.

4. Official travel and study abroad are carried out in accordance with the Regulation on Selection and Management of Civil Servants of the Ministry traveling and studying abroad and related laws.

Article 19. Receiving guests and citizens

1. Domestic guests visiting units within the Ministry's agency must register with the Office of the Ministry to be guided. The Office of the Ministry is responsible for understanding the content, composition, and time of the visit to proactively receive guests.

2. Heads of units under the Ministry, if they consider it necessary for the Ministry leadership to receive their unit's guests (except in emergencies), must send a written notice to the Office of the Ministry at least three working days before the planned reception. The notice should clearly state the content, format, number of guests, time, and location of the reception.

3. The Office of the Ministry is responsible for submitting the above reception requests to the Ministry leadership; informing the relevant units of the leadership's opinion; coordinating to prepare for receiving guests.

4. Foreign guest receptions are implemented in accordance with the "Provisional Regulation on the Management of Foreign Activities of the Fisheries Sector" issued together with Decision No. 627/1999/QĐ-BTS.

5. Citizen receptions are carried out in accordance with national regulations and the Ministry's citizen reception regulation.

CHAPTER V

WORK RELATIONSHIPS

Article 20. Relations between the Minister and the Fisheries Sector Party Cadre Committee

Implemented in accordance with Article 9 of the Fisheries Sector Party Cadre Committee Work Regulation No. 37/QC-BCS issued on August 4, 2004.

Article 21. Relations between the Minister and the Party Committee of the Fisheries Ministry

1. The Party Committee participates with the Minister in cadre work as stipulated in Decision No. 27/2003/QĐ-TTg dated February 19, 2003, of the Prime Minister on the issuance of the Regulation on Appointment, Reappointment, Rotation, Resignation, and Removal of Leading Cadres and Civil Servants.

2. Ministry leadership is responsible for coordinating with the Party Committee in building a clean and strong Party organization; creating conditions for the Party organization to effectively fulfill its political tasks.

Article 22. Relations between Ministry Leadership and the Vietnam Fisheries Trade Union

1. Ministry leadership seeks the opinion of the Vietnam Fisheries Trade Union in the formulation of strategies, plans for sector development, and normative legal documents related to the rights and obligations of workers.

The Ministry's leadership shall create favorable conditions for the Vietnam Fisheries Union to fully exercise its rights and responsibilities.

2. The Ministry's leadership shall coordinate with the Vietnam Fisheries Union to carry out the following tasks:

a) Implementing systems and policies for officials and civil servants as stipulated and other related works to ensure fair, democratic, and solidarity systems.

b) Initiating and organizing labor and production competition movements within the Ministry and the industry; reviewing and awarding commendations;

c) Inspecting the implementation of laws, resolving petitions, complaints, and accusations related to the rights and obligations of workers.

3. Annually, the Ministry's leadership shall meet with the Executive Board of the Vietnam Fisheries Union to hear opinions and proposals.

Article 23. Relations with Associations and Trade Unions

Apply according to points a and b, Clause 1, Article 11 of Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government on the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies and the Operational Regulations of the Ministry with Associations and Trade Unions.

Chapter VI

IMPLEMENTATION

Article 24. Implementation Provisions

1. The Director of the Office shall be responsible for disseminating, supervising, urging, inspecting the implementation of this Regulation, and periodically reporting to the Minister.

2. Heads of units shall be responsible for disseminating, urging, inspecting, and reporting on the implementation of this Regulation within their units; they shall bear joint liability if officials and civil servants under their unit violate this Regulation.

3. Officials and civil servants in administrative management units under the Ministry's agency have the responsibility to implement this Regulation.

Officials and civil servants who violate this Regulation shall be subject to handling according to the provisions of the law depending on the nature and extent of the violation.

During the implementation of the operational regulations of the Ministry's agency, if officials and civil servants find any provisions that are still inappropriate, they should promptly report through the Ministry's Office to the Minister for supplementation and amendment./.
