At the proposal of the Director of the Department of Meteorology and Hydrology and the Director of the Department of Organization and Cadres,

DECISION:

Article 1. These Regulations on the establishment, relocation, upgrading, downgrading, and dissolution of meteorological and hydrological stations are hereby issued together with this Decision.

Article 2. This Decision shall take effect fifteen days from the date of publication in the Official Gazette. The Directive No. 540/KTTV dated August 3, 1977 of the General Director of the General Department of Meteorology and Hydrology on procedures for establishing and relocating meteorological and hydrological stations is hereby abolished.

Article 3. The Head of the Ministry's Office, the Directors of the Departments of Organization and Cadres, Planning and Finance, Meteorology and Hydrology, Science and Technology, and the Director of the National Center for Meteorology and Hydrology and the Heads of related units are responsible for implementing this Decision.

REGULATIONS

Establishment, relocation, upgrading, downgrading, and dissolution of meteorological and hydrological stations(Issued together with Decision No. 03/2006/QĐ-BTNMT dated March 17, 2006)

Article 1. These regulations prescribe the procedures, formalities, and contents regarding the establishment, relocation, upgrading, downgrading, and dissolution of surface meteorological stations, agricultural meteorological stations, upper-air meteorological stations, marine meteorological stations, and hydrological stations (hereinafter referred to collectively as meteorological and hydrological stations), and the acceptance of specialized meteorological and hydrological stations into the basic network of meteorological and hydrological stations.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 2. These regulations apply to basic meteorological and hydrological stations managed by the Ministry of Natural Resources and Environment and specialized meteorological and hydrological stations that have been accepted.

Meteorological and hydrological station

Article 2. Interpretation of Terms

In these Regulations, the following terms shall be understood as follows:

1. is a facility for monitoring meteorological and hydrological factors, air and water environmental factors on land, underwater, on rivers, lakes, seas, and in the atmosphere. Basic meteorological and hydrological station

2. is a station constructed by the State for basic investigations of meteorology and hydrology, managed and operated stably and long-term by the Ministry of Natural Resources and Environment to serve societal needs. Specialized meteorological and hydrological station

3. is a station built, managed, and operated mainly for specific purposes and needs by ministries, sectors, localities, economic organizations, defense, security entities, and individuals (collectively referred to as the Project Owner). Type of station

4. is a concept used to classify meteorological and hydrological stations based on the field of monitoring they perform. Rank of station

5. is a concept indicating the level of each type of station, determined based on the tasks and monitoring factors of the station, uniformly prescribed for each type of station. Establishment of a station

6. is the construction of a new station and the commencement of monitoring activities at a location where there was previously no station or where a station had been dissolved. Upgrading of a station

7. is the addition of tasks or monitoring factors to the station and the elevation of its rank to a higher level. Downgrading of a station

8. is the reduction of tasks or monitoring factors of the station and the lowering of its rank to a lower level. Relocation of a station

9. is the movement of the entire station or some components of the station from its current operational location to a newly selected location. Dissolution of a station

10. is the complete cessation of all monitoring work and termination of all other activities of the station. Specialized works

11. are facilities for installing monitoring equipment or serving the monitoring of meteorological and hydrological factors, air and water environmental factors. which is a facility for installing observation equipment or serving the observation of meteorological, hydrological factors, air environment, and water.

Article 3. Approval Authority

1. The Minister of Natural Resources and Environment:

a) Proposes to the Prime Minister for decision on relocating basic meteorological and hydrological stations belonging to the special category and the international warning network as stipulated in Article 11 of the Ordinance on Exploitation and Protection of Meteorological and Hydrological Works, Article 3 and Clause 2 of Article 11 of Decree No. 24/CP dated March 19, 1997 of the Government detailing the implementation of the Ordinance on Exploitation and Protection of Meteorological and Hydrological Works;

b) Approves the establishment plan for stations, station locations; decides on the establishment of stations; approves investment project plans for station construction (excluding projects for station construction delegated to the National Hydro-Meteorological Center); decides on the operation of newly constructed stations and upgraded stations; decides on upgrading, downgrading, or dissolution of basic meteorological and hydrological stations;

c) Decides on the relocation of basic meteorological and hydrological stations not covered by point a of Clause 1 of this Article;

d) Decides on the acceptance of specialized meteorological and hydrological stations into the network of basic meteorological and hydrological stations.

2. Director of the National Hydro-Meteorological Center: Approves investment project plans for the construction of basic meteorological and hydrological stations according to the delegation.

Chapter II

ESTABLISHMENT OF BASIC METEOROLOGICAL AND HYDROLOGICAL STATIONS

Article 4. Principles of Establishment

1. The establishment of basic meteorological and hydrological stations must follow the planning of the station network that has been approved by the competent authority.

2. In cases where there is no provision in the planning but it is necessary to establish a station to meet new requirements for basic surveys, warnings, forecasts, services, scientific research, and other social needs, the Ministry of Natural Resources and Environment will decide within its authority or propose to the Prime Minister for consideration and decision.

Article 5. General Requirements for Station Locations

1. The location of basic meteorological and hydrological stations must represent the area or river basin in terms of natural conditions and meteorological and hydrological factors, especially those factors that the station measures; it must meet technical requirements specified in relevant meteorological and hydrological observation regulations.

2. The technical safety corridor for each type of meteorological and hydrological station must be implemented as prescribed in Article 7 of Decree No. 24/CP dated March 19, 1997 of the Government detailing the implementation of the Ordinance on Exploitation and Protection of Meteorological and Hydrological Works.

3. Conditions regarding transportation, communication, power supply, water supply; living and working conditions for observers must be ensured according to the requirements of each type of station. Planning for economic and social development in the area should not affect the future operations of the station.

Article 6. Procedures for Establishing Stations

The establishment of basic meteorological and hydrological stations must follow the following procedures:

1. Preliminary survey, determination of station location;

2. Review and approval by the competent authority of the station location;

3. Technical survey, determination of scale and type of observation works;

4. Review and decision on station establishment by the competent authority;

5. Survey, design, preparation of investment project plans for station construction;

6. Review and approval of construction project plans by the competent authority;

7. Construction of works, installation of equipment for the station;

8. Technical inspection, operation of equipment, observation checks;

9. Decision to put the station into formal operation.

Article 7. Preliminary Survey

1. General survey, including the following contents:

a) Surveying natural conditions such as topography, soil, vegetation cover, rainfall, temperature, humidity, prevailing wind direction, typhoons, floods, inundations, and surrounding environment to assess the representativeness for the area or river basin where the station is planned to be located;

b) Surveying technical safety clearance conditions for the station;

c) Understanding and grasping the socio-economic planning and development situation of the local area where the station is planned to be located;

d) Surveying living conditions, transportation, communication, power supply, and water supply;

e) Preliminarily determining the coordinates and elevation of the land plot for the station and the construction site of the observation facility;

f) Seeking opinions from local authorities on the preliminary surveyed location of the station.

2. In addition to the provisions of Clause 1 of this Article, it is necessary to conduct some specific surveys for different types of stations:

a) For surface meteorological stations, agricultural meteorological stations, and high-altitude meteorological stations, there is no need to preliminarily determine the position and height of obstacles; the distance and direction of obstacles relative to the observation garden or specialized facilities;

b) For hydrological stations, it is necessary to understand the general characteristics and hydrological features of the river basin; select a section of the river that can meet technical requirements for station placement; investigate flow characteristics; preliminarily survey the highest water level, lowest water level, tidal phenomena, branching and merging phenomena, and water loss phenomena along the river section; determine the flood control capacity of the river section; understand the current and future use and exploitation of the river section, the current and expected changes due to population growth, economic development, construction of hydropower and irrigation projects, etc.;

c) For marine meteorological stations, it is necessary to survey the characteristics and tidal regime in the area where the station is planned to be located; survey the openness towards the sea for the main and prevailing wind directions; preliminarily determine the depth of the sea at the wave observation site, the highest water level, lowest water level, slope, and curvature of the coastline; preliminarily survey islands, sandbars, submerged rocks, or other obstructions (if any)...

3. Prepare a preliminary survey report according to Model No. 1 in Appendix 1 of this Regulation.

Article 8. Technical Survey

1. A technical survey may only be conducted after the station location has been approved by the competent authority. In certain cases, when the station location is basically determined, information related to the preliminary survey is clear (usually for meteorological stations), or the survey area is far away, remote, and difficult to access (usually for hydrological stations), both preliminary and technical surveys can be combined, but this must be agreed upon by the Ministry of Natural Resources and Environment.

2. The content of the technical survey for each type of station is stipulated in Appendix 2 of this Regulation.

3. Prepare a technical survey report according to Model No. 2 in Appendix 1 of this Regulation.

Article 9. Construction and Operation of the Station

1. The survey, design, project investment preparation, and construction of the station must comply with current regulations on investment and construction.

2. Specialized works, machinery, and equipment must be technically inspected, operated, and tested for monitoring after installation to evaluate the installation quality and stability of the works and equipment before putting the station into operation and officially collecting data.

Article 10. Documents for Approval

1. Preliminary survey documents (2 copies), including:

a) The proposal from the National Hydro-meteorological Center;

b) The preliminary survey report prepared by the Regional Hydro-meteorological Station in accordance with Clause 3, Article 7 of this Regulation;

c) The local government's approval document regarding the station location (copy);

d) The technical unit's review document under the National Hydro-meteorological Center.

2. Technical survey documents (2 copies), including:

a) The proposal from the National Hydro-meteorological Center;

b) The technical survey report prepared by the Regional Hydro-meteorological Station in accordance with Clause 3, Article 8 of this Regulation;

c) The local government's approval document for land allocation and construction permit (copy);

d) Other relevant legal documents related to the establishment of the station (if applicable);

e) A copy of the technical station file (if it is a previously dissolved station being revived);

f) The technical unit's review document under the National Hydro-meteorological Center.

3. Construction station documents (2 copies), including:

a) The proposal from the National Hydro-meteorological Center along with the technical unit's review document on hydro-meteorological standards under the National Hydro-meteorological Center (if within the Ministry's approval authority);

b) The investment and construction station file, prepared by the Regional Hydro-meteorological Station in accordance with current regulations on investment and construction;

c) A copy of the Decision of the Minister of Natural Resources and Environment regarding the establishment of the hydro-meteorological station;

d) A copy of the land allocation decision of the Provincial People's Committee, directly under the Central Government, accompanied by a layout plan of the station site;

4. Documents for officially operating the station (2 copies), including:

a) The proposal from the National Hydro-meteorological Center;

b) The technical acceptance record of the specialized works, the installation equipment and machinery acceptance record;

c) The report from the Regional Hydro-meteorological Station on the results of monitoring, testing, and evaluating the quality of installation and stability of the works and equipment;

d) The technical unit's review document under the National Hydro-meteorological Center.

Chapter III

MOVING BASIC HYDRO-METEOROLOGICAL STATIONS

Article 11. Cases Requiring Relocation

1. The current station location is no longer suitable for the approved network planning of hydro-meteorological stations.

2. Due to economic and social development requirements, the State needs to reclaim land in the station area.

3. The technical safety corridor or observation facilities of the station no longer meet technical requirements and are unsafe for observations due to natural changes, urbanization, or the impact of economic and social activities.

Article 12. Conditions for Relocation

1. The new location must meet technical requirements for setting up a hydro-meteorological station. The hydro-meteorological conditions at the old and new station locations must be basically similar to ensure the meteorological and hydrological data measured at both locations maintain consistency and continuity, allowing mutual conversion through the correlation between the two stations.

2. If the old and new locations do not satisfy the conditions stipulated in Clause 1 of this Article, it shall not be considered relocation but rather dissolution of the old station and establishment of a new one.

3. When relocating a hydro-meteorological station that monitors air and water environmental factors, the new location must simultaneously meet the conditions for monitoring hydro-meteorological elements and environmental factors. In cases where these conditions cannot be met, priority should be given to selecting a location that meets the conditions for monitoring hydro-meteorological elements, while recommending to the competent authority to transfer the monitoring of air and water environmental factors to another suitable location.

4. The relocation of hydro-meteorological stations related to national defense and security must consult the opinions of the Ministry of Defense and the Ministry of Public Security.

Article 13. Procedure for Relocation

1. Survey the current status of the technical safety corridor of the station, the current status of the works, assess the degree of impact on monitoring conditions and data accuracy, recommend relocation methods, and submit to the competent authority.

2. Survey the new location where the station or works will be relocated to, prepare and submit the application dossier for station relocation.

3. Approval by the competent authority.

4. Construct the station or works at the new location, connect the elevation between the old and new locations.

5. Organize simultaneous monitoring at both locations.

6. Put the new station or works into operation, decommission the old station or works.

Article 14. Survey for Relocation

1. In cases of relocating the entire station, it must be carried out as establishing a new basic meteorological and hydrological station according to Articles 5, 6, 7, and 8 of this Regulation.

2. In cases of relocating one or several components of the works, supplementary surveys must be conducted to review, examine, and construct these components anew.

Article 15. Dossier for Approval

1. For stations that need to be relocated entirely, the approval dossier shall be prepared as when establishing a station, as stipulated in Article 10 of this Regulation.

2. For stations that need to relocate one or several components of the works, two copies of the dossier shall be submitted, including the following contents:

a) A request from the National Meteorological and Hydrological Center clearly stating the necessity to relocate components of the meteorological and hydrological station;

b) A survey report for the works to be relocated, prepared by the Regional Meteorological and Hydrological Station;

c) A copy of the land allocation agreement and construction permit for the works to be relocated issued by the local authorities (if such works are outside the station's premises);

d) An assessment document from a specialized unit under the National Meteorological and Hydrological Center;

e) Compensation agreements and related legal documents (if applicable).

Article 16. Construction of Stations (or Works) and Simultaneous Monitoring

1. The construction and operation of stations (or works) at the new location shall be carried out in accordance with Article 9 of this Regulation.

2. Simultaneous Monitoring:

a) Simultaneous monitoring at both old and new locations shall be conducted in accordance with the professional standards of meteorological and hydrological disciplines;

b) The time and specific content of simultaneous monitoring in each case shall be reviewed and decided by the National Meteorological and Hydrological Center;

c) Upon completion of simultaneous monitoring, the Regional Meteorological and Hydrological Station shall prepare a report and propose the official operation of the new station or works, and the decommissioning of the old station or works. In special cases, after completing simultaneous monitoring, if the data at both locations are inconsistent and the correlation between the two data series cannot be determined, the National Meteorological and Hydrological Center shall submit to the Ministry of Natural Resources and Environment to replace the relocation decision with a decision to establish a new station;

d) Monitoring documents must be handed over for archiving.

Chapter IV

UPGRADE OF BASIC METEOROLOGICAL AND HYDROLOGICAL STATIONS

Article 17. Cases for Upgrade

1. According to the approved network planning of meteorological and hydrological stations.

2. To enhance the monitoring tasks and elements of the station to meet the needs of utilizing data for basic investigation purposes, research, forecasting to serve disaster prevention and mitigation, and economic and social development, ensuring national defense and security.

Article 18. Procedures for upgrading

1. Submit and review proposals and contents for station upgrades.

2. The competent authority decides on the station upgrade.

3. Conduct technical surveys to build related works involving new monitoring elements; prepare documentation, estimates, and submit for review.

4. Implement construction works, install and supplement equipment.

5. Put upgraded station facilities into operation.

Article 19. Documentation for Review

1. Station upgrade proposal documentation (two sets), including:

a) The proposal from the National Hydro-meteorological Center;

b) The regional Meteorological and Hydrological Station's proposal for station upgrade along with relevant survey documentation. The content should be carried out similarly to when the station was established for these elements;

c) Relevant legal documents such as extracts from approved network station planning schemes by authorized bodies; requirements from sectors and localities regarding station upgrades; land allocation documents from local authorities for constructing upgrade works (if applicable);

d) The technical unit's review document under the National Hydro-meteorological Center.

2. Construction project documentation for station upgrades (two sets), including:

a) The proposal from the National Hydro-meteorological Center along with the technical unit's review document on hydro-meteorological standards under the National Hydro-meteorological Center (if within the Ministry's approval authority);

b) Investment and construction documentation for station upgrade projects, prepared by the regional Meteorological and Hydrological Station according to current investment and construction regulations;

c) A copy of the Decision of the Minister of Natural Resources and Environment on station upgrade;

d) A copy of the land allocation decision by the provincial or centrally-administered city People's Committee, accompanied by a site plan for the construction area of the station upgrade works (if applicable).

3. Documentation for putting station upgrade works into operation (two sets), including:

a) The proposal from the National Hydro-meteorological Center;

b) The technical acceptance record of the specialized works, the installation equipment and machinery acceptance record;

c) The report from the Regional Hydro-meteorological Station on the results of monitoring, testing, and evaluating the quality of installation and stability of the works and equipment;

d) The technical unit's review document under the National Hydro-meteorological Center.

Chapter V

BASIC STATION DOWNGRADE

Article 20. Cases for Downgrading

1. According to the approved network planning of meteorological and hydrological stations.

2. The observation period for one or more meteorological and hydrological factors at the station has been sufficiently long, and collected data meets research, calculation, and service requirements, thus no further observations are needed.

3. Service needs do not require the station to continue its current tasks (observation factors can be reduced, observation frequency decreased; international telegrams may not be required, etc.).

4. Technical safety zones have been compromised due to natural conditions and socio-economic activities, making it impossible to ensure technical conditions for observing certain factors, or although observations can be made, the data no longer represent the natural laws of meteorological and hydrological factors as before.

5. Observing certain factors is too difficult and unsafe for observers without feasible solutions to address the issues.

Article 21. Procedures for Downgrading

1. Examine and assess observation needs, the situation of collected data for observed factors; survey and evaluate the impact of technical safety zones, natural conditions, and socio-economic activities on observed factors; assess observation conditions; prepare a report proposing station downgrade.

2. The competent authority makes the decision to downgrade the station.

3. Recover equipment (if applicable); conduct observations according to the provisions of the new station category.

4. Until a downgrade decision is made, the station must maintain normal observations of all factors. If observations cannot be conducted or are unsafe for observers, the regional Meteorological and Hydrological Station must promptly report to the National Meteorological and Hydrological Center for guidance.

Article 22. Documents for Approval

The application for downgrading the station (two copies) shall include the following contents:

1. The report from the National Hydro-meteorological Center;

2. Reports and survey documents related to the station downgrade prepared by the Regional Hydro-meteorological Station in accordance with Clause 1 of Article 21 of this Regulation;

3. Other relevant legal and technical documents such as extracts of the approved network planning; reports and photographs of the current status of the facility, river section, riverbank, station area or affected structures;

4. The review document from the specialized unit under the National Hydro-meteorological Center.

Chapter VI

DISSOLUTION OF BASIC HYDROMETEOROLOGICAL STATIONS

Article 23. Cases for Dissolution

1. The station is no longer included in the approved hydro-meteorological station network planning.

2. The observation period at the station has been sufficiently long, and the collected data meets the requirements for research, calculation, and service purposes, making further observation unnecessary.

3. The station cannot continue to operate at its current location due to economic and social development needs, national defense, and security requirements necessitating land recovery; technical safety corridors being infringed upon; natural conditions affecting the station's ability to conduct observations, rendering the data non-representative and unable to accurately reflect natural laws and meteorological-hydrological conditions at the station; observation being too difficult or unsafe for observers without feasible solutions, and no alternative location meeting the relocation criteria stipulated in Article 12 of this Regulation can be found.

Article 24. Procedure for Dissolution

1. Depending on specific circumstances, based on the station network planning and socio-economic development planning in the region, conduct surveys and assess the impact of technical safety corridors on the station's observation requirements; evaluate the observation conditions, observation needs, and collected data of the station to prepare a report and propose station dissolution.

2. Decision on station dissolution by the competent authority.

3. Implement station dissolution and recover equipment.

4. Until a dissolution decision is made, the station must maintain normal observation. In special cases where continued observation is not possible, the Regional Hydro-meteorological Station must promptly report to the National Hydro-meteorological Center for guidance.

Article 25. Documents for Approval

The application for station dissolution (two copies) shall include the following contents:

1. The report from the National Hydro-meteorological Center;

2. Survey and evaluation documents related to station dissolution prepared by the Regional Hydro-meteorological Station in accordance with Clause 1 of Article 24 of this Regulation;

3. Relevant legal and technical documents such as extracts of the approved station network planning; socio-economic development planning in the station area, local government announcements on land recovery in the station area (if the station is dissolved due to land recovery by the state); compensation agreements (if the station is dissolved due to land recovery by the state); reports and photographs of the current status of the facility, river section, riverbank, station area (if the station is dissolved due to inadequate conditions for observation);

4. Report from the Regional Hydro-meteorological Station on the station's history, observation duration, and collected data;

5. Review document from the specialized unit under the National Hydro-meteorological Center.

Article 26. Handling issues when station dissolution occurs

1. The National Hydro-Meteorological Center shall direct the Regional Hydro-Meteorological Station to redeploy and arrange work for the staff of the station. The station building, observation facilities, assets, and land of the station shall be resolved according to current regulations.

2. The Regional Hydro-Meteorological Station shall be responsible for recovering, inventorying, classifying, and preserving the observation equipment, machinery, and means of the station; notifying the local authorities about the station's dissolution; planning long-term protection of the station's elevation markers (for marine meteorological and hydrological stations where markers are not being removed).

3. The technical files of the station must be submitted for storage.

Chapter VII

ACCEPTING SPECIAL METEOROLOGICAL AND HYDROLOGICAL STATIONS INTO THE BASIC STATION NETWORK

JOIN THE BASIC METEOROLOGICAL AND HYDROLOGICAL STATION NETWORK

Article 27. Acceptance of stations

1. A special meteorological and hydrological station may be accepted into the basic station network when the Project Owner does not require continued observation but the station's location and type are suitable for the approved basic meteorological and hydrological station network plan, and the station's observation data can serve other sectors and purposes.

2. Conditions for acceptance:

a) The station's location and technical safety zone meet technical standards;

b) The station's observation facilities comply with or can be upgraded to meet the technical standards for basic meteorological and hydrological stations;

c) The station has conditions to maintain stable and long-term operations.

Article 28. Procedure for acceptance

1. Proposing and reviewing the policy for accepting the station.

2. Upon having the acceptance policy, conducting surveys and evaluations of the station's technical conditions, completing the dossier, and submitting for review.

3. Approval by the competent authority.

4. Accepting the station into the network.

Article 29. Review Dossier

The dossier for reviewing the acceptance of a special meteorological and hydrological station into the basic station network consists of two copies, including the following contents:

1. The report from the National Hydro-meteorological Center;

2. Documents established by the Project Owner of the special meteorological and hydrological station, including:

a) Document requesting transfer of the station;

b) Copy of the station's technical file. In case there is no station technical file, a summary of the station's current technical status according to Model No. 3 of Appendix 1 of this Regulation is required;

c) Copy of the land allocation dossier by the competent authority;

d) Copy of the most recent asset report of the station;

e) Extract from the personnel dossier of the station's staff (if accepting staff);

3. Report on surveying and evaluating the current status of the technical safety zone, infrastructure, station building, facilities, observation equipment, and machinery of the station, established by the Regional Hydro-Meteorological Station where the special meteorological and hydrological station is located, according to Model No. 4 of Appendix 1 of this Regulation.

4. The review document from the specialized unit under the National Hydro-meteorological Center.

5. Other technical and legal documents (if any).

Chapter VIII

IMPLEMENTATION

Article 30. Responsibilities of agencies and units

1. The Regional Hydro-Meteorological Station:

a) Carry out tasks of surveying and evaluating technical issues; prepare dossiers for submission to the National Hydro-Meteorological Center; organize acceptance of construction works, machinery, and equipment; organize observation checks, simultaneous observations, and related specialized tasks when establishing, relocating, upgrading, downgrading, dissolving basic meteorological and hydrological stations, and accepting special meteorological and hydrological stations into the basic station network;

b) Coordinate with local authorities to implement procedures for land allocation, compensation, and clearance (if necessary).

2. The National Hydro-Meteorological Center:

a) Organize the implementation of this Regulation;

b) Review dossiers and propose the Ministry to approve or approve within its authority the relevant contents when establishing, relocating, upgrading, downgrading, dissolving basic meteorological and hydrological stations, and accepting special meteorological and hydrological stations into the basic station network;

c) Annually compile and report to the Ministry on the implementation of this Regulation.

3. The Meteorology and Hydrology Department:

a) Review dossiers and submit to the Minister for approval;

b) Urge, monitor, and inspect the implementation of this Regulation.

4. During the implementation of this Regulation, if there are difficulties or obstacles, units shall reflect them in writing to the Ministry of Natural Resources and Environment for consideration and resolution./.
