JOINT CIRCULAR

Guidelines for Managing Map Publication Activities

Pursuant to the Law on Publishing No. 30/2004/QH11 adopted by the National Assembly of the Socialist Republic of Vietnam at its 6th session of the 11th term on December 3, 2004;

Pursuant to Decree No. 111/2005/NĐ-CP dated August 26, 2005 of the Government detailing and guiding the implementation of certain provisions of the Law on Publishing;

Pursuant to Decree No. 12/2002/NĐ-CP dated January 22, 2002 of the Government on mapping activities;

The Ministry of Natural Resources and Environment and the Ministry of Culture, Sports and Tourism issue guidelines for managing map publication activities as follows:

I. GENERAL PROVISIONS

This Circular applies to units under the Ministry of Education and Training; departments of education and training, education and training divisions; preschool education institutions, general education institutions, regular education institutions, teacher training colleges, college of education, universities, universities, academies, other educational institutions, and related organizations and individuals (hereinafter referred to collectively as agencies and units).

1.1. These Circular provides guidance on map publication, printing, reproduction, and distribution activities.

1.2. These Circular applies to state agencies, political organizations, socio-political organizations, social organizations, socio-professional organizations, economic organizations, public service units, people's armed forces units, Vietnamese citizens (hereinafter collectively referred to as agencies, organizations, and individuals); international organizations, foreign organizations operating within the territory of Vietnam, and foreign individuals residing in Vietnam participating in map publication activities within the territory of Vietnam.

2. Explanation of terms

refers to the control and maintenance of the operation of technical equipment systems, security and safety services, environmental sanitation, risk management, and guidance on the use of apartment buildings for owners and users of apartment buildings.

2.1. Map publication product is a map product published in the form of individual sheets, map sets, maps in books, printed or reproduced on paper, plastic, fabric, magnetic tape, optical discs, or uploaded onto computer information networks using various technical means;

2.2. Administrative map is a type of map whose main content shows national borders, administrative boundaries, names of administrative units, and the central locations of administrative units;

2.3. Map with content related to borders and administrative boundaries is a type of map with content different from administrative maps but showing elements such as national borders, administrative boundaries, or one of these two elements to serve the representation of other contents on the map;

2.4. Geographic base of the map is a collection of hydrographic, transportation, population, national border, administrative boundary, place name, and topographic elements serving as a basis for representing other contents on the map;

2.5. Base map is a map consisting solely of geographic base elements.

3. State management responsibilities for map publication activities.

3.1. The Department of Surveying and Mapping under the Ministry of Natural Resources and Environment (hereinafter collectively referred to as the Department of Surveying and Mapping) is responsible for assisting the Minister of Natural Resources and Environment in coordinating with the Ministry of Culture, Sports and Tourism to manage state activities related to map publication nationwide.

3.2. Provincial Departments of Natural Resources and Environment are responsible for coordinating with Provincial Departments of Culture, Sports and Tourism to assist the Chairman of the People's Committee of provinces and centrally-administered cities in managing state activities related to map publication locally.

3.3. The Department of Publishing under the Ministry of Culture, Sports and Tourism (hereinafter collectively referred to as the Department of Publishing) and Provincial Departments of Culture, Sports and Tourism are responsible for organizing the reading of map publication products for preservation and handling violations according to laws on publishing; the Department of Surveying and Mapping is responsible for coordinating with the Department of Publishing, and Provincial Departments of Natural Resources and Environment are responsible for coordinating with Provincial Departments of Culture, Sports and Tourism to read map publication products for preservation and handling according to laws on publishing.

4. Publication of Various Types of Maps

4.1. The Ministry of Natural Resources and Environment establishes and publishes various types of maps for uniform use throughout the country including:

a) National topographic map system for mainland and maritime areas of Vietnam;

b) Base map system;

c) Administrative maps of the Socialist Republic of Vietnam and provincial administrative maps;

d) World, continental, regional, and country administrative maps;

đ) National land use status maps, regional maps;

e) National atlas, comprehensive national geographical atlases, regional atlases;

g) Geographic base of the national geographic information system.

4.2. Organizations, individuals, and other agencies may collaborate with publishers to publish map products not covered by point 4.b of this clause.

II. FIELD OF PUBLICATION AND DISTRIBUTION OF MAP PUBLICATION PRODUCTS

1. Agencies, organizations, and individuals wishing to publish maps must contact publishers with the appropriate mission and functions to carry out the publication.

2. When registering publication plans with the Department of Publishing according to Model No. 1 issued along with Decree No. 111/2005/NĐ-CP dated August 26, 2005 of the Government, publishers must clearly indicate the name and scale of the map in column 02 (name column) and must record the projection grid, coordinate system, height system, date of map creation, primary source materials used for map creation, material used for representation, and a summary of the main content of the map in column 12 (summary column).

3. For non-commercial map publication products, publishers must apply for a publication permit. The application for a publication permit includes:

3.1. Application for permission to publish;

3.2. Two complete drafts of the map product to be published, except for topographic maps, which must be hand-drawn or printed, with dimensions, layout, content, symbols, colors, and presentation format identical to the final publication product.

4. The map product to be published must meet technical and aesthetic requirements for content representation and ensure the following conditions:

4.1. In cases where the map product is a thematic or specialized map, it must be based on the geographic base derived from the national topographic map system, base map, administrative map, or geographic base of the national geographic information system established and published by the Ministry of Natural Resources and Environment;

4.2. In cases where the map product contains content related to the entire territory of Vietnam, it must be represented according to the layout of the latest administrative map of the Socialist Republic of Vietnam established and published by the Ministry of Natural Resources and Environment up to the time of applying for publication.

4.3. In case the map product is an administrative map or contains content related to borders, administrative boundaries at various levels, or territories, it must fully and accurately reflect all elements related to the territorial sovereignty, territorial waters of the Socialist Republic of Vietnam within the scope of administrative management of those territories.

4.4. In case the map product is an administrative map or contains content related to the borders, administrative boundaries of countries around the world, it must accurately reflect national borders, capital city names, and other major place names according to the latest world administrative maps, continental maps, and regional maps published by the Ministry of Natural Resources and Environment up to the time of application for publication.

5. Information recorded on map publications

On map publications, information as prescribed in Clause 2, Article 26 of the Law on Publishing must be recorded, along with the scale, projection grid, coordinate system, height system, date of map creation, and information about primary materials used to create the map.

6. Map publications that are legally issued and do not fall within the scope of state secrets may be exchanged or exported abroad without requiring permission from the competent state management agency for publishing activities. The publication and distribution of maps within the scope of state secrets shall be carried out in accordance with the laws on protecting state secrets.

III. IMPLEMENTATION

1. This Circular shall take effect fifteen days after its publication in the Official Gazette.

2. Ministries, ministerial-level agencies, agencies under the Government, People's Committees of provinces and centrally governed cities; agencies, organizations, and individuals involved in map publishing activities are responsible for implementing this Circular./.
