Supplementing Circular Joint No. 14/TTLB dated September 30, 1995 of the Joint Ministries of Health - Finance - Labor, Invalids and Social Affairs - Government Price Control Board on guiding the implementation of partial hospital fees collection

In anticipation of the issuance of new hospital fee policies by the Government; to ensure the rights of patients, healthcare facilities, and unified management, the Ministry of Health - Ministry of Finance - Ministry of Labor, Invalids and Social Affairs supplement certain contents of Circular Joint No. 14/TTLB dated September 30, 1995 of the Joint Ministries of Health - Finance - Labor, Invalids and Social Affairs - Government Price Control Board guiding the implementation of partial hospital fees collection as follows:

1. Issuing temporarily with this Circular a framework of partial hospital fees for some medical services arising from 1995 to date but not yet stipulated in the framework of partial hospital fees issued together with Circular Joint No. 14/TTLB dated September 30, 1995 of the Joint Ministries of Health - Finance - Labor, Invalids and Social Affairs - Government Price Control Board guiding the implementation of partial hospital fees collection.
2. The framework of partial hospital fees for these medical services does not include costs of various types of drugs, radioactive substances used in cancer diagnosis and treatment, special consumable materials, and replacement materials.
3. Based on the framework of partial hospital fees for medical services issued with this Circular and Circular Joint No. 14/TTLB dated September 30, 1995 of the Joint Ministries of Health - Finance - Labor, Invalids and Social Affairs - Government Price Control Board guiding the implementation of partial hospital fees collection; taking into account the economic and social conditions of the locality, the Chairman of the People's Committee of provinces and centrally-administered cities shall decide the level of partial hospital fees collection for healthcare facilities under their management; the Minister of Health shall decide the level of partial hospital fees collection for healthcare facilities directly under the Ministry of Health and other ministries and sectors.
4. The Ministry of Health shall be responsible for issuing a list of drug types, radioactive substances used in cancer diagnosis and treatment, consumable materials, and replacement materials, and guiding the implementation of charges for these drugs, radioactive substances, consumable materials, and replacement materials according to the purchase price of healthcare facilities and the actual quantity used by patients.
5. The level of partial hospital fees for each medical service at healthcare facilities decided by the competent authority and the actual costs of drugs, radioactive substances used in cancer diagnosis and treatment, replacement materials, and special consumable materials stipulated in Point 4 that patients have used during the diagnosis and treatment process (including both outpatient and inpatient treatments) serve as the basis for hospital fee settlement for patient groups, including those with health insurance cards.
6. The Social Insurance Agency shall be responsible for settling examination and treatment costs for individuals with health insurance cards according to Point 5 of this Circular and according to the provisions in Circular No. 21/2005/TTLT-BYT-BTC dated July 27, 2005 of the Joint Circular of the Ministries of Health and Finance guiding the implementation of mandatory health insurance and Circular Joint No. 22/2005/TTLT-BYT-BTC dated August 24, 2005 of the Joint Circular of the Ministries of Health and Finance guiding the implementation of voluntary health insurance.
The settlement of costs for high-tech medical services and large costs issued together with Decision No. 36/2005/QD-BYT dated October 31, 2005 of the Minister of Health includes: the prices of medical services already decided by the competent authority and the costs of various types of replacement materials and special consumable materials according to the provisions in Point 4 of this Circular.
This Circular takes effect 15 days after its publication in the Official Gazette. All previous regulations contrary to this Circular are abolished.
During implementation, if there are difficulties or obstacles, please report them to the joint ministries for consideration and resolution.
