THE MINISTER OF TRADE
Pursuant to the Agreement between the Ministry of Trade of the Socialist Republic of Vietnam and the Ministry of Trade of the Lao People's Democratic Republic on goods benefiting from preferential import tariff rates, signed on July 28, 2005;
Pursuant to the Agreement between the Ministry of Trade of the Socialist Republic of Vietnam and the Ministry of Industry and Trade of the Lao People's Democratic Republic on amending and supplementing the Agreement between the Ministry of Trade of the Socialist Republic of Vietnam and the Ministry of Trade of the Lao People's Democratic Republic on goods benefiting from preferential import tariff rates, signed on December 19, 2006;
Pursuant to Decree No. 29/2004/NĐ-CP dated January 16, 2004 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Trade;
Implementing the guidance of the Prime Minister in Document No. 4672/VPCP-QHQT dated August 19, 2005 approving the Agreement with the Lao Ministry of Trade on goods benefiting from preferential import tariff rates, Documents No. 1878/TTg-KTTH dated November 15, 2006 and No. 7238/VPCP-KTTH dated December 11, 2006 regarding the application of tariff quotas for goods imported from Laos in 2007.
At the proposal of the Director of the Import-Export Department,
DECISION:
Article 1. Apply tariff quotas for the year 2007 for three groups of goods imported from Laos enjoying a zero percent preferential import tariff rate, including: rice and paddy, tobacco leaves and stalks, motorcycle accessories. The commodity codes and total quantities of tariff quotas enjoying a zero percent preferential import tariff rate in 2007 for these groups of goods are set out in Appendix I attached to this Decision.
Article 2. Vietnamese traders importing goods specified in Article 1 of this Decision shall enjoy a zero percent preferential import tariff rate if they have a Certificate of Origin in Form S issued by the competent authority of the Lao People's Democratic Republic. For tobacco leaves and stalks, only traders holding import licenses for tobacco raw materials under tariff quotas issued by the Ministry of Trade in accordance with Circular No. 04/2006/TT-BTM dated April 6, 2006 of the Ministry of Trade are permitted to import (the quantity imported will be deducted from the import license for tobacco raw materials issued by the Ministry of Trade).
Article 3. Goods imported as specified in Article 1 of this Decision shall be cleared through border gates specified in Appendix II attached to this Decision. Procedures for importing goods within tariff quotas enjoying a zero percent preferential import tariff rate shall be handled at the customs office where the import procedures are carried out according to the principle of automatic backward deduction (i.e., the total quantity of goods imported enjoying preferential import tariffs shall be deducted from the quantity of each type of goods with a Certificate of Origin in Form S - C/O form S).
Article 4. This Decision shall take effect 15 days after its publication in the Official Gazette and shall remain in force until December 31, 2007.
