Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;
Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; and Decree No. 75/2009/NĐ-CP dated September 10, 2009 of the Government amending Article 3 of Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Considering the proposal of the Minister of Agriculture and Rural Development,
DECISION:
Article 1. Position and Functions
1. The Water Resources General Department is an agency under the Ministry of Agriculture and Rural Development, performing the function of advising and assisting the Minister of Agriculture and Rural Development in state management and implementing state management tasks related to water resources; managing and directing public service activities within the scope of management of the General Department.
2. The Water Resources General Department has legal personality, a seal with the National Emblem, a separate account, operational funds provided by the state budget, and its headquarters is located in Hanoi City.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Submit to the Minister of Agriculture and Rural Development for issuance within his/her authority or for the Minister of Agriculture and Rural Development to submit to the competent state agency:
a) Draft laws, draft resolutions of the National Assembly; draft ordinances, draft resolutions of the Standing Committee of the National Assembly; draft decrees of the Government, draft decisions of the Prime Minister regarding water resources;
b) Strategies, plans, long-term, five-year, annual plans, programs, projects, proposals, and important national works on water resources;
c) National technical standards, professional procedures, technical regulations, and economic-technical norms specific to water resources.
2. Submit to the Minister of Agriculture and Rural Development for the national standard proposal to be reviewed and announced by the competent authority.
3. Organize the dissemination, popularization, and education on laws related to water resources.
4. Implement regulatory documents, strategies, plans, programs, projects, and proposals on water resources after approval or issuance.
5. Issue professional guidance documents, internal regulatory documents, and individual documents within the scope of management of the General Department; review and announce industry-based standards.
6. Approve basic investigation projects, planning projects, and adjustments to planning for water resource regions, inter-provincial areas, and systems of agricultural water resource facilities serving multiple purposes associated with various sectors of the economy and society.
7. Regarding the exploitation, utilization, and protection of water resource facilities, drainage, and rural clean water supply:
a) Submit to the Minister of Agriculture and Rural Development for the operation procedures for regulating water in reservoirs under the state management of the Ministry;
b) Submit to the Minister of Agriculture and Rural Development for the safety assurance plan for reservoirs; implement comprehensive, economical, safe, and effective water usage from water resource facilities; resolve disputes arising according to the law;
c) Issue, revoke, and extend permits for activities requiring permission within the protected area of water resource facilities and discharging wastewater into the water resource system according to the law;
d) Direct the preparation of plans for construction, management, exploitation, utilization, and protection of rural drainage and water supply facilities.
8. Submit to the Minister of Agriculture and Rural Development for decision-making within his/her authority on investment, construction, repair, upgrading, and maintenance of water resource facilities, dike consolidation, drainage, clean water supply, and rural environmental sanitation. Manage and organize the implementation of projects according to the classification of the Minister of Agriculture and Rural Development and the provisions of the law.
9. Regarding work to prevent and mitigate damage caused by water:
a) Submit to the Minister of Agriculture and Rural Development for measures to mobilize resources, materials, and equipment to prevent, combat, and mitigate drought, flooding, saline intrusion, landslides, and water pollution in the water resource system; handle accidents at water resource facilities;
b) Organize, direct, guide, and inspect the implementation of prevention, mitigation, and handling of drought, flooding, saline intrusion, and accidents at water resource facilities to ensure production, mitigate the consequences of flooding and drought, saline intrusion, and reduce water pollution in the water resource system.
10. Regarding dike and flood control work:
a) Submit to the Minister of Agriculture and Rural Development for submission to the competent authority for approval of the flood prevention planning and adjustment of such planning for river sections with dikes nationwide; approve planning and adjustment of dike planning for regions, provinces, and the whole country;
b) Submit to the Minister of Agriculture and Rural Development for public announcement of flood prevention planning and adjustment of such planning for river sections with dikes nationwide; approve planning and adjustment of dike planning submitted by ministries, ministerial-level agencies, and provincial People's Committees;
c) Guide the procedures and formalities for planning and adjusting dike planning;
d) Submit to the Minister of Agriculture and Rural Development for decision-making on approving permits for activities concerning special-grade, grade I, grade II, and grade III dikes and construction, improvement of transportation works related to dikes affecting two or more provinces or cities according to the law;
đ) Specify permissible load limits and permit issuance for motor vehicles traveling on dikes; guide the issuance, revocation, and extension of permits for certain activities related to dikes according to the law.
11. Regarding disaster prevention, mitigation, and reduction work:
a) Implement the Disaster Prevention, Mitigation, and Reduction Strategy according to the law and propose necessary adjustments;
b) Submit to the Minister of Agriculture and Rural Development for decision-making within his/her authority or for submission to the competent authority for decision-making on mobilizing forces, materials, and equipment to protect dikes and mitigate the consequences of floods, typhoons, and storms affecting dikes.
c) Monitor and update information on rain, typhoons, floods, thunderstorms, tornadoes, earthquakes, tsunamis nationwide; coordinate with relevant sectors, organizations, and localities to promptly propose solutions to the Central Steering Committee for Flood and Storm Control regarding handling emergencies of water conservancy works and addressing situations caused by the aforementioned natural disasters.
d) Direct, guide, and inspect the implementation of regulations concerning emergency situations requiring flood diversion, delayed flooding, evacuation measures, ensuring production and livelihoods of the people, mitigating flood aftermaths, providing relief to the people; preventive and mitigation measures against natural disasters.
đ) Implement tasks related to flood and storm prevention, reduction of natural disaster impacts according to the classification by the Minister of Agriculture and Rural Development and the requirements of the Central Steering Committee for Flood and Storm Control.
12. Organize and direct statistical work and manage databases in the field of water conservancy as prescribed.
13. Organize scientific research, application of scientific and technological progress in the field of water conservancy and agricultural extension activities in this field according to the classification by the Minister of Agriculture and Rural Development.
14. Carry out international cooperation in water conservancy according to the classification by the Minister of Agriculture and Rural Development and as stipulated by law.
15. Implement administrative reform in the field of water conservancy according to the Ministry of Agriculture and Rural Development's administrative reform plan.
16. Manage organizational structure and staffing; implement salary systems and incentive policies, commendation and reward, disciplinary measures; provide professional training for civil servants and employees under the General Department; practice thrift, prevent waste, and combat corruption within the General Department; participate in training and professional development for civil servants and employees under the General Department's management according to law and the classification by the Minister of Agriculture and Rural Development.
17. Guide and inspect the activities of associations and non-governmental organizations in the field of water conservancy according to the classification by the Minister of Agriculture and Rural Development and as stipulated by law.
18. Inspect, investigate, resolve complaints and denunciations, and handle violations in the field of water conservancy.
19. Manage financial resources and assets assigned, funds, and international financial sources supporting the water conservancy sector as prescribed.
20. Perform national standing tasks for flood and storm prevention and control; Office of the National Target Program on Clean Water Supply and Environmental Sanitation in Rural Areas; Climate Change Office; PIM Vietnam Office; Office of the Standing Steering Committee for Boundary Delimitation and Marker Planting according to the law.
21. Perform other tasks assigned by the Minister of Agriculture and Rural Development or as stipulated by law.
Article 3. Organizational Structure
1. Planning and Finance Department;
2. Science, Technology, and International Cooperation Department;
3. Construction Management Department;
4. Water Resources and Rural Water Supply Management Department;
5. Water Conservancy Works Management Department;
6. Dike Management and Flood and Storm Prevention and Control Bureau;
7. General Department Office (with representation in Ho Chi Minh City);
8. General Department Inspectorate;
9. Institute of Water Resources Planning;
10. Southern Institute of Water Resources Planning;
11. Center for Consulting and Transfer of Water Conservancy Technology;
12. Center for Disaster Prevention and Mitigation.
In this Article, organizations from Clause 1 to Clause 8 assist the General Department Director in performing state management functions; organizations from Clause 9 to Clause 12 are subordinate public service units of the General Department.
Article 4. Leadership of the General Department
1. The General Department of Water Resources has a Director-General and not more than three Deputy Director-Generals.
2. The General Department Director of the Water Conservancy General Department shall concurrently hold the position of Deputy Minister of Agriculture and Rural Development, responsible to the Minister of Agriculture and Rural Development and the law for all activities of the General Department.
The General Department Director of the Water Conservancy General Department shall define the functions, tasks, authorities, and organizational structure of subordinate agencies and units; promulgate the General Department's operational regulations; appoint, dismiss, and remove leaders and managers under the General Department according to the law and the personnel management classification by the Minister of Agriculture and Rural Development.
3. Deputy General Department Directors shall be appointed, dismissed, or removed by the Minister of Agriculture and Rural Development based on the General Department Director's proposal; they are responsible to the General Department Director and the law for their assigned areas of work.
Article 5. Effectiveness and Responsibility for Implementation
1. This Decision takes effect from March 15, 2010.
2. The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairmen of Provincial People's Committees directly under the Central Government, and the General Department Director of the Water Conservancy General Department are responsible for implementing this Decision./.
