Provisions on the issuance, distribution, management, and use of community access cards for personnel participating in interventions to reduce harm in HIV prevention measures
pursuant to Resolution No. 64/2006/QH11 dated June 29, 2006 on prevention and control of infection with human immunodeficiency virus (HIV) and acquired immune deficiency syndrome (AIDS)

Pursuant to the Law number 64/2006/QH11 dated June 29, 2006 on HIV/AIDS;Pursuant to Decree No. 108/2007/NĐ-CP dated June 26, 2007 detailing and guiding the implementation of certain provisions of the Law on Prevention and Control of Infection with Human Immunodeficiency Virus (HIV) and Acquired Immune Deficiency Syndrome (AIDS) STANDARDS FOR PERSONS ELIGIBLE FOR COMMUNITY ACCESS CARD AND THE DESIGN OF THE COMMUNITY ACCESS CARD
Pursuant to Decree No. 188/2007/NĐ-CP dated December 27, 2007 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health
The Ministry of Health and the Ministry of Public Security hereby prescribe the criteria for individuals eligible to be issued community access cards, the card model, procedures for issuance, distribution, management, and use of community access cards for personnel participating in interventions to reduce harm in HIV prevention measures (hereinafter referred to as community access personnel) as follows:
Pursuant to Decree No. 77/2009/NĐ-CP dated September 15, 2009 stipulating the Functions, Tasks, Authorities, and Organizational Structure of the Ministry of Public Security;
STANDARDS FOR INDIVIDUALS ELIGIBLE TO BE ISSUED COMMUNITY ACCESS CARDS AND THE MODEL OF COMMUNITY ACCESS CARDS

COMMUNITY AND EMPLOYEE ACCESS BADGE TEMPLATE
Article 1. Criteria for Individuals Eligible to Be Issued Community Access Cards
1. They must be Vietnamese citizens aged 18 years or older, having full civil capacity, and voluntarily working as community access personnel.
2. They must not be under investigation for criminal responsibility, nor serving a criminal sentence or administrative sanction decision involving placement in an educational facility, medical facility, or community-based education program.
Article 2. Form, Material, and Color of Community Access Cards
1. The material of the community access card (hereinafter referred to as the Card): Couche paper with a weight of 230 g/m² and laminated with plastic.2 and laminate plastic.
2. The size of the Card: length 10 cm, width 6.5 cm.
3. The color of the Card: white background; the text "COMMUNITY ACCESS CARD" and the symbol of the HIV/AIDS Prevention and Control Program on the front side of the Card in red; all other text on the Card in black.
Article 3. Content of the Card
1. The front side of the Card includes the following information:
a) On the left, from top to bottom:
- Symbol of the HIV/AIDS Prevention and Control Program;
- A photograph measuring 2cm x 3cm of the community access personnel affixed with the stamp of the issuing unit;
- Card number;
- Validity period of the Card.
b) On the right, from top to bottom:
- Name of the issuing unit;
- Text "COMMUNITY ACCESS CARD" in uppercase letters;
- Full name; gender;
- Date of birth;
- Scope of duties;
- Permitted operational area;
- Date of issuance of the Card;
- Signature, full name of the head of the issuing unit, and the stamp of the issuing unit.
2. The back side of the Card includes regulations on the use of the Card, specifically as follows:
a) The Card may only be used when participating in interventions to reduce harm in HIV prevention measures within the assigned area according to the provisions of the law;
b) Altering, repairing, or lending the Card to others is prohibited;
c) When the Card is lost, damaged, or has expired, it must be reported immediately to the head of the program or project to request a replacement Card.
3. The Card model is specified in Model No. 01 attached hereto.
Chapter II
ISSUE AND RECALL OF CARDS
Article 4. Application File for Issuing Cards
1. Application file for initial issuance of Cards:
a) Application form for Card issuance with a 4cm x 6cm photo attached (as prescribed in Model No. 02 attached hereto);
b) Two photographs measuring 2cm x 3cm of the individual applying to work as community access personnel;
c) Certificate of personal information of the individual applying to work as community access personnel (as prescribed in Model No. 04 attached hereto);
d) List of selected community access personnel with confirmation by the head of the program or project;
đ) Official letter requesting issuance of Cards for selected community access personnel from the head of the program or project.
2. Application file for reissuance of Cards:
a) Application form for reissuance of Card with a 4cm x 6cm photo attached, specifying the reason for reissuance (as prescribed in Model No. 03 attached hereto);
b) Two photographs measuring 2cm x 3cm of the community access personnel requesting reissuance of the Card;
c) List of community access personnel requesting reissuance of the Card with confirmation by the head of the program or project;
d) Official letter requesting reissuance of Cards for community access personnel from the head of the program or project.
Article 5. Competence and Procedure for Issuing Cards
1. Competence to Issue Cards:
The Director of the Center for HIV/AIDS Prevention and Control or the provincial agency responsible for HIV/AIDS prevention and control (hereinafter referred to as the Center for HIV/AIDS Prevention and Control) has the authority to issue Cards to community outreach staff within the province's jurisdiction.
2. Procedure for Initial Card Issuance:
a) Individuals wishing to become community outreach staff voluntarily submit an application for a Card to the head of the program or project.
b) The head of the program or project compiles a list of individuals who have registered to be community outreach staff and sends this list along with their voluntary applications to the Police Station of the commune, ward, town (hereinafter referred to as the Commune Police Station) where they are registered as permanent or temporary residents, requesting confirmation of their personal information.
c) Within seven working days from the date of receiving the application for a Card and the list of individuals who have registered to be community outreach staff submitted by the head of the program or project, the Commune Police Station reviews and confirms the place of permanent or temporary residence as well as other contents stipulated in Article 1 of this Joint Circular (in accordance with Model No. 04 issued together with this Joint Circular). In case of non-confirmation, a written response must be provided with clear reasons stated.
d) After receiving the personal information confirmation letter from the Commune Police Station, the head of the program or project completes the application dossier for a Card and submits it to the Center for HIV/AIDS Prevention and Control.
e) Within ten working days from the date of receiving complete and valid application dossiers, the Director of the Center for HIV/AIDS Prevention and Control must issue a decision to grant Cards to selected community outreach staff (in accordance with Model No. 05 issued together with this Joint Circular). In case of non-granting, a written response must be provided with clear reasons stated for each individual case.
3. Procedure for Reissuing Cards:
a) Within five working days from the date the Card is lost or damaged, and within one month before the expiration of the Card's validity period, community outreach staff must submit an application for reissuance of the Card to the head of the program or project.
b) The head of the program or project is responsible for completing the application dossier for reissuance of the Card and submitting it to the Center for HIV/AIDS Prevention and Control.
c) Within five working days from the date of receiving complete and valid application dossiers, the Director of the Center for HIV/AIDS Prevention and Control must issue a decision to reissue Cards to community outreach staff (in accordance with Model No. 05 issued together with this Joint Circular). In case of non-reissuance, a written response must be provided with clear reasons stated for each individual case.
Article 6. Validity Period of the Card
The validity period of the Card corresponds to the duration of operation of each program or project but shall not exceed five years per issuance, starting from the date of issuing the Card.
Article 7. Situations for Revoking the Card, Competence and Procedure for Revocation
1. The Card will be revoked in the following situations:
a) Community outreach staff violate prohibited acts stipulated in Clause 3, Article 9 of this Joint Circular;
b) The Card expires or the program or project ends its operational period;
c) The holder of the Card no longer participates in the program or project.
2. Competence to Revoke the Card:
The Director of the Center for HIV/AIDS Prevention and Control has the authority to revoke Cards issued to community outreach staff within the province's jurisdiction.
3. Procedure for Revocation of the Card:
a) When discovering situations requiring revocation of the Card as stipulated in Clause 1 of this Article, the head of the program or project, the police agency, People's Committees at all levels, and the Health Station of the commune, ward, town (hereinafter referred to as the Commune Health Station) must temporarily hold the Card. Temporary holding of the Card must be recorded in a record (in accordance with Model No. 07 issued together with this Joint Circular). If discovering that community outreach staff violate prohibited acts stipulated in Clause 3, Article 9 of this Joint Circular, a violation record of the law on Card usage must be compiled before temporarily holding the Card (in accordance with Model No. 06 issued together with this Joint Circular).
b) Within three working days from the date of temporarily holding the Card, the head of the program or project, the police agency, People's Committees at all levels, and the Commune Health Station must send the Card and the violation record of the law on Card usage (if any) to the Center for HIV/AIDS Prevention and Control for review and decision on revocation of the Card.
c) Within five working days from the date of receiving the temporarily held Card and the violation record of the law on Card usage (if any) sent by the agencies specified in point b, Clause 3 of this Article, the Director of the Center for HIV/AIDS Prevention and Control must issue a decision to revoke the Card (in accordance with Model No. 08 issued together with this Joint Circular). In case of non-revocation, a written response must be provided with clear reasons stated for each individual case.
For cases where the Center for HIV/AIDS Prevention and Control discovers situations requiring revocation of the Card itself, the Director of the Center for HIV/AIDS Prevention and Control issues a decision to revoke the Card immediately without having to go through the temporary holding procedure. If the Center for HIV/AIDS Prevention and Control discovers that community outreach staff violate prohibited acts stipulated in Clause 3, Article 9 of this Joint Circular, a violation record of the law on Card usage must be compiled before issuing the decision to revoke the Card.
d) Within three working days from the date of issuing the decision to revoke the Card, the Center for HIV/AIDS Prevention and Control must send the decision to revoke the Card to the program or project where the community outreach staff is operating and the agencies specified in point d, Clause 2 of Article 8 of this Joint Circular.
Chapter III
MANAGEMENT AND USE OF CARDS
Article 8. Management of Cards
1. The head of the program/project and the person directly responsible for community outreach staff shall be responsible for inspecting and supervising the use of Cards in accordance with Article 11 of Decree No. 108/2007/NĐ-CP dated June 26, 2007 detailing certain provisions of the Law on Prevention and Control of Viral Infections Causing Acquired Immunodeficiency Syndrome (AIDS) and this Joint Circular.
2. The AIDS Prevention and Control Center shall be responsible for:
a) Managing applications for initial issuance and reissuance of Cards;
b) Issuing, distributing, recalling, and canceling Cards;
c) Inspecting and supervising the use of Cards;
d) Notifying the Public Security Office at the district level, People's Committee, Health Station, and Public Security Office at the commune level where the program/project operates about the list of individuals who have been issued Cards, had their Cards recalled, or no longer meet the conditions to continue using Cards but whose Cards have not yet been recalled, to facilitate coordination in management, detection, and handling of violations.
3. The Public Security Agency shall be responsible for coordinating with the health agency at the same level to create favorable conditions and provide support to community outreach staff in implementing harm reduction interventions in HIV prevention and conducting inspections and supervision in accordance with Article 11 of Decree No. 108/2007/NĐ-CP dated June 26, 2007 detailing certain provisions of the Law on Prevention and Control of Viral Infections Causing Acquired Immunodeficiency Syndrome (AIDS) and this Joint Circular.
Article 9. Use of Cards
1. Cards may only be used when community outreach staff directly participate in implementing harm reduction interventions in HIV prevention within the assigned area in the program/project.
2. Community outreach staff shall be responsible for preserving Cards, preventing loss or damage to Cards; they must submit a written report to the head of the program/project where they work if the Card is lost, torn, or damaged.
3. Strictly prohibited are the following actions:
a) Lending Cards to others or borrowing Cards from others;
b) Erasing, altering, or forging Cards;
c) Using Cards for purposes other than intended or to commit illegal acts.
Chapter IV
IMPLEMENTATION
Article 10. Responsibility for Implementation
1. The Ministry of Health and the Ministry of Public Security, within their respective functions and duties, shall be responsible for disseminating, guiding, inspecting, and urging the implementation of this Joint Circular in agencies and units under their jurisdiction. Annually, the Ministry of Health shall take the lead and coordinate with the Ministry of Public Security to organize summaries to evaluate the results of cooperation in implementing this Joint Circular.
2. Provincial People's Committees and municipal people's committees directly under the central government shall be responsible for directing the Department of Health to coordinate with the Public Security agency at the same level and relevant agencies to implement this Joint Circular locally.
3. Annually, the Department of Health shall take the lead and coordinate with the Public Security agency at the same level to organize summaries and evaluations of the issuance, distribution, management, and use of Cards, activities of community outreach staff, and report the results to the inter-ministerial body.
Article 11. Effective Date
This Joint Circular shall take effect from April 1, 2010.
During implementation, if difficulties or obstacles arise, units and localities are requested to reflect them to the Ministry of Health and the Ministry of Public Security for timely guidance.
