CIRCULAR

Guidelines for Implementing Salary and Allowance Systems for Workers and Civil Servants Constructing the Lai Chau and Dong Nai 5 Hydropower Projects

Pursuant to Decree No. 205/2004/NĐ-CP dated December 14, 2004 of the Government stipulating the wage scale and wage system and the allowance regime in state-owned enterprises;

Pursuant to Decree No. 186/2007/NĐ-CP dated February 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

To implement the Prime Minister's opinion expressed in Document No. 9410/VPCP-KTTH dated December 28, 2010 of the Government Office, after receiving opinions from relevant ministries and sectors, the Ministry of Labor, Invalids, and Social Affairs hereby issues guidelines for implementing salary and allowance systems for workers and civil servants directly involved in constructing the Lai Chau hydropower project and the Dong Nai 5 hydropower project as follows:

Article 1. Scope of Regulation

This Circular guides the implementation of salary, allowance, non-stable production coefficient, and midday meal system for workers and civil servants directly participating in the construction of the Lai Chau hydropower project and the Dong Nai 5 hydropower project.

Article 2. Applicability

1. Workers and civil servants directly participating in the construction of the projects.

2. Workers and civil servants under the Project Management Board directly working at the projects.

3. Surveyors, consultants, and designers directly working at the projects.

Article 3. Salary and Allowance System

1. The minimum wage level shall be applied according to the general minimum wage level prescribed by the Government corresponding to each period.

2. The job grade wage shall be calculated based on the wage scale specified in the wage scale and table issued together with Decree No. 205/2004/NĐ-CP dated December 14, 2004 of the Government stipulating the wage scale and allowance system in state-owned companies corresponding to the job grade of each specific job according to the construction project quota of the Ministry of Construction.

3. Allowance System

a) Regional Allowance: If the construction project or its component lies within the territory (district, commune) of a certain area, then the regional allowance rate prescribed for that area shall be applied according to Circular Jointly Issued No. 11/2005/TTLT-BNV-BLDTBXH-BTC dated January 5, 2005 of the Ministry of Home Affairs - Ministry of Labor, Invalids, and Social Affairs - Ministry of Finance - Committee for Ethnic Minorities guiding the implementation of the regional allowance system.

b) Attraction Allowance: For the Lai Chau hydropower project, it shall be applied at a rate of 50% of the job grade wage, position wage, or specialized wage, and for the Dong Nai 5 hydropower project, it shall be applied at a rate of 30% of the job grade wage, position wage, or specialized wage. The calculation method for attraction allowance shall be implemented according to Circular Jointly Issued No. 10/2005/TTLT-BNV-BLDTBXH-BTC dated January 5, 2005 of the Ministry of Home Affairs - Ministry of Labor, Invalids, and Social Affairs - Ministry of Finance guiding the implementation of the attraction allowance system.

c) Mobility Allowance: It shall be applied at a rate of 0.4 times the general minimum wage level prescribed by the Government corresponding to each period and shall be implemented according to Circular No. 05/2005/TT-BLDTBXH dated January 5, 2005 of the Ministry of Labor, Invalids, and Social Affairs guiding the implementation of the mobility allowance system.

Article 4. Non-Stable Production Coefficient

The non-stable production coefficient shall be applied at a rate of 15% of the job grade wage, position wage, or specialized wage.

Article 5. Midday meal system

The midday meal system shall be applied at a rate of 15,000 VND/person/day and implemented in accordance with the provisions set out in Clause 1, Section IV of Circular No. 22/2008/TT-BLDTBXH dated October 15, 2008 of the Ministry of Labor, Invalids, and Social Affairs guiding the implementation of the midday meal system in state-owned enterprises. The cost of midday meals shall be budgeted separately in the construction project budget.

Article 6. Sources of funding for implementation

1. The sources of funds for implementing the systems prescribed in Articles 3, 4, and 5 of this Circular are as follows:

a) For workers and staff directly involved in constructing projects, such costs shall be included in the construction project costs.

b) For workers and staff under the Project Management Board, such costs shall be included in the project management costs.

c) For workers and staff directly providing consultancy, surveying, and statistical services for projects, such costs shall be included in the consultancy investment construction project costs.

2. Additional funds required to implement the systems prescribed in this Circular shall be sourced from the contingency reserve within the total investment ceiling of the construction project; if the total investment exceeds the approved ceiling, the investor shall submit to the competent authority for review and adjustment of the total investment in accordance with current regulations on construction project investment cost management.

Article 7. Implementation Organization

1. The investor shall be responsible for:

a) Determining project costs in the budget in accordance with this Circular and other guiding documents on the preparation and management of investment project costs currently in effect.

b) Provisionally paying and settling accounts with construction contractors in accordance with the regulations.

2. Construction contractors shall be responsible for:

Organizing timely and full payment to workers in accordance with their unit's regulations, linked to labor productivity, workload, work quality, and construction progress.

Article 7. Effective Date

1. This Circular takes effect from March 20, 2011.

2. The systems prescribed in this Circular shall apply to the entire volume of projects. During implementation, any difficulties should be reported to the Ministry of Labor, Invalids, and Social Affairs for prompt supplementary guidance./.
