Guidance on adjusting the monthly subsidy level from July 1, 2013 for village cadres who have retired according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers.

Pursuant to Clause 2, Article 4 of Decree No. 73/2013/NĐ-CP dated July 15, 2013 of the Government adjusting pensions, social insurance subsidies, and monthly subsidies for village cadres who have retired.

The Minister of Interior and the Minister of Finance issue this Joint Circular guiding the implementation of the adjustment of the monthly subsidy level from July 1, 2013 for village cadres who have retired according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers,

Pursuant to Decree No. 61/2012/NĐ-CP dated August 10, 2012, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

The subjects to which this Joint Circular applies are village cadres who have retired and are receiving monthly subsidies according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers (hereinafter referred to as retired elderly village cadres).

From July 1, 2013, adjust the monthly subsidy level for retired elderly village cadres according to the provisions of Article 2 of Decree No. 73/2013/NĐ-CP dated July 15, 2013 of the Government adjusting pensions, social insurance subsidies, and monthly subsidies for village cadres who have retired (hereinafter referred to as Decree No. 73/2013/NĐ-CP), increasing the monthly subsidy by 9.6% over the monthly subsidy amount received in June 2013, specifically as follows:

Article 1. Scope of application

1. Formula for adjusting the monthly subsidy level from July 1, 2013:

Article 2. Adjustment of Monthly Allowance

The monthly subsidy amount received in June 2013

a) For cadres who were originally Secretaries of the Party Committee, Chairmen of the People's Committee of the commune: VND 1,452,000/month.

b) For cadres who were originally Deputy Secretaries, Deputy Chairmen, Permanent Members of the Party Committee, Secretaries of the People's Committee, Secretaries of the People's Council, Commune Militia Battalion Leaders, Chiefs of Public Security Stations: VND 1,400,000/month.

c) For other positions: VND 1,285,000/month.

1. Provincial People's Committees guide and implement the payment of monthly subsidies from July 1, 2013 according to the guidance provided in this Joint Circular for the subjects under their management.

3. Retired elderly village cadres who move to a new legal place of residence within the same district must have a subsidy transfer certificate issued by the People's Committee of the commune; within the same province, a subsidy transfer certificate issued by the Department of Interior of the district; outside the province, a subsidy transfer certificate issued by the Department of Interior; the subsidy transfer certificate must be accompanied by the file and decision at the time of retirement (in case of loss, there must be a confirmation letter from the competent authority at the same level). The office at the place of transfer will continue to pay the transferred cadre. Retired elderly village cadres who moved to a new legal place of residence before the effective date of Decree No. 73/2013/NĐ-CP shall continue to be paid by the current paying entity.

Article 3. Implementation

1. This Joint Circular takes effect from September 15, 2013.

2. The source of funds for adjusting the monthly allowance for retired elderly village cadres shall be implemented according to the guidance of the Ministry of Finance.

2. The regulations stipulated in this Joint Circular shall be implemented from July 1, 2013.

Article 4. Effective date

Repeal Joint Circular No. 02/2012/TTLT-BNV-BTC dated May 16, 2012 of the Ministry of Interior and the Ministry of Finance guiding the implementation of the adjustment of the monthly subsidy level from May 1, 2012 for village cadres who have retired according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers, Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers.

During the implementation process, if there are any difficulties, please report to the Ministry of Interior for coordination with the Ministry of Finance to study and resolve them./.

3. Repeal Circular Joint Circular No. 02/2012/TTLT-BNV-BTC dated May 16, 2012, issued by the Ministry of Home Affairs and the Ministry of Finance, guiding the implementation of monthly subsistence allowance adjustments from May 1, 2012, for village cadres who have retired under Decision No. 130-CP dated June 20, 1975 of the Council of Ministers, and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers.

In the course of implementation, if there are any difficulties, it is requested that ministries, sectors, and localities report to the Ministry of Home Affairs for coordination with the Ministry of Finance to study and resolve them./.
