Provisions on test flights, calibration of navigation systems and equipment, monitoring,

and evaluation flights using equipment methods,

in the field of civil aviation,g

Pursuant to the Civil Aviation Law of Vietnam dated June 29, 2006;

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Decree No. 94/2007/NĐ-CP dated May 4, 2007 of the Government on management of flight activities;

PURSUANT TO THE PROPOSAL OF THE HEAD OF THE SCIENCE AND TECHNOLOGY DEPARTMENT AND THE DIRECTOR OF THE VIETNAM CIVIL AVIATION ADMINISTRATION,

The Minister of Transport issues this Circular providing for test flights, calibration of navigation systems and equipment, monitoring, and evaluation flights using equipment methods in the field of civil aviation.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular stipulates on:

a) Test flights, calibration of navigation systems and equipment, monitoring;

b) Evaluation flights using equipment methods;

c) Organizations providing test flight services, calibration of navigation systems and equipment, monitoring;

d) Organizations providing test flight services, calibration of navigation systems and equipment, and evaluation flights using equipment methods.

2. This Circular applies to organizations and individuals in Vietnam and foreign organizations and individuals related to test flights and calibration of navigation systems and equipment, monitoring; and evaluation flights using equipment methods.

Article 2. Abbreviations

In this Circular, the abbreviations shall be understood as follows:

1. ADS-B (Automatic Dependent Surveillance - Broadcasting): Automatic surveillance - broadcasting mode.

2. AIP (Aeronautical Information Publication): Aeronautical information publication.

3. DME: (Distance Measuring Equipment): Radio distance measuring equipment.

4. FMS (Flight Management System): On-board flight management system.

5. FVP (Flight Validation Pilot): Pilot conducting evaluation flights using equipment methods.

6. GBAS (Ground Based Augmentation System): Ground-based augmentation system for satellite navigation signal accuracy.

7. GNSS (Global Navigation Satellite System): Global satellite navigation system.

8. GP (Glide Path): Glide slope beacon of the instrument landing system.

9. ICAO (International Civil Aviation Organization): International Civil Aviation Organization.

10. IFP (Instrument Flight Procedure): Instrument flight procedure.

11. ILS (Instrument Landing System): Instrument landing system.

12. LOC (Localizer): Localizer beacon of the instrument landing system.

13. MM (Middle Marker): Middle marker beacon of the instrument landing system.

14. NDB (Non Directional Radio Beacon): Non-directional radio beacon.

15. NOTAM (Notice To Airmen): Notice to airmen.

16. OM (Outer Marker): Outer marker beacon of the instrument landing system.

17. PAPI (Precision Approach Path Indicator): Precision approach path indicator system.

18. PBN (Performance Based Navigation): Performance-based navigation.

19. PSR (Primary Surveillance Radar): Primary surveillance radar.

20. RNAV (Area Navigation): Area navigation.

21. RNP (Required Navigation Performance): Required navigation performance.

22. SID (Standard Instrument Departure): Standard instrument departure procedure.

23. SSR (Secondary Surveillance Radar): Secondary surveillance radar.

24. UTC (Universal Time Coordination): Coordinated universal time.

25. VFR (Visual Flight Rule): Visual flight rules.

26. VHF AM (Very High Frequency - Amplitude Modulation): Very high frequency amplitude modulation.

27. WGS-84 (World Geodetic System): World geodetic system.

28. VOR (Very High Frequency Omnidirectional Radio Range): Very high frequency omnidirectional radio range beacon.

Article 3. Explanation of Terms

In this Circular, the English and Vietnamese terms shall be understood as follows:

1. Autopilot: Onboard automatic pilot system.

2. Flight Ability: Airworthiness.

3. Flight Inspection Aircraft: Flight inspection aircraft.

4. Flight Inspector: Flight inspector.

5. Flight Testing, Inspection: Flight testing and inspection.

6. Flight Simulator: Flight simulator.

7. Flight Validation: Flight validation.

8. Mode A (Mode A): Activates the transponder to respond for aircraft identification and surveillance.

9. Mode C (Mode C): Activates the transponder to respond with altitude pressure data for surveillance.

10. Mode S (Mode S): For selective communication and surveillance data exchange with individual Mode S transponders. Only the transponder with the address specified in the interrogation signal is activated to respond.

11. Position reference system: Position reference system.

12. Antenna gain: Is the ratio of the strength of the antenna's radiation in a specific direction compared to its uniform radiation in all directions. When an antenna receives or transmits signals, it focuses them in a particular direction or side, thereby narrowing the coverage area and enhancing the signal in a narrow region, which is called gain.

Chapter II

TEST FLIGHTS, CALIBRATION OF NAVIGATION SYSTEMS AND EQUIPMENT, MONITORING

 

Section 1

GENERAL PROVISIONS ON TEST FLIGHTS, CALIBRATION OF NAVIGATION SYSTEMS AND EQUIPMENT,

MONITORING

 

Article 4. Purpose of flight inspection, calibration of navigation systems and equipment, surveillance

Flight inspection and calibration shall be conducted in the air by flight inspection and calibration pilots and flight inspection and calibration crew members using aircraft equipped appropriately for the purpose of inspecting and calibrating ground-based navigation systems and equipment, and monitoring and evaluating the quality of satellite-based radio navigation systems.

Article 5. Navigation systems and equipment required to undergo regular flight inspection and calibration

Navigation systems and equipment required to undergo regular flight inspection and calibration include:

1. VOR station;

2. NDB station;

3. GP station;

4. LOC station;

5. MM station;

6. OM station;

7. DME equipment;

8. Auxiliary lighting system for aviation navigation;

9. PAPI system;

10. GBAS system.

Article 6. Navigation systems and equipment, surveillance systems required to undergo acceptance flight inspection and calibration

1. All navigation systems and equipment specified in Article 5 of this Circular and PSR, SSR used in Vietnam's civil aviation sector must undergo acceptance flight inspection and calibration when put into operation.

2. Navigation systems and equipment, surveillance systems that have undergone major repairs or antenna changes, power adjustments, frequency changes, or have been out of service for more than three months must undergo re-acceptance flight inspection and calibration.

Article 7. Organization providing flight inspection and calibration services for navigation systems and equipment, surveillance

1. The organization providing flight inspection and calibration services for navigation systems and equipment, surveillance must have three components: flight inspection and calibration crew; inspection and calibration aircraft; inspection and calibration systems and equipment.

2. The organization providing flight inspection and calibration services must hold a license issued by the Civil Aviation Authority of Vietnam or a license issued by another national civil aviation regulatory authority which must be recognized by the Civil Aviation Authority of Vietnam.

Article 8. Flight inspection and calibration crew

1. The flight inspection and calibration crew must consist of at least two flight inspection and calibration pilots and two flight inspection and calibration crew members.

2. Members of the flight inspection and calibration crew must meet the conditions and be licensed in accordance with Articles 53 and 54 of this Circular.

Article 9. Duties of flight inspection and calibration crew members

1. Ensure accurate measurement of parameters of navigation systems and equipment, surveillance during flight inspection and calibration.

2. Coordinate with ground technical staff to adjust technical parameters of navigation systems and equipment, surveillance according to prescribed standards during flight inspection and calibration.

3. Confirm accurately and truthfully the quality status of navigation systems and equipment, surveillance after flight inspection and calibration and take responsibility for such confirmation.

Article 10. Duties of flight inspection and calibration pilots

1. Ensure precise control of the flight inspection and calibration aircraft in accordance with flight procedures published by the Civil Aviation Authority of Vietnam.

2. Accurately and truthfully confirm the operational suitability of traditional Instrument Flight Procedures (IFPs).

Article 11. Basic requirements for flight inspection and calibration aircraft

Flight inspection and calibration aircraft must comply with the requirements set forth in Annex 1 Chapter 1 of ICAO Document 8071 on supplementary radio navigation aids inspection (Doc 8071 Volume 1).

Article 12. Basic requirements for flight inspection and calibration systems and equipment

1. Flight inspection and calibration systems and equipment on flight inspection and calibration aircraft used to determine the effectiveness of radio signals from navigation equipment and ground surveillance systems must minimize the level of unreliable measurements being conducted to the lowest possible extent.

2. The basic components of flight inspection and calibration systems and equipment on flight inspection and calibration aircraft include:

a) Synchronized receivers, transmitters, and antennas;

b) Standard position reference system;

c) Data processing and display equipment;

d) Data recording equipment.

3. All flight inspection and calibration systems and equipment must be listed in a catalog and must be periodically calibrated and inspected according to the manufacturer's specifications to maintain accuracy according to appropriate standards. Documentation must be provided regarding the methods of calibration and inspection and records of calibration and inspection results for each system and piece of equipment.

4. Flight inspection and calibration systems and equipment and replacement spare parts must be stored in accordance with the manufacturer's specifications.

5. The standard position reference system on flight inspection and calibration aircraft provides accurate positioning information to determine the accuracy of the systems and equipment being flight inspected and calibrated. The standard position reference system is independent of the systems and equipment being flight inspected and calibrated.

6. The total error of all flight inspection and calibration systems and equipment must be less than five times the published quality of the ground navigation signal.

7. When the systems and equipment on flight inspection and calibration aircraft are shared between the pilot of the flight inspection and calibration aircraft and the flight inspection and calibration personnel, the flight inspection and calibration personnel are responsible for controlling the equipment during flight.

8. Receivers on flight inspection and calibration aircraft provide both navigation information similar to standard aircraft equipment and navigation information for inspection and calibration.

9. Data generated by receivers or the standard position reference system on flight inspection and calibration aircraft must be compared with ground equipment system information and standard position reference system information.

10. There must be equipment to print flight inspection and calibration data and results.

11. Antennas on flight inspection and calibration aircraft must be widely tested and calibrated to verify their quality, serving to check the coverage range of ground equipment.

12. Antenna gain must be checked and determined for accurate magnetic field strength measurement (including cables, switches, power dividers). Antennas must have measurable characteristics across the entire frequency band used and at various flight directions while conducting measurements. Real-time antenna gain characteristics must be applied when data is entered and displayed or processed later to produce final reporting data. Omnidirectional pattern antennas must be used for magnetic field strength measurement during ILS Category 2 and ILS Category 3 calibration flights.

13. Installation of antennas on flight inspection and calibration aircraft.

a) For propeller aircraft, antenna positions must ensure they are not interfered with by propeller modulation effects.

b) Weather radar antennas, if installed, must ensure their movement direction does not affect the proper operation of the GP receiver antenna.

c) In cases where there is cross-connection between receiving antennas and transmitting antennas such as VHF omnidirectional and VOR, LOC, appropriate spacing must be ensured to prevent mutual interference.

d) Aircraft structure must be considered when selecting antenna installation locations. If good thermal contact surfaces are required, antennas should not be installed near material joints.

đ) Receivers used for flight inspection and calibration need to use separate antennas. In cases where a single antenna is used for two or more receivers, checks must be made to ensure that adjusting the second receiver does not affect the signal level of the receiver used for coverage area measurement across the entire frequency band.

e) Flight inspection and calibration systems and equipment must use software and inputs from receiver sensors to calibrate the relative positions of measurement antennas and the observed system position when the flight inspection and calibration aircraft changes altitude.

g) Calibration receivers used for calibrating pulse-emitting equipment such as DME and radar must provide video signals from the equipment.

14. Processing, displaying, and recording flight inspection and calibration data.

a) Flight inspection and calibration systems and equipment must include computers used to read data from sensor systems or standard reference systems and from flight inspection and calibration receivers. Computers process data to compare navigation information from equipment and standard positioning reference information. Computers must be able to determine equipment parameters (beam width, LOC straightness accuracy in the ILS system, and other necessary parameters).

b) All relevant information such as equipment navigation information, standard position reference information (standard positioning), equipment accuracy, and additional receiver information such as magnetic field strength must be displayed for flight inspection and calibration personnel on the aircraft using digital devices on computer screens.

c) Printers are used to document flight inspection and calibration results. All data must be appropriately annotated by flight inspection and calibration personnel or by automatic data processing systems.

d) All raw and calculated data must be recorded on disks and stored according to regulations, for the purpose of allowing future processing, if specific investigations are needed.

15. System integration on the aircraft must not affect the aircraft's airworthiness certification. Each modification must be recorded in the aircraft's technical documentation along with the approval of the manufacturer or the relevant civil aviation authority.

16. Specific operating instructions for the system on the aircraft inspection and calibration equipment must be recorded in the in-flight operation manuals. If this integration imposes any quality limits or operational restrictions on the aircraft, such limits or restrictions must be clearly stated in the corresponding documents.

Article 13. Standard Positioning System

1. The standard positioning system is an important component of the inspection and calibration system and equipment. The system consists of onboard components connected to ground-based components.

2. To determine the accuracy of navigation signal, all forms of flight inspection and calibration must have standard position information provided by the standard positioning system of the inspection and calibration aircraft.

3. The standard positioning system must be independent and compatible with the ground-based inspection and calibration systems and equipment.

Article 14. Inspection and Calibration of Flight Inspection and Calibration Systems and Equipment

1. Standard signal generation devices used to calibrate flight inspection and calibration systems and equipment must be inspected and calibrated according to Circular No. 24/2013/TT-BKHCN dated September 30, 2013, issued by the Minister of Science and Technology regarding inspection, calibration, and testing activities for measuring instruments and metrological standards.

2. For devices that cannot be inspected or calibrated in Vietnam, the Civil Aviation Authority of Vietnam shall designate foreign organizations suitable to perform the inspection and calibration.

Article 15. Priority Order for Flight Inspection and Calibration

Flight inspection and calibration shall be carried out in the following priority order:

1. Priority 1: Special flight inspection and calibration.

2. Priority 2: Acceptance flight inspection and calibration; periodic flight inspection and calibration.

3. Priority 3: Position survey flights.

Article 16. Ground System and Equipment Inspection Before Flight Inspection and Calibration

1. Prior to flight inspection and calibration of ground navigation surveillance systems and equipment, they must be inspected on-site by aviation information, navigation, and surveillance personnel licensed by the Civil Aviation Authority of Vietnam using appropriate measurement equipment.

2. Ground inspection data results are used to compare with flight inspection and calibration data results and serve flight inspection and calibration operations.

Article 17. Periodic Flight Inspection and Calibration Time for Navigation Systems and Equipment

Traditional ground-based navigation systems and satellite signal accuracy enhancement systems on the ground must undergo periodic flight inspection and calibration every twelve months.

Article 18. Adjustment of Periodic Flight Inspection and Calibration Time for Navigation Systems and Equipment

1. In cases where a radio navigation system has four consecutive periodic flight inspections and calibrations requiring transmitter adjustments due to tolerances exceeding allowable limits, the Civil Aviation Authority of Vietnam may consider reducing the periodic flight inspection and calibration time for the Instrument Landing System (ILS) approach system to six months.

2. A radio navigation system that has four consecutive periodic flight inspections and calibrations without requiring transmitter adjustments, maintaining tolerances within allowable limits, and showing consistency between ground inspection data records and flight inspection and calibration data records may be considered for extending the periodic flight inspection and calibration period by an additional twelve months.

3. The Civil Aviation Authority of Vietnam will consider and decide on whether to shorten or extend the periodic flight inspection and calibration time.

Article 19. Nighttime Flight for Inspection and Calibration

1. The nighttime period (the time from when the sun sets - the center of the sun forms a 6° angle below the horizon - to when the sun rises - the center of the sun forms a 6° angle below the horizon).

2. In cases of nighttime flight for inspection and calibration, the effects of the nighttime environment on emitted signals must be considered, and the differences between nighttime measurement results and daytime measurement results must be assessed.

3. When conducting nighttime flight for inspection and calibration in areas with obstructions, the flight altitude must be higher than 300 meters (1000 feet) compared to the daytime flight altitude or cruise level. If it is necessary to check the parameters of the navigation system or auxiliary equipment, the horizontal distance must be adjusted to maintain a constant vertical angle from the position of the corresponding navigation system or auxiliary equipment.

4. Nighttime flight for inspection and calibration of the GP station at a lower level than the standard glide path of the ILS system shall not be carried out during nighttime or periods of low natural light levels.

5. Reports of nighttime flight for inspection and calibration must clearly record the nighttime flight time.

Article 20. Flight for Inspection and Calibration of Auxiliary Navigation Lighting Systems

1. The contents of flight for inspection and calibration of lighting subsystems include:

a) Approach lights: visibility, brightness, color, elevation angle.

b) Flashing lights: visibility, clarity, flashing speed.

c) Runway edge lights: visibility, brightness.

d) Touchdown zone lights: visibility, brightness, alignment.

đ) Shoulder and centerline runway lights: continuity, color, brightness, and alignment.

e) Rotating beacon lights: brightness and rotation speed.

2. At airports that have not yet implemented the Instrument Flight Procedure (IFP), nighttime flight for inspection and calibration of auxiliary navigation lighting systems must be conducted to determine the suitability of the auxiliary lighting systems before deciding on the minimum operational standards for nighttime operations.

Article 21. Coordinate System for Flight for Inspection and Calibration

The coordinate system used for flight for inspection and calibration is the World Geodetic System 1984 (WGS-84).

Article 22. Data for Flight for Inspection and Calibration

1. All data related to the list of systems and equipment participating in flight for inspection and calibration (name of station, frequency, WGS-84 coordinates, and type of flight for inspection and calibration); technical content of flight for inspection and calibration; methods (courses) of flight for inspection and calibration, and other relevant data must be accurately prepared and fully submitted for approval by the Civil Aviation Authority of Vietnam before conducting flight for inspection and calibration.

2. The organization providing flight for inspection and calibration services must submit one set of application documents for approval of the data for flight for inspection and calibration through postal service or directly to the Civil Aviation Authority of Vietnam. The application documents include:

a) A request for approval of the data for flight for inspection and calibration.

b) List of systems and equipment participating in flight for inspection and calibration.

c) Technical content of flight for inspection and calibration.

d) Methods (courses) of flight for inspection and calibration.

đ) Schedule for flight for inspection and calibration.

3. Within two working days from the date of receipt of the documents, the Civil Aviation Authority of Vietnam will review the documents and notify the requesting organization if the documents are incomplete.

4. Within twenty days from the date of receipt of complete documents as stipulated, the Civil Aviation Authority of Vietnam is responsible for reviewing and approving the data for flight for inspection and calibration. If approval is not granted, a written response must be provided with specific reasons.

Article 23. Coordination between flight inspection, calibration and ground equipment testing

1. Personnel holding telecommunications, navigation, and air traffic control licenses issued by the Civil Aviation Authority of Vietnam shall be permitted to participate and perform system parameter adjustments on ground equipment according to the standards specified based on the requirements of the flight inspection and calibration personnel during the flight inspection and calibration process.

2. The VHF AM radio communication equipment installed on the inspection aircraft and the mobile VHF AM radio communication equipment on the ground are used for two-way communication between the flight inspection and calibration personnel on the aircraft and the technical staff adjusting the system and ground equipment parameters. This communication must not interfere with the VHF AM radio communication of air traffic services.

Article 24. Determination of Operational Status of Systems and Equipment After Flight Inspection and Calibration

The operational status of systems and equipment after flight inspection and calibration shall be determined as follows:

1. Usable:

a) Unrestricted use: Systems and equipment providing signals in space that fully meet all parameters and standards within their coverage area.

b) Restricted use: Systems and equipment providing signals in space that do not fully meet all parameters and standards within their coverage area but are safe for use within defined limits.

2. Not usable: Systems and equipment not ready for operational use due to the provision of incorrect or unsafe signals or signals whose quality cannot be controlled in space.

Article 25. Authority to Determine the Operational Status of Systems and Equipment After Flight Inspection and Calibration

1. The Civil Aviation Authority of Vietnam is responsible for determining the operational status of navigation and surveillance systems and equipment after flight inspection and calibration.

2. Such determination is based on:

a) Evaluation and confirmation by flight inspection and calibration personnel regarding the condition of the systems and equipment;

b) Reports from ground equipment maintenance personnel;

c) Monitoring and supervision results of flight inspection and calibration conducted by the Civil Aviation Authority of Vietnam.

Article 26. Notification of Changes in System and Equipment Status

1. Navigation and surveillance systems and equipment with standards different from those of ICAO must be published in the Aeronautical Information Publication (AIP) by the Civil Aviation Authority of Vietnam and officially notified to ICAO.

2. Changes in the operational status of navigation and surveillance systems and equipment that have long-term effects must be notified by the Civil Aviation Authority of Vietnam to aircraft operators and published in the AIP.

3. Sudden and temporary changes in the status of navigation and surveillance systems and equipment must be immediately announced to operators by the service provider through Notice to Airmen (NOTAM).

4. Changes in the status of navigation and surveillance systems and equipment detected during flight inspection and calibration must be immediately announced to operators by the service provider through NOTAM. Navigation systems and equipment in "not usable" status must be revoked by the Civil Aviation Authority of Vietnam and may only operate in test mode or for maintenance purposes.

5. Service providers must announce the cessation of service for navigation and surveillance systems and equipment participating in flight inspection and calibration (except for systems and equipment that are only inspected for station identification or aircraft identification decoding).

Article 27. Maintaining data and reporting flight test and calibration results

1. Service providers for navigation guidance and surveillance shall be responsible for storing complete data for at least five (5) years to serve quality monitoring work of the system and equipment.

2. Flight test and calibration acceptance reports and data storage files must be maintained at the equipment for the most recent five (5) years. All special flight test and calibration reports conducted during this period must be kept in the file.

Section 2

FLIGHT TEST AND CALIBRATION OF TRADITIONAL NAVIGATION SYSTEMS AND EQUIPMENT

 

Article 28. Classification of flight test and calibration forms for traditional navigation systems and equipment

1. Position survey flights: Conducted at the proposed installation location of the system and equipment to determine the impact of the environment on the quality of the radio signal of the proposed system and equipment. Mobile equipment installed on the ground is used for position survey flights.

2. Acceptance flight test and calibration: Conducted following ground quality inspection to establish the effectiveness of the signal in space. System and equipment parameters subject to acceptance flight test and calibration must be adjusted to achieve the highest possible accuracy.

3. Periodic flight test and calibration: Conducted regularly or after major maintenance of the equipment according to plan, to periodically confirm the effectiveness of the signal in space.

4. Special flight test and calibration: Conducted to check parameters that may affect the quality of the system and equipment when there is suspicion of malfunction, aircraft accidents, or other special cases.

Article 29. Technical requirements for flight test and calibration of traditional navigation systems and equipment

The Civil Aviation Authority of Vietnam shall provide specific guidelines for flight test and calibration parameters, measurement values, and permissible tolerances for each type of traditional ground-based navigation system and equipment, corresponding to each form of flight test and calibration.

Article 30. Methods (courses) of flight test and calibration of traditional navigation systems and equipment

1. Organizations operating the systems and equipment base their flight test and calibration methods on the technical requirements specified in Article 29 of this Circular and additional area, altitude, and direction requirements for flight test and calibration provided by related air navigation service providers for each flight period (if applicable).

2. Organizations providing flight test and calibration services base their methods on the geographical conditions in each area, developing flight test and calibration courses for each system and equipment and for each form and period of flight, submitting them to the Civil Aviation Authority of Vietnam for approval in accordance with Article 22 of this Circular.

Section 3

 FLIGHT TEST AND CALIBRATION OF WIRELESS NAVIGATION SYSTEMS AND EQUIPMENT BASED ON SATELLITES

USING SATELLITES

 

Article 31. Flight test and calibration of wireless navigation systems and equipment based on satellites

Flight test and calibration of wireless navigation systems and equipment based on satellites are carried out with GBAS systems and satellite parameters.

Article 32. Requirements for Technical Flight Testing and Calibration of the GBAS System

The requirements for technical flight testing and calibration of the GBAS system shall be guided by the Civil Aviation Administration of Vietnam based on the recommendations of ICAO in Doc 8071 Part II - Testing Satellite-Based Radio Navigation Systems.

Article 33. Methods (Flights) for Testing and Calibrating the GBAS System

1. Organizations operating the GBAS system shall base their technical flight testing and calibration requirements as stipulated in Article 32 of this Circular and supplement the areas, altitudes, and directions required for each flight test and calibration period according to the requirements of air navigation service providers (if applicable).

2. Air navigation service providers shall develop methods (flights) for testing and calibrating the GBAS system based on the geographical conditions in each area, for each GBAS system and type of flight, and submit them to the Civil Aviation Administration of Vietnam for approval in accordance with Article 22 of this Circular.

Section 4

FLIGHT TESTING AND CALIBRATION OF SYSTEMS AND MONITORING EQUIPMENT

 

Article 34. Evaluation of Ground PSR and SSR Quality

Annually, organizations operating PSR and SSR must conduct periodic evaluations of PSR and SSR. The results of these periodic evaluations must be reported to the Civil Aviation Administration of Vietnam. In cases where the periodic evaluation results do not maintain the quality achieved during acceptance testing and calibration, the operating organizations must conduct special testing and calibration flights.

Article 35. Role of Test and Calibration Aircraft During PSR and SSR Testing and Calibration Flights

1. During PSR testing and calibration flights, the test and calibration aircraft serve as targets for detection within the necessary areas.

2. For SSR testing and calibration flights, the test and calibration aircraft must use Mode A, Mode C, and Mode S transponders to respond to signals from ground SSR stations.

3. Test and calibration aircraft equipped with Mode B SSR transponders (technical mode) may automatically measure the strength of interrogation signals from ground SSR stations to determine the coverage area of the ground SSR station.

Article 36. Evaluation of PSR and SSR Quality During Testing and Calibration Flights

1. During PSR and SSR testing and calibration flights, radar technicians shall base their assessments on target signals displayed on the radar screen or measured magnetic field strengths to:

a) Evaluate the range, altitude, accuracy, and bearing of target detection by PSR and SSR;

b) Assess the decoding of identification and emergency codes by SSR.

2. When Mode B SSR transponders are used on test and calibration aircraft, they will automatically measure and determine the range, altitude, and bearing of target detection by ground SSR stations.

3. Organizations operating PSR and SSR may use radar evaluation tools provided by equipment manufacturers to collect data during testing and calibration flights for analysis and assessment of system quality.

Article 37 Classification of Types of PSR/SSR Testing and Calibration Flights

1. Acceptance Testing and Calibration Flights

Acceptance testing and calibration flights are conducted to evaluate PSR and SSR quality, determine coverage diagrams, and prepare coverage diagram documentation before putting PSR and SSR into operation. Data obtained serves as a basis for detecting system and equipment quality degradation and for periodic comparisons of quality in subsequent testing and calibration flights (if applicable).

2. Special Testing and Calibration Flights

Special testing and calibration flights are carried out when there are changes, modifications, or quality degradation in the PSR and SSR systems that have undergone acceptance testing and calibration; operational needs (new flight paths) require additional parameter, altitude, direction, and area testing, or at the request of the Civil Aviation Administration of Vietnam. New coverage diagrams will be used as a basis for comparison in subsequent testing and calibration flights (if applicable).

Article 38. Announcing the Coverage Diagram of PSR, SSR

After flight testing and calibration acceptance, the organization operating PSR, SSR shall report to the Vietnam Civil Aviation Authority the coverage diagram of PSR, SSR for publication in the Air Traffic Information Bulletin.

Article 39. Technical Requirements for Flight Testing and Calibration of PSR, SSR

The technical requirements for flight testing and calibration acceptance, and special flight testing and calibration for each type of PSR, SSR shall be guided by the Vietnam Civil Aviation Authority (based on the recommendations of ICAO in Document (Doc) 8071 - Radio Navigation Aids Inspection, Volume III - Surveillance Radar Systems Inspection, Annex A - Flight Test Methods, Table A-1 - Test and Calibration Checklist).

Article 40. Flight Testing and Calibration Method (Procedure) for PSR, SSR

1. The flight testing and calibration method (procedure) for PSR and the flight testing and calibration method (procedure) for SSR must be combined into one, except in areas where only PSR is present.

2. The organization operating PSR, SSR shall base on the technical requirements for flight testing and calibration acceptance and special flight testing and calibration specified in Article 39 of this Circular and the additional area, altitude, bearing, and parameters required for flight testing and calibration (if any) by the air navigation service provider.

3. The organization providing flight testing and calibration services shall develop the flight testing and calibration method (procedure) for each PSR, SSR system based on the geographical conditions in each area, and submit it to the Vietnam Civil Aviation Authority for approval according to the provisions of Article 22 of this Circular.

 

Chapter III

FLIGHT EVALUATION OF FLIGHT PROCEDURES USING EQUIPMENT

 

Article 41. Flight Procedures Using Equipment

Flight procedures using equipment (IFP) include traditional IFP and IFP based on Performance-Based Navigation (PBN).

Article 42. Evaluation Process of Flight Procedures Using Equipment

1. The evaluation process of IFP includes ground validation and flight validation, as follows:

a) Ground validation of IFP;

b) Validation of IFP using a flight simulator;

c) Flight validation of IFP (by aircraft, in-flight).

2. The evaluation process of IFP is stipulated in Appendix 1 issued together with this Circular.

Article 43. Need for Flight Evaluation of Flight Procedures Using Equipment

1. Before issuing IFP, flight evaluation must be conducted. Periodic flight evaluation of traditional IFP shall be carried out similarly to calibration flights for flight procedures using equipment as prescribed in Article 5 of Circular No. 28/2009/TT-BGTVT dated November 10, 2009, of the Minister of Transport regarding civil aviation flight procedures.

2. Flight evaluation of IFP based on PBN shall be conducted as follows:

a) The airport operator ensures for GBAS and SID procedures;

b) Other IFP based on PBN shall be ensured by the air navigation service provider within their respective areas of responsibility.

c) The Vietnam Civil Aviation Authority decides the necessity of re-evaluating specific IFP.

Article 44. Flight Evaluation of Flight Procedures Using Equipment

1. Flight evaluation of IFP aims to assess the quality of the design of flight procedures, including airspace obstacle data, navigation data, and provide an assessment of the suitability of the draft IFP for implementation.

2. Flight evaluation of IFP shall be conducted after ground validation and validation using a flight simulator have been completed.

3. The organization providing flight evaluation services for IFP must hold a license.

Article 45. Organizations providing flight service to evaluate flight procedures using equipment

In addition to the contents stipulated in Article 7 of this Circular, organizations providing flight services to evaluate IFP must also have the following:

1. FVP pilot.

2. Flight evaluation IFP system and equipment on aircraft.

Article 46. Pilots performing flight evaluations of flight procedures using equipment

1. The FVP pilot must meet the licensing conditions set forth in Clause 1 of Article 59 of this Circular.

2. The FVP pilot must have a seat in the cockpit with good visibility to properly execute the flight evaluation IFP procedures and content according to the guidance of the Civil Aviation Administration of Vietnam.

Article 47. Aircraft and flight evaluation IFP equipment conditions under PBN

1. Aircraft conducting flight evaluations of IFP under PBN must be equipped with FMS systems, autopilots, and devices capable of testing traditional IFPs and IFPs under PBN.

Article 48. Duties of pilots and FVP

1. When conducting flight evaluations using equipment, the FVP must truthfully and accurately confirm relevant factors and provide a final assessment of the flight ability of the IFP.

2. The aircraft pilot must:

a) Ensure accurate control of the aircraft according to the approved IFP safely by the Civil Aviation Administration of Vietnam.

b) Perform the duties specified in Clause 1 of Article 48 of this Circular (in cases where they concurrently serve as the FVP pilot).

Article 49. Flight Evaluation of Flight Procedures Using Equipment, Utilizing GNSS

1. This flight evaluation is conducted when the GNSS signal has been permitted for use as the primary navigation means for the IFP being evaluated within Vietnam's airspace.

2. There is no need to verify the accuracy of signals transmitted from GNSS navigation satellites; instead, the focus is on verifying the method and ensuring the suitability of the radio signal reception environment for the procedure.

3. Flight evaluation of IFP utilizing the GBAS system is carried out after testing and calibrating the GBAS system.

Article 50. Data for Flight Evaluation of Flight Procedures Using Equipment

1. The organization developing the IFP is responsible for ensuring that the draft IFP has been reviewed by an independent flight procedure designer and approved by the Civil Aviation Administration of Vietnam before providing it to the flight evaluation organization.

2. The flight evaluation organization is responsible for evaluating the IFP prior to conducting the flight evaluation or before evaluating the IFP using simulated flight equipment.

Chapter IV

ORGANIZATIONS PROVIDING FLIGHT SERVICES FOR TESTING, CALIBRATION AND FLIGHT EVALUATION

OF FLIGHT PROCEDURES USING EQUIPMENT

Section 1

ORGANIZATIONS PROVIDING FLIGHT SERVICES FOR TESTING, CALIBRATING SYSTEMS,

NAVIGATION EQUIPMENT, SUPERVISION

 

Article 51. Issuing and Reissuing Licenses for Organizations Providing Flight Services for Testing and Calibration

1. Conditions for issuing licenses for organizations providing flight services for testing and calibration include:

a) Having test and calibration aircraft licensed by the Civil Aviation Administration of Vietnam;

b) Having test and calibration aircraft pilots licensed by the Civil Aviation Administration of Vietnam;

c) Having test and calibration flight personnel licensed by the Civil Aviation Administration of Vietnam;

d) Having test and calibration flight systems and equipment licensed by the Civil Aviation Administration of Vietnam;

e) Having operational guidelines for providing test and calibration flight services compiled in accordance with the Civil Aviation Administration of Vietnam’s instructions and approved by the Civil Aviation Administration of Vietnam.

2. Organizations providing flight services for testing and calibration submit one set of application documents for obtaining a license for providing test and calibration flight services through postal mail or directly to the Civil Aviation Administration of Vietnam. The documents include:

a) An application form for obtaining a license for operating organizations providing test and calibration flight services as prescribed in Appendix II issued together with this Circular;

b) A list of test and calibration flight systems and equipment of the organization providing test and calibration flight services that have been licensed;

c) A list of test and calibration flight personnel who have been licensed;

d) A copy of the airworthiness certificate of the aircraft used for test and calibration flights;

e) A copy of the pilot license of the aircraft pilot;

f) A copy of the approval document for operational guidelines of the organization providing test and calibration flight services.

3. Reissuing licenses for operating organizations providing flight services for testing and calibration

a) In the following situations, the organization must apply to the Civil Aviation Administration of Vietnam for reissuing the license for operating organizations providing test and calibration flight services: loss, damage, or destruction of the license; change of name or main office address of the organization providing test and calibration flight services; change of name or address of the organization providing test and calibration flight services in the issued license; change in purpose, scope, method of service provision, operation mode, organizational structure of the organization providing test and calibration flight services;

b) Application documents for reissuing the license for operating organizations providing test and calibration flight services as stipulated in Clause 2 of Article 51 of this Circular.

4. Time limit for issuing and reissuing licenses for operating organizations providing flight services for testing and calibration is as follows:

a) Within two working days from the date of receipt of the application, the Civil Aviation Administration of Vietnam will review the application and notify the applicant organization if the application is incomplete.

b) Within ten days from the date of receipt of a complete application, the Civil Aviation Administration of Vietnam is responsible for reviewing the application, conducting inspections, evaluations, and deciding on the issuance of the license for operating organizations providing test and calibration flight services.

c) If the application is rejected, the Civil Aviation Administration of Vietnam must notify the organization in writing within seven working days from the date of receipt of the application, stating the reasons.

d) During the inspection and review process, the Civil Aviation Administration of Vietnam may request the applicant to provide additional information or documents to clarify related issues. The time taken to obtain such information does not count towards the time limit specified in Point b of Clause 4 of this Article but shall not exceed twenty days.

Article 52. Issuance of Aircraft Airworthiness Certificate for Testing and Calibration Flights

The conditions, documents, procedures, methods, and deadlines for issuing the Aircraft Airworthiness Certificate for Testing and Calibration Flights shall be carried out in accordance with the provisions of Part 3 and Part 20 of the Civil Aviation Safety Regulations on Aircraft and Aircraft Operations issued together with Circular No. 01/2011/TT-BGTVT dated January 27, 2011, by the Minister of Transport.

Article 53. Issuance of Pilot Qualification for Testing and Calibration Flights

1. Conditions for issuing pilot qualification for testing and calibration flights:

a) Possess a valid Aircraft Pilot License in accordance with the provisions of Part 7 of the Civil Aviation Safety Regulations on Aircraft and Aircraft Operations issued together with Circular No. 01/2011/TT-BGTVT dated January 27, 2011, by the Minister of Transport.

b) Hold a certificate of completion of training courses on testing and calibration flights issued or recognized by the Civil Aviation Authority of Vietnam.

2. Organizations or individuals requesting issuance of pilot qualification shall submit one set of documents via postal service or directly to the Civil Aviation Authority of Vietnam. The documents include:

a) A request for issuance of pilot qualification for testing and calibration flights;

b) A copy of the Aircraft Pilot License;

c) A certified copy of the certificate of completion of training courses on testing and calibration flights.

3. Within two working days from the date of receipt of the documents, the Civil Aviation Authority of Vietnam shall examine the documents and issue a notification to the requesting organization if the documents are incomplete.

4. Within twenty days from the date of receipt of complete documents as stipulated in Clause 2 of this Article, the Civil Aviation Authority of Vietnam shall be responsible for reviewing the documents and issuing pilot qualification for testing and calibration flights to the requesting organizations or individuals.

Article 54. Issuance of Licenses and Qualifications for Flight Test and Calibration Personnel

1. Conditions for issuing licenses and qualifications for flight test and calibration personnel:

a) Be a Vietnamese citizen aged 21 years or older, without criminal records or currently serving a criminal sentence or being pursued for criminal responsibility;

b) Have at least graduated from a college of electronics and telecommunications;

c) Have completed training courses on flight test and calibration at a training institution recognized by the Civil Aviation Authority of Vietnam;

d) Have participated in and passed the qualification examination for issuance of flight test and calibration personnel license;

đ) Possess a health certificate meeting Category 2 standards as specified in Section 6.4 of Chapter 6 of Annex 1 of ICAO.

2. The procedures, methods, and deadlines for issuing licenses and qualifications for flight test and calibration personnel shall be carried out in accordance with the provisions of Articles 17 and 18 of Circular No. 22/2011/TT-BGTVT dated March 31, 2011, issued by the Minister of Transport regarding administrative procedures in the field of air traffic safety assurance.

Article 55. Issuance of Licenses for Flight Test and Calibration Systems and Equipment

1. Conditions for issuing licenses for flight test and calibration systems and equipment:

a) The system and equipment meet the standards prescribed by the Civil Aviation Authority of Vietnam or recognized as conforming to ICAO standards;

b) Have a certificate of origin and quality certificate from the manufacturer;

c) Have operating and maintenance manuals in Vietnamese or English;

d) Have a completion acceptance report for the project put into use;

đ) Have a frequency usage permit;

e) Have appropriate backup power supply and equipment;

g) Have recording and storage equipment in compliance with regulations;

h) The flight test and calibration system and equipment must comply with the manufacturer's standards for flight test and calibration aircraft if they are directly connected to onboard equipment or require aircraft modifications.

2. Service providers of flight test and calibration shall submit one set of application documents for the operation license of flight test and calibration systems and equipment via postal service or directly to the Civil Aviation Authority of Vietnam. The documents include:

a) An application form for the operation license of flight test and calibration systems and equipment according to the model prescribed in Appendix III issued together with this Circular;

b) A report explaining the suitability of the system and equipment for the provided flight test and calibration services;

c) A report explaining the operational, maintenance, and repair capabilities of the system and equipment;

d) A copy of the frequency usage permit and radio transmitting equipment license issued by the Radio Frequency Management Department under the Ministry of Information and Communications for radio transmitting equipment;

đ) A copy of the certificate of origin and quality certificate from the manufacturer.

3. Organizations must apply for reissue of the operation license for flight test and calibration systems and equipment with the Civil Aviation Authority of Vietnam in the following cases:

a) When there are changes compared to the contents of the previously issued operation license;

b) When the enterprise carries out renovation or upgrading of the flight test and calibration systems and equipment that have been licensed by the Civil Aviation Authority of Vietnam;

c) When the license has expired.

4. Application documents for reissuing the operation license for flight test and calibration systems and equipment include:

a) An application form for reissuing the operation license for flight test and calibration systems and equipment according to the model prescribed in Appendix III issued together with this Circular;

b) A report explaining the renovation and upgrading of the flight test and calibration systems and equipment;

c) A copy of the frequency usage permit and radio transmitting equipment license issued by the Radio Frequency Management Department under the Ministry of Information and Communications for radio transmitting equipment.

5. Time limit for issuing and reissuing the operation license for flight test and calibration systems and equipment

a) Within two working days from the date of receipt of the application, the Civil Aviation Administration of Vietnam will review the application and notify the applicant organization if the application is incomplete.

b) Within thirty days from the date of receipt of complete documents as stipulated, the Civil Aviation Authority of Vietnam shall be responsible for reviewing the documents, conducting inspections and evaluations, and deciding on the issuance of the operation license for flight test and calibration systems and equipment to the requesting organization.

During the inspection and evaluation process, the Civil Aviation Authority of Vietnam may request the organization to provide additional information or documents to clarify related issues.

c) In case of rejection of the application, within seven working days from the date of receipt of the application, the Civil Aviation Authority of Vietnam shall notify the organization in writing and specify the reasons.

d) Within twenty days from the date of receiving a complete application file in accordance with Clause 4 of this Article, the Civil Aviation Authority of Vietnam shall reissue the airworthiness certificate for the system and equipment flight inspection and calibration.

6. The airworthiness certificate for the system and equipment flight inspection and calibration shall be valid for two years from the date of issuance.

Section 2

ORGANIZATIONS PROVIDING FLIGHT INSPECTION AND CALIBRATION SERVICES FOR NAVIGATION SYSTEMS, EQUIPMENT, MONITORING, AND FLIGHT EVALUATION USING EQUIPMENT

 

Article 56. Issuance and Reissuance of Airworthiness Certificates for Organizations Providing Flight Inspection and Calibration Services and Flight Evaluation Using Equipment

1. Conditions for Issuing an Airworthiness Certificate for Organizations Providing Flight Inspection and Calibration Services and Flight Evaluation Using Equipment:

a) Having an organizational structure capable of simultaneously providing flight inspection and calibration services and flight evaluation using equipment, in compliance with regulations;

b) Having aircraft equipped appropriately, capable of simultaneously performing flight inspection and calibration and flight evaluation using equipment, which have been issued an airworthiness certificate by the Civil Aviation Authority of Vietnam;

c) Having at least two pilots for flight inspection and calibration and flight evaluation using equipment who have been issued an airworthiness certificate by the Civil Aviation Authority of Vietnam;

d) Having at least one pilot for flight validation procedure (FVP) who has been issued an airworthiness certificate by the Civil Aviation Authority of Vietnam;

đ) Having at least two flight inspectors and calibrators for flight evaluation using equipment who have been issued an airworthiness certificate by the Civil Aviation Authority of Vietnam;

e) Having systems and equipment for flight inspection and calibration and flight evaluation using equipment that have been issued an airworthiness certificate by the Civil Aviation Authority of Vietnam;

g) Having operational guidance documents for flight inspection and calibration and flight evaluation using equipment approved by the Civil Aviation Authority of Vietnam.

2. Organizations providing flight inspection and calibration services shall submit one set of application files for issuing an airworthiness certificate for organizations providing flight inspection and calibration services and flight evaluation using equipment through postal service or directly to the Civil Aviation Authority of Vietnam. The application file includes:

a) An application form for issuing an airworthiness certificate for organizations providing flight inspection and calibration services and flight evaluation using equipment according to the model prescribed in Appendix II attached to this Circular;

b) A list of systems and equipment for flight inspection and calibration and flight evaluation using equipment provided by the organization, which have been permitted by the Civil Aviation Authority of Vietnam;

c) A list of personnel conducting flight inspection and calibration and flight evaluation using equipment who have been issued an airworthiness certificate by the Civil Aviation Authority of Vietnam;

d) A list of pilots for flight inspection and calibration and flight evaluation using equipment who have been permitted by the Civil Aviation Authority of Vietnam;

đ) A copy of the airworthiness certificate of the aircraft used for flight inspection and calibration and flight evaluation using equipment;

e) A copy of the pilot's license for pilots and FVP pilots;

g) A copy of the document approving the operational guidance documents of the organization providing flight inspection and calibration services;

3. Organizations must apply for reissuance of the airworthiness certificate with the Civil Aviation Authority of Vietnam in the following cases:

a) The airworthiness certificate for organizations providing flight inspection and calibration services and flight evaluation using equipment is lost, damaged, or destroyed;

b) Changing the name or main office address of the organization providing flight inspection and calibration services and flight evaluation using equipment;

c) Changing the name or address of the organization providing flight inspection and calibration services and flight evaluation using equipment in the issued airworthiness certificate;

d) Changing the purpose, scope, method of service provision, operating mode, or organizational structure of the organization providing flight inspection and calibration services and flight evaluation using equipment.

4. Application files for reissuance of the airworthiness certificate for organizations providing flight inspection and calibration services and flight evaluation using equipment in accordance with Clause 2 of this Article.

5. Time limit for issuing and reissuing the airworthiness certificate for organizations providing flight inspection and calibration services and flight evaluation using equipment:

a) Within two working days from the date of receipt of the application file, the Civil Aviation Authority of Vietnam shall examine the application file and notify the applicant organization in writing if the file is incomplete;

b) Within thirty days from the date of receipt of a complete application file, the Civil Aviation Authority of Vietnam shall be responsible for examining the application file, conducting inspections and evaluations, and deciding on the issuance of the airworthiness certificate for organizations providing flight inspection and calibration services and flight evaluation using equipment to the applicant organization;

c) In case of refusal of the application, within seven working days from the date of receipt of the application, the Civil Aviation Authority of Vietnam shall notify the organization in writing and specify the reasons;

d) During the examination and verification process, the Civil Aviation Authority of Vietnam may request the applicant to provide additional information or documents to clarify related issues.

Article 57. Issuance and Reissuance of Aircraft Inspection, Calibration, and IFP Evaluation Flight Permit

1. Conditions for Issuing an Aircraft Inspection, Calibration, and IFP Evaluation Flight Permit:

a) The aircraft must have the capability to perform inspection and calibration flights as stipulated in Article 52 of this Circular;

b) The aircraft must be equipped with systems and devices capable of performing traditional IFP evaluation flights and IFP evaluation flights under PBN.

2. Documents, procedures, methods, and deadlines for issuing and reissuing permits for pilots conducting inspection, calibration, and IFP evaluation flights shall be carried out according to the provisions set forth in Part 3 and Part 20 of the Civil Aviation Safety Regulations on Aircraft and Aircraft Operations issued together with Circular No. 01/2011/TT-BGTVT dated January 27, 2011, by the Minister of Transport.

Article 58. Issuance of Qualification Certificates for Pilots Conducting Inspection, Calibration, and IFP Evaluation Flights

1. Conditions for Issuing Qualification Certificates for Pilots Conducting Inspection, Calibration, and IFP Evaluation Flights:

a) As stipulated in Clause 1 of Article 53 of this Circular;

b) Hold a certificate of completion for the IFP evaluation flight training course.

2. Organizations or individuals requesting issuance of pilot qualification shall submit one set of documents via postal service or directly to the Civil Aviation Authority of Vietnam. The documents include:

a) A request for issuance of a qualification certificate for pilots conducting inspection, calibration, and IFP evaluation flights;

b) A copy of the Aircraft Pilot License;

c) A certified copy of the certificate of completion for the IFP evaluation flight training course.

3. Within two working days from the date of receipt of the application, the Vietnam Civil Aviation Authority shall review the application and issue a written notice to the applicant if the application is incomplete.

4. Within twenty days from the date of receipt of a complete application as stipulated in Clause 2 of this Article, the Vietnam Civil Aviation Authority shall be responsible for reviewing the application and issuing a qualification certificate for pilots conducting inspection, calibration, and IFP evaluation flights to the organization or individual requesting it.

5. In case of refusal to grant the requested permit, within seven working days from the date of receipt of the application, the Vietnam Civil Aviation Authority shall be responsible for issuing a written notice to the organization and specifying the reasons.

6. Pilots conducting inspection and calibration flights may be considered for additional qualifications as FVP pilots if they meet all conditions stipulated in Clause 1 of Article 59 of this Circular.

Article 59. Issuance of Qualification Certificates for Pilots Conducting IFP Evaluation Flights

1. Conditions for Issuing Qualification Certificates for FVP Pilots:

a) Hold a Commercial Pilot License as stipulated in Part 7 of the Civil Aviation Safety Regulations on Aircraft and Aircraft Operations issued together with Circular No. 01/2011/TT-BGTVT dated January 27, 2011, by the Minister of Transport, or hold a license issued by a foreign authority recognized by the Vietnam Civil Aviation Authority.

b) Hold a certificate of completion for the IFP evaluation flight training course.

2. Organizations or individuals requesting issuance of pilot qualification shall submit one set of documents via postal service or directly to the Civil Aviation Authority of Vietnam. The documents include:

a) A request for issuance of a qualification certificate for pilots conducting IFP evaluation flights;

b) A certified copy of the Commercial Pilot License;

c) A certified copy of the certificate of completion for the IFP evaluation flight training course.

3. Within two working days from the date of receipt of the application, the Vietnam Civil Aviation Authority shall review the application and issue a written notice to the applicant if the application is incomplete.

4. Within twenty days from the date of receipt of a complete application as stipulated in Clause 2 of this Article, the Vietnam Civil Aviation Authority shall be responsible for reviewing the application and issuing a qualification certificate for pilots conducting IFP evaluation flights to the organization or individual requesting it.

5. In case of refusal to grant the requested permit, within seven working days from the date of receipt of the application, the Vietnam Civil Aviation Authority shall be responsible for issuing a written notice to the organization and specifying the reasons.

Article 60. Issuance and Reissuance of Permits for Aircrew Conducting Inspection, Calibration, and IFP Evaluation Flights

1. Conditions for Issuing Permits for Aircrew Conducting Inspection, Calibration, and IFP Evaluation Flights:

a) As stipulated in Clause 1 of Article 54 of this Circular;

b) Hold a certificate of completion for the IFP evaluation flight training course.

2. Documents, procedures, methods, and deadlines for issuing and reissuing permits for aircrew conducting inspection, calibration, and IFP evaluation flights shall be carried out according to the provisions set forth in Articles 17 and 18 of Circular No. 22/2011/TT-BGTVT dated March 31, 2011, of the Minister of Transport regarding administrative procedures in the field of air traffic safety assurance.

Article 61. Issuance and Reissuance of Permits for Flight Inspection Calibration Systems and Equipment

1. Conditions for issuing permits for flight inspection calibration systems and equipment include:

a) As stipulated in Clause 1 of Article 55 of this Circular;

b) Having the capability to evaluate parameters and conditions for traditional IFP and IFP based on PBN.

2. Organizations providing flight inspection calibration and IFP evaluation services shall submit one set of application documents for the issuance of exploitation permits for flight inspection calibration systems and equipment and IFP evaluation through postal service or directly to the Civil Aviation Administration of Vietnam. The documents include:

a) An application form for the issuance of exploitation permits for flight inspection calibration systems and equipment and IFP evaluation according to the model prescribed in Appendix III attached to this Circular;

b) A report explaining the suitability of the system and equipment with the provided flight inspection calibration and IFP evaluation services.

c) A report explaining the operational, maintenance, and repair capabilities of the system and equipment;

d) A copy of the frequency usage permit and radio transmitting equipment license issued by the Radio Frequency Management Department under the Ministry of Information and Communications for radio transmitting equipment;

đ) A copy of the certificate of origin and quality certificate from the manufacturer.

3. Organizations must apply to the Civil Aviation Administration of Vietnam for reissuance of exploitation permits for flight inspection calibration systems and equipment and IFP evaluation in the following cases:

a) When there is a change in the content of the already issued permit;

b) When the enterprise carries out renovation or upgrading of the flight inspection calibration systems and equipment and IFP evaluation that have been granted permits by the Civil Aviation Administration of Vietnam;

c) When the permit expires.

4. Application documents for reissuing exploitation permits for flight inspection calibration systems and equipment and IFP evaluation include:

a) An application form for reissuing exploitation permits for flight inspection calibration systems and equipment and IFP evaluation according to the model prescribed in Appendix III attached to this Circular;

b) A report explaining the renovation and upgrading of the flight inspection calibration systems and equipment and IFP evaluation.

c) A copy of the frequency usage permit and radio transmitting equipment license issued by the Radio Frequency Management Department under the Ministry of Information and Communications for radio transmitting equipment.

5. Time limit for issuing and reissuing exploitation permits for flight inspection calibration systems and equipment:

a) Within two working days from the date of receipt of the application file, the Civil Aviation Authority of Vietnam shall examine the application file and notify the applicant organization in writing if the file is incomplete;

b) Within thirty days from the date of receipt of complete documents as prescribed, the Civil Aviation Administration of Vietnam shall be responsible for reviewing the documents, inspecting, evaluating, and deciding on the issuance of exploitation permits for flight inspection calibration systems and equipment and IFP evaluation for the requesting organization.

During the inspection and evaluation process, the Civil Aviation Authority of Vietnam may request the organization to provide additional information or documents to clarify related issues.

c) In case of refusal of the application, within seven working days from the date of receipt of the application, the Civil Aviation Administration of Vietnam shall be responsible for notifying the organization in writing and specifying the reasons.

d) Within twenty days from the date of receipt of complete documents as prescribed in Clause 4 of this Article, the Civil Aviation Administration of Vietnam shall reissue the exploitation permits for flight inspection calibration systems and equipment and IFP evaluation.

6. Exploitation permits for flight inspection calibration systems and equipment shall be valid for two years from the date of issuance.

Article 62. Recognition of Foreign Service Providers.

1. Foreign organizations providing flight inspection calibration and IFP evaluation services shall be recognized by the Civil Aviation Administration of Vietnam based on permits issued by aviation regulatory authorities of other countries and meeting corresponding conditions as stipulated in Articles 51 and 56 of this Circular.

2. Foreign organizations specified in Clause 1 of this Article may only provide services to the Vietnamese Civil Aviation Industry upon approval by the Civil Aviation Administration of Vietnam.

Chapter V

RESPONSIBILITIES OF ORGANIZATIONS FOR FLIGHT INSPECTION, CALIBRATION AND IFP EVALUATION TASKS

FLIGHT INSPECTION, CALIBRATION AND IFP EVALUATION TASKS

 

Article 63. Responsibilities of organizations providing flight inspection, calibration services, and flight evaluation of procedures using equipment

1. Organizations providing flight inspection, calibration services, or organizations providing flight inspection, calibration services and flight evaluation of IFP within the Civil Aviation sector of Vietnam shall be responsible for:

a) Ensuring the provision of flight inspection, calibration services for navigation system equipment, surveillance systems, and flight evaluation of IFP within the Civil Aviation sector of Vietnam in accordance with this Circular and related guiding documents of the Civil Aviation Administration of Vietnam;

b) Supervising and ensuring the condition of inspection and calibration of systems and equipment as directed by the Civil Aviation Administration of Vietnam;

c) Based on the requirements of organizations providing air traffic control services, surveillance, and geographical conditions in each area, developing flight inspection, calibration methods (courses) for each navigation system, surveillance equipment for each type of flight and inspection period;

d) Compiling and submitting to the Civil Aviation Administration of Vietnam for approval for each inspection period: The list of navigation systems, surveillance equipment participating in flight inspections and calibrations; technical contents of flight inspections and calibrations for each system and equipment; flight inspection, calibration methods (courses) for each system and equipment; schedules for flight inspections, calibrations, and flight evaluations of IFP;

đ) Applying for permission for flight inspections, calibrations, and flight evaluations of IFP, permits to enter and exit airport areas;

e) Notifying organizations providing aviation information services about relevant flight inspection, calibration, and IFP evaluation information to issue NOTAMs promptly;

g) During the implementation of flight inspections, calibrations, and IFP evaluations, coordinating with relevant agencies and units and complying with the directives of the Civil Aviation Administration of Vietnam, and direct supervision by staff assigned by the Civil Aviation Administration of Vietnam;

h) Submitting to the Civil Aviation Administration of Vietnam for review and approval of the results of each flight inspection, calibration, and IFP evaluation period (within 14 days from the end of the inspection period). In cases where specific systems or equipment need to be put into operation immediately after completion of flights, reports should be made according to the requirements of the Civil Aviation Administration of Vietnam;

2. Foreign service-providing organizations shall be responsible for complying with guidance and supervision by the Civil Aviation Administration of Vietnam during their operations in Vietnam;

Article 64. Responsibilities of organizations providing air traffic control and surveillance services

1. Ensuring that their navigation systems, surveillance systems are subject to flight inspections and calibrations as stipulated in this Circular and related guidelines of the Civil Aviation Administration of Vietnam;

2. Implementing flight evaluations of IFPs within their scope of responsibility when designated by the Civil Aviation Administration of Vietnam, prior to putting them into operation for flight activities;

3. Coordinating with organizations providing flight inspection, calibration, and IFP evaluation services and relevant agencies and units to implement flight inspection, calibration, and IFP evaluation plans within their areas of responsibility, including:

a) Coordinating with the inspection and calibration unit to inspect and adjust systems and equipment; resolving related work matters during preparation and during the flight inspection and calibration period;

b) Coordinating with the IFP evaluation organization to monitor the results of IFP evaluations; resolving related work matters during preparation and during the IFP evaluation period;

c) Performing tasks to ensure operational readiness for their systems, equipment, and IFPs assigned by the Civil Aviation Administration of Vietnam following each flight inspection, calibration, and/or IFP evaluation period.

Article 65. Responsibilities of organizations providing air traffic services

Organizations providing civil aviation air traffic services shall be responsible for managing and ensuring safety for flight check, calibration, and IFP evaluation flights.

Article 66. Responsibilities of organizations providing NOTAM services

Organizations providing NOTAM services shall be responsible for timely and detailed notification of information related to flight check, calibration, and IFP evaluation flights.

Article 67. Responsibilities of Vietnamese airlines

Implementing the assessment of IFPs on their own flight simulators upon request from the Civil Aviation Administration of Vietnam.

Article 68. Responsibilities of the Civil Aviation Administration of Vietnam

1. Directing and supervising flight check, calibration, and IFP evaluation activities.

2. Issuing licenses:

a) Organizations providing flight check and calibration services;

b) Organizations providing flight check, calibration, and IFP evaluation services;

c) Aircraft certification for flight check and calibration;

d) Aircraft certification for flight check, calibration, and IFP evaluation;

đ) Flight check and calibration personnel;

e) Flight check, calibration, and IFP evaluation personnel;

g) Systems and equipment for flight check and calibration;

h) Systems and equipment for flight check, calibration, and IFP evaluation;

i) Aircraft pilots for flight check and calibration;

k) Aircraft pilots for flight check, calibration, and IFP evaluation;

l) FVP pilots.

3. Approving aircraft modifications for flight check, calibration, and IFP evaluation purposes (if applicable).

4. Recognizing licenses of foreign organizations providing flight check, calibration, and IFP evaluation services (if applicable).

5. Guiding, directing, and supervising foreign organizations providing flight check, calibration, and IFP evaluation services during implementation in Vietnam (if applicable).

6. Reviewing and deciding on IFP evaluations and re-evaluations.

7. Supporting organizations providing flight check, calibration, and IFP evaluation services in obtaining permission to fly with Vietnamese military authorities and relevant foreign agencies (when necessary).

8. Approving each batch of flight checks, calibrations, and IFP evaluations, including: List of systems and equipment participating in flight checks and calibrations; technical contents of flight checks and calibrations; methods (courses) of flight checks and calibrations; detailed flight schedules; results of flight checks, calibrations, and IFP evaluations.

9. Guiding flight checks over VHF AM ground-to-air communication station coverage areas and ADS-B stations based on practical needs, relevant standards, and ICAO recommendations.

10. Directing organizations providing navigation, surveillance, and air traffic control services to implement measures to resolve and mitigate issues after each batch of flights.

Chapter VI

IMPLEMENTING PROVISIONS

 

Article 69. Effective Date

1. This Circular takes effect from May 1, 2014.

2. In cases where the referenced documents in this Circular have been amended, supplemented, or updated, the corresponding amendments, supplements, or updates shall apply.

3. Abolishing Articles 41, 42, 43, 44, 45, and Article 46 of Decision No. 14/2007/QĐ-BGTVT dated March 26, 2007 issued by the Minister of Transport on the Civil Aviation Navigation, Surveillance Regulations.

Article 70. Responsibility for Implementation

The Head of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, the Director of the Civil Aviation Administration of Vietnam, Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.
