Regulations on scientific appraisal to assess athletic training levels and health check-ups for athletes

Pursuant to the Law on Physical Culture and Sports dated November 29, 2006;
Pursuant to Decree No. 76/2013/NĐ-CP dated July 16, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;
At the proposal of the Director-General of the General Department of Physical Training and Sport;
The Minister of Culture, Sports and Tourism issues this Circular stipulating regulations on scientific appraisal to assess athletic training levels and health check-ups for athletes.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates regulations on scientific appraisal to assess athletic training levels and health check-ups for athletes.
Article 2. Applicability
This Circular applies to organizations and individuals involved in activities related to scientific appraisal to assess athletic training levels and health check-ups for athletes in Vietnam.
Article 3. Scientific Appraisal
1. Scientific appraisal to assess athletic training levels of athletes (hereinafter referred to as scientific appraisal) is the process of using scientific methods, technical skills, and measuring devices to examine and comprehensively evaluate the training level of athletes.
2. Scientific appraisal activities are carried out according to plans approved by the General Department of Physical Culture and Sports to serve the examination and evaluation of athletes' training levels, research, and application of scientific and technological solutions in athlete training processes and other activities related to physical culture and sports.
3. The General Department of Physical Culture and Sports decides on the list of outstanding athletes and the list of athletes preparing to participate in the Southeast Asian Games (SEA Games), the Asian Games (Asian Games), and the World Games (Olympics) to conduct scientific appraisals.
Article 4. Health Inspection
1. Health inspection of athletes aims to assess their health and illnesses to determine the conditions for participating in athletic training and competitions.
2. Health inspections are applied to athletes belonging to national teams; athletes belonging to provincial and central city sports teams, sectoral teams, and sports training and coaching institutions.
Chapter II
SPECIFIC PROVISIONS
Section 1
SCIENTIFIC APPRAISAL
Article 5. Appraisal Board
1. Scientific appraisal is conducted by the Scientific Appraisal Board (hereinafter referred to as the Appraisal Board).
2. The General Department of Physical Culture and Sports decides on the establishment of the Appraisal Board consisting of the Chairman and members; it defines the tasks, timeframes, and working procedures of the Appraisal Board. Depending on the requirements of the appraisal, the composition of the Appraisal Board includes scientists, doctors, head coaches, and sports experts with appropriate professional qualifications.
3. The Appraisal Board operates based on democratic and transparent principles regarding the results of the appraisal. Members of the Appraisal Board collectively discuss appraisal issues, and the opinions of the members must be fully recorded in the minutes of the Appraisal Board meetings.
4. Responsibilities of the Appraisal Board:
a) Selecting necessary and appropriate methods to conduct scientific appraisals in accordance with the specialized content requirements;
b) Members bear individual responsibility for their appraisal opinions and collective responsibility for the overall results of the Appraisal Board;
c) Maintaining confidentiality about the results of the appraisal, appraisal information, and documents.
5. The Institute of Physical Culture and Sports serves as the permanent body of the Appraisal Board and is responsible for:
a) Proposing a list of Appraisal Board members for the General Department of Physical Culture and Sports to consider and decide;
b) Developing scientific appraisal plans for the General Department of Physical Culture and Sports to decide.
Article 6. Content of Scientific Appraisal
1. Examination and evaluation of physical fitness and technical skills according to the criteria proposed by the Appraisal Council for consideration and decision by the General Department of Physical Culture and Sports.
2. Examination and evaluation of morphology according to the criteria selected by the Appraisal Council from those specified in Appendix 1 issued together with this Circular.
3. Examination and evaluation of biological aspects according to the criteria selected by the Appraisal Council from those specified in Appendix 2 issued together with this Circular.
4. Examination and evaluation of psychological aspects according to the criteria selected by the Appraisal Council from those specified in Appendix 3 issued together with this Circular.
5. Health examination according to the content stipulated in Clause 1, Article 9 of this Circular.
6. Doping test: The doping test shall be carried out in accordance with the laws on preventing and combating doping in sports activities. The Appraisal Council uses the results of the doping test to serve the scientific appraisal process to evaluate athletes' training levels.
Article 7. Organization of Scientific Appraisal
1. The scientific appraisal activity is conducted annually based on the Appraisal Plan approved by the General Department of Physical Culture and Sports.
2. The Appraisal Council implements the appraisal as follows:
a) Drafting the appraisal outline with the following basic contents: determining the professional conditions, relevant legal provisions expected to be applied during the appraisal; estimated time to complete the appraisal; list of personnel conducting the appraisal, the person assigned to lead the appraisal, information about the capabilities of the individuals conducting the appraisal;
b) In cases where necessary, the Appraisal Council proposes to conduct surveys of the subjects to be appraised to serve the planning and implementation of the appraisal work;
c) Collect information and documents related to the content to be appraised.
d) Conduct the appraisal.
d) Building the appraisal results.
3. During the implementation process, the Appraisal Council must fully, truthfully, and promptly record the entire appraisal process in writing. The written records of the implementation process must be kept in the Appraisal File.
4. The Appraisal Council has the right to use experimental results, additional testing results, or specialized conclusions by individuals or organizations with appropriate qualifications and capabilities to serve the appraisal process.
Article 8. Results of Scientific Appraisal
1. The scientific appraisal results of the Appraisal Council must be recorded in a protocol signed by the Chairman and members of the Council. Within fifteen working days from the date of the appraisal protocol, the Appraisal Council is responsible for reporting the appraisal results to the General Department of Physical Culture and Sports.
2. Based on the scientific appraisal results, compared with the adjacent scientific appraisal indices (if any), the Appraisal Council reports to the General Department of Physical Culture and Sports for consideration and decision on the training and use of athletes.
3. The Appraisal File must be retained at the Institute of Physical Culture and Sports, except where otherwise provided by law. The Institute of Physical Culture and Sports is responsible for preserving and retaining the Appraisal File under the "Confidential" regime.
Section 2
HEALTH CHECKUP
Article 9. Content of Health Checkup
1. Content of health checkup for athletes: Athletes are checked for health according to the content recorded in the Health Examination Certificate prescribed in Appendix 1 and Appendix 2 issued together with Circular No. 14/2013/TT-BYT dated May 6, 2013 of the Ministry of Health on guiding health examinations.
2. Time of health checkup:
a) Annual health checkup according to the training goals and plans.
b) Additional health checkup for newly recruited athletes, athletes starting training after injury treatment, transfer of training lines, and other cases required by the training and coaching institution.
Article 10. Health Examination Authority
Medical facilities that have been granted a license and meet the conditions stipulated in Circular No. 14/2013/TT-BYT dated May 6, 2013, issued by the Ministry of Health on guiding health examinations for athletes shall conduct health checks.
Article 11. Responsibilities of Training and Coaching Institutions
1. The health examination of athletes shall be carried out by health examination authorities based on the decision of the head of the training and coaching institution.
2. Based on the results of the athlete's health examination, the training and coaching institution shall be responsible for:
a) Submitting to the competent authority for approval the list of athletes who are fit and whose training level is appropriate for the training and coaching line.
b) Storing the health examination and evaluation results in accordance with regulations.
Chapter III
IMPLEMENTING PROVISIONS
Article 12. Implementation Funding
1. Scientific appraisal funds are allocated in the annual budget of the General Department of Physical Culture and Sports.
Provincial People's Committees, municipalities directly under the Central Government, training and coaching institutions shall base their scientific appraisal regulations and application for assessing athletic training levels for athletes they manage on this Circular and local conditions.
2. The cost of athlete health examinations shall be arranged and implemented by the direct training and coaching management authority overseeing the athletes.
Article 13. Responsibility for Implementation
1. Authorities managing training and coaching institutions, organizations, and related agencies are responsible for implementing this Circular.
2. The General Department of Physical Culture and Sports is responsible for guiding, urging, and inspecting the implementation of this Circular.
Article 14. Effective Date
1. This Circular takes effect from August 1, 2015.
2. Abolish the health examination provisions for athletes set forth in Decision No. 44/2005/QĐ-UBTDTT dated January 13, 2005, issued by the Minister and Chairman of the State Sports Committee on issuing the Regulations on Ensuring Medical Care for Athletes of National Sports Teams.
3. During implementation, if there are any difficulties, they should be promptly reported to the Ministry of Culture, Sports and Tourism for review and necessary amendments.
