Units under the Ministry of National Defense and the Ministry of Public Security that employ workers under labor contracts. This Circular applies to the Governmental Committee for Religious Affairs, Departments of Home Affairs, Inspection Departments of Home Affairs, administrative state agencies, organizations, and individuals related to the implementation of laws on beliefs and religions. ect thực hiện một số Article Article 3. Notification of labor movement working under labor contracts at units under the Ministry of National Defense and the Ministry of Public Security according to Clause 6 of Article 32 of Decree No. 28/2015/ND-CP 1. Cases determined as labor movement in the unit:a) Increase in workers working under labor contracts; b) Decrease in workers working under labor contracts;c) Temporary suspension of labor contracts.2. Units under the Ministry of National Defense and the Ministry of Public Security report the number of increased workers, the number of decreased workers, reasons for increase, reasons for decrease; the number of workers temporarily suspending labor contracts according to the guidance of the Ministry of National Defense and the Ministry of Public Security. 3. The Ministry of National Defense and the Ministry of Public Security are responsible for compiling the situation of labor movement of units to notify the Ministry of Labor - Invalids and Social Affairs as follows:monitoring the effectiveness of management and use of the budget for business activities, equipment, anda) Annually six months into the year (before July 15) notify the Ministry of Labor - Invalids and Social Affairs (Employment Bureau) about the situation of labor movement (from January 1 to June 30); b) Annually (before January 15 of the following year) notify the Ministry of Labor - Invalids and Social Affairs (Employment Bureau) about the situation of labor movement (from January 1 to December 31 of the relevant year);

Article 1. Scope of Regulation

c) The Ministry of National Defense and the Ministry of Public Security notify about the situation of labor movement of units under the Ministry of National Defense and the Ministry of Public Security according to Model No. 1 issued together with this Circular.

Article 2. Applicability

4. Within seven working days from the date when units under the Ministry of National Defense and the Ministry of Public Security reduce or plan to reduce 100 workers or more, they must report to the Ministry of National Defense and the Ministry of Public Security to notify the Ministry of Labor - Invalids and Social Affairs (Employment Bureau).

2. The Social Insurance Department of the People's Public Security assists the Minister of Public Security in guiding units to report, compile the situation of labor movement and notify the Ministry of Labor - Invalids and Social Affairs about the situation of labor movement according to this Circular, coordinating with ministries, sectors, localities to resolve issues arising during implementation.

3. The Employment Bureau assists the Minister of Labor - Invalids and Social Affairs in compiling the situation of labor movement working under labor contracts at units under the Ministry of National Defense and the Ministry of Public Security and coordinating with ministries, sectors, localities to resolve issues arising during implementation.

2. Circular No. 14/2013/TTLT-BLDTBXH-BQP-BCA dated August 22, 2013 between the Minister of Labor - Invalids and Social Affairs, the Minister of National Defense and the Minister of Public Security on guidelines for implementing Clause 2 of Article 10 of Decree No. 127/2008/ND-CP dated December 12, 2008 of the Government providing detailed regulations and guidance on implementation of certain provisions of the Social Insurance Law regarding unemployment insurance, which has been amended and supplemented by Decree No. 100/2012/ND-CP dated November 21, 2012 of the Government on notification to labor authorities when there is labor movement at units under armed forces, shall cease to be effective from the date this joint circular takes effect.

3. During the implementation process, if there are any difficulties, please reflect them to the Ministry of Labor - Invalids and Social Affairs, the Ministry of National Defense and the Ministry of Public Security for timely consideration and resolution./.

The Social Insurance of the People's Public Security assists the Minister of Public Security in guiding units to report, compile the situation of labor movement, and notify the Ministry of Labor, Invalids and Social Affairs about the situation of labor movement in accordance with this Circular, and coordinate with ministries, sectors, and localities to resolve related issues and problems arising.

The Employment Department assists the Minister of Labor, Invalids and Social Affairs in compiling the situation of labor movement working under labor contracts at units under the Ministry of National Defense and the Ministry of Public Security, and coordinates with ministries, sectors, and localities to resolve related issues and problems arising.

Article 5. Effective Date

1. This Circular takes effect from May 15, 2016.

2. Circular Jointly Issued No. 14/2013/TTLT-BLDTBXH-BQP-BCA dated August 22, 2013, between the Minister of Labor, Invalids and Social Affairs, the Minister of National Defense, and the Minister of Public Security on guiding the implementation of Clause 2, Article 10 of Decree No. 127/2008/NĐ-CP dated December 12, 2008 of the Government detailing and guiding the implementation of certain Articles of the Law on Social Insurance regarding unemployment insurance, which has been amended and supplemented by Decree No. 100/2012/NĐ-CP dated November 21, 2012 of the Government concerning notification to labor authorities when there is labor movement at units under the armed forces, shall cease to be effective from the date this Circular Jointly Issued takes effect.
