OBJECTIVE OF THE NATIONAL SUSTAINABLE POVERTY REDUCTION PROGRAM FOR THE PERIOD 2016 - 2020
Pursuant to the Law on Government Organization dated June 19, 2015;
Considering the proposal of the Minister, Chairman of the Committee for Ethnic Minorities Affairs;
The Prime Minister issues this Decision on criteria for determining rural communities completing the objectives of Project 2 (Program 135) under the National Target Program on Sustainable Poverty Reduction period 2016-2020.
Article 1. Scope of Regulation
Particularly difficult communes, border communes, safe area communes, and particularly difficult hamlets and villages implementing Project 2 (Program 135) as stipulated in Article 1 of Decision No. 1722/QĐ-TTg dated September 2, 2016 of the Prime Minister approving the National Target Program on Sustainable Poverty Reduction period 2016-2020.
Article 2. Criteria for Determining Communes Completing the Objectives of Project 2 (Program 135) Under the National Target Program on Sustainable Poverty Reduction Period 2016-2020
A commune completing the objectives of Program 135 is a commune that meets one of the following two criteria:
1. Being recognized by competent authorities as reaching the new rural standard or being upgraded to a town or township.
2. Meeting four conditions set out in point a and at least two of six conditions set out in point b as follows:
a) Conditions that must be met:
- Having a total poverty rate and near-poverty rate according to the poverty standard for the period 2016-2020 below 35%, with the poverty rate below 20% (for border communes and safe area communes not in Zone III, and communes in the Southeast region and the Mekong Delta: having a total poverty rate and near-poverty rate according to the poverty standard for the period 2016-2020 below 25%, with the poverty rate below 15%).
- Road infrastructure meeting Criterion 2 of the National Standards for New Rural Communes for the period 2016-2020 as prescribed in Decision No. 1980/QĐ-TTg dated October 17, 2016 of the Prime Minister on issuing the National Standards for New Rural Communes for the period 2016-2020 (hereinafter referred to as the National Standards for New Rural Communes).
- Schools meeting Criterion 5 of the National Standards for New Rural Communes.
- Meeting the national health criterion.
b) Flexible conditions:
- Irrigation systems meeting Criterion 3 of the National Standards for New Rural Communes.
- Electricity meeting Criterion 4 of the National Standards for New Rural Communes.
- Cultural facilities meeting Criteria 6.1 and 6.3 of the National Standards for New Rural Communes.
- Radio stations meeting Criterion 8.3 of the National Standards for New Rural Communes.
- The proportion of households using hygienic and clean water meeting Criterion 17.1 of the National Standards for New Rural Communes.
- More than 15% of poor and near-poor household representatives in the commune and over 50% of grassroots cadres have been trained to improve their capacity under Program 135 and other programs, projects, and policies during the period 2016-2020.
Article 3. Criteria for Determining Hamlets, Villages, and Equivalent Units (hereinafter collectively referred to as hamlets) Completing the Objectives of Project 2 (Program 135) Under the National Target Program on Sustainable Poverty Reduction Period 2016-2020
A hamlet completing the objectives of Program 135 is a hamlet that meets one of the following three criteria:
1. The hamlet of a commune recognized as reaching the new rural standard or the hamlet recognized as reaching the new rural standard.
2. The hamlet has a total poverty rate and near-poverty rate from 55% (in the Southeast region and the Mekong Delta from 30%) to below 65% according to the multidimensional poverty standard for the period 2016-2020 and meets at least two of the following three conditions:
a) The main road in the hamlet or connecting hamlets is hardened according to the new rural standard.
b) At least 60% of preschool classrooms are constructed solidly.
c) There is a communal cultural house and sports area in accordance with regulations of the Ministry of Culture, Sports and Tourism.
3. The hamlet has a total poverty rate and near-poverty rate below 55% (in the Southeast region and the Mekong Delta below 30%) according to the multidimensional poverty standard for the period 2016-2020 and meets at least one of the following three conditions:
a) The main road in the hamlet or connecting hamlets is hardened according to the new rural standard.
b) At least 60% of preschool classrooms are constructed solidly.
c) There is a communal cultural house and sports area in accordance with regulations of the Ministry of Culture, Sports and Tourism.
Article 4. Procedures for identifying communes and villages that have achieved the objectives of Program 135
1. Commune level: Based on the criteria stipulated in Articles 1 and 2 of this Decision, the People's Committee at the commune level shall register villages and communes that have completed the objectives of Program 135 (in Form No. 01 attached to this Decision); direct villages to organize reviews of villages and reviews of communes that have completed the objectives of Program 135; prepare reports on the results of reviewing communes and villages that have completed the objectives of Program 135 (in Form No. 02 attached to this Decision) and submit them to the People's Committee at the district level (through the leading agency of Program 135 at the district level).
2. District level: After receiving all reports from the commune level, the People's Committee at the district level shall compile and prepare reports on the results of reviewing communes and villages that have completed the objectives of Program 135 at the district level (in Form No. 03 attached to this Decision) and submit them to the People's Committee at the provincial level (through the ethnic affairs agency at the provincial level).
3. Provincial level: After receiving all reports from the district level, the People's Committee at the provincial level shall assign the ethnic affairs agency at the same level to take the lead, coordinate with relevant departments to review (the review record form is in Form No. 04 attached to this Decision) and report to the People's Committee at the provincial level. Based on the review results, the People's Committee at the provincial level shall prepare reports on the results of reviewing and proposing communes and villages that have completed the objectives of Program 135 (in Form No. 05 attached to this Decision), accompanied by the review record and the report on the results of reviewing communes and villages that have completed the objectives of Program 135 at the district level, and submit them to the National Ethnic Minorities Commission.
4. Central level: After receiving all reports on the results of reviewing and proposing communes and villages that have completed the objectives of Program 135 from the People's Committees at the provincial level (accompanied by the review records and reports on the results of reviewing communes and villages that have completed the objectives of Program 135 at the district level) in accordance with the regulations, the National Ethnic Minorities Commission shall take the lead, coordinate with relevant ministries and agencies to review, inspect the results, and compile and present to the Prime Minister for consideration and decision to recognize communes that have completed the objectives of Program 135; the Minister and Head of the National Ethnic Minorities Commission shall decide to recognize villages that have completed the objectives of Program 135.
5. Timeframe for identifying communes and villages that have completed the objectives of Program 135:
a) Reports on the results of reviewing and proposing communes and villages that have completed the objectives of Program 135 at the provincial level (accompanied by the review records and reports on the results of reviewing communes and villages that have completed the objectives of Program 135 at the district level) shall be submitted to the National Ethnic Minorities Commission before April 30 of the year immediately preceding the year in which the completion of the objectives of Program 135 is proposed.
b) The timeframes for registering villages and communes that have completed the objectives of Program 135 at the commune level and the timeframes for submitting reports on the results of reviewing at the commune level to the district level and at the district level to the provincial level shall be specified by the People's Committee at the provincial level.
c) Data for determining the criteria for communes and villages that have completed the objectives of Program 135 shall be taken as of December 31 of the year in which the completion of the objectives of Program 135 is proposed. For data not yet compiled up to that date, it shall be taken as of the nearest available date. Specifically, data on the poverty rate and near-poverty rate must be taken as of December 31 of the year in which the completion of the objectives of Program 135 is proposed.
Article 5. Principles for handling funds for communes and villages that have completed the objectives of Program 135
Communes and villages that have been approved by competent authorities as having completed the objectives of Program 135 shall continue to implement investment support from Program 135 until the year the approval decision takes effect. From the following year, these communes and villages will not be eligible for investment support under Program 135 for the period 2016-2020.
Article 6. Implementation Organization
1. The Committee for Ethnic Minority Affairs: Shall take the lead and coordinate with relevant ministries and sectors to direct and guide localities in implementing the program; review, inspect, and compile results to determine communes and villages that have completed the objectives of Program 135, and submit to competent authorities for decisions on communes and villages that have completed the objectives of Program 135.
2. People's Committees of provinces and centrally governed cities: Shall direct and organize the determination of communes and villages that have completed the objectives of Program 135 according to the criteria specified in this Decision and guidelines from the Committee for Ethnic Minority Affairs; allocate budgets to organize reviews of communes and villages that have completed the objectives of Program 135 in accordance with current state budget management levels.
Article 7. Implementation Provisions
1. This Decision shall take effect from March 1, 2019.
2. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, and Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Decision./.
