CIRCULAR

Regulations on periodic reporting within the scope of management under the Ministry of Science and Technology

Pursuant to Decree No. 95/2017/NĐ-CP dated August 16, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

Decree No. Decree No. 09/2019/NĐ-CP dated January 24, 2019 of the Government stipulating the reporting system of administrative agencies;

At the proposal of the Director of the Office of the Ministry of Science and Technology and the Director of the Legal Department;

The Minister of Science and Technology issues this Circular stipulating the periodic reporting system within the scope of state management of the Ministry of Science and Technology.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

1. This Circular stipulates the periodic reporting system of administrative agencies under the scope of management of the Ministry of Science and Technology; the application of information technology in implementing the reporting system and building the Information Reporting System of the Ministry of Science and Technology; the responsibilities of units under the Ministry of Science and Technology and related organizations and individuals in implementing the reporting system.

2. This Circular does not regulate:

a) The statistical reporting system for the science and technology sector as prescribed by laws on statistics;

b) Internal reporting systems within agencies under the Ministry of Science and Technology;

c) Confidential reporting systems as prescribed by laws on state secrets.

Article 2. Applicability

1. Administrative agencies, civil servants, and officials related to the implementation of the periodic reporting system within the scope of management of the Ministry of Science and Technology.

2. Organizations and individuals related to the implementation of the periodic reporting system within the scope of management of the Ministry of Science and Technology shall be determined by competent authorities.

Article 3. Principles and requirements for issuing reporting regulations

Principles and requirements for issuing periodic reporting regulations shall be implemented in accordance with Articles 5 and 11 of Decree No. 09/2019/NĐ-CP dated January 24, 2019 of the Government stipulating the reporting system of administrative agencies (hereinafter referred to as Decree No. 09/2019/NĐ-CP).

Chapter II

CONTENTS OF PERIODIC REPORTING SYSTEM WITHIN THE SCOPE OF MANAGEMENT OF THE MINISTRY OF SCIENCE AND TECHNOLOGY

Article 4. Types of Reports

1. Report on the results of state management activities in science and technology at local levels (Form No. 01 attached as Appendix to this Circular).

2. Report on the results of state management activities in science and technology of ministries and sectors (Form No. 02 attached as Appendix to this Circular).

3. Report on the results of activities of High-Tech Zones (Form No. 03 attached as Appendix to this Circular).

4. Report on the implementation of the Program "Supporting the National Innovation Ecosystem until 2025" (Form No. 04 attached as Appendix to this Circular).

Article 5. Subjects Implementing Reports

1. Ministries, ministerial-level agencies, and government agencies implement reports as stipulated in Clause 2 and Clause 4 of Article 4 of this Circular.

2. People's Committees of provinces and centrally governed cities implement reports as stipulated in Clause 1 and Clause 4 of Article 4 of this Circular.

3. High-Tech Zones established by the Prime Minister's Decision and falling under the scope of management of the Ministry of Science and Technology implement reports as stipulated in Clause 3 of Article 4 of this Circular.

Article 6. Receiving Agency

The Ministry of Science and Technology is the agency receiving the reports stipulated in Article 4 of this Circular.

Article 7. Frequency of Reporting, Time for Finalizing Data, and Deadline for Submitting Reports

1. Frequency of Reporting: Annually

2. Time for finalizing data and deadline for submitting reports:

a) The time for finalizing data for annual periodic reports is from December 15 of the previous reporting year to December 14 of the current reporting year;

b) The latest submission deadline for reports is December 20 each year.

Article 8. Forms of reports and methods for submitting reports

1. Reports shall be presented in one of the following forms:

a) Written reports signed by authorized persons of the agencies or organizations, stamped according to regulations, and sent in electronic form (file.doc) via email;

b) Electronic reports in the form of data messages, formatted according to the guidelines of the competent state authority, created or digitized from paper documents, and submitted and received through the National Document Interconnection System and the Information Reporting System of the Ministry of Science and Technology.

2. Reports shall be submitted to the Ministry of Science and Technology through one of the following methods:

a) Through the National Document Interconnection Trunk;

b) Submission through the Information Reporting System of the Ministry of Science and Technology;

c) Submission via email;

e) Sending via postal service.

d) Sending through postal services;

e) Submission via fax.

Chapter III

APPLICATION OF INFORMATION TECHNOLOGY IN IMPLEMENTING THE REPORTING SYSTEM AND THE INFORMATION REPORTING SYSTEM OF THE MINISTRY OF SCIENCE AND TECHNOLOGY

Article 9. Application of Information Technology in Implementing Reporting Systems

1. The Ministry of Science and Technology shall be responsible for applying information technology in implementing reporting systems, building an Information Reporting System to facilitate electronic reporting, making it easier to aggregate and share reporting information and saving time and costs for entities required to report.

2. The legal validity of electronic reports and the use of digital signatures shall be implemented in accordance with current laws on the application of information technology in the activities of state agencies.

Article 10. Information Reporting System of the Ministry of Science and Technology

1. The Information Reporting System of the Ministry of Science and Technology shall be built in accordance with the principles stipulated in Article 15 of Decree No. 09/2019/ND-CP and the basic functional requirements stipulated in Article 17 and Clause 2 of Article 18 of Decree No. 09/2019/ND-CP.

2. The Information Reporting System of the Ministry of Science and Technology shall be connected to the Government's Information Reporting System through a national data integration and sharing platform.

Article 11. Technical Infrastructure and Technology

The Ministry of Science and Technology shall ensure technical infrastructure, technology, security, and information safety to serve the construction and operation of the Information Reporting System of the Ministry of Science and Technology.

Chapter IV

Article 30. IMPLEMENTATION AND ORGANIZATION OF IMPLEMENTATION

Article 12. Responsibilities of Units under the Ministry of Science and Technology

1. Units under the Ministry shall regularly review and evaluate regulations on the implementation of reporting systems within their authority to amend, supplement, or propose amendments and supplements to align with the scope of management functions of the Ministry of Science and Technology and meet the principles and requirements of Decree No. 09/2019/ND-CP.

2. Responsibilities of the Ministry’s Office:

a) Announce the List of Regular Reports as prescribed in legal normative documents issued by the Ministry of Science and Technology or advised to issue according to Clause 3 of Article 30 of Decree No. 09/2019/ND-CP;

b) Manage, store, and share reporting information in the field of science and technology under the management responsibility of the Ministry of Science and Technology.

3. Responsibilities of the Information Technology Center:

a) Build, manage, and operate the Information Reporting System of the Ministry of Science and Technology, ensuring its connection to the Government's Information Reporting System;

b) Implement monitoring measures and information security assurance measures.

Article 13. Effective Date

1. This Circular takes effect from November 1, 2019.

2. Abolish the regular reporting system from administrative agencies sending reports to the Ministry of Science and Technology as prescribed in Circulars issued by the Minister of Science and Technology: Circular No. 16/2012/TT-BKHCN dated August 27, 2012 on state inspection of product quality in production under the management responsibility of the Ministry of Science and Technology; Circular No. 27/2012/TT-BKHCN dated December 12, 2012 on state inspection of imported goods' quality under the management responsibility of the Ministry of Science and Technology; Circular No. 28/2012/TT-BKHCN dated December 12, 2012 on conformity declaration and assessment methods; Circular No. 28/2013/TT-BKHCN dated December 17, 2013 on state measurement inspection; Circular No. 03/2014/TT-BKHCN dated March 31, 2014 guiding conditions for establishment and registration of scientific and technological organizations, representative offices, branches of scientific and technological organizations; Circular No. 02/2015/TT-BKHCN dated March 6, 2015 on evaluation and appraisal of non-state budget-funded scientific and technological tasks; and Circular No. 03/2016/TT-BKHCN dated March 30, 2016 on files, contents, procedures, and formalities for appraising the scientific basis of socio-economic development programs and technology of investment projects.

3. For regular reporting systems within the scope of management of the Ministry of Science and Technology currently in force as prescribed in legal normative documents issued by the Government and the Prime Minister, they shall be implemented according to Clause 3 of Article 32 of Decree No. 09/2019/ND-CP.

4. Regular reporting systems within the scope of management of the Ministry of Science and Technology issued by the Minister of Science and Technology before this Circular takes effect shall continue to be valid until amended, supplemented, replaced, or abolished.

5. Regular reporting systems within the scope of management of the Ministry of Science and Technology issued after this Circular takes effect must comply with the principles and requirements set forth in Decree No. 09/2019/ND-CP and this Circular.

Article 14. Implementation Organization

1. Ministries, ministerial-level agencies, government agencies, provincial People's Committees, centrally governed cities, and related organizations and individuals are responsible for organizing the implementation of this Circular.

2. Provincial People's Committees may apply this Circular to issue regular reporting systems in the field of science and technology within their management scope to require subordinate administrative agencies and related organizations and individuals to implement.

3. In the course of implementation, if there are difficulties, relevant agencies, organizations, and individuals are requested to promptly reflect them to the Ministry of Science and Technology for review, amendment, and supplementation to ensure compliance./.
