CIRCULAR

Detailed regulations guiding standards and quotas for the use of area of educational and training facilities

works and public services belonging to in the field of education and training

 

Pursuant to the Higher Education Law dated June 18, 2012; the Law Amending and Supplementing Certain Provisions of the Higher Education Law dated November 19, 2018;

Pursuant to Decree No. 69/2017/NĐ-CP dated May 25, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 152/2017/NĐ-CP dated December 27, 2017 of the Government stipulating standards and quotas for the use of office premises and activity bases of public institutions;

At the proposal of the Director of the General Infrastructure Department;

The Minister of Education and Training issues this Circular detailing and guiding standards and quotas for the use of area of educational and training facilities in the field of education and training.

Article 1. Scope of Regulation and Applicability

1. This Circular details and guides standards and quotas for the use of area of educational and training facilities in the field of education and training under the management of the Ministry of Education and Training as provided for in Article 9 of Decree No. 152/2017/NĐ-CP dated December 27, 2017 of the Government stipulating standards and quotas for the use of office premises and activity bases of public institutions.

2. This Circular applies to universities, academies, university-level schools, scientific research institutes authorized to train at the doctoral level, teacher training colleges, and secondary teacher training schools (hereinafter referred to collectively as training institutions) within the national education system and related units, organizations, and individuals.

Article 2. Interpretation of Terms

In this document, the following terms are understood as follows:

1. Educational and training facilities in the field of education and training are components of facilities within training institutions, including: classrooms, lecture halls; laboratories, practical rooms, workshops/farms; library (or learning resource center); offices for professors, associate professors, senior lecturers, lecturers; physical activity areas (sports competition house, sports practice house, indoor sports practice field, outdoor sports practice field, and swimming pool); dormitories; comprehensive service areas (cafeteria, canteen, grocery store); health station; parking house; lecturer restrooms.

2. Special-use area is determined as floor area measured according to clear dimensions (excluding corridor, staircase, lobby, balcony, wall base, column, technical box) of educational and training facilities in the field of education and training.

3. To serve as a basis for evaluating and recognizing "Learning Communities" at the commune, district, and province levels.

Standards and quotas for the use of area of educational and training facilities in the field of education and training stipulated in this Circular shall be used as a basis for training institutions to prepare plans and budget estimates; allocate, invest in construction, purchase, lease educational and training facilities; manage and utilize such facilities.

Article 4. Basis for determining standards and quotas for special-use area

1. Scale of students, trainees, lecturers converted according to the development orientation of the training institution.

2. Stable majors of training according to the development orientation of the training institution.

3. Training requirements of majors to determine the number of special-use facility components.

Article 5. Standards, quotas, and methods of calculation to determine special-use area for educational and training facilities in the field of education and training

1. Conference hall with 250 seats or more

The special-use area of conference halls with 250 seats or more is determined as follows:

SHT = A x K

Where: SHT is the total special-use area of conference halls with 250 seats or more, measured in square meters (m2);

A is the number of seats;

K is the quota area, measured in m2.

2. Lecture hall with a scale of 200 seats or more

The special-use area of lecture halls with 200 seats or more is determined as follows:

SGĐ = A x K

Where: SGĐ is the total special-use area of lecture halls with a scale of 200 seats or more, measured in m2;

A is the number of seats in the lecture hall;

K is the quota area, measured in m2.

3. Lecture hall with a scale of 100 seats or more

The special-use area of lecture halls with 100 seats or more is determined as follows:

SGĐ1 = A x K

Where: SGĐ1 is the total special-use area of lecture halls with a scale of 100 seats or more, measured in m2;

A is the number of seats in the lecture hall;

K is the quota area, measured in m2.

4. Ordinary classroom with less than 100 seats

a) Ensuring the number of classrooms meeting the training scale of the training institution;

b) The special-use area of classrooms is determined as follows:

SPH = SCN1 + SCN2 + ... + SCNn

Where: SPH is the total special-use area of ordinary classrooms with less than 100 seats, measured in m2;

SCN1, SCN2,… SCNn is the special-use area of each classroom of each major, determined as follows:

Where: CN1, CN2,…, CNn is the number of majors trained;

i is the order number of the academic year of students in a major;

T is the total number of theoretical lessons of one student in the i-th year of a major;

A is the total number of students in the i-th year of a major;

2. 160 is the maximum number of lessons that one seat can achieve in one academic year based on a program consisting of two semesters, each semester 15 weeks, six days per week, and a maximum of 12 lessons per day; K is the quota area, measured in m2.

5. Laboratory, practical room, workshop/farm

a) Ensuring the number of laboratories, practical rooms, workshops/farms meeting the training scale and majors of the training institution;

b) The special-use area of laboratories, practical rooms, workshops/farms is determined as follows:

STN = STN1 + STN2 + ... + STNn

Where: STN is the total special-use area of laboratories, practical rooms, workshops/farms, measured in m2;

STN1, STN2,… STNn is the special-use area of each laboratory, practical room, workshop/farm of each major, determined as follows:

Where: TN1, TN2,…, TNn is the number of types of laboratories, practical rooms, workshops/farms;

i is the order number of the academic year of students in a major;

T is the total number of lessons of one student in the i-th year using one type of laboratory, practical room, workshop/farm;

A is the total number of students in the i-th year using one type of laboratory, practical room, workshop/farm;

2. 160 is the maximum number of lessons that one seat can achieve in one academic year based on a program consisting of two semesters, each semester 15 weeks, six days per week, and a maximum of 12 lessons per day; K is the quota area, measured in m2.

6. Library

The special-use area of libraries is determined as follows:

STV = A x K

Where: STV is the total special-use area of the library, measured in m2;

A is at least 25% of the total number of students, trainees, and lecturers converted;

K is the quota area, measured in m2.

7. Dormitory

The special-use area of dormitories is determined as follows:

SKTX = A x K

Where: SKTX is the total special-use area of the dormitory, measured in m2;

A is the number of students, trainees requiring residence;

K is the quota area, measured in m2.

8. Physical activity area

a) The dedicated area for sports facility components shall be determined according to the current standards for each sport;

b) A multi-purpose sports hall must have a minimum size of 42m x 24m x 12.5m.

9. Working area for professors, associate professors, principal lecturers, and lecturers:

a) Each professor requires a working area of 18m²;

b) Each associate professor requires a working area of 15m²;

c) Each principal lecturer and lecturer requires a working area of 10m².

10. Waiting room for lecturers

a) For every 20 classrooms, there shall be one waiting room for lecturers;

b) The dedicated area for the waiting room is 3m² per lecturer, with the room's total area not being less than 24m² per room.

11. Comprehensive service area

The dedicated area for comprehensive service areas shall be determined as follows:

SDV = A x K

In which: SDV is the total dedicated area of the comprehensive service area, measured in square meters;

A is at least 30% of the scale of students and trainees;

K is the quota area, measured in m2.

12. Health station: The maximum total dedicated area of the Health Station shall not exceed 300m², including: Headroom and on-duty doctors' room; Examination room; Injection and procedure room; Nurse record and dispensing room; Medicine and equipment storage; Patient room; Patient dining room.

13. Parking lot

a) The parking lot must ensure sufficient space for vehicles of 30% to 60% of the total number of students and trainees, and from 60% to 90% of the total number of lecturers, staff, and employees;

b) Area standard: 0.9m²/bicycle; 2.5m²/motorcycle; 25m²/car; Arranging parking areas for disabled students and trainees near the entrance.

14. Toilet facilities

a) Staff, lecturer, and employee toilet facilities: arranged according to functional blocks, in cases where they are separate, they should be placed in convenient locations without affecting the environment. Separate male and female toilets; ensuring the number of facilities: for males, 1 urinal for every 15 people, 1 toilet for every 20 people, 1 sink for every 4 toilets but not less than 1; for females, 1 toilet for every 15 people, 1 sink for every 2 toilets but not less than 1;b) Student and trainee toilet facilities: arranged according to functional blocks, in cases where they are separate, they should be placed in convenient locations without affecting the environment. Separate male and female toilets, ensuring accessibility for disabled students and trainees; ensuring the number of facilities: for males, 1 urinal, 1 toilet, and 1 sink for 30 students and trainees, with partitions between urinals and toilets; for females, 1 toilet and 1 sink for 30 students and trainees.

15. Dedicated area quota (coefficient K) (Annex attached).

1. For standards and quotas for the use of construction area for educational and training public services that have been issued or delegated authority to issue before this Circular takes effect, if they comply with the provisions of this Circular, they shall continue to be implemented. If they do not comply with the provisions of this Circular, a review shall be conducted and proposals made for appropriate amendments and supplements.

Article 6. Transitional Provisions

2. For new investment construction projects and renovation and upgrading of existing educational public service facilities approved by competent authorities according to regulations before this Circular takes effect, the standards and quotas shall not be re-determined according to the provisions of this Circular.

1. Training institutions shall base their standards and quotas for the use of dedicated areas on the provisions of this Circular, develop them, and submit them to the directly superior authority for issuance or seek authorization for issuance.

Article 7. Implementation Organization

2. Training institutions that self-finance recurrent expenses and investments shall base their standards and quotas for the use of dedicated areas on the provisions of this Circular, develop, and issue them.

3. Decisions on the issuance of standards and quotas for the use of dedicated areas shall be publicly disclosed on the websites of training institutions.

1. This Circular shall take effect from March 27, 2020.

Article 8. Effectiveness and Responsibility for Implementation

2. The Director of the Office, the Director of the Department of Infrastructure, the Heads of units under the Ministry of Education and Training; the Chairmen of Provincial People's Committees; the Directors of Departments of Education and Training; the Heads of training institutions and related organizations and individuals are responsible for implementing this Circular./.

2. The Director of the Office, the Director of the Material and Infrastructure Department, the Heads of units under the Ministry of Education and Training; the Chairpersons of the People's Committees of provinces and centrally governed cities; the Directors of Departments of Education and Training; the Heads of training institutions and related organizations and individuals are responsible for implementing this Circular./.
