Based on Decree No. 62/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

Pursuant to Decree No. 27/2022/NĐ-CP dated April 19, 2022, promulgated by the Government stipulating the management mechanism and organization of implementing national target programs;

Implementing Decision No. 1719/QD-TTg dated October 14, 2021, approving the National Target Program on Socio-Economic Development in Ethnic Minority and Mountainous Areas for the period 2021-2030, Phase I: from 2021 to 2025, issued by the Prime Minister;

Implementing Decision No. 90/QD-TTg dated January 18, 2022, approving the National Target Program on Sustainable Poverty Reduction for the period 2021-2025, issued by the Prime Minister;

Implementing Decision No. 263/QD-TTg dated February 22, 2022, approving the National Target Program on New Rural Development for the period 2021-2025, issued by the Prime Minister;

Based on the proposal of the Director General of the General Department of Vocational Education;

The Minister of Labour - Invalids and Social Affairs issues this Circular amending and supplementing some articles of Circular No. 17/2022/TT-LDTBXH dated September 6, 2022, guiding the implementation of certain contents on vocational education and employment for workers in small projects and components under three national target programs during the period 2021-2025.

Article 1. Amending and supplementing some articles of Circular No. 17/2022/TT-LDTBXH dated September 6, 2022, issued by the Minister of Labour - Invalids and Social Affairs guiding the implementation of certain contents on vocational education and employment for workers in small projects and components under three national target programs during the period 2021-2025 (hereinafter referred to as Circular No. 17/2022/TT-LDTBXH).

1. Supplement Clause 3 to Article 7 as follows:

"3. The industries and trades selected to establish economic and technical norms for training shall be decided by the agency entrusted with the task of organizing their establishment based on the planning, strategy, and development plan of the region, industry, and locality within the scope of the Program."

2. Supplement Clause 3 to Article 8 as follows:

"3. The industries and trades selected to establish the minimum training equipment list shall be decided by the agency entrusted with the task of organizing their establishment based on the planning, strategy, and development plan of the region, industry, and locality within the scope of the Program."

3. Supplement Clause 3 to Article 9 as follows:

"3. The industries and trades selected to establish the standards for material infrastructure in practical, experimental, and testing activities shall be decided by the agency entrusted with the task of organizing their establishment based on the planning, strategy, and development plan of the region, industry, and locality within the scope of the Program."

4. Amend and supplement Article 10 as follows:

"a) In accordance with the provisions of the law on prices; Decree No. 60/2021/NĐ-CP dated June 21, 2021, promulgated by the Government stipulating the financial autonomy mechanism of public service units and other relevant provisions; Decree No. 32/2019/NĐ-CP dated April 10, 2019, promulgated by the Government stipulating the assignment of tasks, ordering or tendering for the provision of products and services using state budget funds from regular expenditure.

b) The industries and trades selected to establish the price of vocational education services using state budget funds shall be decided by the competent authority according to the list of public goods and services in the field of vocational education and training, ensuring consistency with the planning, strategy, and development plan of the region, industry, and locality within the scope of the Program."

5. Amend the name of Article 23 and amend Clause 2 of Article 23 as follows:

a) Amend the name of Article 23 as follows:

"Article 23. Establishing vocational training models; supporting vocational training."

b) Amend Clause 2 of Article 23 as follows:

"2. Implementation method: As stipulated in Clause 2 of Article 20, Clause 2 of Article 21 of this Circular and Article 24 of Circular No. 15/2022/TT-BTC."

6. Amend Clause 1 of Article 32 as follows:

"1. Supporting repair and maintenance of some items of construction works, workshops, classrooms, dormitories, and facilities serving student life and training; purchasing machinery and equipment for training at vocational education institutions in ethnic minority and mountainous areas."

7. Amend Point e of Clause 2 of Article 36 as follows:

"e) Supporting vocational training at the primary level and less than three months for rural laborers within the working age group in rural areas including villages, communes, districts, towns, and cities in provinces with communes among the 63 centrally governed provinces and cities."

Article 2. Effective Date

1. This Circular takes effect from May 31, 2023. Activities related to Articles 7, 8, 9, 10, 23, 32, and 36 of Circular No. 17/2022/TT-LDTBXH amended and supplemented by this Circular that have arisen before the effective date of this Circular shall continue to be implemented in accordance with Circular No. 17/2022/TT-LDTBXH until the completion of the content and fiscal year.
