CIRCULAR

Amending and supplementing certain articles of Circular No. 27/2011/TT-BGTVT dated April 14, 2011, issued by the Minister of Transport on the Implementation of the 2002 Amendments to the International Convention on Safety of Life at Sea 1974 adopted with the International Code for the Security of Ships and of Ports

Pursuant to the Vietnam Maritime Code on November 25, 2015;

Pursuant to the 2002 Amendments to the International Convention on Safety of Life at Sea 1974 adopted with the International Code for the Security of Ships and of Ports;

BASED ON THE DECREE NO. 56/2022/ND-CP dated August 24, 2022 of THE GOVERNMENT stipulating the functions, tasks, powers, and organizational structure of THE MINISTRY OF TRANSPORT;

Pursuant to Decision No. 191/2003/QĐ-TTg dated September 16, 2003, of the Prime Minister approving the 2002 amendments to certain chapters of the International Convention on Safety of Life at Sea 1974;

At the proposal of the Director of the Department of Transport and the Director of the Vietnam Ship Inspection Bureau;

The Minister of Transport hereby issues this Circular amending and supplementing certain articles of Circular No. 27/2011/TT-BGTVT dated April 14, 2011, issued by the Minister of Transport on the Implementation of the 2002 Amendments to the International Convention on Safety of Life at Sea 1974 adopted with the International Code for the Security of Ships and of Ports.

Article 1. Amending and supplementing certain articles of Circular No. 27/2011/TT-BGTVT dated April 14, 2011, issued by the Minister of Transport on the Implementation of the 2002 Amendments to the International Convention on Safety of Life at Sea 1974 adopted with the International Code for the Security of Ships and of Ports (hereinafter referred to as Circular No. 27/2011/TT-BGTVT).

1. Amend and supplement Clause 2, Article 3 as follows:

"2. Responsibilities of the Vietnam Ship Inspection Bureau

The Vietnam Ship Inspection Bureau performs the function of "Recognized Security Organization," with responsibilities and authorities as follows:

a) Guide shipping companies in developing the Ship Security Plan, approve the Ship Security Plan;

b) Assess ship security and issue the International Ship Security Certificate."

2. Amending and supplementing Clause 4 of Article 3 as follows:

"4. Responsibilities of Training Institutions

a) Organize training for port security officers, ship security officers, and company security officers in accordance with the standard program of the International Maritime Organization; issue the Port Security Officer Professional Training Certificate according to the model specified in Appendix V and the Ship Security Officer Professional Training Certificate, Company Security Officer Professional Training Certificate according to the model specified in Appendix XIV of this Circular;

b) Organize refresher training for port security officers and company security officers;

c) Maintain and update the list of individuals who have been issued the Port Security Officer Professional Training Certificate, Ship Security Officer Professional Training Certificate, and Company Security Officer Professional Training Certificate."

3. Supplement Point g following Point e Clause 5 Article 3 as follows:

"g) At least once every five years, arrange for port security officers to participate in refresher training organized by training institutions."

4. Amending and supplementing Points c and d Clause 6 Article 3 as follows:

a) Amending and supplementing Point c Clause 6 as follows:

"c) Arrange for those officers expected to be designated as Ship Security Officers and personnel expected to be assigned as Company Security Officers to participate in training courses for the issuance of the Ship Security Officer Professional Training Certificate and the Company Security Officer Professional Training Certificate organized by training institutions.

At least once every five years, arrange for company security officers to participate in refresher training organized by training institutions;"

b) Amending and supplementing Point d Clause 6 as follows:

"d) Ensure that ships fully and promptly comply with requirements for: ship security assessment; development of the Ship Security Plan for review, approval, and issuance of the International Ship Security Certificate. At the same time, ensure that these ships are issued the "Ship Record" and "Security Commitment" for use when necessary;"

5. Amending and supplementing Point b Clause 1 Article 4 as follows:

"b) The Vietnam Ship Inspection Bureau receives and reviews the application; if the application is incomplete, within two working days from the date of receipt of the application, guide the shipping company to complete the application; if the application is complete, within seven working days from the date of receipt of a valid application, agree on the time and place for the assessment at the request of the shipping company;"

6. Amending and supplementing Point a Clause 2 Article 4 as follows:

"a) Shipping companies submit applications through the postal service or directly to the Vietnam Ship Inspection Bureau;"

7. Amending and supplementing Point b Clause 1 Article 5 as follows:

"b) The Vietnam Ship Inspection Bureau receives and reviews the application; if the application is incomplete, within two working days from the date of receipt of the application, guide the shipping company to complete the application;"

8. Amending and supplementing Point a Clause 3 Article 5 as follows:

"a) Application contents:

One Application for Approval of the Ship Security Plan according to the model specified in Appendix X and one original copy of the Ship Security Plan;"

Article 2. Repeal and replace certain provisions of Circular No. 27/2011/TT-BGTVT

1. Replace Appendix V, Appendix VI, Appendix VII, Appendix X, and Appendix XIV issued together with Circular No. 27/2011/TT-BGTVT respectively with Appendices I, II, III, IV, and V issued together with this Circular.

2. Repeal Article 6.

Article 3. Effectiveness and Implementation

1. This Circular takes effect from April 15, 2024.

2. Transitional provisions: Certificates of Security Officer Training for Seafarers and Certificates of Security Officer Training for Company Security Officers issued before the date this Circular takes effect shall continue to be valid until their expiration dates as stated on the certificates.

3. The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, Directors of the Vietnam Maritime Administration, Directors of the Vietnam Ship Registry, Heads of agencies and units under the Ministry of Transport, relevant organizations and individuals are responsible for implementing this Circular./.
