Pursuant to the Bidding Law No. 22/2023/QH15 dated June 23, 2023;
Pursuant to Decree No. 23/2024/NĐ-CP dated February 27, 2024 of the Government detailing certain provisions and measures for implementing the Law on Tendering regarding the selection of investors to implement projects in cases where tendering must be organized according to the provisions of sectoral laws;
Pursuant to Decree No. 89/2022/NĐ-CP dated October 28, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Planning and Investment;
Article 1. Scope of Application
The Minister of Planning and Investment hereby issues this Circular regulating the model dossier for selecting investors to implement projects in cases where tendering must be organized according to the provisions of sectoral laws.
Article 1. Scope of Regulation
This Circular regulates the model dossier for selecting investors to implement projects in cases where tendering must be organized according to the provisions of sectoral laws, including:
1. Model Notice of Interest Invitation and Interest Dossier.
2. Model One-Stage Single-Envelope Tender Dossier.
3. Model One-Stage Two-Envelope Tender Dossier.
Article 2. Preparation of Interest Invitation Dossiers and Tender Dossiers and Principles for Applying Models
1. The Inviting Party shall prepare the Notice of Interest Invitation, Interest Dossier, and Tender Dossier as follows:
a) The Notice of Interest Invitation and Interest Dossier shall be prepared according to the model specified in Appendix I attached hereto;
b) The Tender Dossier shall be prepared according to the model specified in Appendix II attached hereto for projects applying open tendering or selective tendering methods with a single-envelope stage;
c) The Tender Dossier shall be prepared according to the model specified in Appendix III attached hereto for projects applying open tendering methods with a two-envelope stage.
2. In Appendices I, II, and III attached hereto, italicized content serves as guidance and illustration and should be concretized based on the scale, nature, field, and specific conditions (if any) of each project.
3. For projects applying open tendering methods with a two-stage single-envelope approach, the Inviting Party shall apply Appendix II attached hereto while ensuring compliance with the provisions of the Law on Tendering No. 22/2023/QH15 and Decree No. 23/2024/NĐ-CP dated February 27, 2024 of the Government detailing certain provisions and measures for implementing the Law on Tendering regarding the selection of investors to implement projects in cases where tendering must be organized according to the provisions of sectoral laws.
Article 3. Responsibility for Implementation
1. This Circular takes effect from the date of issuance.
2. During implementation, if there are any difficulties related to the content regulated in this Circular, relevant ministries, ministerial-level agencies, government agencies, provincial people's committees, and related agencies shall submit their opinions to the Ministry of Planning and Investment for timely review and guidance.
