Decision No. 03/2025/QĐ-TTg amends and supplements some provisions of Decision No. 15/2019/QĐ-TTg dated March 28, 2019 of the Government on implementing electronic border procedures at border gates managed by the Ministry of National Defense.

Pursuant to the Law on National Border dated June 17, 2003;

Pursuant to the Law on Information Technology dated June 29, 2006, amended and supplemented by Law No. 21/2017/QH14, Law No. 20/2023/QH15, and Law No. 24/2023/QH15;

Pursuant to the Law on Border Defense of Vietnam dated November 11, 2020;

Pursuant to the Law on Electronic Transactions dated June 22, 2023;

Pursuant to the Law on Identity Cards dated November 27, 2023;

Pursuant to Decree No. 112/2014/NĐ-CP dated November 21, 2014 of the Government on management of land border gates; Decree No. 34/2023/NĐ-CP dated June 16, 2023 of the Government amending and supplementing certain articles of Decree No. 112/2014/NĐ-CP dated November 21, 2014 of the Government on management of land border gates;

Pursuant to Decree No. 69/2024/ND-CP dated June 25, 2024 of the Government on electronic identification and authentication;

"Based on the proposal of the Minister of National Defense;"

The Prime Minister promulgates this Decision to amend and supplement certain articles of Decision No. 15/2019/QĐ-TTg dated March 28, 2019 of the Prime Minister on the implementation of electronic border control procedures at border gates managed by the Ministry of National Defense.

Article 1. Amending and supplementing certain articles of Decision No. 15/2019/QĐ-TTg dated March 28, 2019 of the Prime Minister on the implementation of electronic border control procedures at border gates managed by the Ministry of National Defense

1. Amend Point a Clause 2 Article 5 as follows:

"a) A person who performs the procedure of declaring an electronic border control dossier and receives confirmation of completion of the declaration of the electronic border control procedure at a land border gate shall use an electronic identity account established and verified in accordance with the laws on electronic identification and authentication and the provisions of this Decision, which can be accessed from anywhere with internet access;"

2. Amend Article 7 as follows:

“Article 7. Using an electronic identity account to log in to the Electronic Border Control Procedure Portal to perform electronic border control procedures at land border gates

1. A person performing the procedure uses an electronic identity account created by the electronic identification and authentication system, connected and integrated on the Electronic Border Control Procedure Portal to log in to the Electronic Border Control Procedure Portal to perform electronic border control procedures at land border gates in accordance with the laws on electronic identification and authentication and the provisions of this Decision.

2. The process of using an electronic identity account to log in to the Electronic Border Control Procedure Portal to perform electronic border control procedures at land border gates:

a) Individuals access the address: http://thutucbienphong.gov.vn to log in to the Electronic Border Procedure Portal;

b) At the login interface of the Electronic Border Control Procedure Portal, the person performing the procedure selects the type of account as individual (for individuals performing the procedure for organizations, select the type of account as organization), then choose to log in with an electronic identity account issued by the Ministry of Public Security for Vietnamese citizens (for individuals performing the procedure for organizations, choose to log in with an electronic identity account issued by the Ministry of Public Security for organizations); the system automatically redirects to the electronic identification and authentication system;

c) At the interface of the electronic identification and authentication system, the person performing the procedure logs in with their individual electronic identity account issued by the Ministry of Public Security (for individuals performing the procedure for organizations, log in with their organizational electronic identity account issued by the Ministry of Public Security);

d) After successful login, the system automatically redirects to the interface of the Electronic Border Control Procedure Portal for the person performing the procedure to declare the electronic border control procedure."

3. Amending Article 8 as follows:

“Article 8. Suspension of use of electronic identity account for logging into the Electronic Border Control Procedures Portal to perform electronic border control procedures at land border gates.

In case of detecting risks affecting the security and safety of data in electronic border control procedures, the Border Gate Commander of the land border gate has the right to temporarily suspend the use of the electronic identity account for logging into the Electronic Border Control Procedures Portal and notify the person performing the procedure, clearly stating the reason for not accepting electronic data.

4. Amend Clause 2 of Article 12 as follows:

“2. In case the National Single Window Portal encounters technical issues, electronic border control procedures for Vietnamese vessels operating on domestic routes entering and leaving port customs gates shall be carried out through the Electronic Border Control Procedures Portal in accordance with this Decision.

The use of digital signatures in implementing electronic border control procedures for Vietnamese vessels operating on domestic routes entering and leaving port customs gates shall be carried out in accordance with the regulations of the Ministry of National Defense on implementing electronic border control procedures for seaports.

5. Amend Clause 2 of Article 15 as follows:

“2. When the Electronic Border Control Procedures Portal has not yet completed its connection with the National Single Window Portal or the National Single Window Portal encounters technical issues, electronic border control procedures for issuing visas at customs gates shall be carried out through the Electronic Border Control Procedures Portal in accordance with this Decision.

The use of digital signatures in implementing electronic border control procedures for issuing visas at seaport customs gates shall be carried out in accordance with the regulations of the Ministry of National Defense on implementing electronic border control procedures for seaports.

6. Amend Clause 2 and Point b of Clause 8 of Article 18 as follows:

a) Amending Clause 2 as follows:

“2. Coordinate with the Government Office to organize the connection of the Electronic Border Control Procedures Portal with the National Public Service Portal in accordance with Decree No. 61/2018/ND-CP dated April 23, 2018 of the Government on implementing the single window mechanism and the inter-connected single window mechanism in administrative procedures; coordinate with the Ministry of Public Security and relevant ministries, sectors, and localities during the implementation and use of electronic identity accounts for logging into the Electronic Border Control Procedures Portal in accordance with Decree No. 69/2024/ND-CP dated June 25, 2024 of the Government on electronic identification and authentication; direct competent authorities to announce the completion of connections and integration of electronic identity accounts on the Electronic Border Control Procedures Portal for relevant agencies, organizations, and individuals to be aware and implement.

b) Amend Point b of Clause 8 as follows:

“b) Review, inspect, and approve organizations and individuals participating in electronic border control procedures; guide the installation and declaration of information for persons participating in electronic border control procedures;

7. Amend Article 19 as follows:

“Article 19. Responsibilities of relevant ministries, sectors, and provincial People's Committees

1. The Ministry of Public Security shall cooperate with the Ministry of National Defense to unify plans for connection and sharing of data to use electronic identity accounts for logging into the Electronic Border Control Procedures Portal in accordance with Decree No. 69/2024/ND-CP dated June 25, 2024 of the Government on electronic identification and authentication and the provisions of this Decision.

2. Ministry of Finance

a) Within the scope of their duties and authority, they are responsible for directing and guiding specialized state management agencies under their jurisdiction to cooperate with the Border Guard in implementing electronic border control procedures; cooperate with the Ministry of National Defense to guide enterprises, organizations, and individuals related to the implementation of electronic border control procedures according to the national single window mechanism;

b) Coordinate with the Ministry of Planning and Investment to ensure funding for the Ministry of National Defense to build, manage, and operate the Electronic Border Control Procedures Portal and implement this Decision;

c) Direct the integration of electronic identity accounts on the National Single Window Portal, connecting with specialized systems to implement electronic procedures according to the national single window mechanism.

3. The Ministry of Planning and Investment

Annually, take the lead and coordinate with the Ministry of Finance and the Ministry of National Defense to balance the budget for investment construction within the medium-term public investment plan to ensure the implementation of this Decision.

4. Relevant ministries and sectors within the scope of their duties and authority are responsible for coordinating with the Ministry of National Defense in implementing electronic border control procedures and deploying the use of electronic identity accounts for logging into the Electronic Border Control Procedures Portal in accordance with Decree No. 69/2024/ND-CP dated June 25, 2024 of the Government on electronic identification and authentication.

5. Provincial People's Committees

Within the scope of their duties and authority, provincial People's Committees are responsible for directing and guiding functional departments and agencies in the locality where electronic border control procedures are implemented to coordinate and create favorable conditions for border gates to deploy and implement electronic border control procedures in the locality.

Article 2. Repeal certain Forms attached to Decision No. 15/2019/QĐ-TTg dated March 28, 2019 of the Prime Minister on the implementation of electronic border procedures at border gates managed by the Ministry of National Defense

Repeal Forms No. 1a, 1b, 02, 03, 04, 05, and Form No. 06 as specified in the Appendix attached to Decision No. 15/2019/QĐ-TTg.

Article 3. Implementation Provisions

1. This Decision shall take effect from April 1, 2025

2. The period for using accounts established through the Electronic Border Procedure Portal shall be implemented in accordance with the provisions of Government Decree No. 69/2024/NĐ-CP dated June 25, 2024 on digital identity and electronic authentication.
