CIRCULAR
DISCONTINUING CERTAIN LEGAL DOCUMENTS ISSUED BY THE MINISTER OF HEALTH
Pursuant to Law on Legislative Regulatory Documents No. 64/2025/QH15, amended and supplemented by Law No. 87/2025/QH15;
Pursuant to Decree No. 78/2025/NĐ-CP dated April 1, 2025 of the Government detailing certain provisions and measures for organizing and guiding the implementation of the Law on Legislative Regulatory Documents, amended and supplemented by Decree No. 187/2025/NĐ-CP;
Pursuant to Decree No. 42/2025/NĐ-CP dated February 27, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
At the proposal of the Director of the Department of Medical Examination and Treatment; the Director of the Department of Traditional Medicine; the Director of the Food Safety Department; the Director of the Disease Prevention Department; the Director of the Health Infrastructure and Equipment Department; the Director of the Drug Administration Department; the Director of the Legal Affairs Department.
The Minister of Health hereby issues this Circular discontinuing certain legislative regulatory documents issued by the Minister of Health.
Article 1. Discontinuing entirely one legislative regulatory document issued by the Minister of Health promulgating
Circular No. 20/2024/TT-BYT dated October 14, 2024 of the Minister of Health amending and supplementing certain articles of Circular No. 09/2015/TT-BYT dated May 25, 2015 of the Minister of Health regarding confirmation of advertising content for special products, goods, and services under the management of the Ministry of Health.
Article 2. Discontinuing part of two legislative regulatory documents issued by the Minister of Health
1. Discontinuing Circular No. 09/2015/TT-BYT, except for the following contents:
a) Point a Clause 3 and Clause 6 Article 1; Clause 1, point a, point b Clause 2 Article 3; Provisions on food at point d Clause 2 Article 3; Article 4; Clause 7 Article 20; Provisions on cases where the validity period of the advertising content confirmation certificate for food, milk, and nutritional products for children expires according to Clause 3 Article 23;
b) Point b, point c, point d and point d Clause 3 Article 1; Article 7, Article 10, Article 16; point b Clause 1 and Clause 3 Article 12 and the scope of application concerning confirmation of advertising content for drugs as stipulated in Circular No. 09/2015/TT-BYT which has been discontinued by Circular No. 25/2018/TT-BYT dated September 28, 2018 of the Minister of Health discontinuing certain legislative regulatory documents in the field of health issued by the Minister of Health, jointly issued.
2. Discontinuing Clause 3 Article 4 of Circular No. 57/2024/TT-BYT dated December 31, 2024 of the Minister of Health stipulating the delegation of authority to handle administrative procedures in the field of medical examination and treatment under the management of the Ministry of Health.
Article 3. Implementation clause
1. This Circular takes effect from February 15, 2026.
2. The Head of the Ministry's Office, the Director of the Legal Affairs Department, the Directors of Departments and Bureaus under the Ministry of Health, and relevant agencies, organizations, and individuals shall be responsible for implementing this Circular.
Article 4. Transitional clause
1. Advertising content confirmation certificates issued according to Circular No. 09/2015/TT-BYT, Circular No. 20/2024/TT-BYT, and Circular No. 57/2024/TT-BYT before the effective date of this Circular shall continue to be applied until they are replaced, revoked, or their validity period expires as provided by law. Files currently being processed shall be handled according to the regulations in force at the time of receipt of the file.
2. Determination of cases where the validity period of advertising content confirmation certificates issued according to Circular No. 09/2015/TT-BYT, Circular No. 20/2024/TT-BYT, and Circular No. 57/2024/TT-BYT before the effective date of this Circular shall continue to be implemented according to Article 23 of Circular No. 09/2015/TT-BYT./.
