JOINT CIRCULAR OF THE POST AND TELECOMMUNICATIONS GENERAL DEPARTMENT - MINISTRY OF AGRICULTURE NO. 3/LB-TT
DATE January 8, 1981 REGARDING THE HANDLING, RECEIVING, TRANSFERRING, AND DELIVERING OF EXPORT AND IMPORT PARCELS CONTAINING PLANTS AND PLANT PRODUCTS
To implement the Plant Quarantine Regulations issued together with Decree No. 214-CP dated July 14, 1980 and the Regulations on Handling, Receiving, Transferring, and Delivering of Parcels issued together with Decree No. 91-CP dated May 2, 1973 of the Council of Ministers, the Post and Telecommunications General Department and the Ministry of Agriculture stipulate the handling, receiving, transferring, and delivering of export and import parcels containing plants and plant products as follows.
1. Export and import parcels containing plants and plant products must undergo plant quarantine (except for export parcels that the importing country does not require to be quarantined).

 

The goods subject to quarantine are listed in Appendix I attached hereto.

 

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

 

2. Senders or recipients of parcels containing plants or plant products listed in Appendix I must pay a quarantine fee. In places where there are no quarantine officers, the postal service will collect the quarantine fee from senders or recipients uniformly at 2 dong per parcel, 5 dong per parcel under 3 kilograms, and 8 dong per parcel over 3 kilograms. After deducting 20% commission, this amount will be transferred to the plant quarantine authority via money transfer, with the postage for the money transfer deducted from the plant quarantine authority's funds.

1. The Post and Telecommunications General Department shall notify the Ministry of Agriculture of locations where foreign postal offices are organized so that the Ministry of Agriculture can organize and direct plant quarantine work in export and import parcels.

2. The quarantine of plants and plant products in export and import parcels shall be conducted once at the foreign postal office concurrently with other export or import procedures. The quarantine time for each parcel shall be as prescribed in Article 9 of the Plant Quarantine Regulations.

 

II. SPECIFIC PROVISIONS

 

Postal services shall only dispatch abroad or deliver to recipients the parcels mentioned in Point 1, Section I above after completing the plant quarantine procedures.

All parcels that have been quarantined shall be issued a certificate and labeled or sealed with lead by the quarantine authority.

3. Senders may send parcels containing plants and plant products from any postal office, after which the parcels will be transferred to a convenient foreign postal office for quarantine officers to handle the export procedures.

4. If the parcels mentioned in Point 1, Section I above are found to be infected with disease or do not meet the requirements of plant quarantine, the quarantine authority will return them to the sender or dispose of them according to current regulations.

1. Foreign postal offices and quarantine stations shall cooperate closely, assist each other to ensure the proper handling, receiving, and transferring of parcels containing plants in accordance with state regulations, and prevent any acts of corruption, favoritism, or inconvenience to users.

III. IMPLEMENTATION

 

a) Depending on the specific conditions of each postal office, quarantine officers shall be assigned a workspace to ensure common tasks while also ensuring convenience for senders and recipients of parcels.

b) When new foreign postal offices are constructed or expanded, the postal service shall consult with the quarantine authority to invest additional capital to arrange quarantine facilities at those locations.

c) Facilities for quarantine work (tables, chairs, cabinets, tools, machinery) shall be provided by the quarantine authority. For new facilities, they should be equipped uniformly like other authorities working at the postal office.

d) Quarantine officers and postal officers working at foreign postal offices must strictly adhere to workplace rules. Any disputes regarding professional matters between both parties must be resolved with respect for state regulations concerning postal and quarantine work. If there are conflicting opinions, both parties must promptly report to the competent authority for resolution.

Monthly meetings shall be held between officers from both sides to review the implementation of this Circular.

1. This Circular takes effect from the date of signature.

Previous regulations contrary to this Circular are hereby abolished.

a) Grains, industrial crops, fruits, food crops, animal feed crops, ornamental plants, forest trees, medicinal plants, etc., and their parts such as seeds, fruits, flowers, branches, leaves, roots, tubers, grafts, etc., in unprocessed form, whether fresh or dry, are capable of carrying pests, diseases, and weeds, and therefore are subject to quarantine. Even if processed, items that still have the potential to carry pests and diseases remain subject to quarantine, such as rice, peanuts, bran, broken rice, flour, baked goods made from flour (cakes, cookies, etc.), cotton fiber, cotton yarn, hemp yarn, ramie yarn, herbal medicines, wooden utensils, bamboo, rattan, straw, etc.; items that no longer have the potential to carry pests, diseases, and weeds are not subject to quarantine, such as jams, canned foods, candies, fabrics, herbal medicines made into pills or soaked in alcohol, etc.

b) Samples of pests, pathogens, and weeds; soil samples or soil in various forms.
c) Means and tools used for producing, processing, storing, and transporting the aforementioned items, such as packaging materials and cargo supports, etc.

d) Animals and animal products capable of carrying pests, diseases, and weeds harmful to crops or crop products, such as livestock, poultry, wild birds, wild animals, their fur, skin, which can spread insects, weeds, and products derived from animal products that can harm crop products, etc.
