OF THE STATE BANK OF VIETNAM NUMBER 03/TT-NH1 SEPTEMBER 1, 1995 GUIDING THE IMPLEMENTATION OF DECREE 29/CP PROVIDING FOR DETAIL RULES TO IMPLEMENT THE LAW ON ENCOURAGING INVESTMENT WITHIN THE COUNTRY

On May 12, 1995, the Prime Minister signed Decree No. 29/CP providing for detailed rules to implement the Law on Encouraging Investment within the Country. To implement uniformly and strictly the provisions of the Law on Encouraging Investment within the Country and the Government's Decree, the State Bank guides specifically the content of Article 11 of Decree No. 29/CP regarding preferential capital lending for production and purchase of export goods as follows:

1. The state commercial banks have the responsibility to provide preferential capital lending for units engaged in production and purchase of export goods under the Law on Encouraging Investment within the Country, including the Foreign Trade Bank, the Industrial and Commercial Bank, the Agricultural Bank, and the Development Bank.

2. The entities eligible for preferential capital lending are organizations engaged in production and purchase of export goods, including direct exports and consignment exports (referred to as export production bases), belonging to all economic sectors within the scope of application of the Law on Encouraging Investment within the Country, which have signed export contracts or sold goods abroad.

3. Conditions for obtaining preferential capital loans:

- Loan conditions shall be implemented according to the current credit regulations of the Governor of the State Bank.

- Borrowing units must have investment incentive certificates according to categories A, B, and C as stipulated in Decree No. 29/CP; investment incentive certificates issued by the Provincial People's Committee for enterprises established with permission from the Prime Minister, or by the provincial or municipal People's Committees for enterprises established with permission from the provincial or municipal authorities.

- Documents proving the signing of export contracts or sales of goods abroad.

4. The implementation of preferential capital lending for export production bases under the Law on Encouraging Investment within the Country shall be carried out as follows:

- When export production and purchase bases meet the conditions specified in Point 3 of this Circular, the banks shall satisfy their loan capital requirements (amount and time) within the limits of their own capital and credit quotas (if any) and comply with the provisions of Article 25 of the Law on Credit Institutions and Finance Companies.

If a commercial bank does not have sufficient capital to lend promptly, it must develop a specific plan to request additional capital from the State Bank (objectives and amount). The State Bank will consider supplementary lending through rediscounting according to the current regulations of the Governor of the State Bank.

5. Loan term: Banks shall determine the loan term based on the borrower, taking into account the cycle of material and goods turnover and production cycle as stipulated in the current credit regulations of the Governor of the State Bank.

6. Regarding interest rates on loans: Decree No. 29/CP and the Law on Encouraging Investment within the Country only stipulate that state commercial banks must provide preferential capital lending for export production and purchase bases. The General Directors of state commercial banks shall set loan interest rates for export production bases within the scope of the Law on Encouraging Investment within the Country, within the framework of interest rates prescribed by the Governor of the State Bank for each period. In cases where world market prices fall or domestic material and raw material prices rise, causing significant losses for export production bases, the State will consider supporting through the price stabilization fund to reduce part of the loan interest rate.

7. This Circular takes effect from the date of issuance; the General Directors of state commercial banks shall guide in detail the units within their systems to implement it. During the implementation process, results and difficulties encountered should be reported to the Central State Bank for resolution.
