CIRCULAR JOINT CIRCULAR

Guidelines for implementing adjustments to the levels of monthly allowances for persons engaged in revolutionary activities, families of martyrs, wounded veterans, disabled veterans, and those who have contributed to the revolution Pursuant to Point 4, Article 1 and Clause b, Point 2, Article 2 of Decree No. 175/1999/NĐ-CP dated December 15, 1999 of the Government; After receiving permission from the Prime Minister and reaching consensus with the Central Organization Committee and the Civil Service Committee of the Government; the Joint Circular of the Ministry of Labor, Invalids and Social Affairs and the Ministry of Finance provides guidelines for adjusting the levels of monthly allowances for persons engaged in revolutionary activities, families of martyrs, wounded veterans, disabled veterans, and those who have contributed to the revolution as follows:

I. Recipients and levels of monthly allowances effective from January 1, 2000

a) Allowance level: 135,000 VND/month

b) Primary dependents of persons engaged in revolutionary activities before 1945 who have passed away:

a. Those who were detached and receiving an allowance of 210,000 VND/month. In addition to this allowance, they also receive a monthly subsidy based on the number of years of pre-revolutionary activity, with 50,000 VND/month for each year;

Basic pension allowance level: 90,000 VND/person/month

Care pension allowance level: 290,000 VND/person/month

2. Persons engaged in revolutionary activities prior to the August 1945 Revolution

Allowance level: 60,000 VND/month

3. Families of martyrs: "Basic pension allowance level: 90,000 VND/person/month":

Care pension allowance level: 290,000 VND/person/month

4. Mothers of Vietnam Heroic Martyrs, Heroes of the Armed Forces, and Labor Heroes:

a) Mothers of Vietnam Heroic Martyrs:

Allowance level: 350,000 VND/month.

Care allowance level for single mothers without support: 400,000 VND/month. b) Heroes of the Armed Forces and Labor Heroes:

Allowance level: 80,000 VND/month.

a) Wounded veterans and those entitled to benefits similar to wounded veterans:

Monthly allowance calculated as: 3,588 VND x percentage of labor capacity loss due to injury (see attached appendix).

b) Wounded veteran category B (confirmed before December 31, 1993, now referred to as military personnel injured in work-related accidents):

Labor capacity loss from 21% to 30%: Allowance level = 62,000 VND/month.

5. War Invalids:

Labor capacity loss from 31% to 40%: Allowance level = 77,000 VND/month.

Labor capacity loss from 41% to 50%: Allowance level = 108,000 VND/month.

Labor capacity loss from 51% to 60%: Allowance level = 123,000 VND/month.

Labor capacity loss from 61% to 70%: Allowance level = 169,000 VND/month.

Labor capacity loss from 71% to 80%: Allowance level = 200,000 VND/month.

Labor capacity loss from 81% to 90%: Allowance level = 246,000 VND/month.

Labor capacity loss from 91% to 100%: Allowance level = 277,000 VND/month.

c) Caregivers for wounded veterans A and B and those entitled to benefits similar to wounded veterans with labor capacity loss of 81% or more currently being treated at home:

Allowance level for caregivers of wounded veterans with labor capacity loss of 81% or more: 132,000 VND/month.

Allowance level for caregivers of wounded veterans with labor capacity loss of 81% or more with severe injuries: 165,000 VND/month.

d) Primary dependents of wounded veterans and those entitled to benefits similar to wounded veterans with labor capacity loss of 61% or more who have passed away:

Basic pension allowance level: 72,000 VND/person/month.

Care pension allowance level: 126,000 VND/person/month.

a) Monthly allowance level for disabled veterans:

Labor capacity loss from 61% to 70%: Allowance level = 180,000 VND/month.

Labor capacity loss from 71% to 80%: Allowance level = 207,000 VND/month.

Labor capacity loss from 81% to 90%: Allowance level = 249,000 VND/month.

6. Disease Invalids:

Labor capacity loss from 91% to 100%: Allowance level = 277,000 VND/month.

b) Disabled veterans category 3 (confirmed before December 31, 1994, now referred to as military personnel suffering from occupational diseases):

Labor capacity loss from 41% to 50%: Allowance level = 97,000 VND/month.

Labor capacity loss from 51% to 60%: Allowance level = 110,000 VND/month.

c) Caregivers for disabled veterans with labor capacity loss of 81% or more currently being treated at home:

Allowance level for caregivers of disabled veterans with labor capacity loss of 81% or more: 132,000 VND/month.

-  Allowance level for caregivers of disabled veterans with labor capacity loss of 81% or more with severe illnesses: 165,000 VND/month.

-  d) Primary dependents of disabled veterans with labor capacity loss of 61% or more who have passed away:

a) Those who contributed to the revolution before the August 1945 Revolution:

Basic allowance level: 90,000 VND/month.

Care allowance level: 290,000 VND/month.

b) Those who contributed to the revolution during the resistance war:

Labor capacity loss from 71% to 80%: Allowance level = 207,000 VND/month.

Labor capacity loss from 81% to 90%: Allowance level = 249,000 VND/month.

7. Persons who have contributed to the revolution:

Basic allowance level: 65,000 VND/month.

Care allowance level: 200,000 VND/month.

Other allowances not specified in this Circular remain unchanged at the levels of December 1999.

II. Funeral Allowance

For individuals confirmed as martyrs; wounded veterans and disabled veterans with labor capacity loss of 61% or more; Mothers of Vietnam Heroic Martyrs; primary dependents of martyrs and those who contributed to the revolution who received care allowances and have passed away, the person responsible for burial will be provided with funeral expenses (burial fees) equivalent to those for deceased civil servants and officials (effective from January 1, 2000, the amount is 1,440,000 VND).

III. Regional Allowance (if applicable)

Calculated according to the general regulations of the State based on the current minimum wage (the minimum wage implemented from January 1, 2000 is 180,000 VND/month).

IV. Procedures and Documentation for Adjustment

1. The Department of Labor, Invalids and Social Affairs (Department of Organizational Labor and Social Affairs) at the district level shall prepare two copies of the list according to Model No. 01, send one copy to the Provincial Department of Labor, Invalids and Social Affairs, and retain one copy. 

2. The Provincial Department of Labor, Invalids and Social Affairs shall compile a summary of eligible recipients for adjustment of allowances according to Model No. 02 (three copies), submit it to the People's Committee of the province for decision, and then send two copies to the Ministry of Labor, Invalids and Social Affairs (Veterans and Martyrs' Affairs Bureau and People with Merit Bureau), and retain one copy at the provincial department.

3. The Ministry of Labor, Invalids and Social Affairs shall compile a summary of eligible recipients for adjustment of allowances, prepare a budget for additional allowances, and submit it to the Ministry of Finance.

IV. PROCEDURE FOR AMENDING DOCUMENTS

1. The Labor, Invalids, and Social Affairs Office at the district level (the Labor and Social Organization Office) shall prepare two copies of the list according to Form No. 01, send one copy to the Provincial Department of Labor, Invalids, and Social Affairs, and retain one copy.

2. The Provincial Department of Labor, Invalids, and Social Affairs shall compile a summary of individuals eligible for adjustment of allowances and subsidies according to Form No. 02 (three copies), submit it to the People's Committee of the province for decision, and then send two copies to the Ministry of Labor, Invalids, and Social Affairs (the Martyrs and Veterans Affairs Bureau and the Bureau for Persons with Meritorious Service), while retaining one copy at the department.

3. The Ministry of Labor, Invalids, and Social Affairs shall compile a list of individuals eligible for adjustment of allowances and subsidies, prepare a budget estimate for additional allowances and subsidies, and submit it to the Ministry of Finance.

4. The Ministry of Finance shall allocate the authorized subsidy and additional allowance funds based on the budget submitted by the Ministry of Labor, Invalids and Social Affairs for the subjects subject to adjustment as prescribed.

5. Upon receipt of the funding notification, the Director of the Department of Labor, Invalids and Social Affairs shall report to the People's Committee at the provincial level to adjust the subsidies and allowances according to the approved list.

V. Implementation

1. The Provincial Department of Labor, Invalids and Social Affairs shall be responsible for examining and approving the beneficiaries entitled to the adjusted subsidies and allowances as stipulated in this Circular.

2. In the interim, to ensure that the subjects can promptly enjoy the adjusted subsidies and allowances as guided by this Circular from January 2000 onwards, the Ministry of Finance will temporarily allocate the additional subsidy and allowance funds for January and the first quarter of 2000 for localities to implement. From the second quarter of 2000 onwards, the Ministry of Finance will allocate the subsidy and additional allowance funds to localities following the approval of the provincial list.

3. The Provincial Department of Labor, Invalids and Social Affairs; the Provincial Department of Finance and Prices; and the Provincial Treasury shall be responsible for coordinating, guiding, and implementing the contents prescribed in this Circular accurately.

4. The Ministry of National Defense and the Ministry of Public Security, after reaching an agreement with the Ministry of Labor, Invalids and Social Affairs and the Ministry of Finance, shall guide the implementation for military forces under their jurisdiction.

5. This Circular shall take effect from January 1, 2000.

Any difficulties encountered during the implementation shall be reported to the Joint Ministries for resolution./.
