REGULATIONS ON THE CONTROL OF EXIT AND ENTRY FOR VIETNAMESE CITIZENS AT BORDER GATES
Circular No. 74/2020/TT-BCA dated July 1, 2020, issued by the Minister of Public Security regarding the control of exit and entry for Vietnamese citizens at border gates, effective from August 15, 2020, has been amended and supplemented by:
Circular No. 59/2024/TT-BCA dated November 7, 2024, issued by the Minister of Public Security amending and supplementing certain provisions of Circular No. 74/2020/TT-BCA dated July 1, 2020, issued by the Minister of Public Security regarding the control of exit and entry for Vietnamese citizens at border gates, effective from January 1, 2025.
Pursuant to the Law on Exit from and Entry into Vietnam of Vietnamese Citizens dated November 22, 2019;
Pursuant to the Law on National Border dated June 17, 2003;
Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;
Pursuant to Decree No. 140/2004/NĐ-CP dated June 25, 2004, issued by the Government detailing certain provisions of the National Border Law;
Pursuant to Decree No. 112/2014/NĐ-CP dated November 21, 2014 of the Government on management of land border gates;
Pursuant to Decree No. 77/2017/NĐ-CP dated July 3, 2017, issued by the Government on management and security protection at port border gates;
At the proposal of the Director of the Immigration Administration Department;
After reaching consensus with the Minister of National Defense, the Minister of Public Security promulgates this Circular regulating the control of exit and entry for Vietnamese citizens at border gates.[1]
Chapter I. GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates principles and areas of exit and entry control; inspection, supervision, and verification of persons and documents for exit and entry for Vietnamese citizens at border gates, and the responsibilities of relevant agencies, organizations, and individuals.
Article 2. Applicability
This Circular applies to Vietnamese citizens exiting and entering the country; units controlling exit and entry at land border gates, port border gates, and air border gates; and relevant agencies, organizations, and individuals.
Article 3. Objectives and Principles of Exit and Entry Control
1. Compliance with the Constitution, laws of Vietnam, and international treaties to which the Socialist Republic of Vietnam is a party.
2. Ensuring transparency and creating favorable conditions for Vietnamese citizens to exit and enter the country in accordance with the law.
3. Ensuring that all exit and entry activities are controlled in accordance with the law, strictly prohibiting the abuse of exit and entry control to commit illegal acts.
4. Exit and entry control aims to prevent, detect, and stop cases where individuals do not meet the conditions for exit and entry; promptly detecting and handling violations of laws related to exit and entry by Vietnamese citizens at border gates.
5. In cases where international treaties to which Vietnam is a party provide different regulations than those stipulated in this Circular, such treaties shall be followed.
Article 4. Scope and Areas of Exit and Entry Control
1. The scope and area of exit and entry control at air border gates include the area from the passenger queue for departure procedures to the aircraft door and from the aircraft door to the arrival immigration counter.
2. The scope and area of exit and entry control at land border gates include the area within the land border gate as defined according to Decree No. 112/2014/NĐ-CP dated November 21, 2014, issued by the Government on the management of land border gates.
3. The scope and area of exit and entry control at port border gates include:
a) The maritime port, wharf, pier, offshore oil terminal areas opened by the Ministry of Transport or the Vietnam Maritime Administration under their respective legal authority for Vietnamese and foreign vessels to dock, load/unload cargo, embark/disembark passengers, and conduct other activities; inland waterway port, wharf, and fishing port areas within the maritime port waters.
b) The inland waterway port, wharf areas opened by the Ministry of Transport or the Vietnam Inland Waterways Administration or the Provincial Department of Transport under their respective legal authority for Vietnamese and foreign vessels to enter, exit, transfer ports to load/unload cargo, embark/disembark passengers, and conduct other activities; the wharf area with pre-pier waters within the inland waterway port border gate waters.
Chapter II. CONTROL OF EXIT AND ENTRY FOR VIETNAMESE CITIZENS
Article 5. Inspection and verification of persons and travel documents for entry and exit
1. Tasks of the border control unit:
a) Verify the legality and validity of travel documents for entry and exit and the conditions for departure and entry;
b) Confirm the consistency between the person departing or entering and their travel documents;
c) Input information of persons departing or entering into the border control system and supplement necessary information;
d) Check and compare personal information in travel documents with information in the National Database on Exit and Entry of Vietnamese Citizens through direct or indirect network connections;
đ)[2] Stamp the verification mark on travel documents of citizens exiting or entering at seaports and land border gates that have not been connected to the National Database on Exit and Entry;
Do not stamp the verification mark on travel documents of Vietnamese citizens exiting or entering at airports and land border gates that have been connected to the National Database on Exit and Entry;
e)[3] Implement temporary suspension of departure for Vietnamese citizens according to the provisions of the Law on Exit and Entry of Vietnamese Citizens 2019, amended and supplemented in 2023;
g)[4] Collect facial images and fingerprints of citizens at border gates as prescribed by law;
1a.[5] Verification of exit and entry:
a) Verification of exit and entry is the confirmation that Vietnamese citizens have completed the procedures for exit or entry in accordance with regulations, including stamping the verification mark or not stamping the verification mark on travel documents;
"d) Stamp verification on the exit and entry documents of Vietnamese citizens exiting or entering through seaport border gates and land border gates not connected to the National Database on Exit and Entry.
2.[6] Border control work at land border gates shall comply with other provisions set forth in Article 5, Article 6, Clause 1 of Article 8, Article 22 of Decree No. 112/2014/ND-CP dated November 21, 2014 of the Government on management of land border gates; Clause 3, Clause 4, Clause 13 of Article 1 of Decree No. 34/2023/ND-CP dated June 16, 2023 of the Government amending and supplementing some articles of Decree No. 112/2014/ND-CP dated November 21, 2014 of the Government on management of land border gates;
3. Border control work at seaports shall comply with other provisions set forth in Article 12, Article 13, Article 14, Article 15, Article 16, Article 17 of Decree No. 77/2017/ND-CP dated July 3, 2017 of the Government on management and security maintenance at seaports;
4.[7] Border control work at airports shall comply with other provisions set forth in Decree No. 93/2022/ND-CP dated November 7, 2022 of the Government on management and security assurance at airports;
5.[8] In cases where personnel on defense and security vehicles enter or leave the territory of Vietnam to perform defense and security tasks, they shall be implemented according to Decree No. 73/2020/ND-CP dated June 30, 2020 of the Government on inspection and verification of exit and entry for personnel on defense and security vehicles entering or leaving the territory of Vietnam to perform defense and security tasks;
6.[9] Border control for citizens exiting or entering through automatic control gates shall be carried out according to the provisions of Decree No. 77/2020/ND-CP dated July 1, 2020 of the Government on management and exploitation of information in the National Database on Exit and Entry; online public services for issuing, managing, and controlling passports for Vietnamese citizens; border control using automatic control gates; Decree No. 67/2024/ND-CP dated June 25, 2024 of the Government amending and supplementing some articles of Decree No. 76/2020/ND-CP dated July 1, 2020 of the Government detailing the subjects, procedures, formalities, authorities for issuing, revoking, and invalidating travel permits; Decree No. 77/2020/ND-CP dated July 1, 2020 of the Government on management and exploitation of information in the National Database on Exit and Entry; online public services for issuing, managing, and controlling passports for Vietnamese citizens; border control using automatic control gates and the Automatic Control Gate Border Control Procedure issued by the Ministry of Public Security in coordination with the Ministry of Defense.
Article 6. Border Exit and Entry Supervision
1.[10] The border exit and entry control units shall carry out border exit and entry supervision at the port area and other areas specified in Article 4 of this Circular, with specific responsibilities as follows:
a) Regulate and guide citizens exiting and entering to ensure order at the inspection counters; answer and guide citizens' legitimate inquiries in accordance with their functions and duties;
b) Supervise and manage citizens exiting and entering the country and persons permitted to enter and leave the border exit and entry control area; detect and prevent unauthorized individuals from entering the border exit and entry control area; check the documents of individuals suspected of violating laws on exit and entry or other laws when entering or leaving the border exit and entry control area;
c) Supervise boarding and disembarking from vehicles;
d) Organize patrol and control work at the border area; supervise the entry and exit of Vietnamese citizens.
2.[11] The work of border exit and entry supervision at land border gates shall be carried out in accordance with other provisions set forth in Articles 5, 6, Clause 1 of Article 8, and Article 22 of Decree No. 112/2014/ND-CP dated November 21, 2014 of the Government on management of land border gates; Clauses 3, 4, and 13 of Article 1 of Decree No. 34/2023/NĐ-CP dated June 16, 2023 of the Government.
3. The work of border exit and entry supervision at port gates shall be carried out in accordance with other provisions set forth in Articles 18, 19, and 20 of Decree No. 77/2017/NĐ-CP dated July 3, 2017 of the Government on management and security protection at port gates.
4.[12] The work of border exit and entry supervision at airway gates shall be carried out in accordance with other provisions set forth in Decree No. 93/2022/NĐ-CP dated November 7, 2022 of the Government on management and security assurance at airway gates.
Chapter III. IMPLEMENTATION AND EFFECTIVE PROVISIONS
Article 7. Responsibilities of the Exit and Entry Administration Department, Ministry of Public Security
1. Take the lead and advise the leadership of the Ministry of Public Security to direct the implementation of border exit and entry control at gates managed by the Ministry of Public Security.
2. Inspect and guide the exit and entry control units under the provincial public security organs to implement border exit and entry control at gates managed by the provincial public security organs.
3. Coordinate with the Gate Management Department, Border Guard Command, and Ministry of National Defense to guide the Border Guard units of provinces and centrally-administered cities to implement border exit and entry control for Vietnamese citizens at gates managed by the Ministry of National Defense.
4.[13] Take the lead in implementing the connection of the National Database on Exit and Entry with the Gate Management Department, Border Guard Command, Ministry of National Defense, and relevant agencies.
Article 8. Responsibilities of the Gate Management Department, Border Guard Command, and Ministry of National Defense
1. Take the lead and advise the leadership of the Border Guard Command and Ministry of National Defense to direct the implementation of border exit and entry control at gates managed by the Ministry of National Defense.
2. Inspect and guide the exit and entry control units under the Border Guard Commands of provinces and centrally-administered cities to implement border exit and entry control at gates managed by the Ministry of National Defense.
3. Coordinate with the Exit and Entry Administration Department, Ministry of Public Security to guide the Border Guard units of provinces and centrally-administered cities to implement border exit and entry control for Vietnamese citizens at gates managed by the Ministry of National Defense.
4.[14] Take the lead and advise the Border Guard Command and Ministry of National Defense to direct the implementation of border exit and entry control at gates managed by the Ministry of National Defense.
5.[15] Notify the Exit and Entry Administration Department, Ministry of Public Security on the electronic portal of the Ministry of National Defense and through mass media about the list of land border gates meeting the conditions for connection with the National Database on Exit and Entry no later than 30 days before the date.
Article 9. Effective Date[16]
1. This Circular takes effect from August 15, 2020.
2. Clause 1 of Article 4, Clause 1 of Article 5, and Clause 1 of Article 6 take effect from July 1, 2020.
Article 10. Implementation Organization
1. The Exit and Entry Administration Department, Ministry of Public Security shall take the lead and coordinate with the Gate Management Department, Border Guard Command, and Ministry of National Defense; the Directors of Public Security and Commanders of Border Guard of provinces and centrally-administered cities shall be responsible for implementing this Circular.
2. Relevant ministries, agencies at the ministerial level, organizations, and individuals shall be responsible for implementing this Circular./.
