Detailed Implementation Decree of Certain Provisions of the Radio Frequency Law No. 42/2009/QH12, amended and supplemented by Law No. 09/2022/QH15

 

Decree No. 63/2023/NĐ-CP dated August 18, 2023 of the Government detailing certain provisions of the Radio Frequency Law No. 42/2009/QH12, amended and supplemented by Law No. 09/2022/QH15, shall take effect from August 18, 2023, and is amended and supplemented by:

Decree No. 229/2025/NĐ-CP dated August 19, 2025 of the Government amending and supplementing Clause 3 of Article 87 of Decree No. 63/2023/NĐ-CP dated August 18, 2023 of the Government detailing certain provisions of the Radio Frequency Law No. 42/2009/QH12, amended and supplemented by Law No. 09/2022/QH15, shall take effect from August 19, 2025.

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Radio Frequency Law dated November 23, 2009; the Law Amending and Supplementing Certain Provisions of the Radio Frequency Law dated November 9, 2022;

At the proposal of the Minister of Information and Communications;

The Government promulgates this Decree to detail certain provisions of the Radio Frequency Law No. 42/2009/QH12, amended and supplemented by Law No. 09/2022/QH15[1].

Chapter I. GENERAL PROVISIONS

Article 1. Scope of Regulation

1. This Decree details Clause 4 of Article 16, Clause 5 of Article 18, Clause 5 of Article 18a, Point b of Clause 1 of Article 19, Clause 5 of Article 24, Clause 3 of Article 25, Clause 3 of Article 26, Clause 4 of Article 31, and Clause 2 of Article 32 of the Radio Frequency Law No. 42/2009/QH12, amended and supplemented by Law No. 09/2022/QH15 on:

a) Granting, reissuing, replacing, amending, supplementing, extending, revoking frequency usage licenses; temporarily suspending part of the rights to use radio frequencies;

b) Leasing, lending radio equipment;

c) Joint use of radio frequencies;

d) Transfer of rights to use radio frequencies;

đ) Pre-granting rights to use radio frequencies;

e) Conditions and procedures for recognizing organizations as qualified to train and issue radio operator certificates for maritime mobile services and amateur radio services; regulations on radio operator certificates, subjects, conditions, and procedures for issuing and revoking radio operator certificates; recognition of foreign radio operator certificates.

2. This Decree does not apply to the use of radio frequencies solely for national defense and security purposes.

Article 2. Applicability

This Decree applies to organizations and individuals involved in managing and using radio frequencies in Vietnam.

Article 3. Explanation of Terms

In this Decree, the following terms are understood as follows:

1. A terrestrial station is a station located on the surface of the Earth or within the main part of the Earth's atmosphere, used for communication with one or more space stations or with one or more similar stations through one or more reflecting satellites or other objects in space.

2. An amateur radio station is a station belonging to the amateur radio service and the amateur satellite service.

3. A ship station is a mobile station installed on ships, floating vessels, or models (for teaching, research purposes), not a rescue ship station, using radio frequencies for maritime mobile services, maritime mobile satellite services, and radio determination services for the Global Maritime Distress and Safety System (GMDSS).

4. A shore station is a land station used in maritime mobile services.

5. The Global Maritime Distress and Safety System (GMDSS) is a maritime communication system adopted by the International Maritime Organization's Conference of Member States in 1988 based on amendments and supplements to Chapter IV of the International Convention for the Safety of Life at Sea 1974 and its amendments (SOLAS 74 and amendments).

6. A radio station installed on fishing vessels is a mobile station installed on fishing vessels, using radio frequencies allocated for fishing vessels, frequencies for vessel monitoring systems, and frequencies for safety purposes.

7. A radio station communicating with fishing vessels is a land-based radio station used to communicate with fishing vessels, using frequencies allocated for fishing vessels and frequencies for safety purposes, without providing telecommunications services.

8. A wireless broadcasting station is a radio station transmitting audio signals unidirectionally to wireless loudspeaker clusters.

9. A private telecommunications network using frequencies for terrestrial mobile services is a telecommunications network consisting of mobile radio stations or fixed and mobile radio stations using frequencies for terrestrial mobile services established by organizations or individuals for internal communication purposes, not directly for profit.

10. An internal radio information network is an internal telecommunications network consisting of mobile radio stations using frequencies for terrestrial mobile services, equipped with integrated antennas, with a maximum transmission power of 5W (Watts), established by organizations or individuals at specific locations with defined addresses and ranges where the network owner has the right to use it for internal communication purposes, not directly for profit.

11. A foreign representative office is a diplomatic mission, consular office, authorized agency performing consular functions in Vietnam, and a representative office of an international organization under the United Nations system and an intergovernmental organization outside the United Nations system in Vietnam.

12. A foreign visitor group is a group of foreign visitors invited to Vietnam by the leadership of the Party, State, National Assembly, Government, and other state agencies of Vietnam.

13. A copy is a reproduction from the original or a typed version containing the full and accurate content as recorded in the original book.

14. A certified copy is a copy issued from the original book, a copy certified from the original, or a copy accompanied by the original for comparison (in cases where the application is submitted directly and signed for confirmation by the person receiving the application).

15. A legally certified electronic copy is an electronic copy issued from the original book or an electronic copy certified from the original.

16. The effective date for determining the base fee level is the date when the Decision of the Minister of Information and Communications regarding the organization to determine the base fee level takes effect.

17. Same type band: bands are of the same type when they are within the same band defined by the Third Generation Partnership Project (3GPP) and have the same dual-mode transmission method.

18. Equivalent frequency bands: two frequency bands defined by the Third Generation Partnership Project (3GPP) as equivalent when they have the same dual transmission mode and at least one radio frequency within the band used for the downlink of one band is between 0.9 to 1.1 times the radio frequency at the midpoint of the band used for the downlink of the other band.

19. An amateur radio operator is a person holding an amateur radio license or a foreign amateur radio license.

Chapter II. ISSUING, RENEWING, REPLACING, EXTENDING, AMENDING, SUPPLEMENTING, REVOKING LICENSES FOR THE USE OF RADIO FREQUENCY; SUSPENDING PART OF THE RIGHT TO USE RADIO FREQUENCY

Section 1. GENERAL PROVISIONS

Article 4. Regulations on issuing licenses and application files for issuing, renewing, replacing, extending, amending, and supplementing the contents of radio frequency usage licenses

1. Organizations and individuals applying for issuing, renewing, replacing, extending, amending, and supplementing the contents of radio frequency usage licenses shall be responsible under the law for the accuracy and legality of the documents and declared contents in the application file.

For applications submitted directly or through postal service: documents in the application file that this Decree does not require to be notarized or certified must be stamped by the organization applying for issuing, renewing, replacing, extending, amending, and supplementing the contents of the license; individuals and households must sign each document; in cases where a document has multiple pages, it must be stamped across the seams for organizations or signed on each page for individuals and households.

For applications submitted through the Online Public Service System: documents in the application file that this Decree requires to be signed and stamped by organizations and individuals applying for issuing, renewing, replacing, extending, amending, and supplementing the contents of the license, organizations do not need to sign or stamp; individuals and households do not need to sign these documents.

Foreigners applying for amateur radio station licenses may submit copies of valid passports as stipulated in Clause 2, Article 6 of this Decree and must present the original when receiving the license.

2. Organizations and individuals who have been granted electronic identity accounts by the competent authority when submitting application files for issuing, renewing, replacing, extending, amending, and supplementing the contents of the license through the Online Public Service System do not need to submit legally certified copies of identification cards or valid passports or business registration certificates.

For applications submitted directly or through postal service: organizations and individuals do not need to submit documents specified in Clause 2, Point b, Clause 3, Article 6 of this Decree regarding identification cards or identity cards or business registration certificates or enterprise registration certificates when the licensing authority can retrieve such information from the National Population Database or the National Enterprise Registration Database. The specific implementation time of this provision will be publicly announced on the website of the radio frequency usage license issuing authority.

3. Organizations and individuals do not need to resubmit documents included in the previously submitted application file if the documents remain valid and there is no change in their content, except for the declaration form specified in Appendix II issued together with this Decree.

4. Organizations and individuals must submit additional documents related to the application file for issuing, renewing, replacing, extending, amending, and supplementing the contents of the license in the following cases:

a) The licensing authority needs to verify the information in the declaration form specified in Appendix II issued together with this Decree to determine the radio frequency and issue, amend, or supplement the contents of the license;

b) The licensing authority needs information to identify organizations and individuals eligible for exemption or reduction of fees for issuing radio frequency usage licenses or radio frequency usage fees (hereinafter referred to as issuance fees and radio frequency usage fees) as prescribed.

5. When the license remains valid, organizations and individuals wishing to amend or supplement certain contents in the license (excluding the usage period) must submit an application file in accordance with the regulations.

6. When organizations and individuals simultaneously apply for extending and amending or supplementing the contents of the same license, the licensing authority issues one license for extension and amendment or supplementation of the license contents.

7. Organizations and individuals are permitted to submit a common declaration form for an application file containing multiple technical parameter declaration forms, license replacement, and extension declaration forms.

8. For radio stations requiring international frequency coordination according to Article 41 of the Radio Frequency Law, organizations and individuals may be considered for issuing, renewing, replacing, extending, amending, and supplementing the contents of the license during the international frequency coordination process but must follow the procedures for amending or supplementing the license contents as prescribed by this Decree when changing radio frequencies or other technical parameters based on the results of international frequency coordination with the International Telecommunication Union.

9. Organizations and individuals can only receive the license after paying all required issuance fees and radio frequency usage fees as prescribed.

10. After 30 days from the date the radio frequency usage license issuing authority sends a notice to complete the application file, if organizations and individuals do not comply, the issuing authority will cancel the application file.

11. After 30 days from the date the radio frequency usage license issuing authority sends a notice to pay issuance fees and radio frequency usage fees, if organizations and individuals do not fully fulfill their obligation to pay the required issuance fees and radio frequency usage fees, the issuing authority will cancel the processing result of the application file.

12. The radio frequency emission limits in the frequency band usage permit shall be prescribed according to the national technical standards. In cases where there are no national technical standards, international standards and practical technological capabilities shall be applied to ensure a reduction in harmful interference potential.

13. Organizations granted a frequency band usage permit shall have the responsibility to report to the Ministry of Information and Communications (Radio Frequency Management Department) quarterly within the time limit specified by the Ministry of Information and Communications on the list of radio transmitting equipment used in the radio communication network according to the form prescribed in Appendix I attached to this Decree, and to submit reports promptly within five working days from the date the Ministry of Information and Communications (Radio Frequency Management Department) sends the document.

14. Organizations and individuals submitting applications for issuance, reissuance, replacement, extension, modification, or supplementation of the content of the permit may do so through one of the following methods: submitting the application through the online public service system, sending the application via postal service, or submitting the application directly.

15. The results of processing applications for issuance, reissuance, replacement, extension, modification, or supplementation of the content of the permit shall be sent to organizations and individuals through one of the following methods: delivering the result through the online public service system, through electronic means, via postal service, or delivering directly.

16. Foreign organizations and individuals granted a permit to use frequencies and radio equipment for amateur radio stations may only use such frequencies and radio equipment during their lawful stay in Vietnam.

17. Within seventy-five days from the date the International Telecommunication Union issues the International Frequency Information Circular (IFIC), organizations granted a permit to use radio frequencies and satellite orbits shall have the responsibility to report to the Ministry of Information and Communications (Radio Frequency Management Department) the results of checking foreign radio frequency registrations and satellite orbits announced by the International Telecommunication Union that could affect satellites already permitted.

Article 5. Issuing Authority for Radio Frequency Usage Permits

1. The Ministry of Information and Communications (Radio Frequency Management Department) shall issue, reissue, replace, extend, modify, supplement, revoke radio frequency usage permits, suspend part of the rights to use radio frequencies, and process requests to cease using radio frequencies for various types of permits as stipulated in the Radio Frequency Law, except for the cases provided for in Clause 2 of this Article.

2. The Radio Frequency Management Department (Regional Radio Frequency Management Center) shall issue, replace, extend, modify, supplement, revoke permits for the use of radio frequencies and equipment, and process requests to cease using radio frequencies for amateur radio stations, ship radio stations, radio stations installed on fishing vessels, radio stations communicating with fishing vessels, wireless broadcasting stations, and internal radio communication networks.

Section 2. ISSUANCE, REPLACEMENT, EXTENSION, MODIFICATION, AND SUPPLEMENTATION OF THE CONTENT OF RADIO FREQUENCY AND RADIO EQUIPMENT USAGE PERMITS EXCLUDING THE CASES PROVIDED FOR IN SECTIONS 3 AND 4 OF THIS CHAPTER

Article 6. Documents for Application for Issuance of License

The documents for application for issuance of license include:

1. A general information form and technical specifications and operation form according to the model prescribed in Appendix II attached to this Decree.

2. A legal copy or a legally certified electronic copy of the Citizen Identity Card or the Identity Card or Passport still valid (for individuals applying for the license); a legal copy or a legally certified electronic copy of the Business Registration Certificate (for business households applying for the license).

3. Other accompanying documents:

a) A legal copy of the Amateur Radio Certificate or relevant information about the Amateur Radio Certificate as prescribed by the local country's regulations for organizations and individuals applying for the license (applicable to amateur radio stations);

b) A legal copy of the Service Agreement with a telecommunications enterprise or an agent authorized by a telecommunications enterprise that has been issued a service provision license by the Ministry of Information and Communications (applicable to independent earth stations of organizations, individual businesses operating outside the sea, multinational companies, government agencies, software development zones, and high-tech zones when using regional or international satellites), except in cases where a telecommunications license has already been granted to establish a fixed satellite network or mobile satellite network; or

A legal copy or a legally certified electronic copy of the establishment decision or Business Registration Certificate or Investment Certificate (applicable to earth stations of organizations and businesses operating outside the sea, multinational companies, government agencies, software development zones, and high-tech zones when using regional or international satellites), except in cases where a telecommunications license has already been granted to establish a fixed satellite network or mobile satellite network; or

A legal copy or a legally certified electronic copy of the document issued by the competent authority (applicable to earth stations of organizations and businesses permitted to participate in aviation safety and maritime safety activities according to the International Civil Aviation Organization and the International Maritime Organization regulations when using regional or international satellites), except in cases where a telecommunications license has already been granted to establish a fixed satellite network or mobile satellite network;

c) A request document from a specialized agency under the Ministry of Foreign Affairs (applicable to radio stations of foreign delegations visiting Vietnam at the invitation of state leaders, the Government); or

A request document from a specialized agency under the Central Committee’s External Relations Commission (applicable to radio stations of foreign delegations visiting Vietnam at the invitation of Party leaders); or

A request document from a specialized agency under the National Assembly Office (applicable to radio stations of foreign delegations visiting Vietnam at the invitation of National Assembly leaders); or

A request document from the host agency responsible for receiving the delegation (applicable to radio stations of other foreign delegations);

d) A request document from a specialized agency under the Ministry of Foreign Affairs or the Department of Foreign Affairs of Ho Chi Minh City or the Department of Foreign Affairs assigned to manage (applicable to radio stations of foreign representative offices);

đ) A request document from a specialized agency under the Ministry of Foreign Affairs (applicable to radio stations of foreign journalists accompanying foreign delegations);

e) A document from a specialized agency under the Ministry of Defense regarding the establishment of a dedicated airport (applicable to radio stations involved in mobile air operations and air traffic control operations at dedicated airports);

g) Documentation proving the case of using radio frequencies outside the planning as stipulated in Article 11a of the Radio Frequency Law amended and supplemented by Clause 3 of Article 1 of the Law Amending and Supplementing One Article of the Radio Frequency Law, accompanied by a plan for using radio equipment (applicable to cases requesting the use of radio frequencies outside the planning).

Article 7. Documents for application to renew, extend, amend, or supplement the contents of a license

1. Documents for application to renew or extend a license include:

A general information form and a form requesting renewal or extension of the frequency and radio equipment usage license according to the model prescribed in Appendix II attached to this Decree.

2. Documents for application to amend or supplement the contents of a license include:

A general information form and a technical specification and operation form according to the model prescribed in Appendix II attached to this Decree.

Article 8. Procedures and formalities for handling applications to issue, renew, extend, amend, or supplement the contents of a license

1. Organizations and individuals submit one set of documents for application to issue, renew, extend, amend, or supplement the contents of a license to the authority issuing the frequency radio usage license.

2. The authority issuing the frequency radio usage license receives and checks the validity of the documents. In cases where the documents are incomplete or do not comply with the regulations on the components of the documents, within five working days from the date of receipt of the documents, the authority issuing the frequency radio usage license will notify and guide organizations and individuals to supplement and complete the documents.

3. Within fourteen days for amateur radio stations, radio stations placed on fishing vessels and ships, and twenty-eight days for other cases from the date of receiving valid documents, the authority issuing the frequency radio usage license issues, extends, amends, or supplements the contents of the license according to the model prescribed in Appendix III attached to this Decree, or refuses to issue, extend, amend, or supplement the contents of the license and states the reasons, except for the cases stipulated in Clause 4 of this Article.

4. In cases where the number of required radio frequencies exceeds 100 frequencies in one application or exceeds 100 frequencies in applications sent within 28 days by an organization or individual, the authority issuing the frequency radio usage license handles applications to issue, extend, amend, or supplement the contents of the license within three months.

5. Within fourteen days from the date of receiving valid documents, the authority issuing the frequency radio usage license reissues the license according to the model prescribed in Appendix III attached to this Decree, or refuses to reissue the license and states the reasons.

Section 3. ISSUING, RENEWING, EXTENDING, AMENDING, AND SUPPLEMENTING THE CONTENTS OF LICENSES FOR FREQUENCY AND RADIO EQUIPMENT USAGE FOR RADIO STATIONS THAT MUST BE REGISTERED WITH THE INTERNATIONAL CIVIL AVIATION ORGANIZATION UNDER MOBILE AIR NAVIGATION SERVICES USING FREQUENCIES OUTSIDE THE 2850 KHz TO 22000 KHz BAND AND RADIO NAVIGATION SERVICES, INCLUDING RADIO STATIONS LOCATED AT SPECIAL PURPOSE AIRPORTS

Article 9. Documents for application to issue, renew, extend, amend, or supplement the contents of a license

b) Certified copy of the business registration certificate;

a) A general information form and a technical specification and operation form according to Model 1a prescribed in Appendix II attached to this Decree;

b) A document from a specialized agency under the Ministry of National Defense regarding the opening of special purpose airports (applicable to radio stations under mobile air navigation services, radio navigation services located at special purpose airports).

2. Documents for application to renew or extend a license include:

A general information form and a form requesting renewal or extension of the frequency and radio equipment usage license according to the model prescribed in Appendix II attached to this Decree.

3. Documents for application to amend or supplement the contents of a license include:

a) A general information form and a technical specification and operation form according to Model 1a prescribed in Appendix II attached to this Decree;

b) A document from a specialized agency under the Ministry of National Defense regarding the opening of special purpose airports (applicable to radio stations under mobile air navigation services, radio navigation services at special purpose airports).

Article 10. Procedure and formalities for processing applications for issuance, amendment, extension, modification, and supplementation of the content of frequency assignment permits

1. Organizations and individuals submit one set of documents for application to issue, renew, extend, amend, or supplement the contents of a license to the authority issuing the frequency radio usage license.

2. The authority issuing the frequency assignment permit shall receive and examine the validity of the application file. In cases where the application file is incomplete or does not comply with the prescribed components, the authority issuing the frequency assignment permit shall notify and guide organizations and individuals to supplement and complete the file within five working days from the date of receipt of the file. In cases where the application file is valid, the authority issuing the frequency assignment permit shall implement the international coordination procedure on radio frequencies as stipulated in Article 11 of this Decree for cases requiring recalculation of radio frequencies for issuance, modification, and supplementation of the content of the permit.

3. Time limit for processing the application file:

a) In cases requiring domestic and international coordination on radio frequencies, the time limit for processing the application file is as follows:

a1) Within seven days from the date of receipt of the notification document from the Ministry of Transport regarding the results of international frequency coordination, the authority issuing the frequency assignment permit shall issue, amend, or supplement the content of the permit according to Model 1a stipulated in Appendix III issued together with this Decree, or refuse to issue, amend, or supplement the content of the permit and specify the reasons;

a2) Within twenty-eight days from the date of receipt of a complete and valid application file, in cases where domestic frequency designation and coordination are not feasible, the authority issuing the frequency assignment permit shall refuse to issue, amend, or supplement the content of the permit and specify the reasons;

b) In cases not requiring domestic and international coordination on radio frequencies, within twenty-eight days from the date of receipt of a complete and valid application file, the authority issuing the frequency assignment permit shall extend, amend, or supplement the content of the permit according to Model 1a stipulated in Appendix III issued together with this Decree, or refuse to extend, amend, or supplement the content of the permit and specify the reasons;

c) Within fourteen days from the date of receipt of a complete and valid application file, the authority issuing the frequency assignment permit shall issue a replacement permit according to the model specified in Appendix III issued together with this Decree, or refuse to issue a replacement permit and specify the reasons.

Article 11. Domestic and International Coordination Procedures on Radio Frequencies

1. Within twenty-one days from the date of receipt of a complete and valid application file, the authority issuing the frequency assignment permit shall carry out the designation and coordination of radio frequencies domestically. If the frequency is feasible, it shall send a document along with a copy of the file as stipulated in Article 9 of this Decree requesting the specialized agency under the Ministry of Transport to coordinate internationally on radio frequencies.

2. Within thirty-eight days from the date of receipt of the request document from the authority issuing the frequency assignment permit, the specialized agency under the Ministry of Transport shall perform the following tasks:

a) Coordinate internationally on radio frequencies with international aviation authorities, the International Civil Aviation Organization;

b) Coordinate with organizations and individuals testing the transmission and reception of radio frequencies when necessary based on the agreement of the authority issuing the frequency assignment permit. The authority issuing the frequency assignment permit shall provide comments on the testing within three working days from the date of receipt of the testing request from the specialized agency under the Ministry of Transport;

c) Send a notification document to the authority issuing the frequency assignment permit regarding the results of international coordination on radio frequencies, including both successful and unsuccessful coordination cases. In cases of successful coordination, the notification shall include information about the successfully coordinated frequencies accompanied by the identification of the radio station.

3. In cases where international coordination on radio frequencies requires technical cooperation, the specialized agency under the Ministry of Transport shall cooperate with the authority issuing the frequency assignment permit to carry out such coordination.

Article 12. Registration of Radio Frequency with the International Telecommunication Union

The licensing authority shall register the radio frequency with the International Telecommunication Union within fifteen days from the date of issuing the radio frequency usage license.

Section 4. ISSUANCE, RENEWAL, EXTENSION, AMENDMENT, AND SUPPLEMENTATION OF CONTENTS OF LICENSE FOR USE OF FREQUENCY AND RADIO EQUIPMENT FOR FOREIGN REPRESENTATIVE AGENCIES' EARTH STATIONS, FOREIGN VISITOR GROUPS' EARTH STATIONS, AND FOREIGN JOURNALISTS' EARTH STATIONS SERVING FOREIGN VISITOR GROUPS USING FOREIGN SATELLITE COMMUNICATION SERVICES OR INTERNATIONAL ORGANIZATIONS ON SATELLITE COMMUNICATIONS

Article 13. Documents for Application for Issuance, Renewal, Extension, Amendment, and Supplementation of License Contents

1. Documents for application for issuance of license for foreign representative agencies' earth stations include:

a) General information form and technical specification and operation form according to Model 1m prescribed in Appendix II issued together with this Decree;

b) Request letter from the specialized agency under the Ministry of Foreign Affairs or the Department of Foreign Affairs of Ho Chi Minh City or the Department of Foreign Affairs assigned to manage.

2. Documents for application for issuance of license for foreign visitor groups' earth stations include:

a) General information form and technical specification and operation form according to Model 1m prescribed in Appendix II issued together with this Decree;

b) Request letter from the specialized agency under the Ministry of Foreign Affairs (applicable for foreign visitor groups' earth stations invited by state leaders or the Government);

Request letter from the specialized agency under the Central Committee's External Relations Board (applicable for foreign visitor groups' earth stations invited by Party leaders);

Request letter from the specialized agency under the Office of the National Assembly (applicable for foreign visitor groups' earth stations invited by National Assembly leaders);

Request letter from the host agency (applicable for other foreign visitor groups' earth stations).

3. Documents for application for issuance of license for foreign journalists' earth stations accompanying foreign visitor groups include:

a) General information form and technical specification and operation form according to Model 1m prescribed in Appendix II issued together with this Decree;

b) Request letter from the specialized agency under the Ministry of Foreign Affairs.

4. Documents for application for renewal and amendment of license include:

General information form and request form for renewal and amendment of license for frequency and radio equipment according to the provisions in Appendix II issued together with this Decree.

5. Documents for application for amendment and supplementation of license contents include:

General information form and technical specification and operation form according to Model 1m prescribed in Appendix II issued together with this Decree.

Article 14. Procedures and Formalities for Processing Applications for Issuance, Renewal, Extension, Amendment, and Supplementation of License Contents

1. Coordination procedures and time limits for issuance, extension, amendment, and supplementation of license contents for foreign representative agencies

a) The foreign representative agency submits one set of application documents for issuance, extension, amendment, and supplementation of license contents as prescribed in Article 13 of this Decree to the licensing authority for radio frequency usage;

b) The licensing authority for radio frequency usage checks the validity of the documents. In case the documents are incomplete, not in accordance with the required components, or require additional information, within three working days from the date of receipt of the documents, the licensing authority for radio frequency usage informs and guides the foreign representative agency to supplement and complete the documents, and simultaneously notifies the specialized agency under the Ministry of Foreign Affairs or the Department of Foreign Affairs of Ho Chi Minh City or the Department of Foreign Affairs assigned to manage for coordination; within three working days from the date the licensing authority for radio frequency usage sends the notification, the foreign representative agency must complete and submit all documents in accordance with the regulations;

c) Within one working day from the date of receiving valid documents, the licensing authority for radio frequency usage forwards a document along with a copy of the application documents for issuance of license to the specialized agency under the Ministry of Public Security;

d) Within six working days from the date the licensing authority for radio frequency usage sends the document, the specialized agency under the Ministry of Public Security provides comments in writing.

In cases requiring additional time for review, the specialized agency under the Ministry of Public Security issues a written notice to the licensing authority for radio frequency usage, but the total processing time does not exceed fourteen days;

e) Within six working days from the date of receiving the document from the specialized agency under the Ministry of Public Security, the licensing authority for radio frequency usage issues the license for frequency and radio equipment according to Model 1m prescribed in Appendix III issued together with this Decree or refuses to issue the license and specifies the reasons, and simultaneously notifies the result to the specialized agency under the Ministry of Foreign Affairs or the Department of Foreign Affairs of Ho Chi Minh City or the Department of Foreign Affairs assigned to manage and the specialized agency under the Ministry of Public Security.

2. Coordination procedures and time limits for issuance, extension, amendment, and supplementation of license contents for foreign visitor groups

a) The foreign visitor group submits one set of application documents for issuance, extension, amendment, and supplementation of license contents as prescribed in Article 13 of this Decree to the licensing authority for radio frequency usage;

b) The licensing authority for radio frequency usage checks the validity of the documents. In case the documents are incomplete, not in accordance with the required components, or require additional information, within one working day from the date of receipt of the documents, the licensing authority for radio frequency usage informs and guides the foreign visitor group to supplement and complete the documents, and simultaneously notifies the host agency for coordination; within one working day from the date the licensing authority for radio frequency usage sends the notification, the foreign visitor group must complete and submit all documents in accordance with the regulations;

c) Within one working day from the date of receiving valid documents, the licensing authority for radio frequency usage forwards a document along with a copy of the application documents for issuance of license of the foreign visitor group to the specialized agency under the Ministry of Public Security;

d) Within three working days from the date the licensing authority for radio frequency usage sends the document, the specialized agency under the Ministry of Public Security provides comments in writing to the licensing authority for radio frequency usage;

đ) Within three working days from the date of receipt of the document from the specialized agency under the Ministry of Public Security, the frequency usage permit issuing authority shall issue the frequency and radio equipment usage permit according to Form 1m prescribed in Appendix III attached hereto, or refuse to issue the permit and specify the reasons, while simultaneously notifying the result to the specialized agency under the Ministry of Public Security and the agency hosting and welcoming.

3. Procedures for coordination and time limit for processing issuance, extension, amendment, and supplementation of the content of permits for foreign journalists accompanying foreign tourist groups.

a) Foreign journalists accompanying foreign tourist groups submit one set of application dossier for issuance, extension, amendment, and supplementation of the content of the permit in accordance with the provisions at Article 13 of this Decree to the licensing authority for radio frequency usage;

b) The frequency usage permit issuing authority checks the validity of the dossier. In case the dossier is incomplete, does not comply with the requirements regarding the components of the dossier, or requires additional information or clarification, within three working days from the date of receipt of the dossier, the frequency usage permit issuing authority shall notify and guide the foreign journalists accompanying foreign tourist groups to supplement and complete the dossier, and simultaneously notify the specialized agency under the Ministry of Foreign Affairs for coordination; within three working days from the date the frequency usage permit issuing authority sends the notification, the foreign journalists accompanying foreign tourist groups must complete and submit the dossier in compliance with the regulations;

c) Within one working day from the date of receipt of the valid dossier, the frequency usage permit issuing authority shall send a document along with a copy of the application dossier for issuance, extension, amendment, and supplementation of the content of the permit of the foreign journalists accompanying foreign tourist groups to the specialized agency under the Ministry of Public Security;

d) Within five working days from the date the frequency usage permit issuing authority sends the document, the specialized agency under the Ministry of Public Security shall provide comments in writing to the frequency usage permit issuing authority;

In cases where additional time is required for review, the specialized agency under the Ministry of Public Security shall issue a document to notify the frequency usage permit issuing authority, but the total processing time shall not exceed fourteen days;

đ) Within five working days from the date of receipt of the document from the specialized agency under the Ministry of Public Security, the frequency usage permit issuing authority shall issue the frequency and radio equipment usage permit according to Form 1m prescribed in Appendix III attached hereto, or refuse to issue the permit and specify the reasons, while simultaneously notifying the result to the specialized agency under the Ministry of Public Security and the Ministry of Foreign Affairs.

4. Procedures, formalities, and time limits for processing applications for replacement of permits for foreign diplomatic missions, foreign tourist groups, and foreign journalists accompanying foreign tourist groups.

a) Foreign diplomatic missions, foreign tourist groups, and foreign journalists accompanying foreign tourist groups submit one set of dossier in accordance with the provisions at Clause 4 Article 13 of this Decree to the licensing authority for radio frequency usage;

b) The frequency usage permit issuing authority checks the validity of the dossier. In case the dossier is incomplete, does not comply with the requirements regarding the components of the dossier, or requires additional information or clarification, within three working days from the date of receipt of the dossier, the frequency usage permit issuing authority shall notify and guide the foreign diplomatic missions, foreign tourist groups, and foreign journalists accompanying foreign tourist groups to supplement and complete the dossier; within three working days from the date the frequency usage permit issuing authority sends the notification, the foreign diplomatic missions, foreign tourist groups, and foreign journalists accompanying foreign tourist groups must complete and submit the dossier in compliance with the regulations;

c) Within five working days from the date of receipt of the valid dossier, the frequency usage permit issuing authority shall issue a replacement permit according to the form prescribed in Appendix III attached hereto, or refuse to issue the replacement permit and specify the reasons.

Section 5. ISSUANCE, RENEWAL, EXTENSION, AMENDMENT, AND SUPPLEMENTATION OF CONTENT OF LICENSES FOR THE USE OF FREQUENCY BANDS AND SATELLITE ORBITS

Article 15. Documents for Application for Issuance, Renewal, Extension, Amendment, and Supplementation of Content of Licenses for the Use of Frequency Bands and Satellite Orbits

1. A declaration form for application for issuance, renewal, extension, amendment, and supplementation of content of licenses for the use of frequency bands and satellite orbits according to Model 3 prescribed in Appendix II issued together with this Decree.

2. Commitment to meet the conditions stipulated in Clause 2, Article 21 of the Radio Frequency Law, consistent with the project or plan approved by the competent authority (applicable in cases of application for issuance, amendment, and supplementation of content of licenses).

Article 16. Procedures for Processing Applications for Issuance, Renewal, Extension, Amendment, and Supplementation of Content of Licenses for the Use of Frequency Bands and Satellite Orbits

1. An organization submits one set of application documents for issuance, renewal, extension, amendment, and supplementation of content of licenses to the issuing authority for radio frequency licenses.

2. The issuing authority for radio frequency licenses receives and checks the validity of the documents. In case the documents are incomplete or do not comply with the required components, within five working days from the date of receipt of the documents, the issuing authority for radio frequency licenses will notify and guide the organization to supplement and complete the documents.

3. For cases of issuance, extension, amendment, and supplementation of content of licenses:

Within five working days from the date of receipt of valid documents, the issuing authority for radio frequency licenses sends a document along with a copy of the application documents to seek the opinion of the specialized agency under the Ministry of Public Security.

Within ten days from the date the issuing authority for radio frequency licenses sends the document, the specialized agency under the Ministry of Public Security provides its opinion in writing.

Within forty days from the date of receipt of the written opinion of the specialized agency under the Ministry of Public Security, the issuing authority for radio frequency licenses issues, extends, amends, or supplements the content of the license according to the model prescribed in Appendix III issued together with this Decree, or refuses to issue, extend, amend, or supplement the content of the license and clearly states the reasons.

4. For cases of renewal of licenses:

Within fourteen days from the date of receipt of valid documents, the issuing authority for radio frequency licenses renews the license according to the model prescribed in Appendix III issued together with this Decree, or refuses to renew the license and clearly states the reasons.

Section 6. ISSUANCE OF LICENSES FOR THE USE OF BANDWIDTH THROUGH AUCTIONS OF RIGHTS TO USE RADIO FREQUENCIES

Article 17. Auction Organization Plan

1. The Minister of Information and Communications approves the auction organization plan and organizes the implementation of the auction.

2. The auction organization plan includes the following main contents:

a) Requirements for commitments to deploy telecommunications networks to ensure the development of telecommunications in accordance with the national telecommunications development plan, harmonizing the interests of the state, people, and businesses;

b) Information on the use of bandwidth and the term of the bandwidth usage license;

c) Starting price, bid increment, and deposit;

d) Form and method of auction;

đ) Handling of auction situations (if any).

3. The auction organization plan must be publicly announced on the Ministry of Information and Communications' electronic portal no later than five working days from the date of approval and can only be used once for organizing an auction.

4. Handling of auction situations when there is only one organization registering to participate in the auction, one organization participating in the auction, or one organization bidding:

a) In the case of re-auctioning frequency bands after an unsuccessful auction, at the re-auction, if after the registration period for participation in the auction, there is only one organization registered to participate in the auction, or there are multiple organizations registered to participate but only one participates in the auction, or there are multiple participants but only one bids, or there are multiple bidders but only one offers the highest bid and the minimum bid is equal to or higher than the starting price, then the frequency band is sold to that organization. The sale of the frequency band to the organization specified in this clause must be provided for in the auction organization plan approved by the Minister of Information and Communications;

b) The auction of assets in the situation specified in point a of this clause can only proceed after fully complying with the procedures and formalities for asset auctions as prescribed by the Auction Law, detailed regulations of the Auction Law, and this Decree, and without any complaints related to the procedures and formalities until the day of the auction;

c) Within three working days from the end of the auction specified in point a of this clause, the auction organization or the Auction Council sends a report to the Ministry of Information and Communications about the auction process and the auction minutes. In this case, the auction minutes, in addition to the contents prescribed by the law on auctions, must reflect the auction process where only one organization registers to participate in the auction, or there are multiple organizations registered to participate but only one participates in the auction, or there are multiple participants but only one bids, or there are multiple bidders but only one offers the highest bid and the minimum bid is equal to or higher than the starting price;

d) Approval and announcement of the auction results are carried out as prescribed in Article 22 of this Decree.

Article 18. Starting price

The starting price for the block of frequency bands shall be determined as follows:

Where:

GKĐ is the starting price, measured in Vietnamese Dong;

MTCSMHz is the basic fee level decided according to the provisions of this Decree, measured in Vietnamese Dong/MHz/year;

Bw is the width of the block of frequency bands whose starting price needs to be determined, measured in MHz (Megahertz);

d.1. Amount of taxable income in Vietnam: is the entire permitted period for using the frequency band, measured in years.

Article 19. Examination of Conditions for Participation in Auctions

1. Examination of conditions for participation in auctions is the process of reviewing and evaluating applications to confirm that participating organizations meet the conditions stipulated in Clause 2 of this Article.

2. Conditions for participation in auctions include:

a) The conditions prescribed at points a and c of Clause 1 of Article 18a of the Radio Frequency Law, supplemented by Clause 6 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Radio Frequency Law;

b) Conditions for obtaining a license to establish a telecommunications network using the frequency band granted through auction as follows:

b1) Meeting the conditions for issuing, renewing, or amending and supplementing a license to establish a telecommunications network as provided for by the Telecommunications Law;

b2) A business plan and technical plan for using the frequency band granted through auction, which is included in the telecommunications service business license and is consistent with the requirements for deploying the telecommunications network of the frequency band granted through auction;

b3) Commitment to meeting the conditions for deploying the telecommunications network for the frequency band granted through auction.

3. Within thirty days from the date the Ministry of Information and Communications publicly announces the auction organization plan, organizations must submit one set of application documents to confirm their compliance with the conditions for participating in the auction to the Ministry of Information and Communications (Telecommunications Department) via one of the following methods: through the online public service system, by postal service, or direct submission. Applications submitted beyond the above deadline will not be accepted or processed.

4. Application documents for obtaining a certificate confirming compliance with the conditions for participating in auctions for organizations already holding a telecommunications service business license include:

a) An application form for obtaining a certificate confirming compliance with the conditions for participating in auctions according to Form 01 attached as Appendix V to this Decree;

b) Application documents for issuing a new telecommunications service business license using the frequency band granted through auction as stipulated by the Telecommunications Law; or application documents for amending and supplementing a public telecommunications network establishment license or a telecommunications service provision license using the frequency band due to changes in the need for telecommunications resources as stipulated by the Telecommunications Law, including:

b1) An application form for amending and supplementing a telecommunications service business license as stipulated by the Telecommunications Law;

b2) A report on the implementation of the license from the date it was issued until the date of submitting the application for amending and supplementing the license as stipulated by the Telecommunications Law;

b3) A business plan and technical plan consistent with the changed telecommunications resources as stipulated by the Telecommunications Law;

c) A commitment to deploy the telecommunications network after winning the auction according to the model at Appendix IV attached to this Decree;

d) A commitment to the bid price in the event that the organization wins the auction, ensuring that the technical and business plans comply with the conditions for issuing, issuing anew, or amending and supplementing a telecommunications service business license using the frequency band granted through auction as stipulated by the Telecommunications Law according to Model 02 attached as Appendix V to this Decree;

đ) Commitment to meeting the conditions stipulated at point a of Clause 1 of Article 18a of the Radio Frequency Law, supplemented by Clause 6 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Radio Frequency Law.

5. Application documents for obtaining a certificate confirming compliance with the conditions for participating in auctions for organizations without a telecommunications service business license include:

a) An application form for obtaining a certificate confirming compliance with the conditions for participating in auctions according to Form 01 attached as Appendix V to this Decree;

b) Application documents for issuing a public telecommunications network establishment license or a telecommunications service provision license using the frequency band as stipulated by the Telecommunications Law;

c) A commitment to deploy the telecommunications network after winning the auction according to the model at Appendix IV attached to this Decree;

d) A commitment to the bid price in the event that the organization wins the auction, ensuring that the technical and business plans comply with the conditions for issuing, issuing anew, or amending and supplementing a telecommunications service business license using the frequency band granted through auction as stipulated by the Telecommunications Law according to Model 02 attached as Appendix V to this Decree;

đ) Commitment to meeting the conditions stipulated at point a of Clause 1 of Article 18a of the Radio Frequency Law, supplemented by Clause 6 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Radio Frequency Law.

6. The examination of granting a certificate confirming compliance with the conditions for participating in auctions is conducted concurrently with the examination of issuing, issuing anew, or amending and supplementing a telecommunications service business license, carried out according to Article 18a of the Radio Frequency Law, supplemented by Clause 6 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Radio Frequency Law and the conditions stipulated at point b of Clause 2 of this Article.

7. Time limit and procedure for handling applications:

a) Within one day from the date of receiving the application, the Ministry of Information and Communications (Telecommunications Department) shall issue a written notice to the organization regarding an invalid application. Within four days from the date of receiving the notice of an invalid application, the organization must complete and resubmit the application in accordance with the regulations; if the application remains invalid, the Ministry of Information and Communications (Telecommunications Department) shall issue a written notice refusing to consider the issuance of a confirmation certificate;

b) Within fifteen days from the date of receiving a valid application, the Ministry of Information and Communications shall examine and issue a certificate confirming that the organization meets the conditions for participating in the auction according to Form 03 attached as Appendix V to this Decree;

c) In cases where the application does not meet the conditions stipulated in Article 18a of the Radio Frequency Law, supplemented by Clause 6 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Radio Frequency Law, the Ministry of Information and Communications shall issue a written notice refusing to issue a confirmation certificate, specifying the reasons.

Article 20. Documents for Participation in Auction

The documents for participation in auction shall include the following main contents:

1. Application for registration to participate in the auction.

2. Block of frequency bands registered for purchase.

3. Original or certified copy of the certificate confirming compliance with the conditions for participating in the auction issued by the Minister of Information and Communications.

Article 21. Handling of Deposit Money

1. After winning the auction, the advance payment amount and interest (if any) of the winning organization shall be converted into deposit money to ensure the fulfillment of the obligation to pay the auction-winning amount.

An organization that fails to fulfill the obligation to pay the fee for the right to use radio frequencies after winning the auction as stipulated in Clause 1, Article 53 of this Decree shall not be refunded the deposit money, which shall be paid into the state budget.

2. Within three working days from the date of the end of the auction, the auction asset organization has the responsibility to remit the deposit money and interest (if any) of the winning organization into the account opened at the state treasury of the Ministry of Information and Communications or the organization entrusted by the Ministry of Information and Communications to collect the fee for the right to use radio frequencies in accordance with the laws on the state budget.

Article 22. Approval of Auction Winning Results

1. Within fifteen days from the date of receiving the list of winning organizations from the auction asset organization or the Auction Asset Council, the Minister of Information and Communications issues a Decision approving the auction winning results to be sent to the winning organizations.

The Decision approving the auction winning results includes the information: winning organization, block of frequency bands won, permitted usage period, auction-winning amount, method of paying the fee for the right to use radio frequencies, and the obligations of the winning organization in fully and timely paying the fee for the right to use radio frequencies to obtain a telecommunications service business license and a frequency band usage permit.

2. At the end of the auction, the Ministry of Information and Communications publicly announces information about the auction on its electronic portal.

Article 23. Issuance of Frequency Band Usage Permit and Telecommunications Service Business License

1. Within three working days from the date the Ministry of Information and Communications approves the auction winning results, the Ministry of Information and Communications (the authority issuing the radio frequency usage permit, the Telecommunications Department) notifies the winning organization of the fees for the right to use radio frequencies, licensing fees, radio frequency usage fees, licensing fees, telecommunications operation fees required to be paid to obtain a telecommunications service business license and a frequency band usage permit.

2. Within fifteen days from the date the organization has fully paid all financial amounts specified in Clause 1 of this Article in accordance with the regulations, the organization will be granted a telecommunications service business license and a frequency band usage permit.

3. If an organization fails to fully and timely pay the financial amounts specified in Clause 1 of this Article, it shall not be granted a telecommunications service business license and a frequency band usage permit. The Ministry of Information and Communications will revoke the Decision approving the auction winning results for this organization.

Section 7. ISSUANCE OF LICENSES FOR BANDWIDTH USE THROUGH BIDDING FOR RADIO FREQUENCY LICENSES

Article 24. Bid organization plan

1. Based on the Prime Minister's Decision regarding the bandwidth to be bid for radio frequency usage rights, the Minister of Information and Communications shall approve the bid organization plan and implement the bidding process. The bid organization plan includes the following main contents:

a) Information on bandwidth usage, license duration;

b) Minimum requirements for commitments to deploy telecommunications networks to ensure telecommunications development in line with the national telecommunications development plan, harmonizing the interests of the state, citizens, and businesses;

c) Fee level for granting radio frequency usage rights;

d) Conditions for participating in the bidding;

đ) Bidding criteria, marking principles, scoring scale;

e) Method for determining the successful bidder and handling situations where bidding documents have equal scores;

g) Model Commitment to Deploy Telecommunications Network;

h) Submission location and method for bidding documents;

i) Time and location for opening bidding documents.

2. The bid organization plan must be publicly announced on the Ministry of Information and Communications' electronic portal no later than five working days from the date of approval and can only be used for one bidding session.

Article 25. Bidding Document Evaluation Committee

1. The Minister of Information and Communications shall establish a Bidding Document Evaluation Committee to assist in marking bidding documents.

2. The Bidding Document Evaluation Committee must consist of at least five members, including one chairperson and mandatory members from units under the Ministry of Information and Communications responsible for telecommunications management functions, radio frequency management, finance, and other members (if necessary).

Article 26. Bidding Documents

1. Within sixty days from the date the Ministry of Information and Communications publicly announces the bid organization plan, organizations must submit their bidding documents to the Ministry of Information and Communications (Telecommunications Department) via postal service or direct submission. Bidding documents submitted beyond this deadline will not be accepted or processed.

2. For organizations that have been granted licenses to operate telecommunications services using bandwidth, the documents include:

a) Application form for participation in the bidding according to Model 04 stipulated in Appendix V issued together with this Decree;

b) Application for new license issuance for operating telecommunications services using bandwidth granted through bidding as prescribed by telecommunications laws; or application for modification or supplementation of public telecommunications network establishment license, telecommunications service provision license using bandwidth due to changes in telecommunication resource needs already granted, including:

b1) An application form for amending and supplementing a telecommunications service business license as stipulated by the Telecommunications Law;

b2) A report on the implementation of the license from the date it was issued until the date of submitting the application for amending and supplementing the license as stipulated by the Telecommunications Law;

b3) Revised business and technical plans consistent with changed telecommunication resources as prescribed by telecommunications laws;

c) Commitment to deploy telecommunications network after winning the bid according to the model set forth in Appendix IV issued together with this Decree;

d) Commitment to meet conditions stipulated in point a, Clause 1, Article 18a of the Radio Frequency Law amended by Clause 6, Article 1 of the Law Amending and Supplementing Certain Provisions of the Radio Frequency Law;

đ) Other documents as required by the bid organization plan.

3. For organizations not falling under the provisions of Clause 2 of this Article, the documents include:

a) Application form for participation in the bidding according to Model 04 stipulated in Appendix V issued together with this Decree;

b) Application for issuance or new issuance of public telecommunications network establishment license, telecommunications service provision license using bandwidth as prescribed by telecommunications laws;

c) Commitment to deploy telecommunications network after winning the bid according to the model set forth in Appendix IV issued together with this Decree;

d) Commitment to meet conditions stipulated in point a, Clause 1, Article 18a of the Radio Frequency Law amended by Clause 6, Article 1 of the Law Amending and Supplementing Certain Provisions of the Radio Frequency Law;

đ) Other documents as required by the bid organization plan.

4. Bidding documents are prepared in two original copies accompanied by an electronic backup copy, packaged and sealed in accordance with the bidding plan.

5. After the bidding document submission deadline, organizations may not change the bidding documents they have submitted.

Article 27. Opening of Tender Submission Files

1. The Ministry of Information and Communications shall organize the opening of tender submission files according to the time and location specified in the examination organization plan.

2. Organizations participating in the tender shall send representatives to attend the opening of tender submission files. The opening of tender submission files shall be conducted strictly in accordance with the prescribed time, regardless of whether the representatives of the participating organizations are present or absent.

3. The procedure for opening tender submission files shall be carried out as follows:

a) Announce the list of participants;

b) Announce the number of tender submission files and the names of the organizations participating in the tender;

c) Check the sealing of the tender submission files;

d) Open each file sequentially and record in the minutes of the tender submission file opening information on: the name of the enterprise, the number of original tender submission files and electronic copies;

đ) Approve the minutes of the tender submission file opening;

e) Representatives of each organization and representatives of the Ministry of Information and Communications shall sign to confirm in the minutes of the tender submission file opening. Copies of the minutes of the tender submission file opening shall be sent to all participating organizations;

g) After the opening of tender submission files, representatives of the Ministry of Information and Communications shall sign to confirm on the original of all tender submission files and seal one set of original tender submission files. On the sealing paper, there shall be signatures of representatives of the Ministry of Information and Communications and representatives of participating organizations who are present.

4. The determination of organizations meeting the conditions to participate in the tender for frequency spectrum usage rights and scoring of tender submission files shall be based on copies. Originals of tender submission files shall be kept and stored at the Ministry of Information and Communications after the tender results are announced.

Article 28. Determination of Organizations Meeting Conditions to Participate in the Tender for Frequency Spectrum Usage Rights

1. Within fifteen days from the date of opening tender submission files, the Ministry of Information and Communications shall approve the list of organizations meeting the conditions to participate in the tender for frequency spectrum usage rights. In cases where organizations do not meet the conditions to participate in the tender for frequency spectrum usage rights, the Ministry of Information and Communications shall issue a notification to the organizations specifying the reasons. Tender submission files of organizations that do not meet the conditions to participate in the tender for frequency spectrum usage rights shall not be scored.

2. An organization shall be determined to meet the conditions to participate in the tender for frequency spectrum usage rights if it meets the following conditions:

a) The conditions prescribed at points a and c of Clause 1 of Article 18a of the Radio Frequency Law, supplemented by Clause 6 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Radio Frequency Law;

b) Conditions for obtaining a telecommunications network establishment license using the allocated frequency band through the tender process are as follows:

b1) Meeting the conditions for issuing, renewing, or amending a telecommunications service business license in accordance with laws on telecommunications;

b2) A business plan and technical plan for using the allocated frequency band through the tender process must be included in the telecommunications service business license and be consistent with the requirements for deploying the telecommunications network of the allocated frequency band through the tender process;

b3) Commitment to meet the conditions for deploying the telecommunications network for the allocated frequency band through the tender process.

3. The determination of organizations meeting the conditions to participate in the tender for frequency spectrum usage rights shall be carried out concurrently with the issuance, renewal, or amendment of a telecommunications service business license, in accordance with Article 18a of the Radio Frequency Law amended by Clause 6 of Article 1 of the Law Amending and Supplementing One Article of the Radio Frequency Law and Clause 2 of this Article.

Article 29. Scoring of Bid Documents and Determination of Successful Organization

1. Within thirty days from the date on which the Minister of Information and Communications approves the list of organizations meeting the conditions to participate in the frequency band usage rights bidding, the Bid Evaluation Committee shall be responsible for organizing the scoring of bid documents and reporting the results to the Ministry of Information and Communications.

2. The criteria for scoring, the grading scale, and the principles for scoring are stipulated in the bidding plan.

3. The Ministry of Information and Communications shall determine the successful organization according to the provisions set out in the bidding plan.

Article 30. Approval of Winning Results, Issuance of Frequency Band Usage Licenses, and Telecommunications Service Business Licenses

1. Within fifteen days from the date of receipt of the Bid Evaluation Committee's report on the scoring results, the Minister of Information and Communications shall issue a Decision approving the winning results.

The Decision approving the winning results shall include information about the successful organization, the awarded frequency band, the permitted usage period, the amount of the frequency band usage right fee, the payment method for the frequency band usage right fee, and the information requiring the organization to fully and timely pay the frequency band usage right fee to obtain the telecommunications service business license and the frequency band usage license.

2. At the end of the bidding process, the Ministry of Information and Communications shall publicly announce information about the bidding process on its electronic portal.

3. Within three working days from the date of approval of the winning results, the Ministry of Information and Communications (the authority issuing the frequency band usage license, the Telecommunications Department) shall notify the successful organization of the fees for the frequency band usage right, registration fees, usage fees, licensing fees, and operation fees required to obtain the telecommunications service business license and the frequency band usage license.

4. Within twenty days from the end of the deadline for paying the frequency band usage right fee as prescribed in point a, Clause 3, Article 54 of this Decree,the organization that has paid all the fees specified in Clause 3 of this Article shall be issued the telecommunications service business license and the frequency band usage license.

Article 31. Revocation of Bidding Results

The Minister of Information and Communications shall revoke the Decision approving the winning results of the organization in the following cases:

1. There is evidence of bribery, collusion, fraud, or abuse of position or power to illegally interfere with the bidding process.

2. The successful organization fails to fully and timely pay the financial amounts stipulated in Clause 3 of Article 30 of this Decree..

Chapter 8. DIRECT ISSUE OF FREQUENCY BAND USAGE LICENSES

Article 32. Application Documents, Procedures, and Formalities for Direct Issuance of Frequency Band Usage Licenses

1. The application documents for direct issuance of frequency band usage licenses include:

a) A completed form according to Model 2 as prescribed in Appendix II attached to this Decree;

b) A certified copy or a legally certified electronic copy of the Prime Minister’s Decision approving the project using the frequency band for economic development combined with national defense and security tasks, in cases where the license is issued according to point d, Clause 4, Article 18 of the Radio Frequency Law amended and supplemented by Clause 6, Article 1 of the Law Amending and Supplementing Certain Provisions of the Radio Frequency Law.

2. Procedures and formalities for processing applications for direct issuance of frequency band usage licenses

a) The organization submits one set of application documents for direct issuance of frequency band usage licenses to the authority issuing the frequency band usage license;

b) The authority issuing the frequency band usage license receives and checks the application documents. If the documents are incomplete or do not comply with the required components, within five working days from the date of receipt of the documents, the authority issuing the frequency band usage license shall notify and guide the organization to supplement and complete the documents; within five working days from the date of receipt of the notification, the organization must complete and submit the full set of documents in accordance with the regulations;

c) Within fifty-five days from the date of receipt of the complete and valid documents, the authority issuing the frequency band usage license shall issue the license according to the model prescribed in Appendix III attached to this Decree or refuse to issue the license and provide the reasons.

Article 33. Documents, procedures, and formalities for directly issuing frequency band usage permits in cases of reissuance

1. Conditions for obtaining a telecommunications service business operation permit with a reissued frequency band usage permit shall be as follows:

a) Meeting the conditions for issuing, amending, or supplementing a telecommunications service business operation permit as prescribed by laws on telecommunications;

b) A business plan and technical plan for using the reissued frequency band that are established jointly for telecommunications service business operations at the business operation permit and are consistent with the requirements for deploying the telecommunications network of the reissued frequency band;

c) Commitment to meet the conditions for deploying the telecommunications network for the reissued frequency band usage permit.

2. At least 12 months before the expiration date of the frequency band usage permit, the Ministry of Information and Communications will notify the validity period of the reissued frequency band usage permit and request commitments to deploy the telecommunications network for the reissued frequency band.

The content of the commitment to deploy the telecommunications network must be consistent with the requirements for telecommunications development periods according to the national telecommunications development plan, harmonizing the interests of the state, citizens, and businesses. In cases where the commitment to deploy the telecommunications network for the reissued frequency band involves stopping the technology being deployed, the minimum duration for which the organization is permitted to maintain the technology being deployed is three years from the effective date of the frequency band usage permit issued for the reissued frequency band. Agreement letter 3. Within thirty days prior to the remaining six-month validity period of the frequency band usage permit, organizations requiring a reissued frequency band usage permit must submit two sets of documents to the competent authority as follows:

a) Submit one set of documents to the agency issuing the radio frequency usage permit, including the application form according to Model 2 stipulated in Appendix II promulgated together with this Decree;

b) Submit one set of documents to the Ministry of Information and Communications (Telecommunications Administration) including the application for issuing a telecommunications service business operation permit for the frequency band requesting a reissued frequency band usage permit as prescribed in Clause 4 of this Article.

4. Application documents for issuing a telecommunications service business operation permit

a) For organizations already holding a telecommunications service business operation permit, the documents include:

a1) Application documents for amending and supplementing the public telecommunications network establishment permit and the telecommunications service provision permit using the frequency band due to changes in the need for telecommunications resources already permitted, including:

An application for amending and supplementing the telecommunications service business operation permit in accordance with the laws on telecommunications;

A report on the implementation of the permit from the date of issuance until the date of submission of the application for amending and supplementing the permit in accordance with the laws on telecommunications;

An amended and supplemented business plan and technical plan consistent with the changed telecommunications resources in accordance with the laws on telecommunications;

a2) A commitment to deploy the telecommunications network according to the model attached in Appendix IV promulgated together with this Decree;

b) For enterprises not falling under the provisions of point a of this clause, the documents include:

b1) Application documents for issuing a new public telecommunications network establishment permit and a telecommunications service provision permit using the frequency band in accordance with the laws on telecommunications;

b2) A commitment to deploy the telecommunications network according to the model attached in Appendix IV promulgated together with this Decree.

5. Time limit for processing applications:

a) Within five working days from the date of receipt of the documents, the Ministry of Information and Communications (the agency issuing the radio frequency usage permit, Telecommunications Administration) shall issue a written notice to the organization regarding incomplete documents. Within five working days from the date of receipt of the notification, the organization must complete and submit the valid documents as required;

b) At least ninety days before the expiration date of the frequency band usage permit, the Ministry of Information and Communications will notify the organization about meeting the conditions for reissuing the frequency band usage permit, stating the reasons if the conditions are not met; the Ministry of Information and Communications (the agency issuing the radio frequency usage permit, Telecommunications Administration) will notify the organization meeting the conditions for reissuing the frequency band usage permit about the amount of money for the right to use the radio frequency, fees, charges for using the radio frequency, fees, charges for operating permits, and charges for the right to operate telecommunications services and frequency bands to obtain the telecommunications service business operation permit and the frequency band usage permit;

c) At least thirty days before the expiration date of the previously issued frequency band usage permit, organizations that have paid all amounts specified in point b of this clause will be issued the telecommunications service business operation permit and the frequency band usage permit.

c) Not later than thirty days before the date when the frequency band usage permit issued expires, an organization that has paid all amounts prescribed in point b of this clause shall be granted a telecommunications service business operation permit and a frequency band usage permit.

Section 9. ISSUANCE OF REPLACEMENT LICENSES, EXTENSION, AMENDMENT, AND SUPPLEMENTATION OF CONTENT IN FREQUENCY BAND USE LICENSES

Article 34. Documents, Procedures, and Formalities for Requesting Replacement, Amendment, and Supplemental Content in Frequency Band Use Licenses

1. Documents for requesting replacement licenses include:

Form 2 as prescribed in Appendix II attached to this Decree.

2. Documents for application to amend or supplement the contents of a license include:

Form 2 as prescribed in Appendix II attached to this Decree.

A legal copy or a legally certified electronic copy of the Prime Minister's Decision on adjusting the Plan for frequency band use for economic development combined with national defense and security tasks for cases where the request is to amend or supplement the content of the license issued according to point d, Clause 4, Article 18 of the Radio Frequency Law amended and supplemented in Clause 6, Article 1 of the Law Amending and Supplementing Certain Provisions of the Radio Frequency Law (in cases involving adjustments to the Plan).

3. Procedures and formalities for processing requests for replacement, amendment, and supplementation of content in frequency band use licenses

a) The organization submits one set of documents for requesting replacement, amendment, or supplementation of content in frequency band use licenses to the authority issuing radio frequency use licenses;

b) The authority issuing radio frequency use licenses receives and checks the documents. In cases where the documents are incomplete or do not comply with the required document components, within five working days from the date of receipt of the documents, the authority issuing radio frequency use licenses will notify and guide the organization or individual to complete and perfect the documents; within five working days from the date of receiving the notification, the organization must complete and submit all required documents;

c) Within fourteen days for replacement licenses and fifty-five days for amending or supplementing the content of the license, from the date of receiving valid documents, the authority issuing radio frequency use licenses issues the license according to the form prescribed in Appendix III attached to this Decree or refuses to issue the license and states the reasons.

Article 35. Documents, Procedures, and Formalities for Processing Requests for Extension of Frequency Band Use Licenses

1. Documents for requesting extension of licenses include:

a) A completed form according to Model 2 as prescribed in Appendix II attached to this Decree;

b) A legal copy or a legally certified electronic copy of the Prime Minister's Decision approving the continuation of implementing the Plan for cases where the request is to extend the license issued according to point d, Clause 4, Article 18 of the Radio Frequency Law amended and supplemented in Clause 6, Article 1 of the Law Amending and Supplementing Certain Provisions of the Radio Frequency Law.

2. Procedures and formalities for processing requests for extension of licenses

a) Within five working days from the date of receipt of the documents, the authority issuing radio frequency use licenses shall issue a written notice to the organization regarding non-compliant documents. Within five working days from the date of receiving the notice, the organization must complete and submit all required documents;

b) At least forty-five days before the frequency band use license expires, the authority issuing radio frequency use licenses shall notify the organization meeting the conditions for extension of the amount of fees for the right to use radio frequencies, registration fees, and radio frequency usage fees that must be paid, and if the conditions for extension are not met, the reasons must be clearly stated;

c) Before the license expires, organizations that have paid all amounts specified in point b of this clause shall have their licenses extended according to the form prescribed in Appendix III attached to this Decree.

Section 10. CONSTRUCTION AND APPROVAL OF THE PLAN FOR UTILIZING FREQUENCY BANDS TO DEVELOP THE ECONOMY IN COMBINATION WITH NATIONAL DEFENSE AND SECURITY TASKS

Article 36. Plan for utilizing frequency bands to develop the economy in combination with national defense and security tasks

1. The contents of the plan for utilizing frequency bands to develop the economy in combination with national defense and security tasks include the following main points:

a) The necessity, purpose, and requirements of the plan;

b) Specific assignment of national defense and security tasks to state-owned enterprises directly serving national defense and security in accordance with the laws on enterprises; the necessity to use public terrestrial telecommunications networks to serve national defense and security tasks;

c) Technical design of public terrestrial telecommunications networks, exploitation plans for the network and frequency band, ensuring that the amount of radio frequencies serving national defense and security tasks accounts for at least 51% of the total proposed radio frequencies;

d) Business operation, financial, organizational structure, and personnel plans;

đ) Implementation plans for national defense and security tasks;

e) Plans to ensure cybersecurity, information security, and protection of state secrets;

g) Fire prevention and firefighting plans, disaster preparedness, and stable service operation assurance plans.

2. The Ministry of Information and Communications, the Ministry of National Defense (in cases where the Ministry of Public Security is the leading agency of the plan), and the Ministry of Public Security (in cases where the Ministry of National Defense is the leading agency of the plan) shall provide opinions on the content of the plan within their respective functions and responsibilities before the Prime Minister approves it.

3. The leading ministry responsible for developing the plan shall be responsible for compiling, explaining, incorporating feedback, perfecting the plan, and submitting it to the Prime Minister for consideration and approval.

4. During the implementation of the plan, if it is necessary to adjust the ratio of radio frequencies serving national defense and security tasks from the ratio approved by the Prime Minister, the leading ministry responsible for developing the plan must report to the Prime Minister for consideration and approval, but it must ensure that the amount of radio frequencies serving national defense and security tasks accounts for at least the minimum ratio stipulated in point c, Clause 1 of this Article.

Article 37. EVALUATION OF THE IMPLEMENTATION OF THE PLAN FOR UTILIZING FREQUENCY BANDS TO DEVELOP THE ECONOMY IN COMBINATION WITH NATIONAL DEFENSE AND SECURITY TASKS

1. Three months before the expiration of the license, the Ministry of National Defense and the Ministry of Public Security shall organize an assessment of the effectiveness of the utilization of the allocated frequency bands, report to the Prime Minister for consideration and decision to stop or continue implementing the plan. The content of the evaluation includes:

a) Results of implementing national security and social order and safety measures on the allocated frequency bands according to the plan;

b) Results of implementing technical and feasible business plans consistent with the plan;

c) Measures to ensure the safety of telecommunication infrastructure and cybersecurity;

d) Results of implementing financial, organizational structure, and personnel plans consistent with the plan;

đ) Directions, key tasks for implementing the plan and recommendations, proposals;

The Prime Minister.

2. In cases where the Prime Minister decides to continue implementing the plan, the enterprise shall be responsible for submitting an application for extension of the frequency band usage license in accordance with Clause 1 of Article 35 of this Decree.

Section 11. WITHDRAWAL OF LICENSES FOR THE USE OF RADIO FREQUENCY

Article 38. Withdrawal of licenses for the use of radio frequency

1. Grounds for withdrawing licenses for the use of radio frequency as prescribed in Clause 1, Article 23 of the Radio Frequency Law amended and supplemented at Point a, Clause 10, Article 1 of the Law Amending and Supplementing Certain Provisions of the Radio Frequency Law:

a) Decisions of the court or competent state agencies regarding cases stipulated in Points a and b, Clause 1, Article 23 of the Radio Frequency Law;

b) Conclusions from inspections and checks on radio frequencies or decisions of the court regarding cases stipulated in Points c and d, Clause 1, Article 23 of the Radio Frequency Law, and Points e and h, Clause 1, Article 23 of the Radio Frequency Law amended and supplemented at Point a, Clause 10, Article 1 of the Law Amending and Supplementing Certain Provisions of the Radio Frequency Law;

c) Confirmation from the fee collection agency for the use of radio frequency or the right to use radio frequency as prescribed in Point d, Clause 1, Article 23 of the Radio Frequency Law amended and supplemented at Point a, Clause 10, Article 1 of the Law Amending and Supplementing Certain Provisions of the Radio Frequency Law;

d) Decisions to withdraw telecommunications licenses, press operation licenses, or broadcasting rights for radio and television as prescribed in Point g, Clause 1, Article 23 of the Radio Frequency Law amended and supplemented at Point a, Clause 10, Article 1 of the Law Amending and Supplementing Certain Provisions of the Radio Frequency Law.

2. Competent authority to withdraw licenses: the issuing agency shall be responsible for withdrawing the license when there are sufficient grounds as prescribed in Clause 1 of this Article.

3. The procedure for withdrawing licenses shall be carried out as follows:

a) Within thirty days from the date of having sufficient grounds as prescribed in Clause 1 of this Article, the competent authority shall issue a decision to withdraw the license for the use of radio frequency;

b) The authority responsible for withdrawing the license for the use of radio frequency shall send the Decision to withdraw the license for the use of radio frequency to the organization or individual whose license is being withdrawn and publicly announce it on the electronic portal of the issuing agency.

4. Organizations and individuals shall be responsible for returning the original license for the use of radio frequency (if any) within fifteen days from the date of receipt of the Decision to withdraw the license for the use of radio frequency issued by the issuing agency.

5. The determination of the expiration date of the license for the use of radio frequency in the Decision to withdraw the license for the use of radio frequency must comply with the provisions of the Telecommunications Law when the withdrawal of the license for the use of radio frequency leads to the withdrawal of the corresponding telecommunications service provision license.

Section 12. SUSPENSION OF PART OF THE RIGHT TO USE RADIO FREQUENCY

Article 39. Evaluation of the Implementation of Commitments to Deploy Telecommunication Networks

1. At the end of each phase of implementing commitments to deploy telecommunication networks, the Ministry of Information and Communications shall issue a plan and organize the evaluation of the implementation of commitments to deploy telecommunication networks.

The evaluation plan for the implementation of commitments to deploy telecommunication networks must be issued and sent to the evaluated entity at least three months before implementation.

2. The Minister of Information and Communications decides to establish an Inspection Team to evaluate the implementation of commitments to deploy telecommunication networks. The evaluation plan for the implementation of commitments to deploy telecommunication networks of an organization includes the following contents:

a) The entity to be evaluated;

b) Time and phases of implementation of the evaluation;

c) Method of selecting samples for evaluation;

d) Evaluation method and identification of violations;

đ) Method of evaluating the remediation of violations;

e) Progress in implementing the plan;

g) Other related contents.

Article 40. Suspension of Part of the Right to Use Radio Frequency

1. An organization shall be suspended from using part of its right to use radio frequency bands in the case of violating any of the commitments made regarding the deployment of telecommunications networks for such bands as follows:

a) The total amount of capital invested in the network;

b) The number of radio transmitters that must be deployed;

c) Coverage area based on population or geographic region.

2. Based on the notification of the results of the inspection confirming the violation of the commitment to deploy telecommunications networks, the Director of the Radio Frequency Management Department shall issue a decision to suspend the use of 50% of the bandwidth granted permission for a period of 12 months. The amount of radio frequency suspended shall be calculated in MHz units, without rounding off to the nearest unit.

Upon expiration of the 12-month suspension period, the competent state authority shall review and assess the extent of the violation remediation to serve as the basis for terminating the suspension decision or issuing a decision to revoke the license according to Article 38 of this Decree. Article 38 of this Decree.

3. In cases where the licensed entity has remedied the violation of the commitment to deploy telecommunications networks before the 12-month period, it shall notify in writing to request consideration for early termination of the partial suspension decision on the right to use radio frequencies.

4. Within 15 days from the date the organization notifies of the violation remedy as stipulated in Clause 3 of this Article, the Ministry of Information and Communications shall organize an assessment of the violation remediation according to the plan issued as prescribed in Clause 2 of Article 39 of this Decree.

Chapter III. LEASING AND LOAN OF RADIO EQUIPMENT

Article 41. Regulations on Leasing and Loaning Amateur Radio Stations and Radio Equipment Installed on Transportation Means

1. Organizations and individuals who are owners of sea vessels, inland waterway vessels, fishing vessels, and other transportation means equipped with radio equipment (excluding earth stations) are permitted to lease or lend their transportation means equipped with radio equipment, which have been granted licenses, to other organizations and individuals for exploitation.

Organizations and individuals who are owners of amateur radio stations are permitted to lease or lend their amateur radio stations, which have been granted licenses, to other organizations and individuals for exploitation.

2. The lessor/lender and lessee/borrower must comply with the regulations in the radio frequency and radio equipment usage permit, the laws on radio frequency, and other relevant laws.

3. The lessor/lender is responsible for checking and retaining all related documents concerning the leasing and lending of amateur radio stations and radio equipment installed on transportation means.

4. The lessor/lender is responsible for notifying the Radio Frequency Management Department (Regional Radio Frequency Management Center) according to the form prescribed in Appendix VI attached to this Decree about the leasing and lending at least five working days before transferring the amateur radio station or radio equipment installed on transportation means.

Article 42. Regulations on the Use of Leased or Lent Amateur Radio Stations

1. When using leased or lent amateur radio stations, the operator must only conduct communications appropriate to their amateur radio license level and operate within the limits specified in the permit for the leased or lent amateur radio station.

2. When leasing or borrowing an amateur radio station, the amateur radio operator must use the call sign of the leased or lent station followed by their own call sign or name.

3. The lessor/lender of an amateur radio station must keep a logbook fully and ensure that the lessee/borrower does not exceed the limits set out in the permit for the amateur radio station.

Chapter IV. SHARED USE OF RADIO FREQUENCY

Article 43. Cases where radio frequency bands must be shared

In addition to cases where radio frequency bands must be shared according to the regulations of the International Telecommunication Union, organizations and individuals using radio frequencies and radio equipment under the following circumstances must share radio frequency bands with other organizations and individuals according to the conditions recorded in the radio frequency and radio equipment usage permit:

1. Private telecommunications networks using terrestrial mobile radio frequencies, using radio equipment with integrated antennas and radio wave transmission power of up to 10W (Watt), excluding private wireless communication networks whose frequency and radio equipment usage is related to human safety and lives; internal private wireless communication networks.

2. Radio stations for communication with fishing vessels.

3. Shore stations (not providing telecommunication services).

Article 44. Regulations on the use of shared radio frequency bands

1. Adhere to the principle that conversations serve only work-related purposes, correct targets, and intended uses as stated in the permit.

2. Before transmitting, listen on the planned radio frequency band to ensure it is free, except in cases involving emergency and human life safety.

3. Transmit call signs specified in the radio frequency and radio equipment usage permit at the beginning and end of each call.

4. Communication time should be brief, not exceeding five minutes per conversation.

5. Encourage the use of encryption or other technical measures to ensure confidentiality of information.

Chapter V. TRANSFER OF RIGHTS TO USE RADIO FREQUENCY BANDS

Article 45. Transfer procedures

1. The organization proposing to acquire the transfer of rights to use radio frequency bands must submit one set of transfer documents to the Ministry of Information and Communications (Telecommunications Administration) through one of the following methods: via the online public service system, through postal service, or direct submission.

2. For organizations already holding a business service license for telecommunications using the proposed frequency band, the transfer documents shall include the following:

a) A request for transfer document bearing the seal and signature of the legal representative of the transferring organization;

b) An agreement between the transferring organization and the acquiring organization regarding the protection of the legitimate rights and interests of affected organizations and individuals due to the transfer;

c) A commitment from the acquiring organization to fully assume the obligations of the transferring organization;

d) A report on the implementation of the telecommunications business license already issued, and the implementation of commitments to deploy telecommunications networks after winning the auction by the transferring organization;

đ) Documents requesting amendments or supplements to the telecommunications business license using the frequency band of the acquiring organization;

e) Documents requesting amendments or supplements to the telecommunications business license or a request for revocation of the telecommunications business license of the transferring organization according to the law on telecommunications.

3. For organizations proposing to acquire the transfer not covered by Clause 2 of this Article, the transfer documents shall include the following:

a) A request for transfer document bearing the seal and signature of the legal representative of the transferring organization;

b) An agreement between the transferring organization and the acquiring organization regarding the protection of the legitimate rights and interests of affected organizations and individuals due to the transfer;

c) A commitment from the acquiring organization to fully assume the obligations of the transferring organization;

d) Documents requesting issuance of a telecommunications business license using the frequency band of the acquiring organization according to the law on telecommunications;

đ) A report on the implementation of the telecommunications business license already issued, and the implementation of commitments to deploy telecommunications networks after winning the auction by the transferring organization;

e) Documents requesting amendments or supplements to the telecommunications business license or a request for revocation of the telecommunications business license of the transferring organization according to the law on telecommunications.

4. Time limit and processing procedure for documents:

a) Within five working days from the date of receipt of the documents, the Ministry of Information and Communications (Telecommunications Administration) will notify the organization about incomplete or non-compliant documents;

b) Within forty-five days from the date of receipt of complete and compliant documents, the Ministry of Information and Communications will consider and decide on granting permission for the transfer of rights to use radio frequency bands or reject it and provide reasons.

5. Issuance of telecommunications licenses after transfer:

Organizations permitted to transfer rights to use radio frequency bands will be issued amended, supplemented, or revoked telecommunications business licenses; organizations receiving the transfer of rights to use radio frequency bands will be issued telecommunications business licenses or amended, supplemented telecommunications business licenses according to the law on telecommunications.

6. Issuance of frequency band usage permits after transfer:

a) Documents for requesting a frequency band usage permit include: Form 2 as prescribed in Appendix II attached to this Decree;

b) The organization submits one set of documents for requesting a frequency band usage permit to the issuing authority.

The issuing authority receives and checks the documents. If the documents are incomplete or do not comply with the required components, within five working days from the date of receipt of the documents, the issuing authority will notify and guide the organization to supplement and complete the documents.

Within five working days from the date of receipt of complete and compliant documents, the issuing authority issues a frequency band usage permit to the organization proposing to acquire the transfer according to the model prescribed in Appendix III attached to this Decree or rejects the issuance of the permit and provides reasons.

7. Transferred telecommunications business licenses and frequency band usage permits issued to the organization proposing to acquire the transfer shall be valid until the expiration date of the telecommunications business licenses and frequency band usage permits already issued to the organization proposing the transfer.

Article 46. Responsibilities of the organization proposing to transfer

The organization proposing to transfer the right to use radio frequency has the following responsibilities:

1. Ensuring the legitimate rights and interests of organizations and individuals affected by the transfer.

2. Fulfill financial obligations related to the transfer of the right to use radio frequency in accordance with the provisions of the law.

3. Complete financial obligations regarding the fee for granting the right to use radio frequency, registration fees, and radio frequency usage fees.

Article 47. Responsibilities of the organization proposing to accept the transfer

The organization proposing to accept the transfer of the right to use radio frequency has the following responsibilities:

1. Fulfill the rights and responsibilities transferred and shall not be permitted to continue transferring the right to use radio frequency to another organization.

2. Fulfill the commitment to deploy telecommunications networks as committed by the transferring party to obtain a license to use the frequency band; fulfill the conditions for obtaining a business service license, rights, and obligations under the business service license of the transferring party.

3. Fulfill financial obligations related to the transfer of the right to use radio frequency in accordance with the provisions of the law.

4. Comply with the provisions of the law on telecommunications and radio frequencies.

5. Pay fully and on time registration fees, radio frequency usage fees, and telecommunications-related fees in accordance with the provisions of the law on radio frequencies and telecommunications.

Chapter VI. LICENSE FEE FOR THE RIGHT TO USE RADIO FREQUENCY

Article 48. Method for determining the base revenue level using the license fee for the right to use radio frequency for the same type of frequency band in Vietnam

1. In the case where within a period of 12 months prior to the date of determining the base revenue level, Vietnam has issued licenses to use the same type of frequency band through reissuing, extending, or auctioning the right to use radio frequency, the base revenue level shall be determined according to the provisions of Clause 2 of this Article.

2. The base revenue level is determined as the highest license fee for the right to use radio frequency (calculated for 01 MHz (Megahertz) for 01 year of use) of the same type of frequency band granted through reissuing, extending, or auctioning within a period of 12 months prior to the date of determining the base revenue level, measured in Vietnamese Dong/MHz/year.

Article 49. Method for determining the base revenue level using information about winning auction prices for frequency bands in countries and territories

In the case where it is not possible to determine the base revenue level according to the method prescribed in Article 48 of this Decree then apply the method prescribed in this Article to determine the base revenue level.

1. The base revenue level is the average of the converted amounts from the winning auction prices of valid samples as follows:

MTCSMHz which is the base revenue level for 01 MHz (Megahertz) for 01 year of use, measured in Vietnamese Dong/MHz/year;

N ||| which is the number of valid samples determined according to the provisions of Clauses 4, 5, and 6 of this Article;

GQĐinternational which is the converted amount from the winning auction price of the auction in the country or territory corresponding to sample international, measured in Vietnamese Dong/MHz/year, determined according to the provisions of Clause 2 of this Article.

2. The converted amount from the winning auction price of the auction from the country or territory to Vietnam (GQĐ) determined as follows:

DSvn is the population of Vietnam at the nearest announcement date before the date of determining the base revenue level, measured in people;

TGvn is the exchange rate between Vietnamese Dong and US Dollar for telegraphic transfer of the head office of Vietnam Joint Stock Commercial Bank for Foreign Trade at the nearest announcement date before the date of determining the base revenue level;

CPId.1. Amount of taxable income in Vietnam: is the Consumer Price Index (CPI) of the country or territory at the nearest announcement date before the date of determining the base revenue level;

CPID is the Consumer Price Index (CPI) of the country or territory at the nearest announcement date before the date the auction results were announced;

GDPvn is the Gross Domestic Product per capita (GDP/capita) of Vietnam at the nearest announcement date before the date of determining the base revenue level, measured in US Dollars;

GDP is the Gross Domestic Product per capita (GDP/capita) of the country or territory at the nearest announcement date before the date the auction results were announced, measured in US Dollars;

TG is the exchange rate converting the currency used in the auction of the country or territory to US Dollar at the nearest announcement date before the date of determining the base revenue level (TG = 1 in the case where the currency used in the auction is US Dollar).

3. yinternational is calculated by rounding down the difference in time between the final payment deadline of the international auction and the time of the auction result announcement according to years;

4. Sampling Principle

a) Information shall only be collected from auctions that have ended before the base revenue level determination time point;

b) Each auction shall be considered as one sample;

c) A valid sample is one that has not been excluded according to the outlier removal method specified in Appendix VII issued together with this Decree;

d) Sample quantity requirement: the total number of samples collected must be four or more, and after excluding outliers, there must be three or more valid samples remaining;

đ) Collect samples of the same frequency band type as the frequency band requiring the base revenue level determination within seven years prior to the base revenue level determination time point. If the sample quantity condition is not met, extend the sample collection period to ten years. If still not met, collect additional samples of similar frequency bands within seven years prior to the base revenue level determination time point. If still not met, extend the sample collection period of similar frequency bands to ten years;

In case the required number of samples of the same type and similar frequency bands within ten years prior to the base revenue level determination time point is still not met, then the method prescribed in this Article shall not be applied to determine the base revenue level;

When collecting samples of the same type and similar frequency bands as those requiring the base revenue level determination, auctions of the same type and similar frequency bands in Vietnam during the sampling period shall also be included as samples;

5. The selection of auction results to serve as samples for determining the base revenue level must meet the following criteria:

a) The term of frequency band usage must be ten years or longer;

b) Auctions must cover the entire national territory; information from regional geographic area auctions shall not be used;

6. Requirements for data collection from countries or territories to determine the base revenue level are as follows:

a) Data on auction winning bid amounts, bandwidth width, and permitted usage terms obtained through auctions from countries or territories shall be sourced from the results of consultations with the respective national management agencies or from sources published by these agencies. If data from different sources vary, the consultation results with the national management agency shall be used;

b) Consultation requirements:

Where a list of countries or territories that have conducted auctions for the required frequency bands is provided by the Global System for Mobile Communications Association (GSMA), consult the countries or territories where the national management agencies have not fully disclosed information on the announcement date of the auction results, winning bid amounts, bandwidth width, and permitted usage terms. In the absence of such a list, consult all countries or territories where the national management agencies have not fully disclosed this information;

Within fifteen days from the date of sending, if no reply is received, it is understood that there is no consultation information; consultations shall be conducted via one of the following methods: email, fax, postal service, or other forms;

c) Population data and per capita gross domestic product (GDP/capita) of countries or territories and Vietnam shall be sourced from the World Bank's electronic information website. For countries or territories without data from the World Bank, use data from their respective national management agencies;

d) Exchange rates of currencies used in auctions in countries or territories shall be sourced from the Bloomberg financial market information website. If data is unavailable from Bloomberg, use the X-rates financial market information website; if data is unavailable from X-rates, use another financial market information website specializing in exchange rates;

đ) Consumer Price Index (CPI) data in countries or territories shall be sourced from the International Monetary Fund (IMF) electronic information website, using the communicated CPI value. If communicated CPI data is unavailable, use the overall CPI value. For countries or territories without data from the IMF, use data from their respective national management agencies;

e) Government bond interest rate data shall be sourced from the Trading Economics electronic information website. If data is unavailable from Trading Economics, use the Investing electronic information website; if data is unavailable from Investing, use the World Government Bonds electronic information website; if data is unavailable from World Government Bonds, use the Refinitiv (LSEG) electronic information website. If data cannot be found on any of these websites, the interest rate shall be calculated at 0% (zero percent).

Article 50. Determining the Basic Revenue Level in Cases Where Articles 48 and 49 of this Decree Are Not Applicable

In cases where it is not possible to determine the basic revenue level according to the methods prescribed in Articles 48 and 49 of this Decree The Ministry of Information and Communications has the authority to hire independent domestic and international consulting organizations to determine the basic revenue level.

Article 51. Organization for Determining and Authority to Decide on the Basic Revenue Level

1. The Minister of Information and Communications issues a decision organizing the determination of the basic revenue level; the organization determining the basic revenue level and deciding on the basic revenue level according to the methods prescribed in Articles 48, 49, or 50 of this Decree.

2. In cases where the basic revenue level is determined according to the method prescribed in Article 49 of this Decree, the Minister of Information and Communications decides on the basic revenue level after receiving the results from an organization with the necessary conditions for price appraisal activities. In cases where the basic revenue level is determined according to the method prescribed in Article 50 of this Decree, the Minister of Information and Communications decides on the basic revenue level after receiving the results from an independent consulting organization.

3. The maximum duration for applying the basic revenue level shall not exceed six months from the date the Decision approving the basic revenue level issued by the Minister of Information and Communications takes effect until the announcement of the fee for granting the right to use frequencies in cases of direct issuance, reissuance, extension, or until the opening of the auction or tender process.

Article 52. Fee for Granting the Right to Use Radio Frequency Bands

1. The fee for granting the right to use radio frequency bands for cases where the license for using the frequency band is granted through an auction of the right to use radio frequencies is the amount won at the auction.

2. Except for the case stipulated in Clause 3 of this Article, the fee for granting the right to use radio frequency bands for cases where the license for using the frequency band is granted directly, extended, renewed, or granted through a tender for the right to use radio frequencies is determined as follows:

MTCSMHz is the basic revenue level of the frequency band granted through a tender, direct grant, renewal, or extension, decided according to the provisions of Article 51 of this Decree, measured in Vietnamese Dong/MHz/year;

Bw is the total width of the frequency band granted through a tender, direct grant, renewal, or extension, measured in MHz (Megahertz);

d.1. Amount of taxable income in Vietnam: is the entire permitted usage period of the frequency band granted through a tender, direct grant, renewal, or extension, measured in months.

3. The fee for granting the right to use radio frequency bands in cases where the license for using the frequency band is directly granted or extended for state-owned enterprises directly serving national defense and security to develop the economy combined with national defense and security tasks in the n year within the validity period of the license is determined as follows:

MTCSMHz is the basic revenue level of the frequency band granted, measured in Vietnamese Dong/MHz/year. MTCSMHz is decided according to the provisions of Article 51 of this Decree and is applied to calculate the annual fee for granting the right to use radio frequency bands until the initial license term or the extension expires;

Bw is the total width of the frequency band granted, measured in MHz (Megahertz);

Canqp is the annual ratio of the amount of radio frequencies serving national defense and security tasks over the total amount of radio frequencies requested for licensing, determined according to the provisions of the Plan for Using Frequency Bands to Develop the Economy Combined with National Defense and Security Tasks approved by the Prime Minister, measured in percent (%);

F is the nominal interest rate of government bonds with the nearest maturity to the term of the license for using the frequency band, issued nearest before the time the agency issuing the license for using radio frequencies directly grants or extends the license for using the frequency band, measured in percent/year; the result of the government bond issuance is taken from the electronic information website of the State Treasury, Ministry of Finance.

Article 53. Collection of Frequency Usage Rights Fee for the Issuance of Frequency Band Usage Licenses through Auctions

The organization that wins the auction for frequency usage rights must pay the frequency usage rights fee according to the following provisions:

1. Within three months from the date the Ministry of Information and Communications approves the auction results, the winning organization must pay at least 50% of the frequency usage rights fee in one lump sum (if the license has a term of thirty months or more) or pay the entire frequency usage rights fee in one lump sum (if the license has a term of less than thirty months).

2. Within thirty months from the date the Ministry of Information and Communications approves the auction results, the winning organization must pay at least 50% of the remaining frequency usage rights fee in one lump sum (if the license has a term of sixty months or more) or pay the entire remaining frequency usage rights fee in one lump sum (if the license has a term of less than sixty months), plus interest calculated according to the provisions of Clause 4 of this Article.

3. Within sixty months from the date the Ministry of Information and Communications approves the auction results, the winning organization must pay the entire remaining frequency usage rights fee in one lump sum, plus interest calculated according to the provisions of Clause 4 of this Article.

4. The amount of interest arising when the winning organization pays the frequency usage rights fee according to the provisions of Clauses 2 and 3 of this Article shall be determined as follows:

organize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular. is the number of days from the end date of the payment deadline specified in Clause 1 of this Article to the date the winning organization pays the frequency usage rights fee according to the provisions of Clauses 2 and 3 of this Article;

F is the nominal interest rate of government bonds with a five-year term (if there is no five-year term, then the nearest term to five years) issued most recently before the date the Ministry of Information and Communications approves the auction results, measured in percent/year; the issuance results of government bonds are taken from the electronic information website of the State Treasury, Ministry of Finance.

Article 54. Collection of Frequency Usage Rights Fee for the Issuance of Frequency Band Usage Licenses through Competitive Examinations, Reissuance, and Extension of Frequency Band Usage Licenses

1. Organizations that win the examination or are reissued or extended a frequency band usage license must pay the frequency usage rights fee annually during the term of the license.

2. Determination of the annual frequency usage rights fee payable

The frequency usage rights fee that the organization must pay for the n year within the validity period of the license is determined as follows:

organize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular. equals twelve months, except for the final year of the license term which does not have a full twelve-month period, then organize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular. is determined by dividing the total remaining effective days of the license by thirty;

F is the nominal interest rate of government bonds with the nearest term to the license usage period, issued most recently before the date the Ministry of Information and Communications approves the examination results or the date the licensing authority announces the frequency usage rights fee in the case of reissuance or extension of the frequency band usage license, measured in percent/year; the issuance results of government bonds are taken from the electronic information website of the State Treasury, Ministry of Finance.

3. Payment Method

a) Within thirty days from the date the licensing authority notifies the winning organization or the organization meeting the conditions for reissuance or extension of the frequency band usage license about the frequency usage rights fee payable, the winning organization or the organization meeting the conditions for reissuance or extension of the license must pay the entire frequency usage rights fee for the first year in one lump sum;

b) Starting from the second year of the license, no later than forty-five days before the start of the next year of the license, the licensing authority must notify the organization holding the frequency band usage license about the frequency usage rights fee payable for the next year;

Within thirty days from the date the licensing authority issues the notification on the frequency usage rights fee payable, the organization holding the frequency band usage license must pay the entire notified frequency usage rights fee in one lump sum.

Article 55. Collection of Frequency Assignment Fees for Direct Issuance and Extension of Frequency Band Usage Licenses to State-Owned Enterprises Serving National Defense and Security; Direct Issuance in Emergency Situations

1. In cases where frequency band usage licenses are directly issued in emergency situations as stipulated in Point c, Clause 4, Article 18 of the Radio Frequency Law amended and supplemented by Clause 6, Article 1 of the Law Amending and Supplementing Certain Provisions of the Radio Frequency Law, organizations may be considered for issuance of frequency band usage licenses before paying the radio frequency assignment fees for the frequencies covered by the emergency usage license.

Within nine months from the date of issuing the license, the licensing authority shall notify the organization that has been granted the frequency band usage license of the amount of radio frequency assignment fees that the organization must pay for the entire duration of the license.

Within three months from the date the licensing authority issues the notification, the organization that has been granted the frequency band usage license must pay the full amount of radio frequency assignment fees notified.

2. In cases where frequency band usage licenses are directly issued or extended to state-owned enterprises serving national defense and security for economic development combined with national defense and security tasks as stipulated in Point d, Clause 4, Article 18 of the Radio Frequency Law amended and supplemented by Clause 6, Article 1 of the Law Amending and Supplementing Certain Provisions of the Radio Frequency Law, the competent ministry of the enterprise that has been granted the license shall annually determine and collect radio frequency assignment fees for the amount of radio frequencies used for economic development.

Where the frequency band used for economic development combined with national defense and security tasks does not have a basic fee level or the basic fee level has expired, the competent ministry of the enterprise that has been granted the license shall request the Ministry of Information and Communications to determine the basic fee level according to this Decree. The use of the basic fee level must ensure that its validity period from the date the Minister of Information and Communications approves it to the date the competent ministry notifies the enterprise of the amount to be paid does not exceed six months.

Article 56. Collection, Payment, Management, and Use of Frequency Assignment Fees

1. The Ministry of Information and Communications shall organize the collection of frequency assignment fees for the cases specified in Article 53, Article 54, and Clause 1 of Article 55 of this Decree into an account opened at the State Treasury of the Ministry of Information and Communications or of the organization entrusted by the Ministry of Information and Communications to collect frequency assignment fees. The Ministry of National Defense and the Ministry of Public Security shall organize the collection of frequency assignment fees and pay them into the state budget for the cases specified in Clause 2 of Article 55 of this Decree. The notification of payment of frequency assignment fees prescribed in Appendix VIII attached to this Decree.

2. Expenses for frequency assignment fee collection activities shall be guaranteed by the state budget according to the current state budget management hierarchy (except in cases provided for in the competent authority's documents).

3. The Ministry of Information and Communications or the organization entrusted by the Ministry of Information and Communications to collect frequency assignment fees shall be responsible for paying all collected frequency assignment fees into the state budget.

4. Frequency assignment fees shall be included in the production and business costs of organizations and deducted when determining taxable income under the Corporate Income Tax Law and related implementing regulations.

Chapter VII.RADIO FREQUENCY LICENSE

Mục 1. LICENSES FOR NON-COMMERCIAL RADIO SERVICES

Article 57. System of Non-Commercial Radio Service Licenses

1. The system of non-commercial radio service licenses includes:

a) Class One Non-Commercial Radio Service License: Holders of this license are permitted to operate amateur radio stations using all transmission methods with an antenna power output not exceeding 1000W (Watts).

b) Class Two Non-Commercial Radio Service License: Holders of this license are permitted to operate amateur radio stations using all transmission methods with an antenna power output not exceeding 200W (Watts).

c) Class Three Non-Commercial Radio Service License: Holders of this license are permitted to operate amateur radio stations using all transmission methods with an antenna power output not exceeding 50W (Watts).

d) Class Four Non-Commercial Radio Service License: Holders of this license are permitted to operate amateur radio stations using all transmission methods except continuous wave (CW) transmission, with an antenna power output not exceeding 20W (Watts).

2. Non-commercial radio service licenses remain valid until they are revoked according to the provisions of this Decree.

Article 58. Conditions for Recognizing Organizations Eligible to Issue Non-Commercial Radio Service Licenses

An organization is recognized as eligible to issue non-commercial radio service licenses when it meets the following conditions:

1. Possessing an amateur radio station with a frequency usage permit that ensures compliance with the practical examination requirements for candidates applying for the corresponding type of non-commercial radio service license.

2. Having a set of theoretical examination questions on non-commercial radio services that align with the structure of the theoretical exam as stipulated in Article 62 of this Decree.

3. Requirements for individuals participating in organizing non-commercial radio service examinations:

a) Graduating from a university or higher in one of the specialties of radio engineering, electronics, telecommunications, or equivalent;

b) Holding a non-commercial radio service license of a higher class than the candidate; or

Holding a license of the same class as the candidate but must have operated an amateur radio station for at least one year prior to the date of the examination; or

Having worked for at least one year as a telegraph operator (able to receive messages by ear and send them by hand in Morse code through a radio transmitter-receiver).

Article 59. Procedures and Formalities for Issuing Certificates Recognizing Organizations Eligible to Issue Non-Commercial Radio Service Licenses

1. The application dossier for issuing certificates recognizing organizations eligible to issue non-commercial radio service licenses includes:

a) A request for issuance of the certificate in accordance with Form 01 prescribed in Appendix IX attached to this Decree;

b) A certified copy of the permit or decision establishing the organization;

c) A report detailing compliance with the requirements specified in Article 58 Form 02 prescribed in Appendix IX attached to this Decree;

d) A set of theoretical examination questions on non-commercial radio services.

2. The organization submits one complete application dossier for issuing certificates recognizing organizations eligible to issue non-commercial radio service licenses to the Ministry of Information and Communications via postal service or directly at the Ministry of Information and Communications.

3. The Ministry of Information and Communications receives and checks the validity of the dossier. In cases where the dossier is incomplete or does not comply with the required components, the Ministry will notify and guide the organization to supplement and perfect the dossier within five working days from the date of receipt of the dossier.

4. Within thirty days from the date of receiving a complete and valid dossier, the Ministry of Information and Communications will organize an evaluation and verify the actual conditions stipulated in Article 58 of this Decree and issue a certificate recognizing an organization as meeting the conditions to issue amateur radio certificates according to Model 03 prescribed in Appendix IX attached to this Decree, or refuse to issue such a certificate and specify the reasons.

5. The results of processing applications for certificates recognizing organizations as meeting the conditions to issue amateur radio certificates shall be sent to the organization through one of the following methods: delivery via postal service or direct delivery at the Ministry of Information and Communications.

6. A list of organizations recognized as meeting the conditions to issue amateur radio certificates shall be published on the electronic portal of the Ministry of Information and Communications..

Article 60. Procedures and formalities for issuing replacement certificates recognizing organizations as meeting the conditions to issue amateur radio certificates

1. A certificate recognizing an organization as meeting the conditions to issue amateur radio certificates shall be replaced in cases of loss, damage, or changes in organizational information.

2. Documents for applying for replacement certificates recognizing organizations as meeting the conditions to issue amateur radio certificates include:

a) A request for issuance of a replacement certificate recognizing an organization as meeting the conditions to issue amateur radio certificates according to Model 05 prescribed in Appendix IX attached to this Decree;

b) A report on changes in organizational information in cases where there are changes in information (signed by an authorized person and stamped by the requesting organization).

3. An organization submits one set of documents for applying for replacement certificates recognizing organizations as meeting the conditions to issue amateur radio certificates to the Ministry of Information and Communications via postal service or directly at the Ministry of Information and Communications.

4. The Ministry of Information and Communications receives and checks the validity of the documents. In cases where the documents are incomplete or do not comply with the required components, within five working days from the date of receipt of the documents, the Ministry of Information and Communications will notify and guide the organization to supplement and complete the documents.

5. Within twenty days from the date of receiving valid documents, the Ministry of Information and Communications issues a replacement certificate recognizing an organization as meeting the conditions to issue amateur radio certificates according to Model 04 prescribed in Appendix IX attached to this Decree, or refuses to issue a replacement certificate recognizing an organization as meeting the conditions to issue amateur radio certificates and specifies the reasons.

6. The results of processing applications for replacement certificates recognizing organizations as meeting the conditions to issue amateur radio certificates shall be sent to the organization through one of the following methods: delivery via postal service or direct delivery at the Ministry of Information and Communications.

Article 61. Revocation of certificates recognizing organizations as meeting the conditions to issue amateur radio certificates

1. Organizations shall have their certificates recognizing them as meeting the conditions to issue amateur radio certificates revoked in the following cases:

a) Ceasing operations as prescribed by law or upon the organization's request;

b) Intentionally distorting information when performing procedures for issuing certificates;

c) Having their radio frequency usage licenses revoked.

2. The Ministry of Information and Communications issues a decision to revoke certificates recognizing organizations as meeting the conditions to issue amateur radio certificates and publishes it on the electronic portal of the Ministry of Information and Communications..

Article 62. Amateur radio examination

Individuals applying for an amateur radio license must take both the theoretical and practical amateur radio examinations at organizations recognized as having the necessary conditions to issue amateur radio licenses.

1. Thi lý thuyết

Thi lý thuyết để kiểm tra kiến thức của thí sinh. Mỗi bài thi lý thuyết bao gồm một bộ câu hỏi sau:

a) Chứng chỉ vô tuyến điện nghiệp dư cấp một: bài thi gồm 50 câu hỏi, trong đó có 10 câu hỏi về quy định của pháp luật Việt Nam đối với hoạt động vô tuyến điện nghiệp dư, 10 câu hỏi về nghiệp vụ vô tuyến điện nghiệp dư trong Thể lệ vô tuyến điện của Liên minh Viễn thông quốc tế, 15 câu hỏi về kỹ thuật điện, 15 câu hỏi về kỹ thuật vô tuyến điện. Yêu cầu thí sinh phải trả lời đúng ít nhất 40 câu hỏi.

Chỉ những người có chứng chỉ vô tuyến điện nghiệp dư cấp hai và đã thiết lập đài vô tuyến điện nghiệp dư từ 01 năm trở lên mới được thi để được cấp chứng chỉ vô tuyến điện nghiệp dư cấp một;

b) Chứng chỉ vô tuyến điện nghiệp dư cấp hai: bài thi gồm 40 câu hỏi, trong đó có 10 câu hỏi về quy định của pháp luật Việt Nam đối với hoạt động vô tuyến điện nghiệp dư, 10 câu hỏi về nghiệp vụ vô tuyến điện nghiệp dư trong Thể lệ vô tuyến điện của Liên minh Viễn thông quốc tế, 10 câu hỏi về kỹ thuật điện, 10 câu hỏi về kỹ thuật vô tuyến điện. Yêu cầu thí sinh phải trả lời đúng ít nhất 30 câu hỏi;

c) Chứng chỉ vô tuyến điện nghiệp dư cấp ba, cấp bốn: bài thi gồm 35 câu hỏi, trong đó có 10 câu hỏi về quy định của pháp luật Việt Nam đối với hoạt động vô tuyến điện nghiệp dư, 05 câu hỏi về nghiệp vụ vô tuyến điện nghiệp dư trong Thể lệ vô tuyến điện của Liên minh Viễn thông quốc tế, 10 câu hỏi về kỹ thuật điện, 10 câu hỏi về kỹ thuật vô tuyến điện. Yêu cầu thí sinh phải trả lời đúng ít nhất 25 câu hỏi.

2. Thi thực hành

a) Thi thực hành điện báo để kiểm tra khả năng nhận chính xác bằng tai hoặc bằng máy vi tính và gửi chính xác bằng tay hoặc bằng máy vi tính các bản tin dưới dạng mã Móc-xơ quốc tế. Đối với chứng chỉ vô tuyến điện nghiệp dư cấp một yêu cầu tốc độ không thấp hơn 36 từ trong 03 phút; đối với chứng chỉ vô tuyến điện nghiệp dư cấp hai yêu cầu tốc độ không thấp hơn 27 từ trong 03 phút; đối với chứng chỉ vô tuyến điện nghiệp dư cấp ba yêu cầu tốc độ không thấp hơn 15 từ trong 03 phút. Mỗi từ tương đương với 05 ký tự (là các chữ cái trong bảng chữ cái tiếng Anh, các số từ 00 đến 09, các ký hiệu, dấu phẩy, dấu hỏi, gạch ngang và các ký hiệu khác theo quy định tại Thể lệ vô tuyến điện của Liên minh Viễn thông quốc tế);

b) Người có chứng chỉ khai thác viên vô tuyến điện báo đang liên lạc bằng vô tuyến điện báo hoặc đã thôi hành nghề không quá 03 năm được miễn thi thực hành điện báo;

c) Người thi thực hành để cấp chứng chỉ vô tuyến điện nghiệp dư cấp một, cấp hai, cấp ba phải thực hành bốn cuộc liên lạc gồm một cuộc thực hành phát thoại, một cuộc thực hành phát điện báo, một cuộc thực hành dò tìm đài bạn bằng phương thức thoại và một cuộc thực hành dò tìm đài bạn bằng điện báo.

Người thi thực hành để cấp chứng chỉ vô tuyến điện nghiệp dư cấp bốn phải thực hành hai cuộc liên lạc bằng phương thức thoại, không phải thi thực hành điện báo.

3. Thời gian tối đa để hoàn thành cả kỳ thi lý thuyết và kỳ thi thực hành là 12 tháng.

Điều 63. Điều kiện, trình tự, thủ tục thi, cấp chứng chỉ vô tuyến điện nghiệp dư

1. Cá nhân thi đạt lý thuyết và thực hành theo quy định tại Điều 62 Nghị định này đủ điều kiện được cấp chứng chỉ vô tuyến điện nghiệp dư.

2. Hồ sơ đăng ký thi để được cấp chứng chỉ vô tuyến điện nghiệp dư gồm:

a) Đơn đăng ký dự thi vô tuyến điện nghiệp dư và cấp chứng chỉ vô tuyến điện nghiệp dư theo Mẫu 01 quy định tại Phụ lục X ban hành kèm theo Nghị định này;

b) Bản sao hợp pháp Căn cước công dân hoặc Giấy chứng minh nhân dân hoặc Hộ chiếu còn thời hạn;

c) 02 ảnh màu kích thước 03 cm × 04 cm, chụp trong vòng 06 tháng trước ngày nộp hồ sơ, rõ mặt, rõ hai tai, không đội mũ, không trang điểm.

3. Trình tự, thủ tục cấp chứng chỉ vô tuyến điện nghiệp dư

a) Người đăng ký dự thi nộp 01 bộ hồ sơ đăng ký thi để được cấp chứng chỉ vô tuyến điện nghiệp dư đến tổ chức được công nhận đủ điều kiện cấp chứng chỉ vô tuyến điện nghiệp dư qua đường bưu chính hoặc nộp hồ sơ trực tiếp tại tổ chức được công nhận đủ điều kiện cấp chứng chỉ vô tuyến điện nghiệp dư;

b) Tổ chức được công nhận đủ điều kiện cấp chứng chỉ vô tuyến điện nghiệp dư tiếp nhận, kiểm tra tính hợp lệ của hồ sơ. Trường hợp hồ sơ chưa đầy đủ, chưa đúng quy định về thành phần hồ sơ thì trong thời hạn 05 ngày làm việc kể từ ngày nhận được hồ sơ, tổ chức được công nhận đủ điều kiện cấp chứng chỉ vô tuyến điện nghiệp dư thông báo, hướng dẫn người đăng ký dự thi bổ sung, hoàn thiện hồ sơ;

c) Trong thời hạn 14 ngày kể từ ngày kết thúc thi lý thuyết, thi thực hành, tổ chức được công nhận đủ điều kiện cấp chứng chỉ vô tuyến điện nghiệp dư cấp chứng chỉ cho thí sinh thi đạt cả thi lý thuyết và thi thực hành theo mẫu quy định tại Phụ lục X ban hành kèm theo Nghị định này hoặc từ chối cấp chứng chỉ vô tuyến điện nghiệp dư và nêu rõ lý do.

Điều 64. Trình tự, thủ tục cấp đổi chứng chỉ vô tuyến điện nghiệp dư

1. Chứng chỉ vô tuyến điện nghiệp dư được cấp đổi trong các trường hợp bị mất, bị hư hỏng hoặc do thay đổi thông tin cá nhân hợp pháp trên chứng chỉ hoặc thông tin cá nhân trên chứng chỉ không đúng với thông tin trong hồ sơ đề nghị cấp chứng chỉ.

2. Hồ sơ đề nghị cấp đổi chứng chỉ vô tuyến điện nghiệp dư gồm:

a) Đơn đề nghị cấp đổi chứng chỉ vô tuyến điện nghiệp dư theo Mẫu 02 quy định tại Phụ lục X ban hành kèm theo Nghị định này;

b) 02 ảnh màu kích thước 03 cm × 04 cm, chụp trong vòng 06 tháng trước ngày nộp hồ sơ, rõ mặt, rõ hai tai, không đội mũ, không trang điểm;

c) Bản gốc chứng chỉ vô tuyến điện nghiệp dư (áp dụng đối với trường hợp chứng chỉ bị hư hỏng hoặc thay đổi thông tin cá nhân hợp pháp trên chứng chỉ hoặc thông tin cá nhân trên chứng chỉ không đúng với thông tin trong hồ sơ đề nghị cấp chứng chỉ);

d) Giấy tờ chứng minh việc thay đổi thông tin đối với trường hợp thay đổi thông tin cá nhân hợp pháp.

3. Trình tự, thủ tục cấp đổi chứng chỉ vô tuyến điện nghiệp dư

a) Người đề nghị cấp đổi chứng chỉ vô tuyến điện nghiệp dư nộp 01 bộ hồ sơ đề nghị cấp đổi chứng chỉ vô tuyến điện nghiệp dư đến tổ chức được công nhận đủ điều kiện cấp chứng chỉ vô tuyến điện nghiệp dư qua đường bưu chính hoặc nộp hồ sơ trực tiếp tại tổ chức được công nhận đủ điều kiện cấp chứng chỉ vô tuyến điện nghiệp dư;

b) Tổ chức được công nhận đủ điều kiện cấp chứng chỉ vô tuyến điện nghiệp dư tiếp nhận, kiểm tra tính hợp lệ của hồ sơ và đối chiếu với dữ liệu về chứng chỉ vô tuyến điện nghiệp dư đã cấp. Trường hợp hồ sơ chưa đầy đủ, chưa đúng quy định về thành phần hồ sơ thì trong thời hạn 05 ngày làm việc kể từ ngày nhận được hồ sơ, tổ chức được công nhận đủ điều kiện cấp chứng chỉ vô tuyến điện nghiệp dư thông báo, hướng dẫn người đề nghị cấp đổi chứng chỉ vô tuyến điện nghiệp dư bổ sung, hoàn thiện hồ sơ;

c) Trong thời hạn 07 ngày làm việc kể từ ngày nhận đủ hồ sơ hợp lệ, tổ chức được công nhận đủ điều kiện cấp chứng chỉ vô tuyến điện nghiệp dư cấp đổi chứng chỉ theo mẫu quy định tại Phụ lục X ban hành kèm theo Nghị định này hoặc từ chối cấp đổi và nêu rõ lý do.

Điều 65. Thu hồi chứng chỉ vô tuyến điện nghiệp dư

Tổ chức được công nhận đủ điều kiện cấp chứng chỉ vô tuyến điện nghiệp dư thu hồi chứng chỉ vô tuyến điện nghiệp dư trong các trường hợp sau:

1. Giả mạo một trong các thành phần hồ sơ quy định tại khoản 2 Điều 63 và khoản 2 Điều 64 Nghị định này.

2. Tẩy, xoá nội dung chứng chỉ.

3. Cho thuê, cho mượn chứng chỉ hoặc sử dụng sai mục đích.

Điều 66. Công nhận chứng chỉ vô tuyến điện nghiệp dư nước ngoài

Bộ Thông tin và Truyền thông công nhận chứng chỉ vô tuyến điện nghiệp dư nước ngoài trong những trường hợp sau đây:

1. Công nhận chứng chỉ vô tuyến điện nghiệp dư nước ngoài đối với khai thác viên vô tuyến điện nghiệp dư đến từ những nước đã ký thoả thuận công nhận lẫn nhau về hoạt động vô tuyến điện nghiệp dư cấp bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ với Việt Nam.

2. Công nhận chứng chỉ vô tuyến điện nghiệp dư nước ngoài đối với khai thác viên vô tuyến điện nghiệp dư đến từ những nước chưa ký thoả thuận công nhận lẫn nhau về hoạt động vô tuyến điện nghiệp dư với Việt Nam nếu có xác nhận của tổ chức được công nhận đủ điều kiện cấp chứng chỉ vô tuyến điện nghiệp dư tại bản khai theo Mẫu 1b tại Phụ lục II ban hành kèm theo Nghị định này.

3. Các trường hợp khác do Bộ trưởng Bộ Thông tin và Truyền thông xem xét quyết định.

Mục 2. CHỨNG CHỈ VÔ TUYẾN ĐIỆN VIÊN HÀNG HẢI

Điều 67. Các khóa đào tạo vô tuyến điện viên hàng hải hệ GMDSS và các loại chứng chỉ vô tuyến điện viên hàng hải hệ GMDSS

1. Các khóa đào tạo vô tuyến điện viên hàng hải hệ GMDSS bao gồm: vô tuyến điện viên hàng hải hạng hạn chế, vô tuyến điện viên hàng hải hạng tổng quát, vô tuyến điện viên hàng hải hạng hai, vô tuyến điện viên hàng hải hạng nhất.

2. Các loại chứng chỉ vô tuyến điện viên hàng hải hệ GMDSS:

a) Các loại chứng chỉ vô tuyến điện viên hàng hải hệ GMDSS bao gồm: chứng chỉ vô tuyến điện viên hàng hải hạng hạn chế, chứng chỉ vô tuyến điện viên hàng hải hạng tổng quát, chứng chỉ vô tuyến điện viên hàng hải hạng hai, chứng chỉ vô tuyến điện viên hàng hải hạng nhất;

b) Chứng chỉ vô tuyến điện viên hàng hải có thời hạn 05 năm kể từ ngày cấp.

Điều 68. Điều kiện công nhận tổ chức đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải

1. Yêu cầu về cơ sở vật chất và trang thiết bị giảng dạy gồm:

a) Phòng học tiêu chuẩn có trang thiết bị cần thiết cho việc giảng dạy;

b) Thiết bị thực hành tối thiểu 01 máy cho 04 học viên đối với hệ thống thiết bị đầu cuối mô phỏng, 01 máy cho 02 học viên đối với hệ thống mô phỏng trên máy vi tính;

c) Thiết bị thực hành phải có khả năng mô phỏng các thiết bị sau: máy thu phát MF/HF có trực canh DSC, điện thoại và NBDP; phao EPIRB 406MHz; thiết bị phát đáp tín hiệu ra-đa tìm kiếm cứu nạn SART hoặc thiết bị nhận dạng tự động phát báo tìm kiếm cứu nạn AIS-SART; thiết bị có khả năng thu EGC; núm báo động cấp cứu đối với các thiết bị huấn luyện hoặc thiết bị mô phỏng VHF-DSC, HF/MF-DSC, Inmarsat-C hoặc hệ thống liên lạc vệ tinh quỹ đạo thấp Iridium; máy thu NAVTEX; máy thu phát VHF có chức năng thoại và DSC, kết hợp với máy thu trực canh DSC kênh 70; máy VHF cầm tay hai chiều; Inmarsat-C hoặc hệ thống liên lạc vệ tinh quỹ đạo thấp Iridium; các thiết bị cần thiết khác theo yêu cầu của Công ước quốc tế về An toàn sinh mạng trên biển năm 1974 và các sửa đổi (SOLAS 74 và các sửa đổi).

2. Yêu cầu về tài liệu giảng dạy gồm:

a) Giáo trình vô tuyến điện viên hàng hải đối với mỗi loại hình đào tạo;

b) Giáo trình hướng dẫn khai thác thiết bị GMDSS đối với mỗi loại hình đào tạo;

c) Danh bạ các đài duyên hải (ITU list of Coast Stations, Amiralty list of Radio Signal - vol.1, vol.5 …);

d) Danh bạ đài tàu (ITU list of Ship Stations);

đ) Danh bạ các đài vô tuyến xác định và các trạm làm nghiệp vụ đặc biệt;

e) Thể lệ vô tuyến điện của Liên minh Viễn thông quốc tế;

g) Sổ tay tìm kiếm cứu nạn hàng không, hàng hải quốc tế (IAMSAR);

h) Tài liệu hướng dẫn ghi nhật ký GMDSS;

i) Tài liệu tham khảo của Tổ chức Hàng hải quốc tế và các tài liệu tham khảo cần thiết khác.

3. Yêu cầu về chương trình đào tạo:

Chương trình và nội dung của các khóa đào tạo phải phù hợp với chương trình mẫu hiện hành của Tổ chức Hàng hải quốc tế.

4. Yêu cầu đối với giảng viên tham gia giảng dạy:

Giảng viên tham gia giảng dạy phải đáp ứng các điều kiện sau:

a) Tốt nghiệp đại học trở lên một trong các chuyên ngành vô tuyến điện, điện tử, viễn thông, điều khiển tàu biển hoặc hàng hải;

b) Có trình độ ngoại ngữ phù hợp với chương trình đào tạo;

c) Có chứng chỉ vô tuyến điện viên hàng hải phù hợp với chương trình đào tạo (chứng chỉ vô tuyến điện viên hàng hải của giáo viên phải có hạng cao hơn hoặc bằng hạng mà giáo viên tham gia giảng dạy) hoặc đã tham gia đào tạo vô tuyến điện viên hàng hải hạng tương đương từ 03 năm trở lên.

5. Yêu cầu về số lượng giảng viên:

Có đủ về số lượng đội ngũ giảng viên đáp ứng yêu cầu của từng chương trình đào tạo, trong đó phải có tối thiểu 50% giảng viên cơ hữu cho từng chương trình đào tạo vô tuyến điện viên hàng hải.

6. Yêu cầu về tỉ lệ học viên/giảng viên: tối đa 25 học viên/giảng viên.

Điều 69. Trình tự, thủ tục cấp giấy công nhận tổ chức đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải

1. Hồ sơ đề nghị cấp giấy công nhận tổ chức đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải bao gồm:

a) Văn bản đề nghị cấp giấy công nhận tổ chức đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải theo Mẫu 07 quy định tại Phụ lục IX ban hành kèm theo Nghị định này;

b) Bản sao hợp pháp giấy phép hoặc quyết định thành lập tổ chức;

c) Báo cáo thuyết minh đáp ứng yêu cầu quy định tại Điều 68 Nghị định này theo Mẫu 08 quy định tại Phụ lục IX ban hành kèm theo Nghị định này;

d) Chương trình đào tạo vô tuyến điện viên hàng hải đã được tổ chức phê duyệt.

2. Tổ chức nộp 01 bộ hồ sơ đề nghị cấp giấy công nhận tổ chức đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải đến Bộ Thông tin và Truyền thông qua đường bưu chính hoặc nộp hồ sơ trực tiếp tại Bộ Thông tin và Truyền thông.

3. Bộ Thông tin và Truyền thông tiếp nhận, kiểm tra tính hợp lệ của hồ sơ. Trường hợp hồ sơ chưa đầy đủ, chưa đúng quy định về thành phần hồ sơ thì trong thời hạn 05 ngày làm việc kể từ ngày nhận được hồ sơ, Bộ Thông tin và Truyền thông thông báo, hướng dẫn tổ chức bổ sung, hoàn thiện hồ sơ.

4. Trong thời hạn 30 ngày kể từ ngày nhận đủ hồ sơ hợp lệ, Bộ Thông tin và Truyền thông tổ chức đánh giá, xác minh thực tế các điều kiện quy định tại Điều 68 Nghị định này và cấp giấy công nhận tổ chức đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải theo Mẫu 09 quy định tại Phụ lục IX ban hành kèm theo Nghị định này hoặc từ chối cấp giấy công nhận tổ chức đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải và nêu rõ lý do.

5. Kết quả giải quyết hồ sơ đề nghị cấp giấy công nhận tổ chức đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải được gửi tới tổ chức qua một trong các phương thức sau: trả kết quả qua đường bưu chính hoặc trả trực tiếp tại Bộ Thông tin và Truyền thông.

6. Danh sách tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải được công bố trên Cổng thông tin điện tử của Bộ Thông tin và Truyền thông.

Điều 70. Trình tự, thủ tục cấp đổi giấy công nhận tổ chức đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải

1. Giấy công nhận tổ chức đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải được cấp đổi trong trường hợp bị mất, bị hư hỏng hoặc có sự thay đổi thông tin về tổ chức.

2. Hồ sơ đề nghị cấp đổi giấy công nhận tổ chức đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải gồm:

a) Văn bản đề nghị cấp đổi giấy công nhận tổ chức đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện hàng hải theo Mẫu 11 quy định tại Phụ lục IX ban hành kèm theo Nghị định này;

b) Báo cáo về thay đổi thông tin của tổ chức đối với trường hợp có sự thay đổi thông tin (có chữ ký của người có thẩm quyền và đóng dấu của tổ chức đề nghị cấp giấy công nhận).

3. Tổ chức nộp 01 bộ hồ sơ đề nghị cấp đổi giấy công nhận tổ chức đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải đến Bộ Thông tin và Truyền thông qua đường bưu chính hoặc nộp hồ sơ trực tiếp tại Bộ Thông tin và Truyền thông.

4. Bộ Thông tin và Truyền thông tiếp nhận, kiểm tra tính hợp lệ của hồ sơ. Trường hợp hồ sơ chưa đầy đủ, chưa đúng quy định về thành phần hồ sơ thì trong thời hạn 05 ngày làm việc kể từ ngày nhận được hồ sơ, Bộ Thông tin và Truyền thông thông báo, hướng dẫn tổ chức bổ sung, hoàn thiện hồ sơ.

5. Trong thời hạn 20 ngày kể từ ngày nhận đủ hồ sơ hợp lệ, Bộ Thông tin và Truyền thông cấp đổi giấy công nhận tổ chức đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải theo Mẫu 10 quy định tại Phụ lục IX ban hành kèm theo Nghị định này hoặc từ chối cấp đổi giấy công nhận tổ chức đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải và nêu rõ lý do.

6. Kết quả giải quyết hồ sơ đề nghị cấp đổi giấy công nhận tổ chức đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện hàng hải được gửi tới tổ chức qua một trong các phương thức sau: trả kết quả qua đường bưu chính hoặc trả trực tiếp tại Bộ Thông tin và Truyền thông.

Điều 71. Thu hồi giấy công nhận tổ chức đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải

1. Tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải bị thu hồi giấy công nhận trong các trường hợp sau:

a) Chấm dứt hoạt động theo quy định của pháp luật hoặc theo đề nghị của tổ chức;

b) Cố ý làm sai lệch thông tin khi thực hiện thủ tục cấp giấy công nhận;

c) Không duy trì các điều kiện quy định tại khoản 1 và khoản 4 Điều 68 Nghị định này.

2. Bộ Thông tin và Truyền thông ra quyết định thu hồi giấy công nhận tổ chức đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải và thông báo trên Cổng thông tin điện tử của Bộ Thông tin và Truyền thông, đồng thời gửi đến các cơ quan liên quan để phối hợp quản lý.

Điều 72. Hội đồng thi tốt nghiệp

1. Hội đồng thi tốt nghiệp (sau đây gọi là Hội đồng thi) do người đứng đầu tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải ra quyết định thành lập.

Hội đồng thi gồm có 05 hoặc 07 thành viên gồm: Chủ tịch Hội đồng là người đứng đầu hoặc cấp phó của người đứng đầu của tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải; ủy viên là các cán bộ của tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải.

2. Hội đồng thi có nhiệm vụ sau đây:

a) Lập danh sách các học viên tham gia kỳ thi tốt nghiệp;

b) Tổ chức, điều hành, kiểm tra, giám sát kỳ thi theo quy định hiện hành;

c) Xử lý các tình huống xảy ra trong kỳ thi (nếu có);

d) Tổng hợp kết quả kỳ thi, báo cáo người đứng đầu tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải để cấp chứng chỉ vô tuyến điện viên hàng hải cho học viên tốt nghiệp.

Điều 73. Thi tốt nghiệp và đánh giá kết quả thi tốt nghiệp

1. Học viên tham dự ít nhất 90% thời lượng của khóa học mới được tham gia thi tốt nghiệp. Trường hợp học viên không đảm bảo thời lượng tham dự khóa học nhưng có lý do chính đáng học viên được bảo lưu thời lượng đã học và học tiếp tại khóa học của cùng một tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải.

2. Thi tốt nghiệp khóa đào tạo được chia thành hai phần: phần thi lý thuyết và phần thi thực hành theo quy định hiện hành của Tổ chức Hàng hải quốc tế. Điểm thi của mỗi phần được chấm theo thang điểm 10.

3. Các bài thi theo hình thức tự luận có điểm đạt từ điểm 5 trở lên. Các bài thi theo hình thức trắc nghiệm có điểm đạt từ điểm 7 trở lên.

4. Đối với các phần thi chưa đạt, học viên được tham gia thi lại 01 lần của cùng một tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải.

5. Học viên có điểm đạt ở cả hai phần thi mới đạt yêu cầu khoá học và được xét tốt nghiệp khóa đào tạo chứng chỉ vô tuyến điện viên hàng hải.

Điều 74. Điều kiện chung để được cấp chứng chỉ vô tuyến điện viên hàng hải

1. Là công dân Việt Nam, người nước ngoài cư trú hợp pháp tại Việt Nam, thuyền viên nước ngoài làm việc trên tàu Việt Nam.

2. Có đủ độ tuổi lao động và tiêu chuẩn sức khỏe theo quy định của pháp luật.

3. Đáp ứng các điều kiện cụ thể về chuyên môn cho từng loại chứng chỉ tương ứng theo quy định tại các Điều 75, 76, 77 và 78 Nghị định này.

4. Tốt nghiệp khoá đào tạo vô tuyến điện viên hàng hải tương ứng.

Điều 75. Điều kiện chuyên môn để được cấp chứng chỉ vô tuyến điện viên hàng hải hạng hạn chế

1. Tốt nghiệp trung học phổ thông trở lên hoặc là sỹ quan boong, đại phó, thuyền trưởng tàu thuyền hoạt động trong vùng biển Việt Nam (vùng A1).

2. Tối thiểu đạt trình độ tiếng Anh bậc A2 theo chuẩn 06 bậc của Bộ Giáo dục và Đào tạo hoặc tiếng Anh hàng hải trình độ 1 theo quy định của Bộ Giao thông vận tải hoặc có chứng chỉ tiếng Anh tương đương khác.

Điều 76. Điều kiện chuyên môn để được cấp chứng chỉ vô tuyến điện viên hàng hải hạng tổng quát

1. Tốt nghiệp từ bậc trung học chuyên nghiệp, trung cấp nghề trở lên một trong các chuyên ngành hàng hải, điều khiển tàu biển, điện tử, viễn thông hoặc tương đương; hoặc là sỹ quan boong, đại phó, thuyền trưởng tàu thuyền từ 500 GT trở lên hoạt động trong và ngoài vùng biển Việt Nam.

2. Tối thiểu đạt trình độ tiếng Anh bậc B2 theo chuẩn 06 bậc của Bộ Giáo dục và Đào tạo hoặc tiếng Anh hàng hải trình độ 2 theo quy định của Bộ Giao thông vận tải hoặc có chứng chỉ tiếng Anh tương đương khác.

Điều 77. Điều kiện chuyên môn để được cấp chứng chỉ vô tuyến điện viên hàng hải hạng hai

1. Tốt nghiệp đại học một trong các chuyên ngành điện tử, viễn thông, hàng hải, chuyên ngành điều khiển tàu biển hoặc tương đương.

2. Tối thiểu đạt trình độ tiếng Anh bậc C1 theo chuẩn 06 bậc của Bộ Giáo dục và Đào tạo hoặc tiếng Anh hàng hải trình độ 3 theo quy định của Bộ Giao thông vận tải hoặc chứng chỉ tiếng Anh tương đương khác.

Điều 78. Điều kiện chuyên môn để được cấp chứng chỉ vô tuyến điện viên hàng hải hạng nhất

1. Đã được cấp chứng chỉ vô tuyến điện viên hàng hải hạng hai.

2. Đã đảm nhận công việc theo chức danh phù hợp với chứng chỉ vô tuyến điện viên hàng hải hạng hai ít nhất là 03 năm.

3. Tối thiểu đạt trình độ tiếng Anh bậc C1 theo chuẩn 06 bậc của Bộ Giáo dục và Đào tạo hoặc tiếng Anh hàng hải trình độ 3 theo quy định của Bộ Giao thông vận tải hoặc chứng chỉ tiếng Anh tương đương khác.

Điều 79. Trình tự, thủ tục cấp chứng chỉ vô tuyến điện viên hàng hải

1. Hồ sơ đăng ký tham gia khóa đào tạo vô tuyến điện viên hàng hải để được cấp chứng chỉ vô tuyến điện viên hàng hải bao gồm:

a) Bản sao hợp pháp Căn cước công dân hoặc Giấy chứng minh nhân dân hoặc Hộ chiếu còn thời hạn;

b) Bản chính hoặc bản sao hợp pháp giấy chứng nhận sức khỏe của thuyền viên theo quy định của pháp luật;

c) Bản sao hợp pháp các tài liệu, văn bằng chuyên môn chứng minh đáp ứng các điều kiện chuyên môn tương ứng với cấp bậc chứng chỉ vô tuyến điện viên hàng hải đăng ký đào tạo theo quy định tại các Điều 75, 76, 77 và 78 Nghị định này;

d) 02 ảnh màu kích thước 03 cm × 04 cm, chụp trong vòng 06 tháng trước ngày nộp hồ sơ, rõ mặt, rõ hai tai, không đội mũ, không trang điểm.

2. Trình tự, thủ tục cấp chứng chỉ vô tuyến điện viên hàng hải

a) Người đăng ký tham gia khóa đào tạo vô tuyến điện viên hàng hải nộp 01 bộ hồ sơ đến tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải qua đường bưu chính hoặc nộp hồ sơ trực tiếp tại tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến viên hàng hải;

b) Tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải tiếp nhận, kiểm tra tính hợp lệ của hồ sơ. Trường hợp hồ sơ chưa đầy đủ, chưa đúng quy định về thành phần hồ sơ thì trong thời hạn 05 ngày làm việc kể từ ngày nhận được hồ sơ, tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải thông báo, hướng dẫn người đăng ký tham gia khóa đào tạo bổ sung, hoàn thiện hồ sơ;

c) Trong thời hạn 14 ngày kể từ ngày học viên hoàn thành thi tốt nghiệp khóa học, tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải cấp chứng chỉ cho thí sinh tốt nghiệp khoá đào tạo vô tuyến điện viên hàng hải theo mẫu quy định tại Phụ lục X ban hành kèm theo Nghị định này hoặc từ chối cấp chứng chỉ vô tuyến điện viên hàng hải và nêu rõ lý do.

Điều 80. Điều kiện gia hạn chứng chỉ vô tuyến điện viên hàng hải

1. Có đủ độ tuổi lao động và tiêu chuẩn sức khỏe theo quy định của pháp luật.

2. Đã đảm nhiệm công việc theo chức danh phù hợp với chứng chỉ vô tuyến điện viên hàng hải đề nghị gia hạn trong thời gian ít nhất 01 năm trong vòng 05 năm kể từ ngày được cấp chứng chỉ hoặc ít nhất là 03 tháng trong vòng 06 tháng ngay trước khi chứng chỉ hết hạn.

3. Trường hợp không đáp ứng điều kiện quy định tại khoản 2 Điều này thì người đề nghị gia hạn phải tham gia và đạt yêu cầu trong kỳ thi tốt nghiệp khóa đào tạo vô tuyến hàng hải hạng tương ứng với chứng chỉ đề nghị gia hạn.

Điều 81. Trình tự, thủ tục gia hạn chứng chỉ vô tuyến điện viên hàng hải

1. Hồ sơ đề nghị gia hạn chứng chỉ vô tuyến điện viên hàng hải bao gồm:

a) Đơn đề nghị theo Mẫu 03 quy định tại Phụ lục X ban hành kèm theo Nghị định này;

b) Bản sao hợp pháp Căn cước công dân hoặc Giấy chứng minh nhân dân hoặc Hộ chiếu còn thời hạn;

c) Bản chính hoặc bản sao hợp pháp giấy chứng nhận sức khỏe của thuyền viên theo quy định của pháp luật;

d) 02 ảnh màu kích thước 03 cm × 04 cm, chụp trong vòng 06 tháng trước ngày nộp hồ sơ, rõ mặt, rõ hai tai, không đội mũ, không trang điểm;

đ) Bản chính chứng chỉ vô tuyến điện viên hàng hải đề nghị gia hạn;

e) Bản sao hợp pháp sổ thuyền viên hoặc văn bản tương đương hoặc Giấy tờ chứng minh đạt yêu cầu kỳ thi tốt nghiệp khoá đào tạo vô tuyến điện viên hàng hải hạng tương ứng với chứng chỉ đề nghị gia hạn (đối với trường hợp quy định tại khoản 3 Điều 80 Nghị định này).

2. Người đề nghị gia hạn chứng chỉ vô tuyến điện viên hàng hải nộp 01 bộ hồ sơ đến tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải qua đường bưu chính hoặc nộp hồ sơ trực tiếp tại tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến viên hàng hải.

3. Tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải tiếp nhận, kiểm tra tính hợp lệ của hồ sơ và đối chiếu với dữ liệu về chứng chỉ vô tuyến điện viên hàng hải đã cấp. Trường hợp hồ sơ chưa đầy đủ, chưa đúng quy định về thành phần hồ sơ thì trong thời hạn 05 ngày làm việc kể từ ngày nhận được hồ sơ, tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải thông báo, hướng dẫn người đề nghị gia hạn chứng chỉ vô tuyến điện viên hàng hải bổ sung, hoàn thiện hồ sơ.

4. Trong thời hạn 10 ngày kể từ ngày nhận đủ hồ sơ hợp lệ, tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải gia hạn chứng chỉ theo mẫu quy định tại Phụ lục X ban hành kèm theo Nghị định này hoặc từ chối gia hạn chứng chỉ vô tuyến điện viên hàng hải và nêu rõ lý do.

5. Chứng chỉ vô tuyến điện viên hàng hải được gia hạn với thời hạn là 05 năm.

Điều 82. Trình tự, thủ tục cấp đổi chứng chỉ vô tuyến viên điện hàng hải

1. Chứng chỉ vô tuyến điện viên hàng hải còn hạn sử dụng được cấp đổi trong các trường hợp bị mất, bị hư hỏng hoặc do thay đổi thông tin cá nhân hợp pháp trên chứng chỉ hoặc thông tin cá nhân trên chứng chỉ không đúng với thông tin trong hồ sơ đề nghị cấp chứng chỉ.

2. Hồ sơ đề nghị cấp đổi chứng chỉ vô tuyến điện viên hàng hải bao gồm:

a) Đơn đề nghị theo Mẫu 03 quy định tại Phụ lục X ban hành kèm theo Nghị định này;

b) 02 ảnh màu kích thước 03 cm × 04 cm, chụp trong vòng 06 tháng trước ngày nộp hồ sơ, rõ mặt, rõ hai tai, không đội mũ, không trang điểm;

c) Bản gốc chứng chỉ vô tuyến điện viên hàng hải (áp dụng đối với trường hợp chứng chỉ bị hư hỏng hoặc thay đổi thông tin cá nhân hợp pháp trên chứng chỉ hoặc thông tin cá nhân trên chứng chỉ không đúng với thông tin trong hồ sơ đề nghị cấp chứng chỉ);

d) Giấy tờ chứng minh việc thay đổi thông tin đối với trường hợp thay đổi thông tin cá nhân hợp pháp.

3. Trình tự, thủ tục cấp đổi chứng chỉ vô tuyến điện viên hàng hải

a) Người đề nghị cấp đổi chứng chỉ vô tuyến điện viên hàng hải nộp 01 bộ hồ sơ đề nghị cấp đổi đến tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải qua đường bưu chính hoặc nộp hồ sơ trực tiếp tại tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải;

b) Tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải tiếp nhận, kiểm tra tính hợp lệ của hồ sơ và đối chiếu với dữ liệu về chứng chỉ vô tuyến điện viên hàng hải đã cấp. Trường hợp hồ sơ chưa đầy đủ, chưa đúng quy định về thành phần hồ sơ thì trong thời hạn 05 ngày làm việc kể từ ngày nhận được hồ sơ, tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải thông báo, hướng dẫn người đề nghị cấp đổi chứng chỉ vô tuyến điện viên hàng hải bổ sung, hoàn thiện hồ sơ;

c) Trong thời hạn 07 ngày làm việc kể từ ngày nhận đủ hồ sơ hợp lệ, tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải cấp đổi chứng chỉ theo mẫu quy định tại Phụ lục X ban hành kèm theo Nghị định này hoặc từ chối cấp đổi và nêu rõ lý do.

Điều 83. Thu hồi chứng chỉ vô tuyến điện viên hàng hải

Tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải thu hồi chứng chỉ vô tuyến điện viên hàng hải trong các trường hợp sau:

1. Giả mạo một trong các thành phần hồ sơ quy định tại khoản 1 Điều 79, khoản 1 Điều 81 và khoản 2 Điều 82 Nghị định này để được cấp, gia hạn hoặc cấp đổi chứng chỉ.

2. Tẩy, xoá nội dung chứng chỉ.

3. Cho thuê, cho mượn chứng chỉ hoặc sử dụng sai mục đích.

Mục 3. TRÁCH NHIỆM CỦA CÁC CƠ QUAN, TỔ CHỨC TRONG VIỆC ĐÀO TẠO, CẤP CHỨNG CHỈ VÔ TUYẾN ĐIỆN VIÊN

Điều 84. Trách nhiệm của các cơ quan, tổ chức trong việc cấp chứng chỉ vô tuyến điện nghiệp dư

1. Bộ Thông tin và Truyền thông có trách nhiệm:

a) Công nhận tổ chức đủ điều kiện cấp chứng chỉ vô tuyến điện nghiệp dư;

b) Tổ chức thanh tra, kiểm tra việc tuân thủ các quy định của Nghị định này về tổ chức thi, cấp chứng chỉ vô tuyến điện nghiệp dư; định kỳ 05 năm một lần kiểm tra tổ chức được công nhận đủ điều kiện cấp chứng chỉ vô tuyến điện nghiệp dư để đánh giá về việc đáp ứng điều kiện quy định tại Điều 58 Nghị định này;

c) Cập nhật, công bố danh sách các tổ chức được công nhận đủ điều kiện cấp chứng chỉ vô tuyến điện nghiệp dư trên Cổng thông tin điện tử của Bộ Thông tin và Truyền thông.

2. Tổ chức được công nhận đủ điều kiện cấp chứng chỉ vô tuyến điện nghiệp dư có trách nhiệm:

a) Tổ chức thi, chấm thi và cấp, cấp đổi, thu hồi chứng chỉ vô tuyến điện nghiệp dư;

b) Xây dựng và cập nhật bộ câu hỏi thi lý thuyết vô tuyến điện nghiệp dư;

c) Lưu giữ các số liệu về kết quả thi, chứng chỉ vô tuyến điện nghiệp dư đã cấp;

d) Trước ngày 06 của tháng cuối quý, gửi báo cáo về tình hình tổ chức thi, cấp chứng chỉ vô tuyến điện nghiệp dư hàng quý theo Mẫu 06 quy định tại Phụ lục IX ban hành kèm theo Nghị định này theo hình thức trực tuyến hoặc qua đường bưu chính hoặc trực tiếp về Bộ Thông tin và Truyền thông (Cục Tần số vô tuyến điện);

đ) Xây dựng cơ sở dữ liệu điện tử về tổ chức thi vô tuyến điện nghiệp dư (kế hoạch thi, danh sách người thi, kết quả thi); cơ sở dữ liệu điện tử về cấp chứng chỉ vô tuyến điện nghiệp dư (họ và tên người được cấp chứng chỉ, ngày sinh, nơi sinh, số Căn cước công dân hoặc số Chứng minh nhân dân hoặc số Hộ chiếu, số chứng chỉ, cấp bậc chứng chỉ, tổ chức cấp chứng chỉ) để tra cứu;

e) Tuân thủ quy định pháp luật về sử dụng tần số và thiết bị vô tuyến điện.

Điều 85. Trách nhiệm của các cơ quan, tổ chức trong việc đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải

1. Bộ Thông tin và Truyền thông có trách nhiệm:

a) Công nhận tổ chức đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải;

b) Tổ chức thanh tra, kiểm tra việc tuân thủ các quy định của Nghị định này về đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải; định kỳ 05 năm một lần kiểm tra tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải để đánh giá về việc đáp ứng điều kiện quy định tại Điều 68 Nghị định này;

c) Cập nhật, công bố danh sách các tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải trên Cổng thông tin điện tử của Bộ Thông tin và Truyền thông.

2. Tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải có trách nhiệm:

a) Đào tạo, cấp, gia hạn, cấp đổi, thu hồi chứng chỉ vô tuyến điện viên hàng hải;

b) Xây dựng, cập nhật chương trình, tài liệu đào tạo vô tuyến điện viên hàng hải phù hợp với chương trình mẫu hiện hành của Tổ chức Hàng hải quốc tế;

c) Tổ chức đào tạo vô tuyến điện viên hàng hải đảm bảo đủ thời lượng, nội dung theo chương trình của từng khóa đào tạo; quản lý thời gian tham dự khóa học của các học viên;

d) Đảm bảo cơ sở vật chất, trang thiết bị, tài liệu giảng dạy và giảng viên tham gia giảng dạy phục vụ đào tạo vô tuyến điện viên hàng hải;

đ) Trước ngày 06 của tháng cuối quý, gửi báo cáo về tình hình đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải hàng quý theo Mẫu 12 quy định tại Phụ lục IX ban hành kèm theo Nghị định này theo hình thức trực tuyến hoặc qua đường bưu chính hoặc trực tiếp về Bộ Thông tin và Truyền thông;

e) Xây dựng cơ sở dữ liệu điện tử về đào tạo vô tuyến điện viên hàng hải (quyết định mở khóa đào tạo, danh sách học viên, kế hoạch thi, kết quả thi); cơ sở dữ liệu điện tử về cấp chứng chỉ vô tuyến điện viên hàng hải (họ và tên người được cấp chứng chỉ, quốc tịch, ngày sinh, nơi sinh, số chứng chỉ, hạng chứng chỉ, ngày cấp, ngày hết hạn, tổ chức cấp chứng chỉ) để tra cứu;

g) Lưu trữ hồ sơ liên quan đến công tác đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải theo đúng quy định của pháp luật;

h) Tuân thủ các quy định của pháp luật về sử dụng tần số và thiết bị vô tuyến điện.

Chương VIII. ĐIỀU KHOẢN THI HÀNH

Điều 86. Hiệu lực thi hành [2]

1. Nghị định này có hiệu lực thi hành kể từ ngày ký ban hành.

2. Nghị định số 88/2021/NĐ-CP ngày 01 tháng 10 năm 2021 của Chính phủ quy định về thu tiền cấp quyền sử dụng tần số vô tuyến điện, đấu giá, cấp phép, chuyển nhượng quyền sử dụng tần số vô tuyến điện đối với băng tần hết hiệu lực kể từ ngày Nghị định này có hiệu lực thi hành.

3. Trường hợp sau ngày Nghị định này có hiệu lực, các quy định về cấp giấy phép, cam kết triển khai mạng viễn thông của Luật Viễn thông có thay đổi thì áp dụng theo quy định của Luật Viễn thông.

Điều 87. Điều khoản chuyển tiếp

1. Các hồ sơ đề nghị cấp, cấp đổi, sửa đổi, bổ sung, gia hạn giấy phép sử dụng tần số vô tuyến điện đã nộp trước thời điểm Nghị định này có hiệu lực thi hành và đang trong thời gian xử lý thì được tiếp tục thực hiện theo các quy định đang áp dụng.

2. Chứng chỉ vô tuyến điện viên hàng hải được cấp trước ngày 01 tháng 7 năm 2024 được gia hạn, cấp đổi tại các tổ chức được công nhận đủ điều kiện đào tạo, cấp chứng chỉ vô tuyến điện viên hàng hải.

3. [3]Tổ chức đã được cấp giấy phép sử dụng băng tần để thiết lập mạng viễn thông công cộng di động mặt đất mà hết hạn sử dụng trước ngày 06 tháng 9 năm 2023 nộp tiền cấp quyền sử dụng tần số vô tuyến điện cho thời hạn còn lại của giấy phép tính từ ngày 01 tháng 7 năm 2023 với mức thu là 0 (không) đồng, được thực hiện khi cấp lại giấy phép.

Điều 88. Trách nhiệm thi hành

Các Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân các tỉnh, thành phố trực thuộc trung ương chịu trách nhiệm thi hành Nghị định này./.

[1] Nghị định số 229/2025/NĐ-CP ngày 19 tháng 8 năm 2025 của Chính phủ sửa đổi, bổ sung khoản 3 Điều 87 của Nghị định số 63/2023/NĐ-CP ngày 18 tháng 8 năm 2023 của Chính phủ quy định chi tiết một số điều của Luật Tần số vô tuyến điện số 42/2009/QH12, được sửa đổi, bổ sung một số điều theo Luật số 09/2022/QH15, có hiệu lực kể từ ngày 19 tháng 8 năm 2025, có căn cứ ban hành như sau:

“Căn cứ Luật Tổ chức Chính phủ số 63/2025/QH15;

Căn cứ Luật Tần số vô tuyến điện số 42/2009/QH12, được sửa đổi, bổ sung một số điều theo Luật số 09/2022/QH15;

Theo đề nghị của Bộ trưởng Bộ Khoa học và Công nghệ;”.

[2] Điều 2 và Điều 3 của Nghị định số 229/2025/NĐ-CP ngày 19 tháng 8 năm 2025 của Chính phủ sửa đổi, bổ sung khoản 3 Điều 87 của Nghị định số 63/2023/NĐ-CP ngày 18 tháng 8 năm 2023 của Chính phủ quy định chi tiết một số điều của Luật Tần số vô tuyến điện số 42/2009/QH12, được sửa đổi, bổ sung một số điều theo Luật số 09/2022/QH15, có hiệu lực kể từ ngày 19 tháng 8 năm 2025 quy định như sau:

Điều 2. Điều khoản thi hành

Nghị định này có hiệu lực thi hành kể từ ngày ký ban hành.

Điều 3. Điều khoản chuyển tiếp

Tổ chức đã được cấp giấy phép sử dụng băng tần để thiết lập mạng viễn thông công cộng di động mặt đất mà hết hạn sử dụng trước ngày 06 tháng 9 năm 2023 và chưa được cấp lại giấy phép thì áp dụng quy định tại khoản 3 Điều 87 Nghị định số 63/2023/NĐ-CP, được sửa đổi, bổ sung theo Điều 1 của Nghị định này khi cấp lại giấy phép.”.
