 DIRECTIVE

Regarding the mid-term review of the implementation of Resolution No. 38/CP dated May 4, 1994 of the Government on reforming administrative procedures in handling citizens' and organizations' affairs in one step

On May 4, 1994, the Government issued Resolution No. 38/CP on reforming administrative procedures in handling citizens' and organizations' affairs in one step.

In nearly five years since then, Resolution No. 38/CP has been organized and implemented by ministries, sectors, and localities, resolving many issues related to administrative procedures in the relationship between state agencies and citizens and organizations, creating a favorable legal environment to promote production and business activities. Issues regarding institutions, organizational structures, civil servants, and public service have been raised and gradually addressed in a coordinated manner.

In nearly five years, Decree No. 38/CP has been organized and implemented by ministries, sectors, and localities, resolving many issues related to administrative procedures in the relationship between state agencies and citizens and organizations, creating a favorable legal environment to promote production and business activities. Issues concerning institutions, organizational structures, civil servants, and public service have been raised and gradually addressed in a synchronized manner.

However, there are still many shortcomings and weaknesses in the process of implementing the Resolution.

Pursuant to the fourth session of the tenth National Assembly, the Government will conduct a mid-term review of the implementation of Resolution No. 38/CP in the second quarter of 1999. The Prime Minister instructs the Ministers, Heads of ministerial-level agencies and government-affiliated agencies, and Chairmen of provincial and centrally-run city People's Committees to conduct a mid-term review of the implementation of Resolution No. 38/CP according to the following contents:

1. Evaluate the results achieved, including:

- Specific results for each type of work mentioned in the Government's resolution (for each type of work, provide evidence directly in the report or attach an appendix);

- General assessment of the implementation results of the Resolution within the ministry, sector, and locality compared to the requirements and goals set forth;

- Main deficiencies and difficulties, obstacles in leadership guidance in the implementation by the ministry, sector, and locality; clearly identify the causes and propose measures to address these deficiencies, difficulties, and obstacles.

2. Propose tasks for administrative reform of the ministry, sector, and locality in 1999; specify main tasks that can be carried out within the authority of the Minister, Head of ministerial-level agency, government-affiliated agency, Chairman of provincial and centrally-run city People's Committee; forecast main difficulties and obstacles that may arise and measures to handle them.

3. Recommend to the Government on directing administrative reform work in 1999, specifically:

- Which current mechanisms and policies within the Government's decision-making authority need to be amended and supplemented to resolve issues and overcome current difficulties and obstacles.

- How to improve the methods of directing and managing administrative reform work at ministries, sectors, and localities.

Resolution No. 38/CP covers many areas. To effectively conduct the mid-term review and consider it a measure to promote the renewal of the organizational structure and activities of the state management apparatus, the Ministers, Heads of ministerial-level agencies and government-affiliated agencies, and Chairmen of provincial and centrally-run city People's Committees must personally and promptly implement this Directive in the first quarter of 1999, no later than April 15, 1999, and submit reports to the Prime Minister.

The Office of the Government is responsible for monitoring and urging the implementation of this Directive and compiling reports to the Prime Minister./.
